§48.24 Cooperative training program.(a) An operator of a mine may conduct his own training programs, or may participate in training programs conducted by MSHA, or may participate in MSHA approved training programs conducted by State or other Federal agapproval; encies, or associations of mine operators, miners' representatives, other mine operators, private associations, or educational institutions.

§46.3 Training plans.(a) You must develop and implement a written plan, approved by us under either paragraph (b) or (c) of this section, that contains effective programs for training new miners and newly hired experienced miners, training miners for new tasks, annual refresher training, and site-specific hazard awareness training.

The citation issued on April 29th was not posted "immediately" as the Act requires. Further, it was not, even under respondent's evidence, posted at a location where it would be protected against unauthorized removal.
On the initial issue Inspector ________ testified that he issued the citation at 2 a.m. on April 29 (Tr. 15-16). However, the citation itself indicates it was issued at 10:20, on a 24 hour time clock. Even if it was issued at the later time, a delay of more than six hours occurred before it was posted. Klobchar testified the citation was not posted until 5:00 to 5:30 p.m.
"Immediately", as defined in Section 109(a) of the Act, means "without interval of time, without delay, straightway, or without any delay and lapse of time", Black's Law Dictionary, 5th Edition, 1979.
Further, respondent's witness __________ agrees that at the location where he posted the citation there was nothing that would have prevented its unauthorized removal (Tr. 54). In this respect the location chosen, accordingly, did not comply with Section 109(a) of the Act.

62.13 Citations and Orders3. How will MSHA determine if an overexposure under the new standard is a significant and substantial (S&S) violation?If miners are overexposed to the PEL, a citation will not be S&S if you provide miners with proper hearing protection and it is being worn. However, a citation will be S&S if proper hearing protection is not worn by miners.

The controls shall be located so that spills or overruns will not endanger persons. (b) Where persons are required to move around or over any facility listed in this standard, suitable walkways or passageways shall be provided. (c) Where persons are required to enter any facility listed in this standard for maintenance or inspection purposes, ladders, platforms, or staging shall be provided. No person shall enter the facility until the supply and discharge of materials have ceased and the supply and discharge equipment is locked out.
