Executive Summary and Staff Analysis PDC Case 5925

This Executive Summary highlights staff’s findings, conclusions, and recommendations regarding a 45-Day Citizen Action Complaint (Complaint) against Kim Wyman, incumbent Washington State Secretary of State and a candidate seeking re-election to that office in 2016. The complaint was filed with the Public Disclosure Commission (PDC) by Jaxon Ravens, Chair of the Washington State Democratic Party.

Allegations

The Complaint alleged that the 2016 Citizens for Kim Wyman campaign (Campaign) violated RCW 42.17A.235 and .240 by failing to timely file Monetary Contribution reports (C-3 reports) and Campaign Summary Contribution and Expenditure reports (C-4 reports) for campaign activities undertaken in April of 2016.

Background On January 18, 2013, Kim Wyman filed a Candidate Registration (C-1 report) declaring her candidacy for re-election to the office of Washington Secretary of State and opening her campaign.

The Campaign received a formal written warning from the PDC earlier this year based on a complaint that the Wyman campaign violated RCW 42.17A.560 by scheduling a campaign fundraising event during the 2016 Legislative session freeze period. Exhibit #1.

Investigative Findings Staff conducted a review of the C-3 and C-4 reports filed by the Citizens for Kim Wyman Campaign for the entire 2016 election, and found the following:

1. April of 2016:

Timely Reports: On May 9, 2016, the Campaign timely filed: Two C-3 reports totaling $3,420 in contributions received in April 2016; and one C-4 report disclosing the receipt of $3,420 in monetary contributions, $234 for in-kind contributions, and $17,924 in expenditures made, with a cash on hand balance of $44,943.

Untimely Reports: On May 20, 2016, the Campaign filed 11 new C-3 reports disclosing an additional $30,567.50 in monetary contributions received and deposited during the month of April 2016. The C-3 reports were filed 10 days late disclosing the contributor information. On that same day, the Campaign filed an amended C-4 report disclosing the receipt of $30,568 in new monetary contributions, the previously reported $234 for in-kind contributions, and $18,867 in total expenditures made that included $943 in new expenditures from the original C-4 filing. The $943 in new expenditures included $722

for printing and postage, $112 for credit card processing fees and business checking fees, and $49 for Facebook advertisements, which were disclosed 10 days late.

On May 22, 2016, Secretary Wyman submitted a letter to the PDC, self-reporting the late filed C-3 and C-4 reports. Exhibit #2.

In addition to the late filed reports, staff found the Campaign received two $100 monetary contributions on April 25, 2016, that were deposited into the campaign bank account on May 5, 2016, which was three days late.

2. Calendar Years 2013 to 2015: Staff’s review of the C-3 and C-4 reports filed by the Campaign for calendar years 2013 through 2015 found the following: (1) The Campaign filed four C-3 reports totaling $5,375 that were 29-55 days late; (2) the Campaign filed three C-3 reports totaling $3,100 that were six to 29 days late, with six of the contributions on the C-3 reports appearing to have been deposited three to 27 days late; (3) the Campaign timely filed five C-3 reports totaling $6,850 that disclosed contributions that appear to have been deposited two to nine days late; and (4) the Campaign failed to timely file seven C-4 reports (filed between three and 25 days, and the expenditure information listed on four of the C-4 reports was disclosed 29 to 274 days late). Conclusion:

While Ms. Wyman “self-reported” that her Campaign late-filed the April 2016 contribution and expenditure reports, and offered mitigating factors for those reports, the Campaign failed to timely file required contribution and expenditure reports for April 2016. In addition, the Campaign failed to timely file C-3 and C-4 reports during calendar years 2013 to 2015; and failed to timely deposit some monetary contributions received. Exhibit #1 March 28, 2016, PDC staff complaint return letter sent to Ms. Bowhay, and a complaint return cover letter that included a warning sent to Ms. Wyman. Exhibit #2 May 22, 2016, letter from Kim Wyman addressed to the PDC Executive Director.

Dear Attorney General Ferguson:

The Washington State Democratic Party (the "Party") reports two apparent violations of Washington's campaign disclosure and contribution laws by Secretary of State Kim Wyman's ("Secretary Wyman") campaign. Specifically, Secretary Wyman's campaign failed to timely report tens of thousands of dollars in expenditures and contributions made and received in April 2016. This latest incident appears to be the latest in a pattern of campaign finance violations by Secretary Wyman's campaign.

I. Campaign Disclosure Requirements

During May 2016, Secretary Wyman appears to have violated RCW 42.17A.235 and RCW 42.17 A.240 by failing to report more than $30,000 in campaign contributions and almost $1,000 in campaign expenditures by the statutory monthly-filing deadline.

Candidates must file reports with the Public Disclosure Commission ("PDC") containing the mandatory campaign contribution and expenditure information required by RCW 42.17 A.240. Secretary Wyman was required to report contributions received and expenditures made in April

2016 by May 10, 2016. RCW 42.17A.235(2)(c). PDC Form C3 is the mandatory form for disclosing bank deposits of campaign contributions. WAC 390-16-031. PDC Form C4 is the mandatory form for disclosing monthly summaries of total campaign contributions and expenditures. WAC 390-16-041. These requirements are not applicable if the candidate did not receive a contribution or make an expenditure in the preceding calendar month exceeding two hundred dollars since the candidate's last report. RCW 42.17 A.235(2)(c).

II. Possible Violations of Statutory Campaign Disclosure Requirements

On May 9, 2016, one day before the May 10 deadline for disclosing contributions and expenditures for the month of April 2016, Secretary Wyman's campaign filed two C3 reports. Exhibit 1. The two reports disclosed 22 total campaign contributions totaling $3,420. Id. The same day, her campaign filed its mandatory monthly C4 report disclosing $3,420 in total campaign contributions for April. Exhibit 2.

On May 20, 2016, 10 days after the statutory deadline, Secretary Wyman's campaign filed 11 additional C3 reports for the month of April detailing 248 separate contributions totaling $30,567.50 for the month of April. Exhibit 3. The same day, her campaign filed an amended C4 report showing $33,987.50 in total campaign contributions for April. Exhibit 4. As a result, it appears that Secretary Wyman's campaign violated the campaign contribution disclosure requirements of RCW 42.17 A.235(2)(c) by grossly underreporting its income for the month of April when it filed its original disclosures.

Finally, it also appears that Secretary Wyman's campaign failed to comply with applicable disclosure laws for campaign expenditures as well. In addition to underreporting its campaign contributions for the month of April, the C4 report filed on May 9 also failed to report six campaign expenditures for the month of April, totaling $942.89, and in apparent violation of RCW 42A.17.240(6). Exhibit 2.

III. Requested Relief

Washington's campaign finance laws are designed to ensure that voters have the information they need to "follow the money." Full, accurate, and timely reporting of campaign contributions and expenditures lies at the core of Washington's campaign finance regime.

Here, Secretary Wyman appears to have failed to comply with these basic reporting requirements by failing to timely and fully disclose tens of thousands of dollars of contributions and expenditures from April 2016. This would not be Secretary Wyman's first violation of Washington's campaign disclosure and contribution laws. Just two months ago, the Public Disclosure Commission served Secretary Wyman with a Fonnal Written Warning for inappropriately soliciting campaign contributions during the 2016 legislative session freeze period. See Exhibit 5. This formal warning explicitly cautions Secretary Wyman that "[i]f there are future violations of PDC laws or rules, the Commission will consider this Formal Written Warning in deciding on further Commission action."

This pattern of repeated noncompliance with campaign finance reporting requirements demonstrated by Secretary Wyman's campaign is deeply troubling and appears to reflect either (a) a larger problem with accountability and oversight in Secretary Wyman's campaign, (b) blatant disregard of public disclosure requirements, or ( c) both. The Party respectfully requests that you conduct a formal investigation into the nature and extent of these potential violations.

Late filed C-3 reports: Four C-3 reports totaling $5,375 were filed 29-55 days late.

• On December 4, 2013, the Campaign filed a C-3 report disclosing a $500 contribution

had been received on September 3, 2013, and deposited on September 10, 2013. The

C-3 report was filed 55 days late.

• On December 9, 2013, the Campaign filed a C-3 report disclosing 16 contributions

totaling $3,775 that had been received on October 10, 2013, and deposited on October

15, 2013. The C-3 report was filed 29 days late.

• On December 9, 2013, the Campaign filed a C-3 report disclosing a $1,000 contribution

had been received on October 9, 2013, and deposited on October 17, 2013. The C-3

report was filed 29 days late.

• On December 9, 2013, the Campaign filed a C-3 report disclosing a $100 contribution

had been received on September 27, 2013, and deposited on October 3, 2013. The C-3

report was filed 29 days late.

Late filed C-3 reports and deposit of contribution: Three C-3 reports totaling $3,100 were filed

six to 29 days late, and six of the contributions received were deposited three to 27 days late.

• On December 9, 2013, the Campaign filed a C-3 report disclosing three contributions

totaling $1,550 had been received on October 10, 22, and November 1, 2013, and all

three deposited on November 12, 2013. The two October 2013 contributions totaling

$1,300 were disclosed 29 days late, and the three contributions were deposited four to

27 days late.

• On December 11, 2013, the Campaign filed a C-3 report disclosing a $200 contribution

had been received on October 16, 2013, and deposited on December 11, 2013. The C-3

report was filed 29 days late and the contribution was deposited 19 days late.

• On December 16, 2014, the Campaign filed a C-3 report disclosing two contributions

totaling $1,350, one received on November 17 and the other received December 2,

2014, with both deposited on December 12, 2014. The C-3 report was filed six days late

and the contributions were deposited three to 19 days late.

Late deposit of campaign contributions: Five C-3 reports totaling $6,850 included

contributions received that were deposited two to nine days late.

• On June 3, 2015, the Campaign timely filed a four-page C-3 report disclosing numerous

contributions totaling $4,475 that had been received April 26 to 28, 2015, and deposited

on May 7, 2013. The contributions were deposited two to four days late.

• On October 8, 2015, the Campaign timely filed a C-3 report disclosing the receipt of two

monetary contributions on September 1, 2015 totaling $700, that had been deposited

on September 17, 2015. The two contributions were deposited nine days late.

• On October 8, 2015, the Campaign timely filed a C-3 report disclosing the receipt of a

$1,500 monetary contribution on September 1, 2015 from an individual, that had been

deposited on September 15, 2015. The contribution was deposited seven days late.

• On December 10, 2015, the Campaign timely filed two C-3 reports totaling $175 in

contributions received, that were deposited two to three days late.

Late filed C-4 reports:

• On December 9, 2013, the Campaign filed a C-4 report covering the period of January 21

through November 30, 2013, disclosing the receipt of $11,625 in monetary

contributions and made expenditures totaling $1,453. Based on the PDC laws, rules and

reporting requirements, the information disclosed on the C-4 report indicated the

Campaign should have filed the following C-4 reports:

1. February 2013 C-4 report: Disclosing a $241 expenditure made by the Campaign on

February 11, 2013 to the Sheraton Hotel for hotel accommodations. The

expenditure was disclosed 274 days late.

2. April 2013 C-4 report: Disclosing three expenditures made by the Campaign totaling

$314.19 on April 8, 15 and 16, 2013. The three expenditures were disclosed 243

days late.

3. September 2013 C-4 report: Disclosing a $500 bank deposit made on September 10,

2013, and three expenditures totaling $114.24 that were made in May and June.

The contribution and expenditure information was disclosed 60 days late.

4. October 2013 C-4 report: Disclosing a $3,775 bank deposit made on October 15,

2013, and three expenditures totaling $41.65 that were made in October. The

contribution and expenditure information was disclosed 29 days late.

• On May 5, 2014, the Campaign filed a C-4 report covering the period of February 1

through April 30, 2014, disclosing no contributions had been received and $1,034 in

expenditures made. The information disclosed on the C-4 report indicates the

Campaign made three expenditures in March of 2014 totaling $590.18 that should have

disclosed on April 10, 2014. The information was disclosed 25 days late.
