    I. Introduction.This application requests special exception approval pursuant to Section 735 of the

    Zoning Regulations for an animal boarding use in the RC/C-2-B Zone District at 1711 FloridaAvenue, N.W. (Square 256 2, Lot 95) (the "Property"). The Property is owned by 1711 FloridaAvenue Property, LLC ("Owner"), and will be leased to Dogs by Day, LLC and Greenpets (newname may be "Planet Pet") (the "Applicant"). The Applicant proposes to operate an animalboarding use, with accessory uses including the retail sale of pet products, and dog training andgrooming.

    II. History and Background of Dogs by Day and Green Pets.Dogs by Day was started in 1999, and has been operated since then at 1724 14 l Street,

    N.W . Dogs by Day offers what is commonly know n as "doggy day care" and overnightboarding for busy District residents that prefer not to leave their dogs home alone throughout theday. The mission statement of Dogs by Day is "To enhance the quality of life for dogs whilerelieving the anxiety of their owners by providing a 'safe, fun, loving, and stimulatingenvironment for the dogs to stay both day and nigh t." Dogs by Day offers 24-hour a day humanand canine companionship in a cageless environment, loving and certified dog handlers andfreedom from guilt about leaving a dog at hom e alone or in a cage.

    Dogs by Day, at their location on 14 th Street, currently provides day care for an averageof about 80 dogs, with about 1,500 active clients that rely on Dogs by D ay for their daily pet careand overnight boarding. Dogs by Day is vital to D.C. residents because it provides an outlet fordogs to play, socialize, work through their fears and aggressions, so that their owners can relaxknowing that their dog isn't hom e dumping the trash or chewing on the furniture. Many of theclients of Dogs by Day work long hours in the City and would not consider owning a dog if

    Dogs by Day wa sn't around to look after those dogs. Most dog lovers understand that it may becruel to leave a dog hom e alone inside the hou se for 10 hours a day.

    Green Pets, an affiliated comp any, currently operates next doo r to Do gs by Day, and willjoin D ogs by Day in a consolidated facility at 1711 Florida Aven ue. Green Pets is the Dis trict'smost popular all-natural pet food and supply store, and a perfect accessory to the primary animalboarding use.

    Dogs by Day and Green Pets have recently been informed by their landlord that theirlease would not be renew ed, after the landlord demand ed a large rent increase. Dogs by Daysearched for quite some time for a location that would be both suitable for the operation, andcompliant with the special exception provisions for animal boarding use.

    III. The Property and Surrounding N eighborhood.The Property is located on the northwest corner of Florida Avenue and Champlain St,

    NW , in the RC/C-2-B Zone District. The building at 1711 Florida Avenue includes acomm ercial parking g arage in the rear of the building - cars enter from C ham plain St. AcrossChamplain S treet is a large ball field/park, which abuts the M arie Reed Comm unity L earningCenter. Across Florida Avenue to the south of the Property are a few comm ercially-zoned rowhomes and retail uses.The proposed location w as an incredible find, for man y reasons. It 's very close to theexisting facility, which is important to the current clients, many of whom walk their dogs to theday care. It is large enough to house what is the most popular dogg y day-care in the City. Also ,the property is well-situated in a heavily commercial district, across from a park, the Marie ReedLearning Center, and other comm ercial retail uses. While the Residence Zone (R-5-B) starts onthe other side of Champlain St., there are no residential uses on Champlain Street in theResidence Zon e. The building is a large, brick building, with very small win dow s, and naturallywell-insulated for sound. Dogs by Day successfully enforces a very successful "n o-bar king"policy, and noise will not be an issue.

    Clients walking the ir dogs to day care will enter the facility on Florida A venu e. Drivingclients will be able to enter the parking garage. Cham plain Street is a one-w ay street headingsouth, except for a small portion of the street dedicated solely to cars turning right off of Florida

    Avenue and entering the parking garage from Cham plain Street. Therefore, cars coming to thisfacility should never ha ve to stop on the street and should not disrupt the flow of traffic, evenwhen slowing down to enter the garage. Dogs by Day walks dogs in nearby M eridian Park or inthe neighborhood, and never walks more than four dogs at one time.

    IV. The App lication Satisfies Special Exception Requirements of Sections 3105 and 735.A. Overview. Pursuan t to Section 3104.1 of the Zoning Re gulations, the Board is

    authorized to grant special exception relief where, in the judgment of the Board, the specialexception will be in harmony with the general purpose and intent of the Zoning Regulations andZoning M aps, and will not tend to affect adversely the use of neighboring property, subject also,in this case, to the specific requirements for relief under Section 735 of the Zoning Regulations.

    Uses that are permitted by special exception are deemed compatible with other usespermitted in that particular zoning classification p rovided certain requiremen ts are met. Inreviewing applications for a special exception under the Zoning Regulations, the Board'sdiscretion is limited to determining whether the proposed exception satisfies the relevant zoningrequiremen ts. If the prerequisites are satisfied, the Board ordinarily must grant the application.See, e.g., Nat'I C athedral Neighborhood Ass 'n . v. D.C. Board of Zoning Adjustmen t, 753 A.2d984, 986 (D.C. 2000 ). This application provides satisfactory evidence that the Applicant hassatisfied the relevant zoning requirements of Sections 3104.1 and 735, as described below.

    B. The Special Exception Requirements.The proposal in this application satisfies the requirements of Sections 735 and 3104.1 of

    the Zoning R egulations.

    Section 735.2 The animal boarding use shall not abut a Residence Zone. The Property is locatedin the RC/C-2-B, and the Residence Zone (R-5-B) begins in the middle of Champlain Street,NW . The Property abuts Cham plain Street where Cham plain Street is still within the C-2-BZone D istrict, and therefore cannot be said to also abut the Residence Zone b eginning in themiddle of Champlain.1 Furthermore, the beginning of the Residence Zone includes a baseballfield and the Marie Reed Le arning C enter, and no residential uses.     Section 735.3 The animal boarding use shall take place entirely within an enclosed andsoundproof building in such a way so as to produce no noise or odor objectionable to n earbyproperties. The windows and doors of the premises shall be kept closed and no animals shall bepermitted in an external yard on the premises.

    The use will take place entirely within the building, wh ich is already significantlysoundproofed so as to produce no noise or odor. The very smal l wind ows camiot be opened.There is a small (100 s.f.) external yard that will not be used except for dogs and handlersentering and exit ing the building to go for walks off the property.

    Section 735.4 The animal boarding use shall place all animal waste in closed waste disposalcontain ers and shall utilize a qualified w aste disposal comp any to collect and dispose of allanim al waste a t least weekly. Odors shall be controlled by mean s of an air filtration system (forexamp le, High Efficiency Particulate Air "HEP A"filtration) or an equivalently effective odorcontrol system.

    Animal waste is placed in heavily l ined cans and kept inside the facil i ty unti l the nightbefore pick-up. Pick-up takes place three t imes per week. Dog s by Day wi l l be using simi larHEPA fil ter equipment as in their current si te.

    Section 735.6 External yards or other exterior facilities for the keeping of animals shall not bepermitted.

    As stated above, the small (100 s.f.) external yard will not be used except for dogs andhandlers entering and exit ing the building to go for walks off the property.

    Section 3104.1 The Board is authorized under 8 of the Zoning Act, D.C. Official Code 6-641.07(e)(2) (formerly codified at D.C. Cod e j 5-424(e)(2) (1994 RepU), to grant specialexceptions, as provided in this title, where, in the judgme nt of the Board, the special exceptionswill be in harmony with the general purpose and intent of the Zoning Regulations and Zoning

    in fact strongly conforms w ith one of the Ove rlay's stated purposes to: "Ensu re that newnonresidential uses serve the local community by providing retail goods, personal services, andother activities that contribute to the satisfaction of unmet social, service, and employment needsin the Reed-Cooke and Adam s-Morgan com munity" (11 DCMR 1400.2(b).)
