the UAA and Housing Authorities agreed to implement an accountabil-ity system for housing authorities and tenants, in which both groups agreed to police their own.

Tucked away on the pictur-esque Southeast coast of Australia is the small town of
Berry, New South Wales. In the cen-ter of the town is a monument “erect-ed by the tenants and friends of the late David Berry, in remembrance of a kind and considerate landlord and true friend of the people.”
Sadly, no matter how good you are your tenants are unlikely to erect a monument in your honor. They probably won’t even remember to send you a Christmas card, let alone a Valentine. But you can still make your tenants love you by doing some simple things. What do you do to make your tenants want to keep you as their Landlord?

event on January 29th at the Realtor building in Sandy.

How You Can Help1, Report any problems you are
having or have had to with Housing Authorities to the UAA. Email them with specific names (such as tenant, which housing authority and name of caseworker) to [email protected] so we can give the housing authorities a chance to make it right or take it to their peers if they don’t.
2, Report any tenants you think are still on housing assistance that you have evicted or have a judgment against so the Housing Authority can help hold them accountable.
3. If you have had rent withheld or money billed back to you by the HA, notify us so we research whether proper procedures were followed.

receiving government assistance. Basically, says Paul Smith, UAAExecutive Director, you have to work with the government including their paperwork, inspections and rules, whether you want to ort not.
“There are a lot of good tenants on housing assistance (sometimes called section 8),” said Smith. “Good ten-ants should never have a problem finding a place to rent.” Smith makes a clear distinction between the ten-ants who are on government assis-tance, and the entities (housing authorities) that administer the pro-
gram. The problem, he says, is that Housing Authorities in Utah, often don’t follow their own rules, are dif-ficult to work with, and do things to increase the risk to landlords.
“If landlords were doctors,” he said, “we could opt out of having to work with the government (like doc-tors can opt out ofMedicare) ifwedidn’t like the rules or hoops we had to jump through. But because of source of income protection, we have to work with housing authorities even when they are mistreating us.”
Over the last few years, many
landlords felt housing authorities had become increasingly hostile to them and were violating their own rules and punishing landlords for things the landlords had little control over, or when minor mistakes were made. Three cases that happened to clients represented by the law offices or Kirk Cullimore illustrate this alarming trend:
Utah CountyAccording to Cullimore there was
a flood in a housing tenant’s apart-ment. While dealing with the prob-lem, the tenant was moved to a nearby unit. When the original place was remediated, the tenant wanted to stay in the new unit, so the land-lord accommodated them. 11 months later the housing authority found there had been no inspection for the new unit (even though it was identi-cal to the first one). This landlord had multiple housing tenants who were all being paid electronically. Without notice, hearing, or any opportunity for the landlord to pres-ent their side, the housing arbitrarily and unilaterally deducted 11 month’s rent from that month’s pay-ment. Essentially, Cullimore says, they stole the rents of that tenant and 10 others as punishment for the landlord being nice to a tenant and letting them stay in a new unit after a flood. The landlord was forced to sue the tenant for the money, which resulted in that tenant having a huge judgment against them and being evicted. In violation of HUD policy not to house people who owed pre-vious landlords money or who were
evicted on housing, the tenant was given a new voucher to rent some-where else.
Davis CountyAccording to Cullimore, a hous-
ing tenant requested a “a reasonable accommodation” of moving from a 2nd to a first floor because of mobil-ity issues. The apartment community honored the request as they were required by law to do. Somehow, there was a miscommunication about the new unit being inspected and approved by housing. It is a tax credit project with lots of regular inspections so even the housing authority said they can understand how easy it was to have made a mis-take. However, when the housing authority came to do an inspection 11 months later, they chose to sue the landlord and “bill back the landlord” for 11 month’s rent, even though the tenant had been in quality habitable housing in an equivalent unit. The case was settled but the landlord ended up being owed a lot of money. To our knowledge, the tenant who owes the landlord money, is still being housed, in violation of HUD rules.
Salt Lake CityAccording to Cullimore, a hous-
ing tenant called the Housing Authority to complain about bed-bugs. Even though HUD regulations require 30 days’ notice to cure and an inspection, the housing authority refused to inspect, and gave only a few days’ notice for a landlord to fix it. When the exterminator came to

spray, the tenant wasn’t ready and did not do what they needed to do to prepare the unit for two weeks. The next month the HA withheld two weeks rent because the place hadn’t been in compliance, even though they hadn’t followed their own rules or EVEN STEPPED FOOT IN THE APARTMENT.
These kinds of things have become common, according to landlords and the attorneys who represent them. So a bill was drafted this year that would allow landlords to stop work-ing with housing authorities who, like in the above examples, violate their own rules and treat landlords poorly.
The bill allowed landlords to:
a.RefusetosigntheHAPagreement(the government’s agreement that modifying a landlords contract)
b. Refuse to participate in a govern-ment program
c. Refuse to work with a specific housing authority that treats land-lords poorly
The bill was HB 310, sponsored by Gage Froerer®, Huntsville, who owns a property management company. It was scheduled to be heard by com-mittee on the day the compromise agreement was made.
The agreementOn February 6th, about 30 people,
mostly housing authority directors,
with a few tenants’ advocates and landlord representatives met to try to solve this problem. Layne Morris,with the West Valley Housing Authority summed up the issue well during the discussion. “It’s my understanding,” he said “that land-lords really don’t have a problem following the section 8 program when the housing authorities follow HUD’s rules. It’s when housing authorities don’t follow HUD’s rules that they want out.” The landlord’s attorney’s and the UAA agreed to that characterization.Many housing authorities follow
all their rules and treat landlords well. So the UAA wanted to work out a system to stop the abuses that were occurring without hurting housing authorities or tenants. At the meeting on February 6, the following agreement was made between the rental housing industry and the housing authorities:1 Communication and accountabil-
ity: When landlords see housing authorities violating their own rules or mistreating them, they will take these cases to the UAA, who will in turn contact the exec-utive director of that housing authority. If it cannot be resolved by that director, the UAA will take it to a committee comprised of other housing authority direc-tors, who will try to resolve the situation.Likewise, if the housing authori-
ties have landlords who are vio-lating the rules, they will come to the UAA who will contact the landlords and try to correct the problem.Education: The housing authori-ties will do more training of their staff and caseworkers of landlord tenant law and proper proce-dures. UAA will do education for landlords on how to correctly work with this program.
2 Dialogue and best practices: Through a regular dialogue, the UAA and housing authorities will try to establish best practices
and assure local housing authori-
ties are not doing anything more restrictive than what HUD requires. The UAA will also, along with NAA, lobby HUD and congress for changes benefi-cial to Utah Housing Authorities.
“We are hopeful this compromise will help protect landlords and lead to better service to landlords and tenants,” said Cullimore, after the meeting. Housing authorities have similar hopes. We will keep you posted.

Executive Director's ReportNew Security Deposit Rules will Benefit both
Landlords and TenantsSb 147, Pat Jones (D),Holladay, will change security deposit return rules to benefit both landlords and tenants. Following is a brief summary of the prob-
lems, the solution, and how it affects landlords and tenants.
The problem:While the vast majority of land-
lords return deposits on a timely basis, a small percentage are not doing this properly and we need to strengthen the statute to protect rent-ers and assure they receive deposits back in a timely fashion.
The solution:SB 147 changes the statute in the following ways:
•Clarifiesthatrefundsoranexpla-nation of charges MUST be sentwithin 30 days (currently if a ten-ant doesn’t give a forwarding address a landlord can keep the deposit until they do).
•Createsa“noticetocure”thatcan
be served by a tenant to a landlord if deposit or explanation of charg-es not received within 30 days. Notice gives landlord 5 businessdays to return it to the address requested or face penalties.
• Increases the penalty to the fullamount of the deposit, plus $100, court costs and attorney’s fees, if a landlord does not comply after receiving the final notice.
Improvements for tenants:
• Raises thepenalty fornot return-ing adeposit on time to 100%ofthe amount of the deposit plus $100, instead of just $100.
• It provides a potentially quickerresolution than litigation by hav-ing tenants serve the landlord a noticetocomplyin5daysorfacethe penalty (we think this will get more renters their deposits back quicker than litigation because many landlords either forget to return it or don't understand the penalties. This 5 day notice willremind and educate them).
•Currentlyifnoforwardingaddressis given, landlords have no obliga-tion to return deposits. This change requires refund even if no addressisgiven,in30days.Mustbe sent to last known address.
• Allowsthetenanttogiveacorrectaddress on the 5 day notice (ifthey haven't received it) so they can for sure get their refund or itemized list of deductions.
Improvements for landlords:
•Itmirrorsthefitpremisesactandcity zoning practices by giving a landlordanopportunitytocure(5days) if they forget to comply or don't understand the law. A lot of landlords, especially those who own the over 100,000 single family homes that are rented in Utah, simply don't know the rules or penalties. This gives them a chance to make right and be educated prior to a penalty.
• Allows landlords to send thedeposit to the last known address if we don't have a better one and
requires the tenant to give us their new address if they don't get our letter. It isawin/winsupportedby the
Apartment Association, the Realtors and the Utah Housing Coalition that is fair to the landlords and the ten-ants in your district.

By the time this is pub-lished, the legislature will be nearly over. While it is a hectic 45days while they are in session, we are fortu-nate they are only in

down at the legislature that day working to protect us. They do such great work and we are lucky to have them.
Here are the main priorities the UAA is working on this year:
1. Preventingproposedlegislationtorequire testing for Radon gas ($300 plus two weeks lost rent waiting for results)
2. Changing the security deposit dis-position statue to require notice to landlords with a forwarding address before any penalties for late return are accrued (see article on page 4)
3. Passing consensus legislation(agreed to by landlords and HOA groups) to prevent HOAs from being able to require pre-approval of your tenants or turning over credit reports or ss#’s of tenants
4. Assuring that in the war on dirty air, landlords aren’t punished
with things like unreasonable reg-ulation of fireplaces, windows, water heaters, etc.
5. Preventing any adversarial ordamaging legislation from passing
