Mendoza Mabutas alleging among others that she married, of legal age, Filipino and a resident of 23 Orchid St. Fairview Brgy Baguio City; that she and Noel Cid Mabutas got married on December 22, 2008 at Baguio City; that they have two (2) minor children, Gabrielle Joyce Mabutas born on June 28, 1997 in Baguio City and Mary Raphael Mendoza Mabutas born on November 13, 1999 also in Baguio City; that there are erroneous entries which appear in the Certificate of Live Births of their minor children, more particularly under item No. 6 of the Certificate of Live Birth of both children, the first name of mother , appear thereon as TERESITA instead of MA. TERESITA; in item No. 17 of the Certificate of Live Birth of minor Mary Rafael Mendoza Mabutas the age of father appear as 41 instead of 42; and in item No. 18, in the Certificate of Live Birth of Gabrielle Joyce Mendoza Mabutas, the place and date of marriage of parents was indicated as November 27, 1984- San Fernando, La Union while in the Certificate of Live Birth of Mary Raphael Mendoza Mabutas what was indicated is November 27, 1984 – Baguio City instead of the true date and place of marriage which is December 22, 2008- Baguio City, that she and her husband were not minors of the time children were conceived and born and the erroneous entries were made in good faith so that her children can use the surname of their father and avoid the stigma of being branded as illegitimates; that the error in the indication of the age of the age of the father was a more harmless and innocuous error arising from an honest mistake in the computation; that the error in the recording of the name of the name of the mother is based on the honest belief that there is no difference between Teresita and Ma. Teresita; that on order to avoid confusion and to set the records straight , there is a need to cancel and / or correct the entries in the certificate of live birth of her minor children and an annotation indicating that the children were “legitimated by the subsequent marriage of their parents on December 22, 2008 at Baguio City.” The petition was found to be sufficient in the form and substance and was set for initial hearing on April 24, 2015 at 9:00 o’clock in the morning on which date and time, the petitioner shall be allowed to substantiate her petition, and any interested person may show cause, if there be

Let a copy of this Notice of Initial Hearing, together with a copy of the petition and its annexes, be sent to the Honorable Solicitor General, Makati City, Metro Manila, the City Prosecutor of Baguio City, the respondent Local Civil Registrar of Baguio City as well as to the National Statistics Office, Manila. Also, furnish copies of this notice to Noel Cid Mabutas and the office of the Clerk of Court for the publication, and the petitioners, through their counsel.

Also, let this notice of Initial Hearing be published at the expense of the petitioners, once a week for three (3) consecutive weeks in the newspaper of general circulation in the City of Baguio and the whole Cordillera Region, the last publication of which shall not be later than the date of Initial Hearing.

The Process Server is hereby directed to post copies of this notice on the bulletin boards of this Court, the Justice Hall, the City Market and the Post Office, all of Baguio City
