DEFINITIONS

This section comprises a series of concepts that are frequently referred to in these General Conditions. Wherever they appear in any of the clauses contained herein, they shall be construed as follows:

ABANDONED VEHICLE: when the Insured Vehicle remains parked for more than fifteen calendar days in someone’s property without having been authorized by or without notifying such person; or when the vehicle remains parked on a public road for the same period.

ADAPTATION AND/OR CONVERSION: any kind of modification or addition made to the bodywork, structure, coatings, mechanisms and/or apparatuses in order to modify the original design or operation of the Insured Vehicle. Armoring shall be deemed an adaptation or conversion.

ADDENDA: the Insured’s and/or the contracting party’s identification file which shall fully comply with Article 492 of the General Law of Insurance Institutions and Mutual Companies.

to carry cargo, merchandise or passengers.

CAR ACCIDENT: collisions, overturning or any kind of event whatsoever that causes property damage to the vehicle due to an external, violent, unexpected and sudden cause.

COINSURANCE: portion of the covered risk borne by the Insured.

COLLISION: the impact of the vehicle, with one or more objects occurred in a single event that causes property damage.

COMBINED SINGLE LIMIT (CSL): maximum liability held by HDI Seguros, as set forth in the policy cover page, operating as the sum insured for any event that implies liabilities during the policy term.

CONTRACTING PARTY: the company or individual whose name appears in the policy and who has the obligation to pay the premium.

COVERAGE OR COVERAGES: refers to the series of Risks set forth in the policy that HDI Seguros covers upon the occurrence of a loss.

DEDUCTIBLE: the amount that the Insured or Loss Payee invariably has to pay in the event

expert in vehicle traffic issues to determine the portion of liability borne by each one of the parties involved in a traffic accident.

ASSISTANCE SERVICES: services rendered to the Insured Vehicle and to the Loss Payees as set forth in these Particular Conditions and according to the coverages purchased hereunder.

BAIL: it is the amount that guarantees that the Insured Vehicle will be returned or released and that the Driver will be under probation in the course of the criminal procedure derived from procedural obligations, repairs of damages, and possible fines imposed by the authority in charge of the case.The bail amount may be expressed in cash or through a bonding policy.

BREAKDOWN: damage sustained by the Insured Vehicle, that prevents the vehicle from moving on its own power as a result of an internal failure and without the intervention of either intentional or accidental external factors.

BUSINESS VEHICLE:any automotive vehicle with registration plate for private, public or federal service purposes, used

ding interests. The actions and contributions under General Average shall be governed, unless agreed otherwise, as it is internationally customary under The Hague – Visby Rules in effect.

HDI Seguros: HDI Seguros S.A. de C.V.

ILLNESS: any alteration in health that starts or manifests itself for the first time after the Coverage in ception date as set forth in the policy cover page and after the date the journey starts.

IMPASSABLE ROAD: a place that it’s difficult or impossible to pass, cross or travel over due to the bad conditions thereof.

INSURED VEHICLE: the vehicle described in the policy cover page, including parts or accessories the reof installed or adapted originally by the manufacturer to each specific model or type of vehicle launched to the market.

INSURED: the person or company who is entitled to file a claim about services, benefits, or payments derived from the policy, and whose name shall appear in the policy cover page.

LOSS PAYEE: the company or individual who, according to this

of loss, under every coverage included in the cover page of the policy.

DEPRECIATION: the yearly reduction in the value of equipment due to the passing of time, wear and tear derived from using such equipment.

DRIVER: any individual driving the Insured Vehicle providing always that such individual is older than 18 (eighteen) years of age and has been granted express and tacit consent from the insurance policy holder.

FIRE: destruction of the Insured Vehicle by fire without human interference.

GROSS AVERAGE: it particularly refers to damages caused to the Insured Vehicle in the course of maritime navigations. General or gross average refers to the reasonable, intentional or voluntary sacrifice or expense incurred into in search of common safety and safeguarding of goods that may become endangered by collective hazards faced during water navigation. In a sea venture, all the parties involved shall bear a proportional share of any loss resulting from a General Avera-ge according to their correspon-

PARTIAL LOSS: damage sustained by the Insured Vehicle when the amount required to repair the property, loss or damage derived from an accident covered hereunder, including workforce, spare parts and materials is smaller than seventy five percent (75%) of the insured sum according to the appraisal carried out byHDI Seguros. The sum insured shall be as set forth in the policy cover page for Coverage 1. Property Damage or for Coverage 2 Total Theft.

PERMANENT ADDRESS: the Loss Payee’s customary, regular place of residence in the Mexican Republic.

PERMANTENT CUSTOMER SERVICE CENTER: Customer service by phone in case of loss, available 24 hours a day and 365 days a year, at: 01 800 019 6000.

PREFERRED LOSS PAYEE: the company or individual who, as previously agreed upon with HDI Seguros, and at the Contracting party’s request, shall be entitledto receive the payment or service; overriding any other loss payee, in the event of total loss derived from property damage or theft. The name or business name, if any, shall appear in the policy cover

policy, is entitled to file a claim and to the ensuing payment or service. As for companies, the LegalRepresentative shall be deemed the Loss Payee.

NEAREST REPAIRSHOP: repair shop or automotive dealership in the Mexican Republic that it’s closer to the site where the loss occurred.

OCCUPANT: any individual traveling on board of the vehicle upon occurrence of a situation that requires assistance. The maximum number of covered occupants shall be as set forth in the vehicle registration card, providing always that they are traveling in the cabin, compartment or box originally designed by the manufacturer to carry passengers. Hitchhikers or “auto-stoppers” are not entitled to assistance.

ORIGINAL INVOICE: invoice that the owner of the Insured Vehicle received from the company or individual who sold the vehicle.

OVERTURN: when the Insured Vehicle, being out of control, spins around and partially loses contact with the road surface it is being driven on.

RISK: an uncertain future event.

ROAD TRAFFIC ACCIDENT: unintentional event that occurs while driving the Insured Vehicle.

SALVAGE CHARGES: salvage operation –related expenses, being such understood and agreed as any act or action aimed to assist a vessel or naval artifact, or safeguard other goods that may be endangered while on waterways or other waters.Whenever a salvage operation is to be carried out, the maritime authority in the first port of arrival shall be notified thereof within the first 24 hours following arrival thereto. In In addition to the maritime honor awarded, the savior shall be entitled to keep the saved vessel and goods on board until the corresponding reward for salvage and interest thereof is fully guaranteed or covered. In any salvage operation, the duties and rights borne by each one of the parties involved shall be governed by the International Convention on Salvage.

SALVAGE INVOICE: invoice issued by the insurance company once the vehicle has been paid for.

SALVAGE VEHICLE: debris of the Insured Vehicle after total loss arising out of property damages or

page or in an endorsement forming integral part of the Contract.

PRESCRIPTION: the non-exercise of rights simply because time has elapsed.For insurance purposes, it is two years as of the date the loss occurs.

PRIVATE VEHICLE: automotive vehicle with a payload capacity of no more than 4.5 tons and bearing a license plate for private use. “Super duty”- type trucks are included providing always that they are for family use only and not used to carry merchandise or cargo.

PRORATE: proportion to calculate the premium to return in an insurance contract based on the number of days remaining for the expiration of the policy term.

REIMBURSEMENT: to return the money spent to whoever spent it.

RELATIVE: refers specifically to the spouse and children under 21 (twenty one) years of age that are the Insured’s financial dependents.

REPRESENTATIVE: any person accompanying or not the Loss Payee, in charge of making any arrangement to make it possible to render assistance or legal services.

appraisal carried out byHDI Seguros, and as set forth in the policy cover page for Coverage 1. Property Damage, 2.Total Theft or 8 Total Loss due to Property Damage.

USUAL AND COSTUMARY COST: it is the average value of prices and professional fees fixed for a market or place determined by the suppliers and receivers of medical and hospital services, according to the nature and technical complexity of the service in question, and the quality, time and cost resulting from using the facilities.

total theft and which rights have been subrogated in favor of HDI Seguros or any other insurance company as set forth in Article 116 of the Law of Insurance Contract.

SPECIAL EQUIPMENT: any part, accessory or label installed under specific request from the buyer or owner of the vehicle, additional to the parts or appurtenances that come originally in every model or type of vehicle that the manufacturer launches to the market.

LOANER VEHICLE: Four-door subcompact vehicle, equipped with air conditioning system and automatic transmission, provided by HDI Insurance to the Loss Payee when applicable.

SUNROOF: a sliding roof.

T-BAR: removable glass roof installed in the vehicle by the manufacturer.

TOTAL LOSS: damage sustained by the Insured Vehicle when the amount required to repair the property losses or damages derived from an accident covered under the policy, including workforce, spare parts and materials, is equal to or exceeds seventy five percent (75%) of the sum insured according to the

PRELIMINARY

HDI Seguros and the Contracting party have reached an agreement with regards to the Coverages, insured sums and maximumliability limit amounts that appear as taken on in the cover page of the policy, knowing that one or more covers described in the 1st Clause of these General Conditions may be chosen.

The Contracting Party declares that, in compliance with article 8th of the Law of Insurance Contract, HDI Seguros has been duly informed in writing of all and any relevant factsfor risk appreciation purposes that might influence the agreed conditions, as known or as should have been known by the Insured upon concluding this Agreement.

For this Agreement purposes, the term Insured Vehicle comprises the automotive unit described in the policy cover page, including parts and accessories thereof adapted originally by the manufacturer to each specific model or type of vehicle launched to the market the reby, excluding any kind of armoring for which a specific coverage shall be purchased.

earthquake, volcanic eruption, landslide, falling rocks, landslip, or collapse of buildings, structures and other objects, falling trees or tree branches and flood.

Damages to the Insured Vehicle’s engine caused by flood areinsured. A thrown rod caused by water getting into the engine while the Insured Vehicle is being driven, shall result on 20% Coinsurance over the engine ensuing damages.

Coverage will not be granted when damage is caused by the normal action of tide or when the Insured Vehicle is being driven on non-conventional or on impassable roads.

e) Acts committed by those taking part in stoppages, strikes, workers’ disturbances, civil disturbances, or acts committed by mean- intentioned people in the course of any of the above, or because of therepressive measuresimplemented by legally recognized authorities while exercising their duties to stop or to prevent such acts.

Coverage will be granted providing always that neither the Insured Vehicles nor their occupants have taken part in any of the above.

Any other type of part, accesory, label, Adaptation, and/or Conversion additionally installed under

The Risks covered hereunder are defined in the 1st Clause of the General Conditions. The Risks purchased hereunder shall be indicated in this policy cover page andsubject to HDI Seguros maximum liability limit as set forth therein.

1st. CLAUSE - COVERAGE SCHEDULE 1. PROPERTY DAMAGE.

If stated as covered in the policy cover page, it covers property losses and damages sustained by the Insured Vehicle because of the following Risks:

a) Collisions and Overturning

b) Breakdown, detachment or theft of glasses (windshields, side view mirrors, quarter window, rear windshield, sunroof and T-bar).

c) Fire, lightning and explosion

d) Cyclone, hurricane, hail,

specific request from the buyer or the owner of the vehicle shall require a specific coverage.

injured the Insured’s Vehicle’s owner.

I. DEDUCTIBLE.

Coverage 1 -Property Damage shall invariably bear a proportion of the loss that will be covered by the Insured; this is known as Deductible, calculated as follows:

Both in Partial and Total Losses: the Deductible results from applying the Deductiblepercentage indicated in the policy cover page to the purchased sum insured also indicated therein. As for claims for glass breakage, the Insured shall cover a 20% Deductible of the value of the affected glasses.

With regards to insurance for cargo vehicles of more than 3.5 (three point five) tons in capacity, in the event of Collision and/or Overturning, if the person driving the Insured Vehicle is younger than 21 (twenty one) years of age, two times the Deductible percentage stated in the policy cover page will be applied.

In case a third party is held responsible for the loss, and if the Affected Insured chooses to repair the vehicle with HDI Seguros, the Affected Insured shall invariably pay(sobrauna a)the Deductible as

f)Transport: stranding, sinking, fire, explosion, collision or overturning, derailing, or falling of the means of transportation on board of which the Insured Vehicle is being carried; the Insured Vehicle falling during loading, transferring, or discharging activities, Gross Average contribution or Salvage Charges.

It is herein understood and agreed that property losses or damages sustained by the Insured Vehicle derived from the risks described above shall be covered, even if occurred when the vehicle has been the subject of breach of trust, except if committed by:

a) The Insured’s relative(s) or by the Insured’s financial dependents.

b) Those who appear as Insured in the Policy cover page.

For this clause purposes when the Insured is a company, the term Insured’s relatives will be understood as the Company’s partners, shareholdersor owners.

For this Coverage to be granted, a lawsuit for breach of confidence must be filed before competent authorities against who ever is held responsible and/or against whoever has

Risks referred to in 1d; e and f in this Clause are covered.

Also, when Coverage 1.Property Damage has not been purchased; 1c is covered herein, except if such damages are produced by Collision or Overturning of the Insured Vehicle.

Protection under this Coverage shall be granted even if the facts that produce the loss derive from breach of trust, except if committed by:

a) The Insured’s relative(s) or by the Insured’s financial dependents.

b) Those who appear as Insured in the Policy cover page.

For this Clause purposes when the Insured is a company, the term Insured’s Relatives will be understood as the Company’s partners, share holders, owners or those who are the holders of rights over such company.

Any claim filed for total theft because of fraud arising out of, or derived from any kind of transaction, contract or agreement concluded to sell the Insured Vehicleto an individual, or connected to the lease, credit or financing of the

set forth in the policy cover page.

Should HDI Seguros recover the total or partial amount of the damage caused to the Insured Vehicle, from the liable third party, HDI Seguros shall reimburse the Deductible in the proportion that the recovered amount bears with the total amount derived from the damage sustained.

2. Total Theft

If stated as covered in the policy cover page, it covers total theft of the Insured Vehicle and the ensuing property losses and/or damages.

Coverage will be granted providing always that a suit for Theft is filed before the competent authorities against whoever may be responsible and/or whoever has harmed the owner of the Insured Vehicle.

Further; when Coverage 1, Property Damage does not appear as purchased in the policy cover page, damages caused by Risks referred to in 1 d, e and f above shall be covered.

Likewise, when Coverage 1. Property Damage does not appear as purchased in the policy cover page, damages caused by

3. THIRD PARTY DAMAGE LIABI-LITY.

I.COMBINED SINGLE LIMIT (CSL) LIABILITY.

If stated as included in the policy cover page, it covers liability incurred into by the Insured or by any other person using the Insured Vehicle with the express and tacit consent from the Insured, and causing any of the following damages derived from such use:

a) Third party’s personal injury or death, except if the affected parties were occupants of the Insured Vehicle when the loss took place.

b) Property damage to third par-ties’ goods.

In both cases, this Coverage extends to cover indemnity for moral damage if legally applicable.

The maximum liability limit held by HDI Seguros under this Coverage appears in the cover page of the policy and shall operate as the only sum insured for the series of Risks covered hereunder.

The indemnity payment derived from one single event shall reduce the corresponding sum insured accordingly; however; the suminsured shall be automatically

I. DEDUCIBLE.

Coverage 2 - Total Theft coverage shall invariably bear a proportion of the loss that will be covered by the Insured; this is known as Deductible, calculated as follows:

Both in Partial and Total Losses derived from total theft of the Insured Vehicle, the Deductible percentage stated in the policy cover page will be applied to the sum insuredalso stated therein.

If an Insured Vehicle under total theft is recovered, the corresponding Deductible purchased for this coverage will be applied when HDI Seguros makes any payment whatsoever for damages or losses sustained by the Insured Vehicle. The cost derived from keeping and safeguarding the Insured Vehicle in the car pound or anywhere else for similar purposes, shall be borne by the Insured. However; the cost of carrying the Insured Vehicle shall be borne by HDI Seguros if the repairs are made in any of HDI Seguros repair centers.

LESextends to cover the first holder

(an individual) in this policy whose name appears in the title page hereon, against the same Risks and on the same basis, limits and conditions agreed for Coverage referred to under subsection I – 3 in this Clause, when being the Driver of another resident vehicle similar in class, use and service to the vehicle covered herein.

It is a condition that, upon the occurrence of the loss, there is no other insurance in effect covering the same Liability Risk insured under this Coverage, and purchased to comply with any legal or administrative provision imposed to the vehicle driven by the first holder named in this policy.

The sum insured in this Coverage shall be the same as the one under Coverage referred to inI – 3 in this Clause and purchased in this policy under the same limits and conditions agreed for such Coverage.

II.1. EXTENDED LIABILITY COVERAGE EXCLUSION FOR PRIVATE VEHICLES.

In addition to all the Exclusions set forth under the 3rd.Clause, “Risks that are not covered under Contract” included in these General

The sum insured in this Coverage shall apply in excess of the amount insured under any other insurance in effect when the loss occurs and covering the same Civil Liability Risk insured under this Coverage, purchased to comply with any legal or administrative provision:or if there is not such other insurance,or if it is not applicable.

As for truck tractors, only liability derived from the first articulated trailer shall be covered, providing always that such articulated trailer is attached to the truck.

Additionally, this coverage extends to covers, up to an amount equal to the maximum liability limit set forth in the policy cover page, charges and expenses that the Insured, or any other person using the Insured Vehicle with the express and tacit consent from the Insured, is held liable to pay in the event of a lawsuit filed against them.

II. PRIVATE VEHICLE EXTENDED LIABILITY.

If stated as covered in the policy cover page, this Coverage

Conditions, in no case shall this Insurance Contract cover the following Risks:

a) Damages sustained or caused by the vehicle driven by the first holder of the policy when it is a company, or when the Insured Vehicle has at least one of the following:

1. Over1.5 tons cargo capacity.

2. It has a public service license plate.

3. It is used to carry merchandise.

a) That the vehicle driven by the first holder of the policy when the loss occurs is a vehicle leased on daily basis, or a truck, or a bus or any other vehicle to carry passengers or cargo other than a private vehicle.

b) It is herein agreed between the parties that neither the Insured Vehicle that caused the damages nor the Occupants on board shall be deemed third parties; therefore, damages sustained by the unit and/or by the Occupants on board shall be excluded from coverage.

III. Deductible for damage to third parties liability.

This Coverage applies with no

Deductible, unless agreed otherwise in the policy cover page; in which case, the amount to be paid by the Insured shall be stated as a fixed amount, or expressed in days of General Minimum Wage in Effect in Mexico City.

4. OCCUPANTS’ MEDICAL EXPENSES.

I. COVERAGE.

If stated as covered in the policy cover page, it covers medical expenses derived from hospitalization, medicines, medical assistance, nursing services, ambulance service, and burial expenses as a result of bodily injury sustained by the Insured or by any other person Occupant of the Insured Vehicle while in the cabin, or compartment used to carry passengers when the Insured Vehicle is involved in a collision or overturning.

Those same medical expenses shall be covered in the event of injuries sustained because of the total robbery and/or assault of the Insured Vehicle or the attempt thereof.

This Coverage shall not be applicable if a claim for robbery and/or injuries is not filed before the corresponding authorities.

e) Burial expenses.

In the event of death of one or more of the Occupants on board of the Insured Vehicle.

Burial expenses shall be covered up to a maximum of 750 days of General Minimum Wage in Effect in Mexico City per Occupant, Such limit is to be applied providing always that there is an insured sum available. The above-mentioned expenses are covered in the Mexican Republic and include an urn, the coffin, cremation, embalmment services, burial taxes and transportation of the corpses.

f) Orthopedic aids and prosthesis.

Orthopedic aids and prosthesis are covered when they have to be used as a result of a Traffic Accident and when prescribed by the treating physician.

Orthopedic aids and prosthesis are also covered when they are an integral part of the body of one of the Occupants of the Insured Vehicle and when damaged in the accident.

g) Aesthetic Surgery expenses.

For this Coverage purposes, travelers using the Insured Vehicle for public service transportation are not considered Occupants of the vehicle.

Occupants’ medical expenses set forth as covered in the policy cover page include the following:

a) Hospitalization.

The cost of food for injured Occupants, hospitalization charges, physiotherapy treatments, hospitalization - related charges, and payment of drugs and medicines prescribed by a professional physician.

b) Medical assistance.

The fees charged by physicians, surgeons, osteopaths, and physiotherapists that are legally authorized to exercise as such.

c) Nurses.

The cost of nursing services by professional nurses with license to practice.

d) Ambulance service

Expenses made for ambulance services when they are considered indispensable.

purchased for Coverage 4. Occupants’ Medical Expenses and will be applicable as Combined Single Limit for the total number of claims derived from the same accident and filed under Coverage 4. Occupants’ Medical Expenses including aesthetic surgery.

In no case shall the payable sums all together will exceed the sum insured purchased per event.

The initial liability limit held by HDI Seguros per Occupant of the Insured Vehicle injured in the accident is the amount resulting from splitting the sum insured purchased for this coverage in equal proportions between the total number of injured Occupants in the Insured Vehicle. If the amount derived from medical expenses required by one or more Occupants exceeds the initial liability limit per person and if the sum insured has not been exhausted, the liability limit shall be extended for those injured Occupants who require of it as follows: the remaining sum insured apportioned to those Occupants who did not exhaust their corresponding portion shall be divided between the number of injured parties whose covered medical expenses have exceeded the initial limit.

expenses arising out of aesthetic surgery in the event of accident sustained by the Driver or by any of the Occupants of the Insured Vehicle during the policy term as a consequence of which, the body surface of the Driver or Occupant is damaged or deformed in such a way that when the healing treatment is completed, the physical appearance of such person becomes affected permanently and therefore; such person decides to go through a surgical procedure to correct the flaw. Coverage applies in the following cases:

The surgical procedure and treatment provided to the Driver or Occupant of the Insured Vehicle shall take place before a period of two years after the accident has elapsed. No expense made after that date will be covered by HDI Seguros. –

This benefit will not apply if the Insured is a company. –

II.MAXIMUM LIMIT OF LIABILITY.

The maximum liability limit held by HDI insurance with regards to the benefit mentioned above shall be the sum insured

5. SPECIAL EQUIPMENT

I. DEFINITION.

Special equipment refers to any part, accessory, or label installed on special request from the buyer or the owner of the Insured Vehicle additional to the parts and accessories originally installed and adapted by the manufacturer to each type or model of vehicle launched to the market.

For this Coverage purposes the term Special Equipment shall not include any type of armoring whatsoever, whether it comes from the manufacturer or installed afterwards; in such case, armor coating will be covered as Adaptation and/or Conversion.

II. COVERAGE

If specified as covered in the policy cover page, Coverage 5 - Special Equipment includes Risks under the following sections:

a) Property damage sustained by Special Equipment installed in the Insured Vehicle because of Risks described under subsection 1- Property Damage in this Policy.

b) Theft, damages or loss of Special Equipment as a consequence of total theft of the Insured Vehicle

III. METHOD OF PAYMENT FOR MEDICAL CARE AND/OR HOSPITALIZATION.

The Insured may choose among the physicians and hospital institutions included in the list of physicians and hospitals provided by the HDI Seguros adjuster. Payments shall be made by HDI Seguros directly to the chosen physician and/or hospital.

If the Insured chooses to visit a physician other than the one assigned in the Medical Service card, HDI Seguros shall reimburse the expenses incurred into according to the Medical and Hospital Service Tab set forth for this purpose or to the Customary and Usual Cost.

In order for reimbursement to proceed, HDI Seguros shall be furnished with the proof of expenses within ten calendar days after the Insured received medical care or hospitalization. Such proofs of payment shall fully comply with all the fiscal requirements in effect on the date of issue and bear the name of the person who made the payment.

IV. Deductible

This Coverage applies with no deductible.

IV. DEDUCTIBLE.

Coverage 5 – For Special Equipment, coverage shall invariably bear a proportion of the loss that will be paid by the Insured; this is known as Deductible, calculated as follows:

Both in partial and total losses the deductible is the result of applying the depreciation percentage according to the table above (III – 5 – Special Equipment) to the sum insured purchased for this Coverage.

The calculated Depreciation shall be subtracted from the sum insured to get the payable amount:

and property losses or damages covered under 2 - Total theft of the policy.

In case of Total theft of the Insured Vehicle, the Insured shall file a claim for theft and for any other ensuing felony before the competent authorities against whoever might be liable.

III. INSURED GOODS AND SUM INSURED.

The description of the insured goods and the sum insured apportioned to each one of them shall be stated through annex or endorsement attached to the policy.

In no case shall the total of payable amounts exceed the insured sum stated for the goods.

Further, for indemnity calculation purposes, the Special Equipment depreciation shall be considered according to the table below. Depreciation will be on accumulative basis from the year the invoice was issued, and according to the years passed by until the date the loss occurred.

The calculated Depreciation shall be subtracted from the sum insured to get the payable amount.

6. ADAPTATIONS AND/OR CON-VERSION

I. DEFINITION.

Any kind of modification or addition made to the bodywork, structure, coatings, mechanisms and/or accessories that modify the original design or operation of the Insured Vehicle.

For the purpose of this Coverage, Armoring shall be deemed an Adaptation and/or Conversion.

II. COVERAGE.

If specified as covered in the policy cover page, Coverage 6 – Adaptations and Conversions covers the following risks:

a) Property damage to the Adaptations and/or Conversions made to the Insured Vehicle arising out of any of the Risks described under Coverage 1. Property Damage.

Armored glasses shall only be covered in the event of Total Loss as stated under Coverage 1. Property Damage, providing always it is specified as included under the policy title page.

b) Theft, damages or losses to the Adaptation and/or Conversions made on the Insured Vehicle as a result of total theft of the Insured

Coverage 5 – For Special Equipment there shall invariably be a proportion of the loss that will be covered by the Insured; this is known as Deductible, calculated as follows:

Both in Partial and Total Losses, the Deductible is the result of applying 25% over the amount resulting from applying the corresponding Depreciation according to the table shown in fraction III– 5 – Special Equipment to the sum insured purchased for this Clause.

V. Special Equipment Coverage Exclusion.

In addition to the Exclusions set forth under the 3rd. Clause “Risks that are not covered under Contract”, to the Exclusions under Coverages 1, Property Damages and 2. Total Theft,included in these General Conditions, in no case shall this Coverage include, nor cover Special Equipment without the corresponding invoice in full compliance with all the legal requirements to prove its validity: if the invoice was issued abroad it shall also include prove of legal ownership.

be subtracted from the sum insured to get the payable amount.

With respect to armoring, when HDI Seguros declares the total loss of the Insured Vehicle, the amount payable to the Insured shall be calculated over the armoring invoice value, minusdepreciation according to the percentages shown in the table below.

The payable amount must not exceed the maximum limit described in the policy title page.

In no case shall partial theft of armored parts be coveredhereunder.

In such cases, the Insured shall file a claim for theft and for any other ensuing felony before the competent authorities against whoever might be liable and/or whoever has harmed the owner of the Insured Vehicle.

III. Insured Goods and Sum Insured

The description of the insured goods and the sum insured apportioned to each one of them shall be stated through annex or endorsement attached to the policy. In no case shall the total of payable amount exceed the sum insured agreed for the goods.

To calculate the payable amount, the corresponding Adaptation and/or Conversion Depreciation percentage shall be subtracted from the sum insured according to the table below, applicable on accumulative basis from the year the invoice was issued and counting the years that have passed by until the date the loss occurred.

7. CAR ACCIDENT SUSTAINED BY THE DRIVER

I. DEFINITION.

Car Accident sustained by the Driver is understood and agreed as any loss of organs or death sustained by the Driver of theInsured Vehicle derived from a Traffic Accident while driving such vehicle. Any injury, loss of organs or death intentionally caused by the Driver is excluded hereunder.

For this Coverage purposes, the Driver of the Insured Vehicle is covered if he/she is legally an adult with a valid driver’s license when the accident occurs, and driving the Insured Vehicle with the express and tacit consent from the policy contracting party up to HDI Seguros liability limit as set forth in the Policy cover page.

II. COVERAGE.

When specified as covered in the cover page of the policy, if during the policy term and as a consequence of a Traffic Accident, the injuries sustained by the Driver of theInsured Vehicle result in the loss of any limb as described below within the first ninety days following the date of the accident, HDI Seguros shall pay the following percentage

As for Insured Vehiclesin which armoring was not totally or partially installed by the manufacturer of the Insured Vehicle, the Loss Payee shall furnish HDI Seguros with the corresponding invoices complying with the fiscal requirements to prove their legal validity and that the armoring service was actually provided.

IIV. DEDUCIBLE.

6th. Coverage. Adaptations and/or Conversions shall invariably bear an amount paid by the Insured, known as Deductible.

it shall be subject to the limits and specifications established by the Federal Law of Labor in this respect.

III. DRIVER’S CAR ACCIDENT COVERAGE EXCLUSIONS.

In addition to the Exclusions set forth under the 3rd. Clause, “Risks that are not covered under Contract”, included in these General Conditions, in no case shall this Coverage include, nor cover:

1. Motorcycle Drivers.

2. The Insured Vehicle taking part in competitions or safety, speed or strength tests.

3. Injuries sustained by the Driver of the Insured Vehicle when the vehicle is being used for military purposes of any kind, warlike actions, insurrection, rebellion, revolution, intentional criminal actions in which the Driver takes part, or any fight provoked by the Driver of the Insured Vehicle.

4. When the Insured Vehicle is used by the Driver to commit suicide, voluntary mutilation or attempt of any of the above, even if the Driver is under a state of mental derangement.

as soon as practicable.

b) Upon being notified of the accident, HDI Seguros shall provide the claimant with all the corresponding declaration formats to prove the limb loss or death of the Insured Vehicle’s Driver.

If, not withstanding the fact that the claimant has dully served notice of the event, HDI Seguros does not provide the declaration format within the first five working days following notification, the claimant shall be deemed to have complied with the requirements established in this policy with respect to proof of loss.

In any case, HDI Seguros may appoint a professional physician to certify the loss or losses claimed.

V. LOSS PAYEE.

In the event the Driver of the Insured Vehicle dies in the car accident, the sum insured purchased under this coverage shall be paid to the Loss Payees set forth in the policy cover page.

If there are no appointed Loss Payees, the sum insured agreed in the event of death shall be paid to the legitimate successors of the Insured Vehicle’s Driver through an executor. Any other amount

5. If the Driver of the Insured Vehicle does not have the express and tacit authorization to use the vehicle from the policy first holder and contracting party.

6. Medical care, hospitalization, nursing services, ambulance service, and burial expenses or any kind of medical expenses.

7. When the Driver of the Insured Vehicle dies or losses a limb or organ after ninety days counted as of the date the accident occurred.

8. When the Insured Vehicle is being used to carry escorts, body guards and/or private security, providing always that the loss occurs when the Insured Vehicle is being used for such purposes and gets involved in risky activities that caused the loss.

IV. PROCEDURE IN THE EVENT OF CLAIM.

a) It is the claimant’s duty to notify HDI Seguros in writing of any accident likely to give raise to indemnity hereunder. Such notice shall be served within the first five working days following the accident unless prevented to do so by force majeure or unforeseeable circumstances; in which case, notice shall be served

III. EXCLUSIONS TO TOTAL LOSS CAUSED BY PROPERTY DAMAGE.

In addition to the Exclusions set forth under the 3rd. Clause “Risks that are not covered under Contract”, included in these General Conditions, in no case shall this Coverage include nor cover property losses or damages sustained by the Insured Vehicle which cost of repair when the loss occurs is less than seventy five percent (75%) of the maximum liability limit purchased for this coverage.

9. TRANSPORT EXPENSE ALLOWANCES

I. COVERAGE

If specified as covered in the policy cover page, HDI Seguros and the Insured hereunder agree that when the vehicle is declared by HDI Seguros a total loss derived from any of the Risks covered under Coverage 1.Property Damage, 2.Total Theft or 8. Total Loss caused by Property Damage, purchased in this policy, HDI Seguros will pay the Insured up to the daily maximum liability limit described in the policy cover

payable to the Driver will be paid accordingly, however; the Driver does nothave the legal capacity to receive such payment, it will be paid to their true and lawful representative.

8. TOTAL LOSS DUE TO PROPERTY DAMAGE

I. COVERAGE.

If specified as covered in the cover page of the policy, HDI Seguros and the Insured hereunder agree that property losses or damages sustained by the Insured Vehicle as a consequence of any of the Risks under Coverage 1 – Property Damage in this clause, shall be paid providing always that it is a Total Loss of the Insured Vehicle as set forth under Definitions in the General Conditions.

The sum insured and Deductible applicable to this Coverage are specified in the policy cover page.

II. DEDUCTIBLE

8th. Coverage - Total Loss derived from Property Damages shall invariably bear a proportion of the loss that will be covered by the Insured; this is known as Deductible, which results from applying the deductible percentage indicated in the policy cover page to the sum

10. FAMILY LIABILITY.

If specified as covered in the policy cover page or through annex or endorsement, HDI Seguros will grant coverage to the policy holder according to the following:

I. COVERAGE

I.1. Family activities and real estate

The Insured’s liability for damages caused to third parties derived from private family activities in the Insured’s capacity as the owners and/or tenant and/or occupant of an apartment or house specially, but not limited to the following:

a) As head of household

b) As the owner and/or tenant of one or more condos and/or apartments and/or houses (including real estate owned by the Insured and used on weekends and holidays), garages, gardens, pools, antennas, and security facilitates and other belongings and appurtenances.

c) Unforeseen or accidental water damage.

d) Practicing sports as an amateur

e) The use of bikes, skates, pedal or rowing ships, or non-motorized vehicles that do not require of a

The payable days the Insured is entitled to shall be counted from the date the Insured furnishes HDI Seguros with proof of ownership of the Insured Vehicle which is required to arrange payment of the unit total loss until the date theTotal Loss becomes effective or until the vehicle is physically recovered and delivered. The maximum liability limit in this Coverage shall be of up to a thirty -day indemnity.

II. TRANSPORT EXPENSES ALLOWANCE COVERAGE EXCLUSION CLAUSE

In addition to the Exclusions set forth under the 3rd. Clause “Risks that are not covered under Contract”, included in these General Conditions, in no case shall this Coverage include nor cover:

a. The third damaged party, even if requested by the Insured.

b. Occurrences when the Insured Vehicle is used without the Insured’s consent.

c. All such facts mentioned in the 2nd and 3rd Clauses in the General Conditions.

d. When the loss that gave origin to the claim is inadmissible.

I.2. Traveling abroad with family.

This coverage insures the Insured’s legal liability for damages to third parties derived from losses occurred during private study trips or holidays outside the Mexican Republic.

I.3. Household workers.

The following liabilities derived from activities carried out by household workers are covered:

a) Accident sustained byhousehold workers in the course of their activities as a result of which theybecomebodily injured or dead.

b) Damages to third parties caused by household workers providing always that the damage occurs in the course of their duties at the Insured’s service.

c) Damages to third parties caused by temporary workers hired by the Insured providing always that such damage occurs in the course of their working activities at the Insured’s service.

I.4. Tenant’s Liability.

HDI Seguros covers the Insured’s liability for damages to the property the Insured occupies as a tenant, the address of which is mentioned in the policy cover page, providing

license plate to circulate.

f) For having and using cold steel, air or fire weapons for hunting or target shooting purposes providing always that the Insured is legally authorized to the use and possession thereof.

g) As the owner of pets, hunting, guard and protection animals inside and outside the permanent address of the Insured.

h) During study trips, holiday or pleasure trips within the Mexican Republic.

i) During cultural and recreational activities in movie theaters, theaters, and malls, social gatherings with relatives and friends and other private activities outside the Insured’s address.

j) Damages caused to common areas of the condominium referred to in the policy cover page if the Insured is a condo dweller, however discounting the indivisible percentage the Insured shall borne as the owner of common areas.

k) Accidents caused to household workers due to gross negligence or non-intentional carelessness with regards to the duties imposed by article 473 and 487 of the Federal Law of Labor.

they are studying or because they are single.

For this policy purposes, none of the persons mentioned above, except for the household workers shall be deemed third parties.

III. COVERAGE SCOPE.

Payment of damages and consequential moral damages for which the Insured is held liable shall be covered according to the applicable legislation for Civil Liability in effect in the Mexican Republic or foreign legislation if going on family trips abroad as set forth in hereunder. The Insured’s defense expenses include:

a) Payment of premiums derived from judicial bonds that the Insured shall submit as surety of payment arising out of Liability covered hereunder.

b) Payment of expenditures, costs and legal interest that the Insured is hereunder obliged to pay as a result of final arbitral or judicial award.

c) Payment of expenses incurred into by the Insured derived from claim processing and settlement.

II. INSURED PARTIES.

The Insured party under this Coverage is the holder of the policy whose name and address are stated in the policy cover page with respect to the Insured’s private and family liability for:

a) The Insured’s own acts.

b) Acts by the Insured’s sons or daughters under the Insured’s custody.

c) Acts by disabled persons under the Insured’s protection

This insurance is extended to cover personal liability from:

a) The Insured’s spouse.

b) Daughters, sons, wards, or disabled people under the Insured’s custody.

c) The Insured’s parents or the Insured’s spouse’s parents, only if living with the Insured on permanent basis and if they are financial dependents.

d) Adult daughters still living with the Insured on permanent basis and financially dependent because

V. FAMILY LIABILITY COVERAGE EXCLUSIONS.

In addition to the Exclusions set forth under the 3rd.Clause “Risks that are not covered under Contract”, included in these General Conditions, in no case shall this insurance contract cover:

1) Liabilities derived from breach of contracts or agreements and corresponding replacement benefits.

2) Liabilities derived from the use or ownership or possession of ships, aircrafts and motorized land vehicles.

The above exclusion does not apply to motorized land vehicles which use is limited to the Insured’s premises and donot require of license plates to be driven in open spaces.

3) Damages derived from taking part in gambling, races, contents, or sport contests or any kind or preparatory tests.

4) Damages derived from exploitation of a business or industry, from exercising a profession, a service rendered or a post, even if honorary.

IV. MAXIMUM LIMIT OF LIABILITY.

The maximum liability limit held by HDI Seguros under this coverage is specified in the Policy and applied as First Loss single sum insured for Risks covered and for one or all of the losses that may occur during the policy term.

For this coverage purposes, First Loss is understood and agreed as the loss or damage payable in full as a consequence of a Risk, regardless of the total value of the goods either individually or as a group but up to the sum insure limit purchased hereunder.

Defense expenses incurred into by the Insured in the Mexican Republic is covered hereunder as a sub limit, without exceeding however 50% of the sum insured established in the policy cover page.

The occurrence of a number of losses during the policy term derived from the same single cause shall be seen as one single event considered as having occurred when the first damage of the series of damages occurred.

13) Claims derived from an unforeseen event and/or force majeure.

14) The Policy holder shall not be covered if it is a company.

I. COVERAGE.

If specified as covered in the policy cover page this coverage includes liability incurred into by the Insured if bodily injuries or death were caused to any of the Occupants because of using the Insured vehicle. This coverage includes any legally valid indemnity extended to people other than the Insured who, with the express and tacit consent from the Insured make use the Insured Vehicle.

The maximum liability limit held by HDI Seguros is specified in the Policy and applied as single sum insured for any amount payable hereunder.

Further, and up to the maximum liability limit, this coverage covers expenses and costs the Insured is liable to pay hereunder in the event of civil trial against the Insured derived from responsibility for bodily injury or death caused to any of the Occupants.

This coverage extends to any person who with the express and tacit

6) Payment of bail bond premiums for the Insured to be set free.

7) Any claim derived from fines, penalties or sanctions such as those known as punitive or vindictive damages, exemplary damages or the like.

8) Claims derived from pure patrimonial damages (financial damages with no physical damage).

9) Liabilities derived from damages intentionally caused by the Insured or with the Insured’s consent.

10) Liabilities derived from damages caused to the spouse, parents, sons, daughters, brothers, sisters or relatives living with the Insured on permanent basis.

11) Professional responsibilities imputable to the Insured in compliance with the Social Security Law and other complementary provisions thereof, except for obligations imposed by articles 473 and 487 of the Federal Law of Labor.

12) Liabilities derived from inconsistency or subsidence.

consent from the Insured uses the Insured vehicle.

This cover shall not apply if the Occupants of the Insured Vehicle were not in the passengers’ cabin or compartment when the accident occurred.

If a Car Accident occurs, and if the number of occupants exceeds the maximum number of persons authorized according to the conventional capacity of the Insured Vehicle, the maximum liability limit per person in this coverage shall be determined proportionally to the number of injured or dead Occupants, without exceeding however the sum insured per event.

When there is a remaining sum insured amount that has not been exhausted on indemnities to Occupants, and it does not exceed the Occupant’s initial limit of liability per personas indicated in the cover page of the policy, such sum shall be proportionally allocated until exhausting the sum insured per event among the other affected Occupants whose damages exceed the initial limit of liability per person as indicated in the Policy.

In no case will indemnities exceed the purchased sum insured per

event. Medical expenses required by the Occupants are not contemplated hereunder since they are included under

Occupants’ Medical Expenses Coverage.

2nd CLAUSE.RISKS THAT ARE NOT COVERED UNDER CONTRACT BUT MAY BE COVERED UNDER EXPRESS AGREEMENT.1. Damages sustained or caused by the Insured Vehicle as a consequence of the following are not covered:

a) Using the vehicle for a purpose other than the purpose described in this policy in such a way that it implies a risk aggravation.

b) Carrying out towing activities, unless the Insured Vehicle is a trailer truck in which case the towing system for the second trailer (DOLLY) and the second trailer are not covered hereunder.

c) Using the vehicle for driving lessons or to instruct on how it works.

d) Taking part either directly or

and agreed as stolen parts of ac-cessories that are part of the In-sured Vehicle, even if they have been insured hereunder, and damages caused to the Insu-red Vehicle as a result of theft or attempt thereof.

7. The Driver’s Legal defense expenses derived from a criminal procedure as a result of any accident and the costs of legal bails and/or surety bonds and/or any other kind of sanction, damages, and duties other than those derived from property damage borne by the Insured given their Civil Liability.

3rd. CLAUSERISKS THAT ARE NOT COVERED UNDER CONTRACT.IN NO CASE WILL THIS POLICY COVER:

1. Damages or losses caused to the Insured Vehicle if the cost of repairing or replacing such losses is smaller than the purchased deductible.

2. As for public service vehicles or vehicles used for services other than private, damage

indirectly with the Insured Vehi-cle, in amateur or professional ra-ces, or safety, strength or speed tests.

2. Liability incurred into by the Insured derived from damages to third parties caused by and/or with any kind of cargo carried on board of the Insured Vehicle (heavy machinery, vehicles, logs or timber, paper rolls, wire for industrial uses, steel joist, materials, parts or modules for the construction industry, cattle, substances and/or toxic and/or corrosive products, and/or flammable products, and/or explosives or any other kind of cargo similar to those listed above, etc.)

3. The Insured’s liability derived from damages caused to third parties’ goods or persons caused by Adaptations and/or Conversions made to the Insured Vehicle.

4. The Insured’s liability derived from personal or property damages caused to travelers or Occupants.

5. Occupants’ Medical Expenses when the policy specifies that the vehicle is to be used for public service purposes.

negligence as the cause of loss, or if the Driver is not deemed responsible by the authorities.

4. The losses or damages sustained or caused by the Insured Vehicle as a consequence of any of the following:

a) War- like operations derived from foreign or civil war, declared or not, insurrection, subversion, rebellion, organized crime, commandos, expropriation, seizure, or detention by legally recognized authorities in exercise of their duties.

Losses or damages sustained or caused by the Insured Vehicle when being used for any kind of military or police and/or emergency services, with or without the Insured’s consent, as well as intentional criminal acts started by the Insured and in which the Insured takes part.

b) Acts of terrorism by a person or persons acting on behalf of, or in connection with, or on request from any organization.

For the purposes of the paragraph above, terrorism is understood and agreed as the use of violence for political purposes including any type of force or violence

sustained or caused by the Insured Vehicle when being driven by someone who does not have the corresponding driving license required to drive the Insured Vehicle, issued by competent authorities according to the kind of servicethe Insured Vehicle was engaged into when the accident occurred; unless the Driver cannot be blamed of inexperience or gross negligence as the cause of loss, or if the Driver is not deemed responsible by the competent authorities.

Besides being issued by competent authorities, the driving licenses shall be in full force and effect when the loss occurs; this same condition applies for Travelers’ Liability Coverage.

3. Damages sustained or caused by the Insured Vehicle if it has a public service license plate when the loss occurs, or if being driven by someone who does not have the corresponding updated driving license required to drive the Insured Vehicle in full force and effect, issued by The Secretariat of Communication and Transport authorities, unless the Driver cannot be blamed of inexperience or gross

or by being subject to excessive traction beyond its capacities.

HDI Seguros will not be held liable for damages caused to

highway bypasses, weight bridges or any other public road, underground objects or facilities either due to vibration or due to the weight of the vehicle or cargo thereof.

10. Damages to the environment and any obligation derived from damages to eco-systems.

11. Damages to paint on the Insured Vehicle caused by Risks other than the Risks covered under a, b, c, d, e and f, in the 1st Clause in these General Conditions.

12. Losses or damages derived from the Insured Vehicle throwing a rod unless it was caused by a Risk covered hereunder or by flood without prejudice to sub-section 8 herein.

13. Insured’s liability derived from property damage to:

a) Goods under the Insured’s responsibility or custody.

b) Goods owned by the Insured’s civil dependents.

aimed to influence the public sector or part thereof using terrorism or violence to arise fear.

5. Any damage, expense, fine or sanction, loss or indirect or moral damage sustained by the Insured, including the deprivation of the use of the vehicle and any obligation other than property damage sustained or confronted by the Insured.

6. Breakage, failure, mechanical, electrical or electronic failure, lack of resistance of any part or accessory of the Insured Vehicle as a consequence of use unless they are caused by any of the covered Risks.

7. Losses or damages caused by normal wear and tear of the Insured Vehicle or parts thereof, Depreciation of the Vehicle’s value, property damage of the Insured Vehicle caused by its own cargo unless it was caused by any of the covered Risks.

8. Losses or damages caused by the normal course of tide, including flood.

9. Damages sustained or caused by the Insured Vehicle due to overload or excessive volume

c) Goods owned by the Insured’s employees, agents, or representatives while in the Insured’s premises.

d) Goods in the Insured’s Vehicle.

14. Liabilities derived from damages to third parties’ goods and/or persons when they are the Insured’s dependents or if at the Insured’s service when the loss occurs, or if they are Occupants of the Insured Vehicle.

15. Losses or damages caused to the lower parts of the Insured Vehicle when it is being driven on roads that are not proper for vehicle transit or when such roads are impassable.

16. Amounts that the Insured or the Driver is obliged to pay for damages sustained by the Insured Vehicle’s Occupants and as a result of which civil and criminal liabilities, or professional Risks liabilities might arise.

17. Damages sustained or caused by the Insured Vehicle when:

a) It is being driven by someone who is under the effects of alcohol when the loss occurs, unless the Driver cannot be blamed of having influenced the accident

due to inexperience or gross negligence, or if the Driver is not considered guilty by competent authorities.

b) It is being driven by someone who is under the effects of drugs that are not prescribed by a physician when the loss occurs.

Both a) and b) apply only for vehicles used for commercial purposes such as pickup trucks, campers, taxis, cars leased per day, emergency vehicles, truck trailers, buses, trucks, passenger buses and any other vehicle used to carry merchandise, except for family pick up vans of up to 3.5 tons, providing always that such service is include under the policy.

18. Liability for damages caused to third parties by the cargo of the Insured Vehicle in accidents that occur when the vehicle is not in service, and/or accidents that occur during loading and/or unloading activities.

19. Mechanical breakdown, throwing a rod or lack of resistance of any part of the Insured Vehicle caused by driving the vehicle or trying to drive the vehicle over flooded roads, puddles or any natural course of water.

4th. CLAUSE.PREMIUM AND PAYMENT DUTIES.The premium is due and shall be paid upon concluding the Contract. The Contract term is specified in the policy cover page.

In the event of loss, HDI Seguros shall deduct from the indemnity payable to the Insured here under the total amount of the outstanding premium until completing the total premium corresponding to the period of insurance purchased.

II. INSTALLMENT PAYMENTS.

The Insured may choose to pay the Premium in installments on monthly, quarterlyor biyearly basis, in which case, the financial rate agreed upon between HDI Seguros and the Insured upon concluding the Contract shall apply.

If payment is agreed to be made through the company where the Contracting party or Insured works, by discounting the installment payment from the Insured’s wage, installments shall be deemed paid on the date the charge is actually made.

In the event of incident causing the Total Loss of the Vehicle, HDI

20. Losses, damages or liabilities included in any of the Coverages described under the 1st Clau-se in these General Conditions if such coverages were not purchased under this Policy.

21. Lossof the Insured Vehicle and/or documents related there to as a consequence of having surrendered the vehicle because of transactions related to the illegal deprivation of liberty.

22. Claims or damages caused by the Insured Vehicle when legitimate ownership and/or legal registration of the vehicle in the Mexican Republic cannot be proven.

23. In compliance with Article 52 of the Law of Insurance Contract, the Insured shall notify HDI Insurance of any essential aggravation of Risks during the Insurance term in the first twenty four hours after becoming aware of it.

If the Insured fails to serve notice or if they cause the essential aggravation of the Risk, any and all present or future obligations held by HDI Seguros here under shall be null and void by operation of law.

IV. REINSTATEMENT.

Notwithstanding anything to the contrary in this Clause the Insured may, within 30 days following the last day of the grace period stated in such clause, pay the premium on this insurance or the corresponding portion thereof. If an installment payment has been elected; in this case, if such payment is made, the insurance shall be reinstated starting from the hour and date shown on the payment receipt and the original term shall be automatically extended for a period equal to that comprised between the last day of such grace period and the hour and day on which the reinstatement becomes effective.

However, if upon making the payment, at the latest, the Insured and requests writing the insurance term to remain effective, HDI Seguros shall adjust, and in such case, immediately return the premium corresponding to the period in which this contract ceased as set forth in Article 40 of the Insurance Contract Law, which inception and termination dates are stated at the end of the preceding paragraph.

Without prejudice to the above-mentioned automatic effects, and for administrative

Seguros shall deduct the total outstanding Premium of the affected Risk from the amount payable to the Contracting party or Insured until the premium established for the corresponding period of insurance is completed.

III. CONTRACT TERMINATON DUE TO BREACH OF PAYMENT.

Insurance Contract Law - Artícle 40.

“If the Premium or installment thereof is not paid within the agreed term, this contract shall automatically cease at midday of the last day of the agreed term.In case such term has not been agreed upon, a thirty calendar day term following the due date shall be applied.

Unless agreed otherwise, the term referred to in the paragraph above shall not be applicable to mandatory insurance referred to in article 150 Bisunder this same law.

Should installments be chosen, this contract and everything derived therefrom shall terminate in case the corresponding installment of the premium is not paid on the due date at the latest.

purposes, HDI Seguros shall state the reinstatement referred to in this clause in the payment receipt and in any other document issued after such payment.

V. PLACE OF PAYMENT.

Unless specifically agreed otherwise and only if a different place of payment is stated in the policy receipt, the premiums shall be paid in the agreed terms at HDI Seguros offices upon delivery of the corresponding receipt.

5th CLAUSE.SUMS INSURED AND MAXIMUM LIABILITY.I. MAXIMUM LIABILITY.

HDI Seguros’ limits of liability forCoverages 3 - Third Party Damage Liability, 4 - Occupants’ Medical Expenses, 5 - Special Equipment, 6 - Adaptations & Conversions, 7 - Driver’s Car Accidents, 9 - Transport Expenses Allowance and 10 - Family Liability are specified in the poli-cy cover page.

For Coverages1 - Property Damage, 2 - Total Theft, and 8 - Total Loss due to Property Damage, HDI Seguros maximum

liability limit is up to the sum insured indicated in the policy cover page, which may be expressed in any of the following variables, in any of which HDI Seguros may repair or replace the damaged good for another of similar characteristics in such a way that it fully complies with any obligation of indemnity as established hereunder.

1. TRADE VALUE (EBC GUIDELINE BLUE BOOK).

Trade Value is understood as the market value of the Insured Vehicle according to the EBC Guidelines for Car buyers in effect on the date of the loss (considering the market value identified under letter” V”)

In the event the Insured Vehicle does not appear in the EBC Guideline, the market value published by the Mexican Association of Automotive Distributors (A.M.D.A) will be considered. With respect to cargo vehicles or trucks that are not included in the EBC Guideline, the market valuespublished by the Mexican Association of Insurance Institutions (A.M.I.S.) shall be considered.

No Price published in newspapers or any other kind of source of information is to be used to determine a vehicle’s value.

1. a. Latest Model Vehicle

The trade value of latest model or zero km vehicles, manufactured in the country or abroad, sold by recognized assembly plants and distributors, with less than a year of use, is determined taking the value stated in the EBC Guideline for these kind of vehicles as the price list or sales price minus a 1.7% depreciation per month to the date the loss occurred.

1. b. Border Registrationor Legalized Vehicles.

For Border Registration vehicles or vehicles that were legally brought to the country by someone different from a nationwide recognized assembly plant or distributor, the trade value of the Insured Vehicle is determined according to the average value indicated in “Auto Trader” or N.A.D.A guides (Official Older Used Car Guide) or according to “Kelly Blue Book Auto Market Report”, published by Kelly Blue Co. in California, US, in effect on the date the loss occurred, whichever is bigger.

As for legally imported vehicles, expenses and import taxes,which in no case shall exceed 25% the value of the Insured Vehicle, will be additionally included in the

indemnity.

In case of partial losses, HDI Seguros shall pay in cash to the Insuredthe amount derived from damages as per the appraisal made by HDI Seguros. The Insured shall be responsible for repairing the vehicle and the liability held by HDI Seguros shall be limited to the payment of indemnity in cash once the corresponding deductible has been discounted.

1. c. Salvage Vehicles.

As for vehicles with a salvage invoice issued by an insurance company or by a vehicle marketing company, the market value will be equal to 75% the trade value indicated in the updated E.B.C. Guide on the date the loss occurs for a vehicle of the same brand, model and characteristics.

The reinstatement and/or repair costs for vehicles bearing a salvage invoice shall be proven through invoices that show that the expenses were actually made.

The trade value of a vehicle bearing a salvage invoice calculated as in the paragraphs above in no case can be bigger than the trade value shown in the EBC, AMDA and/ or AMIS Guides

2. AGREED VALUE.

For this contract purposes, agreed value of the Insured Vehicle shall be understood and agreed as the value agreed for the vehicle between the Insured and HDI Seguros, which is the maximum limit of liability as specified in the policy cover page.

3. INVOICE VALUE.

For this contract purposes invoice value will be understood and agreed as the Insured Vehicle’s invoice price according to recognized dealerships or domestic vehicle assemblingplants, which in no case shall include financing expenses, carrying expenses or any other expense aside from the actual cost of the Insured Vehicle.

In the event of payable indemnity for Total Loss due to Property Damage or Total Theft of the Insured Vehicle, and if the original invoicewas issued less than 365 days when the loss occurred,HDI Seguros will pay the invoice value specified in the policy cover page, in case the original invoice was issued more than 365 days when the loss occurred, HDI Seguros shall pay according to 1a. last model vehicle hereunder.

BENEFICIOSY SERVICIOSADICIONALES

The invoice value can only be assigned to a latest model vehicle with zero kilometers.

II. AUTOMATIC REINSTATEMENT

The sums insured for Coverages 1 – Property Damage, 2 – Total Theft, 3 – Damages to third parties Liability, 4 – Occupants’ Medical Expenses and 6 – Adaptations & Conversions that have been purchased under this policy shall be automatically reinstated for future losses even if reduced by the payment of any indemnity by HDI Seguros during the policy term unless such payment accounts for total loss of the Insured Vehicle.

As for Coverage 5 - Special Equipment, any indemnity paid by HDI Seguros shall equally reduce HDI Seguros’ liability. However, it can be reinstated if requested by the Insured and if previously authorized by HDI Seguros upon payment of the corresponding additional premium by the Insured.

6ª. CLAUSE INSURED’S DUTIES.1. In the event of loss, the Insured or the Driver of the Insured Vehicle is hereunder obliged to:

a) Precautions

Take all the necessary measures to prevent or reduce the damage, and if there is no harm in delay, ask HDI Seguros for instructions, doing specifically as instructed.

Expenses incurred into by the Insured that are not clearly irrelevant shall be covered by HDI Seguros and if instructions are given, HDI Seguros will anticipate the expenses.

If the Insured fails to comply with any of the duties described in the foregoing paragraph, HDI Seguros shall have the right to limit or reduce indemnity up to the amount that would have been paid had the Insured comply with such duties.

b) Loss Notice

In compliance with Article 66 of the Insurance Contract Law, the Claimant shall notify HDI Seguros in five days at the latest, except if prevented to do so by force majeure.

Failure to do so by the Insured shall cause indemnity to be reduced to the amount that would have been paid had HDI Seguros been promptly notified by the Insured.

c) Notice to Authorities

File a formal claim before competent authorities immediately after becoming aware of the facts.

In the event of theft or any other criminal act that might give rise to a claim hereunder, the Insured shall cooperate with HDI Seguros in the recovery of the Insured Vehicle or the amount accounting for the damage sustained thereby.

If the Insured unreasonably refuses to any of the above, they shall compensate HDI Seguros for the damages caused.

2. In the event of claims filed by the Insured for losses affecting any of the purchased coverages.

a) Claim Notice.

The Insured or Driver of the Insured Vehicle is hereunder obliged to notify HDI Seguros, as soon as they become aware of the claims or lawsuits served to the Insured, or to the Insured’s representatives or to the Vehicle’s Driver upon the loss occurrence. The Insured

shall furnish HDI Seguros with all documents related to such claims or lawsuits.

HDI Seguros may, in such case, appoint lawyers to represent the defendants and their interests.

In compliance with Article 69 of the Insurance Contract Law, HDI Seguros is entitled to demand the Insured or Loss Payee for all information related to the occurrence of the loss that may help determine the circumstances and consequences thereof.

Failure to comply with this obligation by the Insured shall release HDI Seguros of any further liability of indemnity with regards to such affected coverage.

HDI Seguros shall not be obliged to acknowledge any debt, transaction, or any other judicial or the like action being engaged into without their previous authorization.

The confession of a material fact cannot be assimilated to the acknow ledgment of liability.

b) Cooperation and assistance provided to HDI Seguros from the Insured.

The Insured is hereunder obliged to the following in any civil procedure filed against them, derived from their liability under this insurance, and on HDI Seguros account:

• Provide any information and proof required by HDI Seguros for the Insured’s defense, whenever it is necessary and on HDI Seguros account.

• Exercise and enforce any actions and defenses corresponding to them by law.

• Appear in any civil procedure.

• Grant powers to the attorneys appointed by HDI Seguros to represent the Insured in such procedures in case the Insured is unable to take direct part therein.

3. OBLIGATION TO NOTIFY OF OTHER INSURANCE.

The Insured has the obligation to immediately notify HDI Seguros in writing of any other insurance purchased to another company over the same Risks and interest covered hereunder, including the Insurer Company name, coverages, and sums insured.

unlawful benefits therefrom, HDI Seguros shall be released of any liability hereunder.

7th. CLAUSEBASIS OF APPRAISAL AND PAYABLE DAMAGES.1. Should the Insured duly comply with the obligation under “b” (Loss Notice) under subsection 1, 6th Clause- Insured’s Obligations in these General Conditions, and if the Insured Vehicle is free from any detention, seizure or any other similar situation ordered by legally recognized authorities in the exercise of their duties, HDI Seguros is hereunder obliged to start the assessment of damages as soon as possible once the physical location of the Insured Vehicle is known.

2. The fact that HDI Seguros does not carry out the assessment of damages sustained by the Insured Vehicle within 72 working hours after notice is served, and providing always that the above paragraph is complied with, the Insured is entitled to make the corresponding repairs and to request HDI Seguros for payment thereof, except if for reasons that are attributable to the Insured,

assessment of damages cannot be performed, in which case, HDI Seguros shall not acknowledge the damage sustained by the Insured Vehicle.

Except as stated in the paragraph above, HDI Seguros will not acknowledge any damage whatsoever sustained by the Insured Vehicle if it has been

repaired prior to such damage being appraised by HDI Seguros.

3. Once the damage has been appraised and liability accepted, and without prejudice to article 71 of the Law of Insurance Contract, HDI Seguros shall proceed to pay the amount of the damage sustained by the vehicle in cash to the Insured or Loss Payee, or repair or replace the damaged good for another with similar characteristics.

Should the vehicle be declared a total loss, HDI Seguros shall deduct any outstanding premium of the policy year from the indemnity amountpayable to the Insured or Contracting partywithin the affected Risk until covering the Premium corresponding to insurance term.

pay for the damage, they must specifically notify the Insured or the Loss Payee, who may choose from any of the following:

a.1. Receive the amount to pay in cash, according to the appraisal made by HDI Seguros, with respect to the damage sustained and in compliance with the criteria set forth in4 hereunder.

a.2. Authorize HDI Seguros to make the payment directly to the service supplier selected by the Insured or Loss Payee from the list of repair shops and car dealers with which HDI Seguros has direct payment agreements and that are closer to the site where the loss occurred. From then on, it will be the Insured’s or the Loss Payee’s responsibility to make sure that the repair services are provided to their satisfaction.

The payable amount for partial losses comprises the invoice value of parts and workforce plus the corresponding taxes.

Without prejudice to the above paragraph, if damage is caused to the engine, and/or to the transmission and/or battery and/or to the tires of the Insured Vehicle, HDI Seguros will discount from the payable amount the depreciation or detri-

ment that such parts may have when the loss occurred, taking into consideration their remaining useful life determined as follows:

a) Engine and transmission.

In case of Total Loss of the engine or transmission, Depreciation shall be calculated over the value of the vehicle as new on the date the loss took place and according to the mileage of the Insured Vehiclebased on the chart below:

b) Battery

In case of Total Loss of the battery or the accumulator, Depreciation due to wear and tear will be applicable to the value as new at cash price on the date the loss took place and according to the chart below, considering the months of use as of the date of manufacture labeled on the battery shell, or as stated in the sales invoice if the original battery has been changed. Where the original battery has not been replaced, the official invoice of the Insured Vehicle will be considered.

Wear and tear depreciation or detriment of the car’s battery or accumulator.

c) Tires.

Depreciation will be applicable considering the difference between the original depth expressed in

millimeters and the remaining depth according to the manufacturer. The Insured shall have its share in the difference between the original depth expressed in millimeters and the remaining useful life for every kind of tire.

Indemnity for Total Loss of the Insured Vehicle with asalvage invoice issued by the insurance Company or any other company that makes business with this kind of vehiclesshall in no case exceed 75% of the market value of such vehicle established in the Blue Book in effect on the date the loss took place for a vehicle of the same brand, model and characteristics, or the equivalent to the amount indicated in the salvage invoice increased by the reinstatement cost thereof.

In no case will indemnity forTotal Loss of a border vehicle or a vehicle that has been legally imported by persons other than the assembling plants or nation – wide recognized distributors and that has been insured under the agreed value scheme exceed the trade value of the vehicle based on “1.b” number I – Clause 5th Sums Insured and Maximum Liability as set forth in these General Conditions.

b) REPAIR.

When HDI Seguros chooses to repair the Insured Vehicle, the choice of the site of repair and suppliers will be subject to availability in the area that is closer to the loss site; such repair shop must comply with the customary quality standards, be equipped with auto body repair and car mechanics areas and have a service supplier agreement concluded with HDI Seguros.

HDI Seguros shall have the Insured Vehicle repaired according to the following:

b.1. For vehicles within the first twelve years of use as per the date stated in the invoice, the repair shopsto choose from will be the manufacturer’s dealership duly authorized by the manufacture.

b.2. For vehicles that are older than twelve months, the repair shops will be chosen from specialized car repairshops.

HDI Seguros liability consists on finding possiblesuppliers of spare parts in the market, make sure that the parts needed are available and feasible to be supplied, and verify that the chosen repair shop or dealership makes the corresponding.

repairs and installation of parts in an adequate manner.

The car parts will be changed only in cases where repair does not offer warrantees or if it damages in any visible way the Insured Vehicle’s aesthetic features.

Availability of parts and spare parts is subject to stock from the manufacturer, importer and/or distributors, therefore, in no case is HDI Seguros obliged under this contract to provide or find such spare parts in case of generalized shortage.

If the required parts or spare parts are not available orifthere is a generalized shortage thereof, orifthe Insured refuses the process of repair as suggested by HDI Seguros, HDI Seguros may choose to pay the corresponding indemnity according to the appraisal and considering the applicable conditions in compliance with “a” – 3 in this clause.

The time to repair the Insured Vehicle shall dependonthe stock of parts and spare parts and on the repairs to be made. HDI Seguros must inform the Insured through the repair shop or car dealer or through the Representative of the process and development of the

repairs to be made.

The repair guarantee is subject to the warranteeoffered by the manufacturer, importer, or distribu-tor of parts or spare parts, and tho-se warrantees given by the dealer or the repair shop with regards to their workshop capacity.

Regardless of the options above, if there is a non-detected damage when carrying on the appraisal, and if such damage is the cause of the claimed loss, the Insured shall notify HDI Seguros of the event and take the Insured Vehicle to be checked and repaired as required.

c) REPLACEMENT.

When HDI Seguros chooses to replace the affected good for another of similar characteristics, the chosen option will be submitted to the Insured’s approval specifically, the Insured or Loss Payee will be notified of the exact location of the good for revision, valuation and approval purposes.

The warrantee of the good chosen to replace the damaged good is subject to what the manufacturer, distributor, or car dealer offers in the market.

4. When the cost of repair of the damage sustained by the Insured

Vehicle exceeds 50% of the value the vehicle had immediately before the loss occurred, and at the Insured’s request, the vehicle can be considered a Total Loss. Unless agreed otherwise, if the cost of repair exceeds 75% of such value, it will always be considered a Total Loss, and the obligation assumed by HDI Seguros will be limited to payment thereof.

5. In the event of Total Loss affecting any of the Coverages described in 1, 2, 5, 6 and 9 under the 1st. Clause. Coverage Schedule,in these General Conditions, HDI Seguros is hereunder obliged to pay,based onthe value stated in the policy cover page for the affected coverage.

6. In the event of Total Loss of the Insured Vehicle, and when the vehicle is in HDI Seguros car’s lotor car pound, the Insured will have thirty calendar days as of the day the Total Loss is notified by HDI Seguros to furnish proof of ownership as requested by HDI Seguros.

If the Insured fails to comply with the above paragraph, the Insured shall pay the cost of storage of the Insured Vehicle amounting to three days of General Minimum Wage in

Effect in Mexico City on the date the loss took place per day for every day in excess of the term stated in the paragraph above.

7. The fact that HDI Seguros collaborates in the assessment of the Insured Vehicle, or any other kind of assistance provided by HDI Seguros or their Representatives to the Insured or to third parties does not imply that HDI Seguros accepts any liability whatsoever with respect to the loss.

8. Moving expenses. In the event of loss likely to give rise to indemnity hereunder, as set forth in the policy cover page when the covered Risks are affected under 1. Property Damage, 2. Total Theft or8. Total Loss due to Property Damage in the 1st. Clause,Coverage Schedule hereunder,and if the damages caused are bigger than the Deductible stipulated for these Coverages, HDI Seguros will pay the expenses andmaneuvers to leave the vehicle in conditions to be moved. If the Insured decides to move the vehicle to a place different than the place chosen by HDI Seguros, HDI Seguros will only be liable for an amount equivalent to sixty days of General Minimum Wage in effect in Mexico City on the date the loss takes

place.

9. Delay Indemnity. If regardless of the fact that they have received the documents and information to establish the grounds of the claim, HDI Seguros fails to comply with the obligation to pay indemnity, capital or income as set forth under article 71 of the Law of Insurance Contract, they will be obliged to pay a delay indemnity as set forth in article 276 of the Law of Insurance and Bonds.

8th. CLAUSE TERRITORY .Coverages included under the policy cover page will be applied in case of accidents in the Mexican Republic and such application will be extended to the United States of America and Canada, except for Coverages3. Third party damage liability,10.I.1) family activities and real state, 10.I.3) Household workers and 10.I.4) Tenant’s Liability.

9th. CLAUSE SALVAGESTotal Loss due to Property Damage or Total Theft.

The parties hereunder agree that, once the Total Loss of the Insured Vehicle has been declared as a consequence of a loss stated as covered in the policy cover page, HDI Seguros will pay the Insured as set forth under “a3 Clause 7ª Basis of Appraisal and Payable Damages in these General Conditions and if there are salvages, the cost of acquisition thereof will be determined through expert’s appraisal or by loss analysis made by HDI Seguros under article 116 of the Law of Insurance Contract.

The expert’s appraisal or loss analysis referred to in the foregoing paragraph shall include the loss estimate sustained by the Insured Vehicle and the salvage acquisition value taking as reference the vehicle sales transactions in the market.

The resulting amount from indemnity and salvage payment less the deductible shall not exceed the sum insured as set forth in the policy cover page.

The salvage cost must not exceed

the difference between the insured sum and the amount equivalent to the damage percentage taken into account to determine theTotal Lossof the Insured Vehicle.

Unless agreed otherwise by the parties, when HDI Seguros pays the salvage costs determined through an expert’s appraisalorloss analysis as mentioned above, under article 116 of the Law of Insurance Contract, HDI Seguros will be the lawful owner of such saved items, except for the special equipment that is not insured hereunder.

Total Theft

In case of total theft of the Insured Vehicle, given the Risk update as set forth in the policy cover page, HDI Seguros will indemnify the Insured with the sum insured indicated in the policy cover page.

In compliance with article 111 of the Law of Insurance Contract upon paying indemnity to the

Insured,HDI Seguros will subrogate up to the amount paid in any and all rights and actions against third parties due to damages sustained. Further, if the Insured Vehicle were recovered, it would be owned by HDI Seguros, except for the

Special Equipment that is not insured hereunder.

Replacement due to Total Loss derived from Property Damages.

In compliance with article 116of the Law of Insurance Contract, when HDI Seguros choses to replace the affected good as set forth in c3, clause 7th. Basis of Appraisal and Payable Damages hereunder, HDI Seguros shall be released of any further indemnity obligation and the Insured will be obliged to guarantee the ownership transfer of the vehicle to HDI Seguros, therefore, HDI Seguros shall be automatically entitled to all the salvage rights.

Salvage in case of agreed coin-surance.

In case the Insured and HDI Seguros agreed on the coinsurance scheme, and ifso stated in the policy cover page, or through endorsement hereto, the Insured and HDI Seguros will take participation in the salvage in the same proportion they shared the loss.

10th. CLAUSE. LOSS OF THE RIGHT TO INDEMNITY.HDI Seguros’ obligations here under will be terminated.

1. If it is proven that the Insured, the Loss Payeeor their Representatives, with the intention to make HDI Seguros fall into error, misrepresent, or make inaccuratestatementswith respect to facts that may exclude or restrict such obligations.

2. If there is fraud or bad faith from the Insured or the Loss Payee or their respective Assignees.

3. If it is proven that the Insured, Loss Payee, or their Representatives, in order to make HDI Seguros fall into error fail to duly and timely provide information requested by HDI Seguros with regards to facts connected to the loss and through which it would be possibleto determine the circumstances and consequences thereof.

11th. CLAUSE. EARLY TERMINATION OF THE CONTRACT.The parties specifically agree that this contract may be terminated through written notice. When the Insured terminates the contract, HDI Seguros shall be entitled to the part of thepremium corresponding to the time during whichthe insurance policy were to have been in force inaccordance with the following tariff for short-term insurance.

When the HDI Seguros terminates the contract, it shalldo so by means of written notification to the In-sured, with the termination of the

insurance policy coming into effect fifteen days after the notification date,and HDI Seguros shall return to the Insured the totality of the premium in proportion to the time of validity not yet passed, at the latest upon effectuating said notification, without this requirement it shall be deemed not to have been done.

When two or more coverages are purchased and before the end of the agreed term if a total loss of the Insured Vehicle occurs, HDI Seguros shall return the Insured the part of the non-accrued premium or premiums on prorated basis corresponding to the Coverages that were not affected by the loss that caused theTotal Loss.

The same procedure will be followed when one or more coverages are purchased and the covered Risks disappear as a consequence of non-insured events.

12th. CLAUSE. PRESCRIPTION.All actions deriving from this Insurance Contract shall prescribe in two years as from the date of the event leading to such actions under the terms of Article 81 of

the Law of Insurance Contract, except for the exceptional cases established in Article 82 of said Law.

The term mentioned in the paragraph above will not run in the event of omission, false or inaccurate statements with regards to the Risk but from the date HDI Seguros knows of it, and with respect to the materialization of the loss, from the date the interested parties know of it, providing that they offer feasible proof that they did not know of such materialization.

As for third loss payees, they shall also be aware of the vested rights on their favor.

The prescription shall be interrupted not only due to ordinary causes, but also for the appointment of an expert or the filing of a claim under articles 50 bis and 65 of the Law for the Protection and Defense of Users of Financial Services.

13th. CLAUSE. COMPETENCE.In the event of controversy, the complainer may file the claim before the National Commission for the Protection and Defense

of Users of Financial Services (CONDUSEF) in its main offices or in the branches thereof that are closer to the Insured’s domicile or in HDI Seguros Customer Service Special Units(UNE) in charge of attending the customers’ claims and enquiries in compliance with articles 50 Bisand 68of the Law for the Protection and Defense of Users of Financial Services within a two-year term from the dateof occurrence of the event that gave origin to the claim, orupon refusal from HDI Seguros to satisfy the Insured’s demands.

It is the complainer’s prerogative to address the administrative instances referred to in the paragraphabove or directly the corresponding judge.

14th. CLAUSE. SUBROGATION.Under the terms of article 111 the Contract of Insurance Law, once the corresponding indemnity is paid, HDI Seguros shall subrogate the rights of the Insured up to the paid amount, as well as the corresponding actions against the authors or third parties responsible of the loss. reof, the Insured shall register the subrogation in apublic document. If, by acts or omissions of the Insured the subrogation is impeded, HDI Seguros shall be released from its obligations.

If the damage were to be only partially indemnified, the Insured and HDI Seguros shall agree toassert their rights at the corresponding proportion.

The right of subrogation shall not apply in case theInsured has a conjugal relationship or is ablood relative or relative by affinity up to the second degree or an in-law of the person who caused thedamage, or if the Insured is civilly responsiblefor such damage.

15th. CLAUSE. AGREED COINSURANCE .In case the Insured and HDI Seguros agree on the Coinsurance scheme, and if so stated in the policy cover page or through endorsement thereof, the coinsurance shall operate only for Coverages1. Property Damage and 2. Total Theft.

This Coinsurance is a percentage applicable to the purchased sum insured, the amount to calculate

the maximumliability held by HDI Seguros.

In the event of Total or Partial Loss or damage subject to indemnity hereunder, the Insured shall invariably bear on their own account, a 20% share in every loss or damage sustained by the Insured goods.

Given the share borne by the Insured in the loss under the coinsurance scheme, HDI Seguros has computed the corresponding Premium based on their maximum liability instead of on the total sum insured.

In case there are other insurance covering the same Risks covered hereunder, the indemnity shall be limited to the amount that results from applying the agreed Coinsurance percentage as set forth in the policy cover page over the amount of the loss ordamage.

In every claim for lossor damage, the indemnity shall be the result of subtracting the agreed coinsurance percentage from the loss amount and then applying the corresponding Deductibles set forth in the policy cover page.

16th. CLAUSE. INFORMATION ABOUT THE INTERMEDIARY.During the policy term, the Contracting party may request HDI Seguros in writing, for information of the Premium percentage that the Intermediary or Company is entitled to receive as a commission or direct compensation for their participation in the conclusion of this contract. HDI Seguros shall provide such information in writing or through electronic means within ten working days at the latest after receiving the request.

17th. CLAUSE. BASIS OF APPRAISAL AND DAMAGE PAYEMEN.

DOCUMENTS FOR INDEMNITY OR PAYMENT OF DAMAGES.

1. In the event of Total Loss derived from property damage.

If the Insured Vehicle, is determined a Total Loss given the extent of property damages, and in compliance with the 7th. Clause under the General Conditions, the following documents shall be furnished for HDI Seguros to be in position of

paying the corresponding indemnity.

A) if the owner is an individual.

a. Original Invoice. Ownership and assignment of rights thereof in favor of HDI Seguros, copies of other invoices if the vehicle has had more than one invoice and the invoice of origin and corresponding cessions thereof.

b. The car tenure tax original vouchers of the last five years.

c. Receipt of license plate termination.

d. Original of the Vehicle’s registration card issued by the Federal Vehicle Registration (applicable only to vehicles model 1990 or older). Original of the Vehicle’s registration card issued by the Federal Vehicle Registration (applicable only to vehicles model 1990 or older).

e. Original and copy of the car’s keys.

B) When the owner is a Company.

a. Invoice in favor of HDI Seguros signed by the Legal Representativeand bearing the Company stamp.

c. Further, all the documents mentioned in b, c, d and e may be delivered.

2. IN THE EVENT OF TOTAL LOSS DUE TO THEFT .

In addition to the documents mentioned in the paragraph above, the following shall be furnished:

Certified copy of a complaint filed before the corresponding authorities such as:

I. The Public Prosecutor’s office

II. The Ministerial Police.

III. Federal Preventive Police

3. VEHICLE WITH BORDER REGISTRATION.

As for border registration vehicles, ownership thereof shall be proven through the following documents:

a) Original of the vehicle’s title certificate and cessions thereof, original invoice and former invoices if any and cessions thereof.

b) Certificate of registration, or

c) Customs declaration.

4. DOCUMENTATION FOR PAYMENT OF DAMAGES.

In the event the Insured request for the payment of damages in compliance with the 7th. Clause in the General Conditions, the following documents shall be submitted.

a) The document to prove legal ownership of the Insured Vehicle in favor of whoever demands payment of damages sustained by the Insured Vehicle.

b) Official ID.

18th. CLAUSE. ACCEPTANCE OF THE CONTRACT.ACCEPTANCE OF THE CONTRACT ARTICLE 25 OF THE LAW OF INSURANCE CONTRACT.

Should the wording of the Policy or its modifications do not meet the offer, the Insured may request the necessary amendment within the 30 (thirty) days following receipt thereof.

After expiry of this period, the provisions or amendments made to the Policy shall be considered as accepted.

BENEFITS AND SERVICES 1. LEGAL ADVISE AND ASSISTANCE.

For this insurance purposes, HDI Seguros is hereunder obliged to supply the following services, providing always that the Insured has purchased such coverages and accepted the Risk as set forth in the policy cover page.

I. HDI Seguros hereunder commits to provide the Insured with the professional services of attorneys appointed thereby twenty for hours a day and seven days a week in case of accident sustained by the Insured when driving the vehicle and if the insured’s freedom is likely to be jeopardized due to damages caused to third parties’ goods or persons.

These services in case of accident will be provided by attorneys appointed by HDI Seguros to carry out the procedures to free the Insured and the vehicle involved in the loss, providing always that the Insured can prove the legal ownership and legal stay of the vehicle in the country.

II. HDI Seguros shall make the payment of fees and legal expenses derived from the proceedings

referred to in the paragraph above, settling the cash guarantee or Bail when so determined by the judicial authority to grant probation to the Insured.

Bail can be granted under the following:

a) Procedural duties bail.

b) Damages and losses bond.

c) Bail for pecuniary penalties.

HDI Seguros shall grant bails up to a maximum equal to the purchased sum insured as stated in the Civil Liability Coverage, if such coverage is not indicated in the policy cover page, it will be the Insured who shall get it, or when the bail limit exceeds the sum insured purchased for such purpose, the Insured shall cover the difference.

III. If the Insured is subject to trial due to an accident, HDI Seguros through their expert attorneys shall provide defense, using any element and proof for the benefit of the Insured and providing all the resources needed. In this case, HDI Seguros shall cover the fees and legal expenses derived from the criminal proceedings until conclusion thereof.

IV. If due to causes attributable to the Insured (contempt) the bail deposited by HDI Seguros becomes effective, the Insured will be under the obligation to reimburse such bail to HDI Seguros who will have the right to enforce any legal proceeding as deemed necessarytorecover such debt.HDI Seguros shall not assume the obligation to grant any bail or bond over the same loss; neither shall it become liable for the amount that the Insured is obliged to pay in the event of judgment of conviction.

V. The Insured shall notify HDI Seguros of the accident, either personally or by phone as soon as they become aware of the event, unless there is an unforeseeable event or force majeure, in which case, notice shall be served as soon as practicable.

VI. The parties know that HDI Seguros services will be provided to the Insured only in case of Car Accidents deducted from reckless crimes within the Mexican United States.

VII. For this Coverage purposes, the Loss Payee entitled to be provided with HDI Seguros Services will be understood as:

a) Individuals: if an Insured Vehicle is involved in an accident, assistance shall be provided to the Driver of the vehicle.

Further, service shall be provided to the Insured whose name appears as the first holder of the policy cover page and who purchased these services, when driving any other vehicle of similar capacity and use, when such vehicle has vehicle insurance in effect or Civil Liability extended coverage.

b) Companies: Service will be provided whenever the Insured Vehicle is involved in an accident whoever the Driver may be.

VIII. The Insured’s duties. The Insured shall notify and furnish to the person or persons appointed by HDI Seguros, as soon as practicable, any subpoena, lawsuit, requirement, judicial order, notices or any other document orlegal documentation received from administrative or judicial authorities directly orindirectly connected to events covered hereunder.

IX. Fines, towing service and night garage services as stated below:

In the event of accident, HDI Seguros shall pay or reimburse the following to the Insured:

a) When the car involved is a Private Vehicle:

The fine amount imposed to the Insured by the corresponding authority due to lack of caution, the towing service to carry the vehicle from the site of the accident to the car deposit site indicated by the authority, and from the site to the nearest repair shop, the stay of the vehicle in the car pound up to a maximum term of sixty days of General Minimum Wage in effect in Mexico City as Combined Single Limit.

b) When the car involved is a Business Vehicle:

The fine amount imposed to the Insured by the corresponding authority due to lack of caution, the stay of the vehicle in the car pound up to a maximum term of sixty days of General Minimum Wage in effect in Mexico City as Combined Single Limit.

HDI Seguros hereunder commits to pay the fine and night garage service from the fifteenth day and until the vehicle in question is released. HDI Seguros will not be responsible for paying the services mentioned above if the Insured Vehicle is released.

XI. In case HDI Seguros conditions the loss taking into consideration the exclusions set forth in the policy cover page or to the payment of the corresponding bails. If HDI Seguros subsequently accepts the loss, it commits to the reimbursement of:

a) The amount of the deposit bail up to the limit purchased within the Civil Liability coverage. On the other hand, the Insured commits to contribute to the Vehicle’s recovery.

b) The amount paid for the bail premium.

XII. Legal consultancy

HDI Seguros commits to attend any consultation on legal issues, with regards to anything the Insured may be concerned about. If consultancy is required, the Insured shall make an appointment with HDI Seguros by phone.

XIII. TheInsured shall transfer all the rights they have before third parties to HDI Seguros upon payment of any payable amount as stated hereunder by HDI Seguros. The Insured is hereunder obliged to furnish any document as may be required.

XIV. EXCLUSIONES.

HDI Seguros shall be released of any liability whatsoever hereunder in the following cases:

a) When the accident occurs in circumstances other than those specified above.

b) When involving an intentional crime.

c) When the Insured fails to follow the pieces of advice given by the attorneys appointed by HDI Seguros with regards to their own defense, or when the Insured make their own arrangements without previously consulting such professionals, or if the Insured hire their attorneys on their own account.

d) In case the Insured choses to conceal information, either written or verbal to the HDI Seguros attorneys regarding the accident or the legal process thereof.

e) When the Insured fails to appear before the authorities when requested to do so.

f) When the Insured fails to reimburse the amounts of bails, in case of contempt in compliance with Clause V above.

offer feasible proof of ownership or legal stay of the vehicle in the country.

h) In cases of exclusions provided for in the resident vehicles insurance policy title page.

2. TRAVEL ASSISTANCE.

In case the Insured has purchased this Coverage, and if stated in the policy cover page, they will be entitled to assistance for the vehicle, assistance for occupants, legal assistance, assistance in the event of assault, in international trips, Reimbursement, assistance to passengers from km “0” and roadside assistance from Km 0 according to the following:

Any Insured Vehicle which model is older than twenty years shall be excluded from this Coverage.

For Business Vehicles with a cargo capacity of more than 4.5 tons, they will be excluded from the benefits referred to in this Section 2. Travel Assistance II, III, IV, V and VI, as well as such benefits mentioned under I.b), e), f), g) Assistance for the Vehicle, lmentioned under VII a.7 and a.8 and tire change, jump start and loaner car under VII. Vehicle assistance from km 0.

I. ROADSIDE ASSISTANCE.

Travel Assistance will be provided within the Mexican Republic, but always more than fifty kilometers from the Insured’s Permanent Address.

For business vehicles, benefits referred to under c) and d) in this section are covered hereunder from km 0, being such understood and agreed as the right the Loss Payee has to request for service from their permanent residence and up to 50 km away therefrom.

For the purposes of providing assistance, the term Loss Payee refers to the Insured (first policy holder individual stated in the insurance policy cover page), the users and occupants of the Insured Vehicle, this benefit shall be applied according to the following:

a) Only in case of Gross Average that cannot be repaired in the very place where it was produced, HDI Seguros shall organize and take care of the towing services to the nearest repair shop. This service is limited to a maximum of 45 days of General Minimum Wage in effect in Mexico City.

truck during towing services. Towing service to Business Vehicles will be solely and exclusively provided to the Insured Vehicle, therefore, cargo thereof is not insured.Transshipment (cargo being carried from one place to another) shall be taken care of by the Loss Payee.

For Business Vehicles with a cargo capacity of more than 4.5 tons the towing service isconditioned to the Insured Vehicle being unloaded before being towed, salvage maneuvers to get the unit out of a ravine, a berm, when the unit is overturned or stuck. Towing service for automotive with a cargo capacity of more than 4.5 tons is limited to two occurrences per year with a maximum limit of four thousand pesos per event.

b) In case of accidentor breakdown, and if the Insured Vehicle’s repair works require more than 8 (eight) hours, HDI Seguros may offer the Loss Payee one of the following three services:

• Pay for the staying in a hotel chosen by the Occupants of the Insured Vehicle, this option being limited to ten days of General

Minimum Wage in Effect in Mexico City per day of stay with a maximum total of thirty days of General Minimum Wage in Effect in Mexico City per event.

• Settle the moving expenses of the Insured Vehicle’s Occupants to their destination or permanent place of residence, HDI Seguros shall pay such expense within a maximum limit of forty days of General Minimum Salary in Effect in Mexico City per event.

c) At the Loss Payee’s request, HDI Seguros shall provide information about authorized repair shops that are near the site.

d) HDI Seguros is hereunder committed to send spare parts available in the Mexican market when they are required and if they are not available in the place where repair are to be carried out. The cost of the spare parts and freight thereof shall be borne by the Loss Payee.

HDI Seguros shall inform the Loss Payeewhether the piece required is available within the next eight hours after request thereof and the estimated delivery time. Limited only to deliveries in the Mexican Republic.

As per Business units with a cargo capacity of more than 4.5 tons this service is limited to two events per year with a maximumlimit of four thousand pesos per delivery per event.

e) If the Driver cannot drive back to their permanent residence due to illness, according to the treating physician and under medical supervision by HDI Seguros, and if there is no other occupant suitable to drive the Insured Vehicle, HDI Seguros shall provide and pay a driver to drive the Insured Vehicle to the city of permanent residence.

f) In the event of theft of the Insured Vehicle, HDI Seguros shall provide information on the steps to follow until the claim is filed before the corresponding authorities.

g) After filing the complaint for theft before the competent authorities HDI Seguros shall pay the staying in a hotel chosen by the Loss Payee, subject to a maximum of 15 days of General Minimum Wage in Effect in Mexico City per day of stay with a total maximum of sixty days of General Minimum Wage in Effect in Mexico City per event.

h) After filing the complaint for theft before the competent authorities HDI Seguros shall pay the leasing

of a vehicle or the transportation of the Insured’s Vehicle’s Occupants to their destination or Permanent Residence whichever the Loss Payee chooses. Such benefit is limited to a cost of eighty days of General Minimum Salary in Effect in Mexico City per event.

II. ASSISTANCE TO PERSONS.

Loss Payee will be understood as the Insured only.

If the Loss Payee suffers of an illness as a result of which, HDI Seguros medical team, in constant contact with the treating physician, onsiders it is indispensable to hospitalize the Insured; HDI Seguros will make the arrangements and pay for:

a) Transportation of the Loss Payee to the nearest hospital; and

b) If necessary for medical reasons:

• Transportation under medical supervision and using the most adequate means (including without limit aerialambulance), commercial airplane, or

• If permitted by the medical condition, HDI Seguros shall arrange transportation to the medical center or hospital closer

to the Loss Payee’s permanent residence, HDI Seguros and the treating physician shall take all the necessary provisions for safe transportation.

• HDI Seguros shall pay the necessary expenses to extend the Loss Payee’s staying in the chosen hotel immediately after they are released from hospital providing always that such extended stay has been prescribed by the treating physician and by HDI Seguros medical staff. Such benefit is limited to fifteen days of General Minimum Wage in Effect in Mexico City per event.

If the Loss Payee, after having received local treatment, provided by the treating physician and HDI Seguros medical staff cannot return to their permanent residence as a normal passenger, or cannot use the means of transportation initially provided for HDI Seguros, shall arrange transportation byplane in a commercial airline and shall take care of all the supplementary expenses required, such as the Loss Payee’s ticket back.

c) In case of death of the Loss Payee due to illness, HDI Seguros shall take care of all the necessary procedures (including any legal issue) and shall take care of:

• Paying for the round trip ticket for member of the family, using the ideal means of transportation from their place of residence to the place where the Loss Payee died, and only if such member of the family travels alone or with minors.

• Transportation of the corpse or ashes to the burial place in the city of permanent residence of the Loss Payee.

• At the request of the Family or the Loss Payee’s Representatives, if the burial place is the same as the place where death occurred, HDI Seguros shall cover the expenses up to a limit of 600 days of General Minimum Salary in Effect in Mexico City per event.

III. LEGAL ASSISTANCE IN CASE OF ASSAULT .

Loss Payee will be understood as the Insured and their family (spouse and children under twenty one, economic dependents) HDI Seguros is hereunder committed to provide the Loss Payee with legal advice and assistance within the Mexican Republic twenty for hours a day and seven days a weekif the Loss Payee has been a victim of assault, physical or moral violence caused by theft or any other crime.

HDI Seguros shall be responsible for the payment without limit of fees and legal expenses derived from procedures referred to in the paragraph above.

IV. ASSISTANCE DURING INTERNATIONAL JOURNEYS.

Loss Payee will be understood as the Insured and their family (spouse and children under twenty one, and economic dependents).

In the event the Loss Payee is in a foreign country and if for whatever reason becomes involved in legal issues that require assistance, our Permanent Service International Center shall contact an attorney with affiliation to our worldwide network in order to provide the adequate professionalassistance, which shall be paid by the Loss Payee.

In the event of injury or illness sustained by the Loss Payee in a foreign country, HDI Seguros shall cover the hospitalization expenses, urgical interventions,medical fees and prescribed medications.

The maximum limit for such concepts will be up to $5,000.00 U.S.D. for one or for a series of events to cover only expenses abroad.

If the Loss Payee has acute

problems originated in a foreign country that require urgent odonatological treatment, HDI Seguros shall cover the expenses up to a maximumof 750.00 U.S.D.for one or for a series of events and shall only cover expenses abroad.

If the Loss Payee dies in another country due to illness HDI Seguros shall fill in all the forms and cover:

a) Paying for the round trip ticket for member of the family, using the ideal means of transportation from their place of residence to the place where the Loss Payee died, and only if such member of the family travels alone or with minors.

b) Transportation of the corpse or ashes to the burial place in the city of permanent residence of the Loss Payee.

c) At the request of the Family or the Loss Payee’s Representatives, if the burial place is the same as the place where death occurred, HDI Seguros shall cover the expenses up to a limit of 600 days of General Minimum Salary in Effect in Mexico City per event.

In the event of theft or loss of documents that are considered essential to continue the journey,

such as Passport, visa, plane tickets etc., HDI Seguros shall provide the necessary information and carry out any necessary procedure before the local authorities or Mexican Consulate in order to get the replacement of such documents.

In the event of theft or misplacement of the Loss Payee’s luggage, our Permanent Customer Service Center shall provide assistance to file the claim for theft or misplacement and collaborate in the process to find it and send it to the place of destination planned by the Loss Payee or to their customary place of residence within the Mexican Republic.

Our Permanent Domestic and International Customer Service will be in charge of transmitting, at the Loss Payee’s request any urgent message derived from the situation.

V. REIMBURSEMENT ASSISTANCE.

Loss Payee will be understood as the Insured and their family (spouse and children under twenty one, and economic dependents).

HDI Seguros provides free of charge legal assistance and consultancy to the Loss Payee to get thereimbursement of all the expenses

they have incurred into in connection with medical, legal and administrative issues during the journey within the Mexican Republicorabroad and which are covered by a credit card (American Express, Diners, Visa, Master Card, etc.) or through any other type of membership that includes this benefit.

VI. ASSISTANCE PROVIDED TO PERSONS KM “0”.

In the event of a Car Accident and only when necessary, HDI Seguros shall get an ambulance for the Loss Payee to be taken to the nearest and most appropriate hospital.

When the Loss Payee requires medical assistance HDI Seguros shall provide advice on the measures to be taken.

HDI Seguros cannot make a diagnosis, but at the Loss Payee’s request and at their own expense, the Loss Payee shall have all the meansavailable to be diagnosed either:

a) By a medical personal visit, or

b) By making an appointment with a physician in a medical center paid by the Loss Payee.

VII. AUXILIO VIAL KM “0”.

The Loss Payee isunderstood as the Insured as well as the vehicle’s users or Occupants.

For this contract purposes kilometer 0 will be understood and agreed as the right the Loss Payee has to request for Roadside assistance services referred to in this paragraph from their permanent residence up to 50 km away therefrom.

As for Business Vehicles, the covered services according to this paragraph shall be extended to cover more than 50 km from the Insured’s permanent residence.

a) In the event the Insured Vehicle sustains any type of situation which prevents it from moving under its own power, HDI Seguros shall provide the following services:

a.1. With regards to towing truck service, HDI Seguros shall carry the Insured Vehicle to the nearest repair shop. In Ievery case, the

Loss Payee must accompany the towing truck during towing services. Towing service to Business Vehicles will be solely and exclusively provided to the Insured Vehicle, therefore, cargo thereof is not insured. Transshipment (cargo being carried from one place to another) shall be taken care of by the Loss Payee.

For Business Vehicles with a cargo capacity of more than 4.5 tons the towing service isconditioned to the Insured Vehicle being unloaded to be carried, salvage maneuvers to get the unit out of a ravine, a berm, when the unit is overturned or stuck. Towing service for automotive with a cargo capacity of more than 4.5 tons is limited to two occurrences per year with a maximum limit of four thousand pesos per event.

a.2. When gasoline or diesel is needed HDI Seguros shall organize and pay for fuel to be sent to the Insured Vehicle for it to move under its own power to the nearest gas station. The cost of fuel shall be paid by the Insured.

The maximum limit of gasoline to be sent per event is five liters for Personal Vehicles and 10 liters for Business Vehicles.

a.3. In the event of Breakdown that requires Roadside Assistance, the Loss Payee shall request for service to the HDI Seguros Permanent Customer Service Center24 hours following the Breakdown at the latest.

a.4. At the Loss Payee’s request, HDI Seguros will provide updated information about authorized repair shops that are near the site where the Breakdown took place.

a.5. Further, in case of Vehicle Breakdown, and at the Loss Payee’s request, HDI Seguros shall provide Mechanical Assistance Service through the network of professionals at the Loss Payee’s favorto have the Insured Vehicle repaired on the site the Breakdown took place, providing always that such repair does not require of elements or supplies that would make it necessary to take the Insured Vehicle to a repair shop, and being respectful at all times, of the traffic regulations.Should the repair works require pieces and/or spare parts the cost thereof will be borne by the Loss Payee.

a.6. The above-mentioned services are limited to three events per yearly policy term.

a.7. In case the Policy holder is unable to drive due to drunkenness and, if none of the other occupants can drive the Insured Vehicle, HDI Seguros shall cover the transportation expenses of both the Loss Payee and the Insured Vehicle to their customary residence within the Mexican Territory. This type of service will be provided only at Kilometer “0”, being such understood as from the place of permanent residence and up to 50 km away there from. Limited to three events per year

a.8. If the keys were forgotten inside the Insured Vehicle, HDI Seguros will send a locksmith service to the site where the Insured Vehicle is located. It will be required that the Insured and/or Driver identify themselves before the service is provided.

Service limited to three events during the annual policy term.

VIII. LOSS PAYEE’S DUTIES.

The Loss Payee is hereunder committed to:

In case the Loss Payee requires assistance, and before taking any type of action whatsoever, the Loss Payee shall call the HDI Seguros Permanent Customer Service Center and provide the following data:

b) Location and phone number where HDI Seguros can contact the Loss Payee or their Representative, and every piece of information that the agent providing assistance requires to locate the site.

• Name, Permanent domicile and number of the car insurance policy.

• Description of the problem and the type of assistance required.

The HDI Seguros specialized team shall have free access to the vehicle, to the Loss Payee and their medical record in order to get familiar with the situation. Should such access be denied, HDI Seguros will not have the obligation to provide any type of Assistance whats o ever.

c) In case of mortal danger.

Should there be a mortal danger situation, the Loss Payee or their Representative must act as fast as possibleto arrange the transportation of the ill person to the nearest hospital, through any adequate means available, or take

any appropriate measure and then call HDI Seguros Permanent Customer Service Center to notify of the situation.

d) Towing service without previous notice to HDI Seguros.

In the event of absolute and proven urgency or if it was not possible to notify HDI Seguros customer service, HDI Seguros shall reimburse any amount spent by the Insured, providing always that notice is served within the next 72 hours following the moment when such impossibility of notification ceases.

Such Reimbursement is limited to a maximum of 45 Days of General Minimum Wage in Effect in Mexico City.

e) Medical attention.

If medical attention is required, and in order to offera better service, the Loss Payee or their Representativeshallprovide HDI Seguros, with the following data:

• Name, address and telephone number of the medical center where the Loss Payee was admitted.

• Name, address and telephone number of the physician attending

the patient and if necessary, data of the attending physician that normally attends the Loss Payee.

HDI Seguros or their Representatives shall have free access to the Loss Payee’s medical records in order to evaluate the Loss Payee’s health conditions, should such access be denied, the Loss Payee will be no longer entitled to receive Assistance Services.

In every case, HDI Seguros medical supervision servicesis to decide when is the most appropriate time to move the patient, the most adequate dates and means to do it.

f) Moderation.

The Loss Payee is hereunder obliged to try to minimize and limit the situations that require Assistance Services.

g) For the Loss Payee to get the reimbursement of expenses incurred into and authorized by HDI Seguros, they shall submit the corresponding invoices issued in favor of the Insured.

IX. EXCLUSIONS.

Additionally, and regardless of the type of vehicle insured, the following is excluded from coverage:

• Situations that occur in the course of journeys made by the Loss Payee against their treating physician medical advice and in the course of journeys that last more than sixty natural days, in which case the Loss Payee is not entitled to Assistance Services.

• Situations that occur before paying the car insurance policy, in which case the Loss Payee is not entitled to Assistance Services.

• HDI Seguros shall not provide any type of assistance if the Loss Payee(s) or their Representative(s)fails to identify themselves properly.

• HDI Seguros shall not reimburse the expenses incurred into by the Loss Payee in case the Loss Payee uses the services of a service supplier other than that approved by HDI Seguros without their approval.

• HDI Seguros shall be released of any obligation whatsoever to provide Assistance Services, as hereunder agreed in such cases that appear as excluded in the policy title page.

• Likewise, Assistance Situations derived from strikes, war,

invasion, acts from foreign enemies, hostilities (having the war being declared or not), rebellion, civil war, insurrection, terrorism, piracy, popular riots, self-inflicted injuries, and participation of the Loss Payee in criminal acts.

• The Loss Payee taking part in fights, unless in cases of self-defense.

• Injuries or death caused by practicing sports as a professional or by taking part in official races or exhibitions.

• Injuries or death caused by the fact that the Loss Payee and/or the Insured Vehicle takes part in any type of race, competitions or exhibitions.

• Radiations coming from nuclear transmutation, radioactivity or from any type of accident caused by nuclear fuel.

• Any pre-existing illness, being such understood as that one starting prior to the policy term, being visible to the naked eye, and for which expense have been made prior to this Coverage inception term. Recovery term is deemed part of the Illness.

• Mental illness or disorder.

• Pregnancy, childbirth, C- section and prenatal care.

• Sight tests to diagnose or correct prescription, surgical procedures such as radial keratotomy and other type of surgeries to correct refractory errors, expenses made on eyeglasses, lenses, etc.

• Transplant of organs or limbs of any type.

• Illnesses or pathological conditions produced by the intentional ingestion or administration of toxic substances (drugs), drunkenness, narcotics, or the use of drugs without medical prescription

• Suicide or illnesses or injuries derived from attempt of suicide

• Automobiles that have been modified in any way, different from the manufacturer’s specifications and considered dangerous, if such have influenced the breakdown or accident according to the expert’s opinion.

• Intentional impact or crashes, or having the Insured Vehicle taking part in criminal actions.

• Maintenance works, vehicle checkups, major repairs and

fixing or assembling of previously disassembled parts by the Loss Payee or by a third party.

• Towing the Insured Vehicle with cargo or injured people on board, free the Insured Vehicle when stuck on a ditch or ravine when it is being driven off road or on impassable roads.

• Prosthesis in general, expenses for crotches, wheelchairs, orthopedic apparatuses.

• Dental treatments that are not an emergency oracute cases such as prosthesis, endodontics, aesthetic treatments or cleaning.

• Any other case as specifically stated by law.

3. MEDICAL ASSISTANCE.

Loss Payee in this coverage will be understood as the Insured and their family (spouse, children under twenty one and economical dependents).

Should this Coverage appear as included in the policy cover page, it will extend to cover:

I.MEDICAL ASSISTANCE BY PHONE.

Should the Loss Payee require medical advice, it is to say, if the

illness or accident in question does not jeopardize the Loss Payee’s life, an organ or physical integrity, HDI Seguros medical team will provide free of charge advice on what to do in case of minor problems (situations that are not consideredan emergency), symptoms and mild discomfort.

HDI Seguros medical team will not make a diagnosis, but at the Loss Payee’s specific requestand on their ownaccount, HDI Seguros will provide the necessary means to get a diagnosis, either by sending a physician to the Loss Payee’s domicile, or by making an appointment with a doctor at a hospital which will be paid by the Loss Payee.

Telephone medical advice service includes information about the use of medications, side effects and recommended doses provided by HDI Seguros medical team.

HDI Seguros medical team will give information about public and private health services, sanitary measures,disease, 24 hours a day and seven day a week nationwide service unlimited calls.

or Illness that might jeopardize human life, compromise any organ or physical integrity of the Loss Payee, HDI Seguros medical team, together with the treatment physician will arrange and pay for transportation to the nearest and/or most adequate medical center.

If necessary, and for medical reasons, transportation will be under medical supervision by intensive, intermediate or standard therapy land ambulance depending on how serious the case is, according to the HDI Seguros medical team.

Nationwide service24 hours a day seven days a week limited to two free services per year.

From the third service on, the Loss Payee will have preferential prices but will always cover 100% of the service directly to the supplier.

III. MEDICAL SERVICE AT HOME.

At the Loss Payee’s request, a general physician will be sent to their home or to wherever they are at the momentof request.

The Loss Payee shall pay directly to the physician the first $180.00 (one hundred and eighty pesos 00/100) upon concluding the

service.

Nationwide service unlimited visits24 hours a day seven days a week

IV. MEDICAL AND HOSPITAL REFERENCE.

HDI Seguros medical team will make an appointment with a professional physician with all the credentials to practice the medical profession, or will contact a medical center in case of accidentor illness and if specifically requested by the Loss Payee,who shall cover the expenses. HDI Seguros will make the arrangements for medical attention to be provided and, together with the treating physician, the Loss Payee and the Medical Center will follow the procedure from the moment the appointment is made until the conclusion of service.

HDI Seguros will not be held liable with respect to such medical attention or lack thereof by any of such doctors ormedical institutions.

no case will the expenses made by any other supplier outside such network be reimbursed.

V. EXCLUSIONS.

The service referred to in the paragraph above shall not be provided in the following cases:

a) Situations that occur in the course of journeys or holidays taken by the Loss Payee against their treating physician’s medical advice, in which case the Loss Payee is not entitled to Assistance Services.

b) If the Loss Payee does not provide truthful information with regards to the nature of the situation and therefore; prevents proper assistance.

c) The Loss Payee will not be entitled to reimbursement of the expenses made for the services received without previous authorization from HDI Seguros.

d) If the Loss Payee cannot offer feasible proof of their capacity of beneficiary entitled to assistance, or when they fail to comply with any of the obligations set forth under the General Conditions.

e) HDI Seguros will not be responsible for delays or

non-compliance due to forcemajeure or administrative or political issues customary in the place where the Assistance Services are to be provided.

f) Services derived from the following are excluded as well:

1. Strikes, war, invasion, acts from foreign enemies, hostilities (having the war being declared or not), rebellion, civil war, insurrection, popular riots, radioactivity or any other force majeure.

2. Attempt of suicide, suicide, self-inflicted injuries by the User of the Insured Vehicle or the Vehicle being involved in criminal actions.

3. Psychiatric or psychological illnesses or mental diseases.

4. Illnesses or pathological conditions produced by the intentional ingestion or administration of toxic substances, overdose of major or minor drugs(except under medical prescription) or illegal drugs.

5. Any intentional setback or involvement in criminal acts.

receive land transportation services within the last ninety days of pregnancy.

7. All types of accidents, injuries or illnesses resulting from professional sports activities or official competitions.

8. The User leaving the site of the accident.

3. BURIAL ASSISTANCE.

Under this Coverage, if purchased, – HDI Seguros shall provide funeral assistance to the Insured through a supplier, in any case of death and/or to the Driver of the Insured Vehicle when death occurs as a consequence of a Car Accident covered under this policy.

Funeral Assistance consists on:

• Legal procedures before the competent authorities for the burial or cremation of the Insured and/or Driver of the Insured’s Vehicle.

• Transportation of the Insured and/or Driver of the Insured’s Vehicle to the wake roomor cemetery.

• Metal lineal coffin as previously agreed.

• Tanatopraxia Service.

• Use of filial wake rooms nation wide for a maximum of 24 hours or

home service.

• Decoration of wake rooms consisting on three flower bouquets (two on the sides and one on the front part of the coffin)

• Religious service held by whoever is chosen by the Family.

• Delivery of a funeral guest book.

• Leased burial plot for seven years of service or cremation.

Should the Insured and/or Driver of the Insured Vehicle die in a country in the American Continent, the following will be covered:

• Legal procedures before the competent authorities or the consulate and transportation of the body from the site of death to the Mexican Republic.

• Embalming and tanatopraxia.

• Hermetically sealed coffin for repatriation.

• Protective cover, coffin lining for aerial transportation.

• Special packing for aerial transportation.

• Taking the deceased from the site of death to an airport in the Mexican Republic.

• Cost of repatriation including air transportation to the Mexican Republic.

• Customs procedures to release the body at an airport in the Mexican Republic.

Public transportation vehicles and those with a cargo capacity of more than 3.5 tons are excluded from coverage.

This Coverage will not be effective when the Driver is less than sixteen years of age or older than seventy at inception of this policy. This Coverage is not subject to reimbursement service must be requested directly at the HDI Seguros Call Center – at 01 800 019 6000.

AMANTE DE LOS AU-TOS MODULE.THEFT OF CAR PARTS.

If described as covered in the policy cover page, this Coverage shall cover the replacement of original auto parts that form part of the original design of the Insured Vehicle if they have been partially stolen, including the cost of workforce associated with the replacement of the covered car parts with exclusions as provided hereunder.

Any car part other than those included in the original design of the vehicle shall be excluded from Coverage.

This Coverage shall only be applicable to the Insured Vehicle described in the Policy cover page and it will only be executable by the Owner of the Insured Vehicle as follows:

• This Coverage covers up to the limit of events set forth in the policy cover page.

• In case the total amount of the stolen car parts in one single event exceeds2,500.00 pesos (two thousand five hundred pesos), the Owner of the Insured Vehicle shall file a complaint before the

I. COVERED RISKS.

a) This coverage does not imply by itself a warrantee that the car parts to replace will be available; therefore, if any of the car parts is not in the market or and/orif they would not be available for a period longer than thirty calendar days counting as of the date of claim, the owner of the Insured Vehicle shall only be entitled to receive the replacement and installation costs of the pieces as per appraisal made by the suppliers authorized by HDI Seguros (except for the conditions and restrictions set forth under tires).

Three theft events will be the maximum number of events covered hereunder, regardlessof the type of car part stolen from those listed above. Event is understood and agreed as an act in which one or more car parts or a combination thereof are stolen, therefore this Coverage shall not be misunderstood to cover three events per each type of auto part.

Tires conditions and restrictions.

b) In addition to the maximum limit of events mentioned above, to the claim filing conditions and to deductible payment provisions referred to in subsequent paragraphs, the following conditions apply in case of theft of installed tires or spare tires, including replaced ones because of a previous event of theft.

Replacement of tires is subject to the following conditions:

b.1 If the adequate set of tiresunder the corresponding specifications as those of the original model of the Insured Vehicle, in legally constituted repair shops and complying with all the legal requirements are available, the tires will be replaced but that does not imply that such replacing tires must be of the same brand as the

replaced ones, therefore, not all the tires (including the non-stolen ones) have to be replaced for matching purposes.

b.2 If the tires required to comply with the technical specifications according to the original parts of the Insured Vehicle are not available in the market, the damaged tires will be replaced by those covering the specifications in effect when the claim is filed.

If the tires covering the technical specifications or specifications of origin are not available in the market, HDI Seguros shall pay indemnity thereof.

The tire warranty shall be covered by the manufacturers and subject to the adjustments they determine.

The maximum liability held by HDI Seguros for theft of tires and rims will be limited to four tires and/or rims within one or more events up to a limit of three.

DEDUCTIBLE.

In case of theft of tires, rims or seats, the theft deductible percentage will be invariably applied, as set forth in the policy cover page under the Total Theft Coverage over the cost to replace the stolen pieces.

Should the Special Equipment or Adaptation or Conversion Coverage appears as purchased in the Policy Cover page to cover tires or rims other than those originally installed, a 25% replacement deductible shall be invariably applied.

1. If derived from an event of theft of car parts the unit cannot move under its own power, the Driver of the Insured Vehicle shall have it carried on theirown account and Risk.

File a claim before the Public Prosecutor’s office that is closer to the site where the event of theft took place, the claim shall include:

a) Name of the claimant.

b) Location where the theft of car parts took place.

c) Name of the owner

d) Vehicle data

- Type.

- Model.

- Color.

- License plate and/or circulation permit.

- Vehicle serial number

- Motor number

- Description of the stolen parts.

The above does not release the claimant from submitting any other piece of information requested by the authority.

2. Request for a certified copy of the claim. Certified copy is understood and agreed as a true copy of the original claim submitted before the Public Prosecutor’s Office or report where the Public Prosecutor certifies that document in question is a true copy of its original.

The existence of the claim or proof thereof that can be validated at any time and, in case of such claim being false or nonexistent the lawful actions will be exercise to recover the amount spent with regards to declared theft and any other ensuing expenditure.

Once the deductible is paid, HDI Seguros shall proceed to replace the damaged goods, if indemnityapplies, the Deductible amount shall be discounted from the payable amount.

EXCLUSIONS

In addition to the restrictions and conditions to file claims for theft of car parts included in this coverage, and the exclusions as set forth under the Insurance Contract General Conditions, the following will be excluded hereunder:

a) In no case will HDI Seguros cover damages caused to the Insured Vehicleand/or any component thereof because of partial theft. This Coverage shall only cover replacement of car parts stolen and covered hereunder, including workforce connected only to instalment (repair works excluded). Replacement of damaged car parts is not covered. HDI Seguros shall only be held liable for stolen car parts.

Should repair works be absolutely necessary to install the replacing car parts, assembling will only be carried out after the parts have been repaired on the claimant’s account.

b) In no case will HDI Seguros be held liable for the stolen car parts covered hereunder when stolen as a consequence of car burglary because of total theft of

the Insured Vehicle.

c) Should this coverage not be in effect or if it is terminated earlier than expected, or should the limit of events be exhausted, this Coverage will no longer be effective.

d) No theft of car parts will be covered when occurred:

d.1) If the Insured Vehicle is abandoned.

d.2) Inside a repair shop or car dealership.

d.3) In a car pound, night garage or in any other car deposit indicated by the competent authorities.

d.4) When the theft occurs while the car is under the care of a valet parking service or in a public parking lot and the original ticket is not delivered to HDI Seguros.

REPAIR AT THE DEALERSHIP.

If stated as covered in the policy cover page, and in case of partial losscovered under 1. Property damage or2. Total Theft occurs, HDI Seguros shall proceed to repair Insured Vehicle according to the following:

For vehicles within the first fifteen years of age counted as of the year of manufacturing, repairs will be carried out at the dealership or those repair shops that are duly authorized by the manufacturer and by HDI Seguros to provide repair services.

The Insured may choose to have the vehicle repaired at the dealership, at HDI Seguros Auto-Pronto Centers or in repair shops that are duly certified and authorized by HDI Seguros.

Forvehicles that are more than fifty years old counted as of the year of manufacturing, repairs will be carried out at the repair centers included under Clause 7th. in the General Conditions hereunder.

All of the other conditions stated under Clause 7th. in hereunder shall remain unchanged.

0% DEDUCTIBLE FOR TOTAL LOSS DUE TO PROPERTY DAMAGE.

If stated as covered in the policy cover page, and in case of total loss covered under 1. Property damage or 8. Total Loss due to Property Damage, HDI Seguros shall release of Deductible payment as specified under the policy cover

page for 1. Property damage or 8. Total Loss due to Property Damage. The operation provisions will be ruled under the Insurance Contract General Conditions.

10% MORE IN TOTAL LOSS INDEMNITY.

If stated as covered in the policy cover page and if total loss is determined under Coverage1.Property damage or 2. Total Theft Daños, in addition to the indemnity established for the affected Coverage, HDI Seguros shall pay 10% of the trade value defined in subsection 1, fraction 1, Clause 5th, under the General Conditions.

MAXIMUM LIABILITY LIMIT

The maximumliability limit held by HDI Seguros with connection to this benefit will be 10% of the Insured Vehicle’s trade value on the date the loss took place.

DEDUCTIBLE

In addition to the deductible under Coverage 1. Property damage or 2. Total Theft which covers the Total Loss of the Insured Vehicle, the“10% more for Total Loss” Coverage is to be purchased with invariable contribution borne by the Insured, known as Deductible.

The Deductible amount results from applying the percentage of Deductible purchased for the affected Coverage1. Property damage or 2. Total Theftor 8. Total Loss due to Property Damage over 10% of the Insured Vehicle’s trade value on the date the loss took place.

VEHICLE WAXING.

In case the Insured takes on the “Amante de los Autos” module,HDI Seguros offers Vehicle Waxing Service at HDI Seguros Auto-Pronto centers.

In its repair shops, HDI Seguros, will evaluate the paint conditions of the Insured Vehicle, if it is considered that waxing could cause damage to the Vehicle’s Paint coat, we will notify the Insured so they can decide whether the service is provided. If regardless of having been notified, waxing service is authorized, the Insured shall release. HDI Seguros of any liability whatsoever derived therefrom.

This service is limited to one event per policy term.

AUTO SIEMPRE MODULECOVRAGES:

Loaner Car up to thirty days.

If described as covered in the policy cover page, this Coverage includes the lease of a loaner car up to a maximum of thirty days, if any of the above situations or a combination thereof occurs under the following circumstances and conditions:

I. IN CASE OF LEGAL DETENTION.

HDI Seguros shall provide the Loss Payee with a Loaner Vehicle for up to a maximum of thirty consecutive calendar days or until the Insured Vehicle is released, whichever is earlier, when derived from a traffic accident, the Insured Vehicle is seized by authorities and not released.

II. IN CASE OF BREAKDOWN.

In the event of Breakdown of the Insured Vehicle and if towing (providing always that it is supplied byHDI Seguros Roadside Assistance Service)and repair shop services are required, HDI

Seguros shall assign a Loaner Vehicle to the Loss Payee.

The Loaner car service will be offered for a maximum of thirty consecutive calendar days or until the Insured Vehicle is delivered back, whichever is earlier.

II. IN CASE OF PARTIAL LOSS.

In case of Partial Loss covered under 1. Property Damage, HDI Seguros, through its assistance service network shall provide the Loss Payee with a Loaner Vehicle if the following essential conditions are fully complied with:

a) The amount resulting from the damages sustained by the Insured Vehicle as per appraisal by HDI Seguros exceeds the Deductible amount purchased and indicated in the policy cover page under Coverage 1. Property Damage, whether the Insured has or does not have to pay such Deductible.

b) HDI Seguros shall declare the loss payable according to the General Conditions of this Policy.

c) The Insured Vehicle is repaired in any of the HDI Seguros repair shops in agreement by both the Insured and HDI Seguros.

d) The loaner vehicle Agreement

made by the service provided shall be signed by the Loss Payee.

e) e) In case the Insuredis affected in the accident and if the Insured Vehicle is repaired in any of the HDI Segurosrepair shops, the Loaner Vehicle Coverage shall be effective providing always that the amount of the damage as per appraisal by HDI Seguros is bigger than the purchased Deductible indicated in the policy cover page under Coverage1.Property Damage, whether the Insured has or does not have to pay such Deductible.

f) It is an essential condition for this Coverage to become effective that the Loss Payee delivers a copy of the admission ticket issued and stamped by HDI Seguros upon accessing the authorized repair shop.

g) The Loaner Vehicle shall be provided to be used and enjoyed by the Insured up to a maximumof thirteen natural consecutive days during the policy term.In case the Insured Vehicle is repaired and delivered before 30 consecutive calendar days, the use and enjoyment term provided for the loaner vehicle shall terminate automatically.

III. IN CASE OF TOTAL LOSS CAUSED BY PROPERTY DAMAGE OR THEFT OF THE INSURED.

In case ofTotal Loss of the Insured Vehicledeclared by HDI Seguros due to a loss under Coverage1. Property damage or 2. Total Theft or 8. Total Loss due to Property Damage indicated as purchased in thepolicy cover HDI Seguros, through its service network shall provide the Loss Payee with a Loner Vehicle if the following essential conditions are fully compliedunder the following terms and conditions:

a) HDI Seguros shall declare the loss payable according to the General Conditions of this Policy.

b) The Loaner vehicle Agreement made by the service provided shall be signed by the Loss Payee.

c) In case the Insured is affected in the accident and if the Insured Vehicle is determine aTotal Loss by HDI Seguros repair shops, the Loaner Vehicle Coverage shall be effective as well.

d) The loaner vehicle shall be provided to be used and enjoyed by the Insured up to a maximum of thirty

natural consecutive days during the policy.

The Insured shall have the possibility to use the total number of days in one single event orto divide them in a series of events, if such is the case.

The loaner vehicle shall be provided to be used and enjoyed by the Insured up to a maximum of thirty natural consecutive days during the policy term, due to any of the caused mentioned above or a combination thereof.

REQUIREMENTS THAT SHALL BE COVERED BY THE LOSS PAYEE.

Forthe Loss Payee to be provided with the use and enjoyment of the Loaner Vehicle the following shall be complied with:

• Being at least 18 years old.

• Having an updated and valid driver´s license.

• Submit an official valid ID.

• Sing the Service supplier agreement.

• Guarantee with a credit card any expense derived from having a

Loaner Vehicle and that it will be returned in the same conditions as it was received.

• If the Insured is a Company, the Legal Representative shall appoint an individual as the beneficiary of the Coverage.

• In case the Loss Payee and the Insured are different entities no additional cost will be charged.

LOSS PAYEE’S DUTIES

Further, the Loss Payee is hereunder obliged to:

• Return the Loaner Vehicle immediately after the assigned terms expire.

• Pay the lease fees established by the supplier in case the use and enjoyment of the Loaner Vehicle exceedsthe number of days set forth under this Coverage.

• Always return the Loaner Vehicle at the time set forth for devolution thereof, it is to say, 12:00 hours, with 2 hour grace period, after which the Loss Payee will be chargedone additional day at the fees charged by the service supplier.

• The Loaner Vehicle must be returned with the same gasoline level registered when it was received

by the Loss Payee, otherwise, the Loss Payee will have to pay the difference.

• In case of loss sustained by the Loaner Vehicle given to use, the Loss Payee is hereunder obliged to pay the Deductible stipulated in the Contract concluded with the service supplier.

• Pay for all the additional expenses and costs (shortage of gasoline, additional days of use, Deductibles, damages, etc.) in connection with the Loaner Vehicle.

• The traffic tickets and surcharges given to the Loaner Vehicle during the length of time when under the Loss Payee’s liability shall be paid by the Loss Payee within fifteen days after having been given at the latest.

• The Loaner Vehicle shall be delivered in the same physical and mechanical conditions as it was received, as stated in the checklist document signed by both parties. In the event of shortage or deteriorations the Loss Payee shall be obliged to compensate the losses and damages to the Supplier.

• The Loss Payee shall receive and return Loaner Vehiclein HDI

Seguros appraisal center and/or at the vehicle supplier facilities that is closer to the Insured’s domicile.

EXCLUSIONS.

In addition to the exclusions set forth under Clause 3rd. Risks that are not covered under Contract, in the General Conditions of the Policy. The Risks that in no case will be covered hereunder are:

The Loaner Vehicle will not be provided in the following cases:

• Any situation involvingfraud or bad faith, inaccurate or misrepresented statements by the Loss Payee or the Insured to have HDI Seguros falling into error.

• Non – compliance with the requirements set forth hereunder.

• The Loss Payee being under the effects of drugs or alcohol and/or in a physical condition that is not adequate to drive a vehicle when making the request.

• HDI Seguros reserves the right to refuse service when the integrity of the staff or the vehicles is jeopardized.

• In case of Partial Lossthe Loaner Vehicleshall not be granted if HDI Seguros indemnifies the

Insured through payment of damages.

The Insured will not be entitled to service under this Coverage when the loss is declared as not payable by HDI Seguros.

SUSPENSION OF SERVICE.

The causes to cancel services, setback or accidents are:

• Using the Loaner Vehicle to make a profit.

• Abandoning the Loaner Vehicle.

• Ignoring the federal, state or local traffic regulations.

• Using the Loaner Vehicle to draw trailers.

• Exceeding the Loaner Vehicle’s normal capacity or resistance.

• Taking direct part with the Loaner Vehicle in races, safety testsor speed or resistance tests.

• Driving the Loaner Vehicle under the influence of drugs or alcohol.

• Driving the Loaner Vehicle without driving license in effect legally issued by the competent authorities.

• Driving the Loaner Vehicle on unpaved and/or impassable

• Using the Loaner Vehicle to take part in illegal acts.

This coverage operates without Deductible.

0% DE DEDUCTIBLE IF THE THIRD PARTY IS NOT INSURED

In case it is specified as covered in the policy cover page, and should a loss occur under Coverage1. Property Damage, this Coverage shall give the Insured the benefit of Deductible payment exemption in case of loss in the following cases:

a) When there is a responsible third party, such third party shall be present at the time and place of loss settlement. The adjuster or the competent authority shall determine responsibility which will be 100% favorable to the Insured or Driver of the Vehicle.

b) If there is a third responsible who drives away, the Insured will be released of payment of Deductible if the damages sustained are bigger than such deductible specified in the policy cover page for Coverage1. Property Damage, providing always that the damage adjustment is made at the loss site

and traces of collision are left on the site. The Adjuster shall

determine the liability held by HDI Seguros or by the competent authorities.

TIRES AND RIMS INSURANCE.

If described as covered in the policy cover page, HDI Seguros shall cover the repair or substitution derived from damages sustained by any of the tires and/or rims installed in the Insured Vehicle due to a Traffic Accident orblown out, up to the number of events described in this Coverage.

In case of change of the damaged tire and/or rim that cannot be detached from each other, they shall be replaced with a tire and/or rim with the same characteristics of size, height, and width as those originally installed by the manufacturer of the Insured Vehicle or with a tire and/or rim of similar characteristics with regards to Price, and characteristics if the original model is not available.

MAXIMUM LIMIT OF LIABILITY.

This coverage applies to a maximum of four tires and/or rims installed within one or more events.

This Coverage operates without deductible.

EXCLUSIONS.

In addition to the Exclusions set forth in Clause 3th. Risks that are not covered under Contract, within the General Conditions in the policy cover page, the Risks that in no case will be covered by this Insurance Contract are the following:

1. Repair or change of tires and/or rims that are different in size or specifications than the tires and/or rims originally installed by the manufacturer of the Insurance Vehicle unless the Coverages for Special Equipment or Adaptation and/or Conversion have been purchased hereunder to cover tires and/or rims that are different to those originally installed, in which case a 25% deductible of the change cost will be invariably applied.

2. Repair or change of tires designed to be used specifically off-road or on snowy roads and that were not originally installed by the manufacturer of the Insured Vehicle.

3. Damages caused by Fire, vandalism, theft or attempt thereof.

4. Damages caused to the tire and/or rim in case the Insured Vehicle is used after a Traffic Accident without the ensuing damages being repaired, whether or not such damage is covered under the Insurance Contract.

5. Repair or change of tires whose tire liners have been totally or partially changed.

6. Repair or change of tires that have extinguished their useful life term in 75% or more.

UNLIMITED ROADSIDE ASSISTANCE AND TIRE REPAIR.

If stated as covered in the policy cover page and for the purposes of this coverage, services described under Traveling Assistance under Additional Benefits and Services, included in the policy cover page are covered hereunder with no limit of events.

Likewise, if a change of tire is required, the service shall include the unlimited free of charge repair of the tire, providing always that the vehicle is found within a ratio that shall not exceed 50 km from the Insured’s customary domicile.

This Coverage applies exclusively to vehicles and pickups declared for family or private use only in the policy cover page.

The regulations and conditions set forth within the Insurance Contract Conditions shall be applicable to this Coverage.

EXCLUSIONS.

In addition to the Exclusions set forth under Clause 3rd. Risks that are not covered under contract, within the General Conditions in the policy cover page, the Risks that in no case will be covered by this Insurance Contract are the following:

• This Coverage shall not be applicable to tires that are impossible to repair.

Deductible.

This Coverage operates without deductible.

EXCLUSIONS.

FREE VEHICLE CHECKUP.

Should the Insuredpurchase the “Auto Siempre”module; HDI Seguros will provide “Check Up” services to the Insured Vehicle.

The “Check Up”service consists on checking of breaks, alignment

and balancing, shock absorbers, liquid level, and lights. The “Check Up”shall in no case oblige HDI Seguros to make any type of repair whatsoever to the Insured Vehicle.

The “Check Up” service will be carried out in the HDI Seguros Auto-Pronto Centers or in repair shops that have concluded agreements with HDI Seguros.

Once the “Check Up” is made to the Insured Vehicle, the owner and/or Insured shall receive a checkup report, and if the Insured decides to make repairs to the Insured Vehicle, the costs of such repairs will be covered by the Insured.

Such service is limited to one event per policy term.

Call HDI Customer service to activate the above described service.

In no case will HDI Seguros cover:

• Repair of the Insured Vehicle derived from a fault detected during the “Check Up”.

• HDI Seguros shall not respond for the warrantee of repair to the Insured Vehicle.

LOSS CLAIM GUIDE LINE.

1. In case of accident orclaim sustained by the Insured Vehicle:

The Insured shall immediately notify the incident to HDI Seguros at: 01 800 019 6000, available 24 hours a day 7 days a week and follow the recommendations listed below:

• Provide the number and location in the policy cover page.

• Remain in the loss site and/or with the affected person.

• Wait for the adjuster to arrive to the site. Do not acknowledge any responsibility whatsoever; do not make arrangements or payments of any sort.

• HDI Seguros will provide assistance by phone on the steps to follow in case of glass breakage.

2. Where to pay Deductible?

a. In case of glass repair or breakage, payment shall be made at that momentto the dealership or repair shop that is repairing the vehicle.

b. If invoice is required, the Insured shall provide HDI Seguros with a copy of the receipt given by the dealership or repair shop, copy of the Tax Registration Number (RFC) and proof of the Insured’s tax address.

c. In case of payment for Total Loss or damages, the Insured may choose to have the Deductible discounted from the corresponding indemnity.
