Before writing responses to questions from the this report we sent all questions to the our five ministries: Ministry of Interior, Ministry of Health, Ministry of Economy, Ministry of Agriculture and Ministry of the Sea, Transport and Infrastructure, then to the two State organizations; National Protection and Rescue Directorate, and Croatian Environment Agency and final to the all regional and local level in country. This report is the result of contributions received responses.

POLICY FOR IMPLEMENTATION OF THE CONVENTION

Provide a general description2 of your country’s policy for prevention of, preparedness for and response to industrial accidents, especially relating to the implementation of the Convention and explain how this policy is reflected in national legislation and followed up by authorities.Please note that an overall comprehensive question (including past reporting rounds and the updates) is estimated at 1,000-1,200 words

Please copy here the content of the last full reply (please note that this might be the one in the last reporting round or in an earlier one)Reply from previous reporting roundsThe first things for the implementation are the coordination of the environmental legal-harmonization fully in the European Union with The Convention on the Transboundary Effects of Industrial Accidents and Directive 96/82/EC (Seveso II, Annex 2) and Seveso III Directive. The SEVESO Directives are considered as the legal and technical instrument to fulfill the obligations of the European Community arising out of the Convention.Croatia’s policy for the prevention of, preparedness for and response to industrial accidents is based on the polluter-pays principle, the application of which is controlled by enforcement authorities at national and regional levels. This policy is stated in Article 15. Environmental protection act and article 14. The Regulation on the Prevention of Major accidents involving Dangerous Substances.

Industrial risk management – legal framework: Convention on the Transboundary Effects of Industrial Accidents (ratified 1999), New Environmental Protection Act (Official Gazette No. 80/13), Regulation on the prevention of major accidents involving dangerous substances (Official Gazette No. 114/08), Ordinance on the register of installations in which dangerous substances have been identified and on the register of reported major accidents (Official Gazette No. No.113/08), Regulation on the manner of establishing environmental damage (Official Gazette No. 139/08), Rule book on the measures for remedying the environmental damage and the restoration programs (Official Gazette No. 145/08), in competence Ministry of Environment and Nature.Rescue and Protection Act (OG, No. 174/04, 79/07, 38/09, 127/10), Ordinance on the Methodology for Drafting Risk Assessment and Protection and Rescue plans (OG, No. 38/08), Ordinance on Mobilization and Actions of Protection and Rescue operational forces (OG, 40/08) are in competence of the National Protection and Rescue Directorate.Others obligations are: Water Protection Plan, Fire Protection Act (including fire risk assessment), Occupational Health and Safety Act (including occupational risk assessment) and Transport of Hazardous Substances Act are in other competence authorities.Croatian Environment Agency is responsible for establishment, development, maintenance and coordination of a register of installations with dangerous substances for Croatia. dangerous substances relate to installations in which or through which, in the performance of activities of the company, dangerous substances are: produced, processed, stored, generated as by-products during the production process; used as raw materials in the production and technological process, transported inside the installation and/or landfills for production process purposes; or which may be generated during a major accident. The operator of the company in whose installation dangerous substances are present shall undertake preventive measures necessary for reducing the risk of occurrence and preventing the occurrence of major accidents and measures for restricting the effect of major accidents on human beings, material assets and the environment. The operator shall deliver, in the prescribed manner, data on the activities and safety measures which he is implementing in accordance with the Safety Report and inform the Ministry and the central administration body competent for safety and rescue as well as legal and natural persons which are likely to be affected by major accidents that the activities of the company in the installation or the installation itself may cause. Information must be available to the public.In the event of a major accident which has occurred on the territory of the State and which can cause transboundary effects on human health and the environment in another country, the Ministry notifies, through the central state administration body competent for safety and rescue, that country and deliver to the competent bodies of that country all the information needed in order to undertake necessary measures.

The operator shall immediately notify the Ministry and the central administration body competent for safety and rescue of the moment of occurrence of a major accident and deliver information on: - causes and conditions due to which the major accident occurred, - dangerous substances present during and after the major accident, - assessment of the consequences of the major accident to human health, material assets and the environment,- undertaken emergency or supplementary activities and measures. The operator shall also notify the Ministry and the central administration body competent for safety and rescue of the activities and measures undertaken for mitigation of mid-term and long-term consequences of major accidents and activities and measures for preventing the potential reoccurrence of the accident. If during subsequent investigation additional circumstances which may affect the application of other measures and activities at the site are found, the operator shall subsequently also notify of those measures and activities. The operator shall immediately deliver the data to the administrative bodies, the city, municipality and the public, on the territory of which the major accident occurred as well as the Agency and other bodies competent for the safety and rescue system.

As to the transboundary collaboration in matter of prevention and preparedness, it is worth mentioning the Agreement between the Croatia Council, the Government of the Republic of Hungary, Slovenia, Serbia, Bosnia and Herzegovina on the transboundary co-operation.

Although the main focus is on the prevention and preparedness, the legal framework also requires the operators to act rapidly in response to an emergency and further requires the competent authorities to co-ordinate the emergency services which are in charge of responding to such accidents. As to the transboundary cooperation in this

matter, it is regulated by bilateral agreements between the Croatia and Hungary, Slovenia, Serbia, Bosnia and Herzegovina, Italy on the mutual assistance in case of a catastrophe or a grave accident.National Protection and Rescue Directorate:

a) Executes the function of the authority to notify major industrial accidents and to request or provide international assistance under separate legislation and in accordance with international agreements,b) Executes the function of Point of Contact for the purpose of Industrial Accident Notification and Mutual Assistance designated within the UNECE Industrial Accident Notification (IAN) System,c) Cooperates with the Ministry of Environment in the execution of state supervision, mainly in approving the inspection plan of the establishment,d) Utilizes the comprehensive reports of major industrial accidents for purposes specified in separate legislation.e) Ensures the contacts and cooperation with others Points of contact.

The National Protection and Rescue Directorate is an independent, professional and administrative organization, tasked with preparing plans and managing operational forces as well as coordinating the activities of all participants in the protection and rescue system.

Basic tasks of the National Protection and Rescue Directorate

The basic tasks of the National Protection and Rescue Directorate are stipulated by the Law on protection and rescue. The most important tasks are risk and vulnerability assessment, drafting measures aimed at preventing crises and accidents, ensuring that these measures are implemented, and effective emergency management in case of major disasters.

Organization of the National Protection and Rescue Directorate (NPRD)At the national level, NPRD is organized into three operational services: Civil Protection Service/Sector, Fire Fighting Sector and the Sector for 112 System. Besides operational services, the NPRD includes the Fire Fighting and Protection and Rescue School, which is responsible for education for protection and rescue purposes, the Personnel, Finance and Legal Sector for needs of the NPRD as well as of other entities included in the protection and rescue system and financed, through NPRD, from the State Budget, and the Director's Office, integrating functions of internal coordination within the NPRD and implementing a highly developed international cooperation in the field of protection and rescue, and public relations in the field of protection and rescue in everyday operation, this including also promotion and education activities.

The National Protection and Rescue Directorate is divided into organizational entities. The central national administration consists of the Directors Cabinet, International Cooperation Department and the Internal Affairs Department as well as five sectors:

Fire Fighting Sector Sector for 112 SystemFire Fighting and Protection and Rescue School and Personnel, Legal and Finance Sector

The functionality of the Directorate is ensured through its territorial organization i.e. each County has a County Protection and Rescue Office consisting of Prevention, Planning and Supervision Department and the County 112 center. In County Offices of the four biggest cities Zagreb, Rijeka, Osijek and Split there are Protection and Rescue Departments, while in the County Offices on the coast (Zadar, Šibenik, Split and Dubrovnik) there are also State Intervention Units.

Inspection Environmental protection for the dangerous substances

The Department for Coordinated Inspection Control is responsible for coordinated control of environmental inspectors and inspectors competent for the control of individual environmental components and protection against impacts of environmental loads according to special regulations, and for thematic controls in conjunction with the representatives of the Ministry of Defense, the Ministry of the Interior, the Board of Customs of the Ministry of Finance and the Coastal Guard of the Ministry of the maritime affairs, transport and infrastructure. The Department for Inspection Control of Accredited Persons deals with the control of legal and physical entities authorized for activities of hazardous waste management and transboundary movement of waste, entities authorized for monitoring air quality and emissions, and entities authorized for expert activities in the field of environmental protection.In reference to the Environmental Protection Act and to the adjustment of the practices of the relevant inspections in the supervision of all environmental components, an agreement has been signed, entitled „Agreement on Cooperation between Environmental Inspection Services“. In addition to the Environmental Inspection within this particular Ministry, the said Agreement has also been implemented by 14 additional inspectional services responsible for environmental issues, which have been established within the Ministry of Agriculture, Forestry and Water Management, the Ministry of Health and Social Welfare, the Ministry of Culture, the Ministry of the Interior, the Ministry of the Sea, Tourism, Transport and Development and the State Inspectorate. In view of the modifications in the scope and organization of the Ministry of Agriculture, Forestry and Water Management, and the Ministry of the Sea, Tourism, Transport and Development, pursuant to the Act on Amendments to the Act on the Organization and Scope of Central State Administration Bodies (OG 5/2008) of January 2008, until the alignment of the Agreement with these modifications, the obligations arising under the Agreement shall be taken over by the newly established Ministry of Regional Development, Forestry and Water Management; Ministry of Agriculture, Fisheries and Rural Development; and Ministry of the Sea, Transport and Infrastructure.In this time we have new Environmental Protection Act and others new sub legislations whose better to prescribe liability provisions TEIA Convention and others obligations regarding internationals relations.Please indicate only changes from the previous reporting roundReply from reporting round 2014-2015

Harmonization of Croatian legislative with The Convention on the Transboundary Effects of Industrial Accidents is partly made through harmonization with Directive 96/82/EC on the control of major-accident hazards involving dangerous substances (Seveso II) which was later repealed with Directive 2012/18 EU on the control of major-accident hazards involving dangerous substances, amending and subsequently repealing Council Directive 96/82/EC (Seveso III Directive). The SEVESO Directives are considered as the legal and technical instrument to fulfill the obligations of the European Community arising out of the TEIA Convention.

Industrial risk management – legal framework: Convention on the Transboundary Effects of Industrial Accidents (ratified 1999), Environmental Protection Act (OG No. 80/13 and amendments to the Law on Environmental Protection Act OG No. 78/15), Regulation on the prevention of major accidents involving dangerous substances (OG No. 114/08; replaced by OG No. 44/14 on 15th April 2014 (Regulation PMAIDS OG 44/14)) and the Ordinance on the registry of installations in which dangerous substances are present and on the register of reported major accidents (OG No. 113/08; replaced with OG No. 139/14 on 04th December 2014), are in competence of MENP.

SEVESO III Directive has been transposed in July 2015 through last amendments of the Environmental protection act. Annexes of the SEVESO III Directive were transposed in April 2014 through Regulation PMAIDS (OG 44/14).

Croatia’s policy for the prevention of, preparedness for and response to industrial accidents is based on the polluter-pays principle, the application of which is controlled by enforcement authorities at national and regional levels. This policy is stated in Article 16th of Environmental protection act.

Protection and Rescue Act (OG, No. 174/04, 79/07, 38/09, 127/10) till July 2015th and Civil Protection System Act (OG, No. 82/15) from July 2015th, Ordinance on the Methodology for Drafting Threats Assessment and Protection and Rescue Plans (OG, No. 30/14, 67/14), Ordinance on Mobilization and Actions of Protection and Rescue operational forces (OG, No. 40/08, 44/08) are in competence of the NPRD.

Others obligations are: Water Protection Plan, Fire Protection Act (including fire risk assessment), Occupational Health and Safety Act (including occupational risk assessment) and Transport of Hazardous Substances Act in competence of other authorities.

CAEN is responsible for establishment, development, maintenance and coordination of a Registry of installations with dangerous substances and the Register of reported major accidents (REDS/RRMA) for Croatia which is accessible to competent authorities and partly to public.

The provisions of the Regulation PMAIDS (OG 44/14) relate to installations in which or through which, in the performance of activities of the company, dangerous substances are: produced, processed, stored, generated as by-products during the production process; used as raw materials in the production and technological process, transported inside the installation and/or landfills for production process purposes; or which may be generated during a major accident. The operator of the company in whose installation dangerous substances are present shall undertake preventive measures necessary for reducing the risk of occurrence and preventing the occurrence of major accidents and measures for restricting the effect of major accidents on human

beings, material assets and the environment.

The operator should submit the Notification on the presence of dangerous substances to the competent authorities and after entering into force the new Regulation on the prevention of major accidents involving dangerous substances (OG No. 44/14) by on-line data delivery into database REDS/RRMA.

The operator shall deliver, in the prescribed manner, data on the activities and safety measures which he is implementing in accordance with Safety Report and inform the MENP and NPRD as well as legal and natural persons which are likely to be affected by major accidents that the activities of the company in the installation or the installation itself may cause. Information must be available to the public.

NPRD:

accordance with international agreements,

Inspection

Inspection for the environmental protection in MENP is responsible for preparation of supervision of facilities and establishments/installations for purpose of determining compliance of use and if they meet prescribed requirements of environmental protection.

In view of the modifications in the scope and organization of the Ministry of Agriculture, Forestry and Water Management, and the Ministry of the Sea, Tourism, Transport and Development, pursuant to the Act on Amendments to the Act on the Organization and Scope of Central State Administration Bodies (OG 5/2008) of January 2008, until the alignment of the Agreement with these modifications, the obligations arising under the Agreement shall be taken over by the newly established Ministry of Regional Development, Forestry and Water Management; Ministry of Agriculture, Fisheries and Rural Development; and Ministry of the Sea, Transport and Infrastructure.

In 2013, another agreement has been signed and implemented, that was Agreement on Cooperation between the MENP and NPRD, which stipulates the way of cooperation, training and international cooperation, the implementation of regulations, informing the public, a plan and a program of cooperation, reporting and implementation of the Agreement in performing their duties and tasks of interest of both parties.

In coordinated inspection visits guidelines are available in check-list format for evaluation of major accident prevention policy and safety management system.

Indicators for the success of a policy are still very hard to come by. However, we think the policy is successful and doesn’t need yet any significant overhaul. It is now rather a matter of fine tuning, adapting to changing conditions and making sure all concerned guard themselves against the routine of implementation in installations and of enforcement by the authorities.

The identification of hazardous activities is based on the results of the application of the Croatian Environment Agency which is responsible for establishment, development, maintenance and coordination of a register of installations with dangerous substances.

Every operator of an installation in the scope of the register has to submit to the competent authority and assessment of the possible damages outside the installation and – when these damages can be serious – a quantified risk assessment.

The operator should submit the Notification on the presence of dangerous substances to the competent authorities (MENP, NPRD, CAEN) and after entering into force the new Regulation PMAIDS (OG 44/14) by on-line data delivery into database REDS/RRMA which is maintained by CAEN. MENP is competent authority for data analysis and validation (Annex I of TEIA Convention is same as Seveso III Directive Annex I). Notification includes classification of chemicals (corresponds to CLP Regulation), risk assessment, worst case scenario analysis results, off-site effects, domino effect, identification of environment of site including neighbouring establishments, possibility of domino effect, transboundary effect. Revision is done by

Our identification mechanism has been successful so far. We may in the future have to pay more attention to domino effects should large industrial zones or park emerge and we have plan for the best coordination with different kind of inspection for the identification other installations whose not provide information in the register risk installations.

PREVENTION OF INDUSTRIAL ACCIDENTS

8. Further to general description provided under Q.1 please explain briefly the main preventive measures taken by operators and authorities during all phases of enterprise.

The operator of the company in whose installation dangerous substances are present shall contain guidelines and measures for preventing major accidents setting out the organization and management of the installation with the aim of reducing major accident hazards to a minimum and ensuring a high level of protection of human beings and the environment.

When the operator ascertains the presence of large quantities of dangerous substances in the installation, he shall develop the Safety Report in conformity with the regulation and best available techniques and technologies which shall contain: guidelines for preventing major accidents, prepared safety system, internal plan (plan for procedures within the installation), data for the plan on preventing major accidents which refers to protection measures and activities to be undertaken outside the installation of the operator (hereinafter referred to as: external plan) and the statement of the operator on the part of the content of the Report which is not accessible to the public due to industrial, trade or business confidentiality, public safety and/or national defense.

It shall be prohibited to perform activities which involve the presence of dangerous substances in the installation of a company without having obtained approval of the Safety Report. The approval shall also be obtained by a company which performs activities in an installation in which dangerous substances are present. The approval shall also be obtained for amendments to the Safety Report for which approval has been obtained. The approval of the Safety Report shall be issued on the basis of the evaluation of whether the said Report has established all measures and activities and requirements and method for their implementation. The company operator shall be responsible for obtaining the approval. The Ministry shall supervise the content of the Notification and the Safety Report as follows:– Every five years,– at any other time at the initiative of the operator or the request of the competent authority, where justified by new facts or to take account of new technical knowledge about safety matters, for example arising from analysis of accidents or, as far as possible, 'near misses', and of developments in knowledge concerning the assessment of hazards.

1. for an installation which will be built or reconstructed, before obtaining the decision on integrated environmental protection requirements and at the latest at the same time as submitting the request for environmental impact assessment if such an assessment is prescribed as mandatory; 2. for existing installations: - in the case of reconstruction, that is, changes in production and operation, - in the case of significant increase of the quantity or significant changes in the nature or physical form of the present dangerous substance in relation to the information stated in the notification which the operator delivered previously, - in the case of any changes in the procedures in which the dangerous substance is used in relation to the change in nature or quantity of dangerous substances, which changes might significantly influence major accident hazards, - In the case of permanent termination of the operation of the installation.

Measures taken by authorities besides inspections include the production of Guidance at the national level for the application all documents for protection and rescue on the Ministry of Environmental and Nature. In line with Guidance on the preparation of a Safety Report to meet the requirements of Seveso II Croatian Center for Cleaner Production prepared Methodology for implementation of activities regarding Seveso II Directive.

The operator (natural or legal person) of the establishment who determines presence of dangerous substances in large quantities is required to produce Safety report and is also considered in charge of hazardous activity. Large quantities are prescribed by Annex I Regulation PMAIDS (OG 44/14) which is in compliance with Seveso III Directive (Annex I upper-tier requirements). Content of safety report is prescribed by Annex III of Regulation PMAIDS (OG 44/14) which is in compliance with SEVESO III directive (Annex II).

Operator is also required to draw up document in writing setting out the major accident prevention policy and to ensure that it is properly implemented through safety management system.

Safety report contains:

1. Information on the management system and on the organisation of the establishment with a view to major accident prevention

2. Presentation of the environment of the establishment

3. Description of the installation

4. Identification and accidental risks analysis and prevention methods

5. Measures of protection and intervention to limit the consequences of a major accident.

Internal emergency plan is also part of the Safety report.

In order to prevent major accidents the operator should undertake all the necessary precautionary measures in proportion to the potential hazards in the establishment.

The precautionary measures should be undertaken so as to minimise, at the very source within the establishment, the likelihood of a major accident hazard occurring, and any adverse consequences in the case of occurrence of a major accident

The operator shall fulfil his obligations by:

1. Undertaking measures to ensure that major emission, release, fire and/or explosion:

- is prevented from occurring within the establishment

- occurring in one unit cannot impact other units within the establishment, and

- occurring outside the establishment cannot impact the establishment in such a manner as to present a safety hazard;

2. Installing suitable warning, alarm and safety equipment in the establishment;

3. Installing measuring and control equipment which shall be separate and independent from other systems if required for safety purposes;

MENP gives approval of Safety report in procedure which involves other relevant authorities. Safety report is being revised every 5 years accept in case of significant change.Inspection can prohibit bringing into use of any establishment or its part if measures taken by the operator are seriously deficient.

At first inspectors were periodically trained and then usually tested plans together with operators who have a duty to make internal emergency plans for protection and rescue.In the event of modification of an installation, storage facility, or process involving dangerous substances or of the nature or quantity of dangerous substances which could have significant repercussions on major accident hazards, the company, i.e. the operator shall: determine whether the major accident prevention policy, management systems and procedures included in plan and need to be revised and after determining that the plan needs to be revised, inform the Ministry of Environment and the central state administration body competent for protection and rescue of the details of the required revision of the plan.In the case if Ministry of Environment deemed necessary, request the operator to amend the existing plan, or to draw up the plan. The operator and the competent public authorities shall periodically review, assess and verify the necessity for amendments to the plan within a period of three years from the date of delivery. Account shall be taken of any changes concerning the operator or modifications of emergency services, new technical knowledge and knowledge concerning major accident responses.. The Croatian Government may decide on requesting and receiving international assistance in accordance with the provisions of the civil protection system and the Croatian obligations assumed under international treaties.

NPRD is the body responsible for the provision of urgent international assistance in civil protection in a way that send civil protection operational forces and material assistance to countries affected by major accident or disaster which has requested international assistance.

Also, Republic of Croatia can request international assistance through the NPRD, ie the National Center of Protection and Rescue (NCPR) by EU Civil Protection Mechanism.

Legislations of the Land Use Planning and sub law sets up the framework for land use planning in general terms. Objectives related to preventing environmental pollution and limiting consequences of pollution shall be taken into consideration when preparing physical plans and making decisions in accordance with a regulation governing physical planning, in particular when selecting locations for new installations, establishing changes which have occurred in existing installations and planning new infrastructure such as roads, public areas and residential areas. Apart from the obligations prescribed the distance between an installation and residential areas, public places and environmentally significant areas, as well as use of additional measures by existing installations should also be taken into consideration when preparing physical plans, all for the purpose of avoiding increased threat to human health, material assets and the environment.

Competent authority on demand of authority in charge of making Land Use Plan is obliged to give data about establishments that have dangerous substances.

NPRD approves documents of land-use planning and if necessary gives special requirements when permits for land use are given.
