Introduct ion

The impact on the consciousness and subconscious long worried people in many countries. New information technologies, mass media repeatedly strengthened thepossibility of such effects on the human psyche, to large groups of people and the whole populat ion of the country. Along w ith the progress that carries us to a newinformation revolut ion, it has drawbacks.

Cruelty, violence, pornography, propagated in the media, print unlimited sale, as well as in computer games, etc., leads to the sometimes unconscious desire amongadolescents and young people to emulate this, helps to perpetuate these behaviors in their own habits and lifestyle, lowers thresholds and legal prohibit ions that, alongwith other condit ions, paving the way for many of them to the offenses.

Numerous exist ing today in the Russian community committees for protect ion from such exposure, including parents, a large number of cit izens to public authorit iesw ith requests for verificat ion of such facts and protect the public from the harmful effects of special devices on their psyche - all this also indicates a serious lagging stateof the pract ice of public relat ions in this sphere. Long overdue need for the part icipat ion of the state in the legal regulat ion of these processes.

These findings indicate the need for development of nat ional legislat ion and internat ional law, to protect the human psyche of unconscious destruct ive informationalinfluences. This brings the problem of legal protect ion against such exposure a priority of the state policy that requires along w ith the improvement of exist ing todaycertain provisions of laws and regulat ions (including "On the Media," "On Advert ising", "On Freedom of Conscience and Religious Associat ions "," Fundamentals of theLegislat ion on health care, "etc.) to adopt a special Federal Law" On information and psychological security. " The bill, according to its authors, is to be a framework, ageneral nature (it does not infringe on freedom of expression, media and freedom of conscience), and could serve as a basis for training and further adopt ion of apackage of other laws in this area.

Such a bill drafted by a working group of the State Duma Committee on Security and was introduced December 3, 1999 as a legislat ive init iat ive to the State Dumaof the second convocat ion VN Lopat in, who headed this direct ion legislat ive work in the Russian parliament. Chapter 1. General

Art icle 1. Object ives and scope of the present Federal Law

The purpose of this Federal Law is to protect individuals in the territory of the Russian Federat ion, of the negat ive information and psychological influences.

Subject to regulat ion hereof are matters arising in connect ion w ith the information - psychological effects on a person, a group of individuals, populat ions, and theirprotect ion from the adverse effects of such exposure.

Subjects of the present Federal Law are: persons subjected to negat ive information and psychological impact; person, group of persons, organizat ions asking forinformation and psychological effects; authorized bodies and organizat ions to provide information and psychological security.

Providing information-psychological security by the state represented by authorized government bodies, local government bodies, specialized agencies andorganizat ions.

Art icle 2. Concepts

For the purposes hereof, the follow ing basic concepts:

Information and psychological security - the state of protect ion of individuals and (or) groups of individuals from the negat ive effects of information-psychological andrelated other vital interests of the individual, society and the state in the information sphere.

Negat ive information and psychological impact - impact on a person or group of persons (including, in addit ion to their w ill), carried out w ith the use of special meansand methods of influence on the human psyche and leads to negat ive consequences for the individual, society and the state.

Special means of influence - both hardware and software used for the negat ive information and psychological impact on a person or group of persons.

Special methods of influence - a sequence of techniques impact on the human psyche, the use of which leads to negat ive consequences for the individual, societyand state.

Standards information-psychological security - duly approved parameters of information and psychological effects that do not cause adverse effects on the humanpsyche.

Art icle 3. Legislat ion on information-psychological security

Legislat ion on information-psychological security consists of the present Federal Law, adopted in accordance w ith it normative legal acts of the Russian Federat ionand normative legal acts of the Russian Federat ion and local self-government w ithin the powers delegated to them by the federal government regulat ing relat ions in thesphere of information and psychological security.

Art icle 4. Principles of information-psychological security

The basic principles of security of information-psychological security are:

the adequacy of exist ing security threats;

state monopoly on the development and product ion of special tools information and psychological warfare, the use of which is permitted in cases st ipulated in Art icle16 of this Federal Law;

combinat ion of centralized command and control to ensure information-psychological security to the transfer, in accordance w ith the federal structure of Russia, part



of the powers in this area state authorit ies of the Russian Federat ion and local authorit ies;

transparency and civilian control over maintenance of information-psychological security;

mandatory part icipat ion in the act ivit ies of non-governmental organizat ions to provide information and psychological security.

Art icle 5. Threats of negat ive information and psychological effects

The main threats to information-psychological security is the possibility of negat ive consequences for subjects exposed to information and psychological effects,which may be expressed in the follow ing forms:

- Causing harm to human health;

- Blocking at the unconscious level of freedom of expression rights, inst illing him art ificial dependence syndrome;

- Loss of ability to polit ical, cultural, moral self-ident ificat ion;

- Manipulat ion of public opinion;

destruct ion of the common informational and spiritual space of the Russian Federat ion, the tradit ional foundat ions of society and public morality, as well as violat ionsof other vital interests of the individual, society and the state.

Threat information-psychological security realized through the development, product ion, distribut ion and use of information and subjects negat ive psychologicaleffects of special tools and techniques that impact.

Chapter 2. State system for ensuring the security of information and psychological

Art icle 6. Main tasks of state policy in the field of information-psychological security

State policy in the field of information-psychological security is aimed at the follow ing goals:

- Improvement of the legislat ion of the Russian Federat ion in the area of information-psychological security;

- Formation system of information-psychological security;

coordinat ion of the act ivit ies of public authorit ies and public associat ions to provide information-psychological security;

definit ion of the powers of state authorit ies of the Russian Federat ion and local authorit ies in the area of information-psychological security;

establishing an appropriate balance between the need for free exchange of information and the permissible limitat ions of its distribut ion;

preservat ion of a common informational and spiritual space of the Russian Federat ion, the tradit ional foundat ions of society and public morality;

- Develop and support domest ic product ion protect ion from negat ive information and psychological effects;

- Development of legal awareness and legal culture of cit izens in the area of information-psychological security;

teaching people techniques to protect themselves from the negat ive psychological effects of information and the basics of safe behavior in the modern informationenvironment;

- Organizat ion of internat ional cooperat ion in the field of information and psychological security.

Art icle 7. Funct ions of the State system of information-psychological security

State system for ensuring information-psychological security performs the follow ing funct ions:

ident ificat ion and registrat ion of ent it ies in a negat ive psychological impact of information and control over their act ivit ies;

- Conduct ing monitoring adverse information and psychological effects;

- Suppression of negat ive information and psychological effects;

training to ensure information-psychological security involving non-state educat ional and scient ific organizat ions;

- Development and improvement of methods and tools to ident ify and neutralize the negat ive effects of information-psychological, rehabilitat ion of persons affectedby such impacts;

- Organizat ion of rehabilitat ion of persons affected by negat ive information and psychological effects;

- Organizat ion of a system of licensing, cert ificat ion, examinat ion and control of information-psychological security;

- Organizat ion of the development and adopt ion of standards in the field of information-psychological security;

development of special means and methods of information-psychological effects for use in cases st ipulated in Art icle 15 of this Federal Law;

- Informing the public about the act ivit ies of individuals and organizat ions that violate the laws of information and psychological safety;

- Promoting the development and adopt ion of internat ional law in the field of information and psychological security.

Art icle 8. Structure system of information-psychological security

For the implementat ion of state policy in the field of information and psychological security in accordance w ith the stated object ives, funct ions and principles formedthe state system to ensure information-psychological security, which consists of agencies and organizat ions providing information and psychological security.

Art icle 9. Bodies of the system of information-psychological security

The organs of state system of information-psychological security are federal authorit ies operat ing w ithin its jurisdict ion fully or part ially the tasks and funct ions referredto in Art icles 6 and 7 of this Federal Law, the state authorit ies of the Russian Federat ion and local authorit ies in accordance w ith delegated to them by higher powers ofpublic authorit ies to provide information and psychological security of current legislat ion.

Coordinat ion of the provision of information and psychological security is implemented by the Government of the Russian Federat ion, a federal agency to provideinformation-psychological security, which also has:

- Organizat ion of the licensing of individuals and organizat ions that make up the forces of information-psychological security, and control of the licensed act ivity;

cert ificat ion organizat ion of means and methods of information-psychological influence and control over the act ivit ies of the cert ificat ion;

- Organizat ion of expert ise in order to provide information and psychological security and control over the act ivit ies of expert organizat ions (units);

- The formation of the state order to conduct research in the field of information-psychological security;

- Control over maintenance of information-psychological security in general;

- Preparing an annual report to the President of the Russian Federat ion on the state of information-psychological security of the country;



informing the public authorit ies and local authorit ies about the threats of information-psychological security and the measures taken to secure it , the shortcomings ofproviding information and psychological security ident ified during the inspect ion. State agencies and local governments are obliged to consider this information whenmaking relevant decisions w ithin its competence.

Authorized by the Government of the Russian Federat ion, the federal body responsible for building the system of information-psychological security organizat ion andits act ivit ies in accordance w ith the object ives, funct ions and principles established by this Federal Law.

Art icle 10. Organizat ions providing information and psychological security

The organizat ions providing information and psychological security include:

head and leading research, scient ific and technical, design, engineering and other public organizat ions that research and development in the field of methods andmeans of protect ion against negat ive information and psychological effects on the human psyche;

educat ional inst itut ions for training and retraining of personnel in the area of information-psychological security;

authorized by the state system of information-psychological security organizat ions performing certain funct ions to ensure information-psychological security.

Art icle 11. Licensing in the area of information-psychological security

Licensing of organizat ions associated w ith the provision of information-psychological security, carried out by bodies authorized by the Government of the RussianFederat ion, on the proposals of the Federal agency to provide information and psychological security and in accordance w ith Federal law.

A prerequisite for obtaining a license is a cert ificate of the means and methods used in carrying out the licensed act ivity.

Public authorit ies have the right to work to ensure the information-psychological security w ithout a license w ithin its competence established by the legislat ion.

Art icle 12. Cert ificat ion tools and techniques of information-psychological security

Subject to mandatory cert ificat ion means and methods to ensure information-psychological security. A list of these tools and techniques and their cert ificat ionprocedure established by the Government of the Russian Federat ion.

Art icle 13. Examinat ion in order to detect negat ive information-psychological influences

State examinat ion in order to ident ify the negat ive information and psychological effects by organizat ions authorized by the Government of the Russian Federat ion, inaccordance w ith the legislat ion of the Russian Federat ion.

State examinat ion is carried out on the instruct ions of providing information and psychological security, as well as in a declarat ive manner.

A statement on the expert ise of the right to appeal a person subjected to negat ive information and psychological warfare, and persons act ing on their behalf inaccordance w ith the civil law, including their relat ives, trustees, employers, public associat ions.

If the examinat ion revealed negat ive information and psychological impact on the human psyche, a person has been exposed to such an impact, providingrehabilitat ion assistance in accordance w ith applicable law.

Expert opinion may be appealed to a court or arbitral tribunal in the prescribed manner.

Art icle 14. Control to provide information-psychological security

The control to provide information and psychological security in the territory of the Russian Federat ion shall be exercised by the Government of the RussianFederat ion authorit ies on information-psychological security, federal authorit ies, the authorit ies of the Russian Federat ion and local authorit ies w ithin their powers, as wellas their authorized bodies and organizat ions.

In exercising oversight of information-psychological security competent authorit ies conduct registrat ion ident ified ent it ies carrying negat ive information andpsychological impact.

Art icle 15. Except ional cases of the use of special means and methods of information-psychological influence

1. Use of special means and methods of information-psychological influence allowed agencies and organizat ions w ithin the state system of providing information andpsychological security in the follow ing cases:

1) w ithout the consent of the subject w ith respect to which such funds are used and methods of influence:

emergencies that occur during natural disasters, man-made and man-made for the purpose of localizat ion and liquidat ion of emergency situat ions;

during ant i-terrorist and peacekeeping operat ions during host ilit ies in repelling foreign aggression against the State;

2) w ith the consent of the person against whom such funds are used and methods of influence:

- For scient ific purposes, for research in the area of the psyche;

- W ith training, using means and methods of influencing the psyche;

- The preparat ion of professionals whose work is related to extreme and emergency situat ions,

- The preparat ion of specialists to conduct ant i-terrorist operat ions;

- W ith training in the field of information security.

2. The grounds for the applicat ion of special means and methods of information-psychological influence is exhaust ive and may be amended only by the Federal Law.

Internat ional cooperat ion in the field of information-psychological security is based on internat ional treat ies and agreements of the Russian Federat ion.

Russian Federat ion in internat ional cooperat ion in the field of information-psychological security emanates from the need to protect the psyche of any person fromthe negat ive psychological effects information and guided by the follow ing principles:

- Every person, regardless of nat ionality and locat ion must be protected from the negat ive information and psychological effects;

- Economic, scient ific and other act ivit ies on the territory of a State shall not be accompanied by negat ive information and psychological effects on the humanpsyche, located on the territory of another State;

States shall ensure state control of information-psychological security based on internat ionally recognized standards;

- State, assist each other in order to ensure information-psychological security of people in their territory;

- Contribute to the state to prosecute those responsible for the implementat ion of information and negat ive psychological effects.

Export and import of tools and techniques of information-psychological security in accordance w ith internat ional treat ies of the Russian Federat ion on the basis of aspecial permit issued by the Government of the Russian Federat ion.



Chapter 3. Final Provisions

Art icle 17. Responsibility for violat ion of this Federal Law

Implementat ion of negat ive information and psychological effects by using special tools and methods, as well as illegal development, product ion and distribut ion ofspecial means and methods of act ion entail criminal, administrat ive and other liability in accordance w ith the legislat ion of the Russian Federat ion.

Compensat ion for damage caused as a result of negat ive information and psychological impact and costs associated w ith medical and psychological rehabilitat ion ofpersons affected by negat ive information and psychological warfare, carried out by the courts.

Act ions (inact ion) of bodies and organizat ions carrying out state regulat ion of relat ions in the field of information-psychological security, as well as the act ions of theirofficials may be appealed in accordance w ith the legislat ion of the Russian Federat ion or to the administrat ive court.

Art icle 18. Financing act ivit ies related to the provision of information-psychological security

Act ivit ies of federal agencies and organizat ions of the state system of information-psychological security is financed by the federal budget of the Russian Federat ionallocated public authorit ies, in accordance w ith their departmental classificat ion.

Art icle 19. Procedure for the entry into force of this Federal Law

This Federal Law shall enter into force on the day of its official publicat ion.

Regulat ions of the Russian Federat ion must be brought into compliance w ith this federal law in the prescribed manner.

Art icle 14 and paragraph 2 of Art icle 15 of this Federal Law shall enter into force on 1 January 2001.

"On information and psychological security"

Possibilit ies of science and technology now allow you to create tools and methods for information management system effects on living organisms, altering theirfunct ion. Potent ially there is a big risk of social technologies of art ificial human behavioral change, restrict ions on the freedom of expression it , as well as the impact onhuman health, and groups of people in general populat ion. In a society increases psychological stress due to the alleged use of some government organizat ions,corporate groups and individuals special means and methods of influence on the human psyche. For example, in the information-analyt ical review of the Moscowcommittee of ecology home "on the deliberate use of inhumane means of special equipment in the Russian Federat ion", presented by the Public Prosecutor of theRussian Federat ion and the State Duma, said on mass appeals of individuals to them in order to find protect ion. The problem of providing information and psychological security is extremely important for Russia and the world community as a whole. It is direct ly related tonat ional security. Since the 70s theresearch programs carried out in the best laboratories in universit ies around the world: USA, Germany, Austria, France, Italy, Japan, Israel, China and others in the UnitedStates published the results of research authoritat ive commission of the American Physical Society in 1993 concluded that such weapons systems (Psychophysical ArmsSystem) can be effect ively used to address a broad range of military tasks. They can be used to create a fundamentally new means and methods of warfare, includingthe creat ion of a new type of strategic weapons.

According to the Russian Foreign Intelligence Service, given the parliamentary hearings in the State Duma, "Threats and challenges in the field of informationsecurity," such information weapon is aimed, inter alia, "the mass distribut ion and introduct ion into the minds of people of certain ideas, habits and behavior patternsthat cause dissat isfact ion or panic among the populat ion, as well as provoking destruct ive act ions of various social groups. "

Today, at the legislat ive level, there is sufficient safeguards to protect people from the risks associated w ith the negat ive effects of information, which may result in:causing harm to human health, at an unconscious level blocking freedom of expression rights, inst illing him art ificial dependence syndrome; manipulat ion of public opinion,etc. These threats are realized through the development, implementat ion and use of special means and methods of act ion.

These facts indicate the need to develop both nat ional legislat ion and internat ional law, to protect the human psyche from negat ive information and psychologicalinfluences.

This federal law is aimed at ensuring the rights of persons w ithin the territory of the Russian Federat ion, to protect their health from the negat ive psychologicalimpact of information and related other vital interests of the individual, society and state in the information sphere.

Concept of the bill is based on the follow ing key posit ions.

- Any person who is in the territory of the Russian Federat ion, must be protected from the negat ive information and psychological effects on his psyche.

- Providing information and psychological security is one of the most important tasks of the state.

To achieve this task should be developed public policy and established a state system of providing information and psychological security. The bill defines the maindirect ions of the state policy and the structure of the state system of information-psychological security, its main tasks and funct ions.

Tools used by the public system should provide a sufficient level of protect ion from the negat ive information and psychological influences. The bill provides for theuse of such instruments of state regulat ion, such as compulsory licensing act ivit ies to ensure information-psychological security, mandatory cert ificat ion means andmethods of security expert ise in order to ident ify negat ive information-psychological influences, supervision to ensure information-psychological security.

The most important duty of the state in the sphere of information-psychological security is to inform cit izens, organizat ions, public authorit ies and local governmentson the availability of information and psychological threats and security measures taken to neutralize them, and provision of training people how to protect againstnegat ive information and psychological impact on their psyche.

Feature negat ive information effects is that they can be detected only by special examinat ion. For hazard ident ificat ion should be developed and used special safetystandards - duly approved parameters of information and psychological effects that do not cause adverse effects on the human psyche. The examinat ion must beavailable to anyone, so the bill establishes that such examinat ion may be conducted in a declarat ive manner (to a person who has been exposed to, or a person act ing inhis best interests), as well as on behalf of the state system of information-psychological security in order control.

Given public concern about the potent ial for uncontrolled use of special tools and techniques of information and negat ive psychological impact and to betteroversight of information-psychological security, the bill provides along w ith the state and civil control.

The bill establishes an exhaust ive list of cases where the use of state funds and special methods of influence on the psyche of people may be just ified, thusimplementing the principle of state monopoly on the use of such means.

Coordinat ing the act ivit ies of bodies belonging to the state system for providing information and psychological security, and the implementat ion of specific publicpolicies in this area by the authorized federal body of the Government of the Russian Federat ion.

Federal law consists of three chapters and 19 art icles.

The first chapter defines the purpose and scope of the Federal Law, the basic concepts, threat information-psychological security; established principles ofinformation-psychological security.

The second chapter is devoted to public policy in the area of information-psychological security, including: key public policy object ives and funct ions of the statesystem of information-psychological security; structure of the state system and methods of state regulat ion (coordinat ion, licensing, cert ificat ion, expert ise and control);except ional cases the use of special means and methods of information-psychological influence; basic principles of internat ional cooperat ion in the field of information and



psychological security.

The third chapter contains the final provisions on monitoring compliance w ith this Act, responsibility for its violat ion, the funding for information and psychologicalsecurity and order of entry into force of the law.

Costs for implementat ion of this law depends on the creat ion w ithin the state system of information-psychological security special federal authority. If such a body iscreated, then to ensure that its act ivit ies would require addit ional budget funding (up to 10 million rubles a year). If the funct ions of the state system of information-psychological security w ill be distributed among exist ing federal authorit ies, the addit ional costs of the federal budget for the first stage is not required.

In the case of adopt ion of the Federal Law "On the information-psychological security" must be:

- Amendments and addit ions to the Criminal Code of the Russian Federat ion (offsett ing the art icle 17 of the Federal Law);

- Amendments to the Code of Administrat ive Offences (offsett ing the art icle 17 of the Federal Law);

- Amendments and addit ions to the Federal Law "On Licensing Certain Types of Act ivit ies" (offsett ing w ith Art icle 12 of the Federal Law);

- Amendments and addit ions to the normative legal acts of the federal government, authorit ies of the Russian Federat ion and local authorit ies involved in the systemto ensure the information and psychological information (offsett ing w ith Art icle 9 of the Federal Law);

- Adopted regulat ions on licensing of organizat ions and individuals associated w ith the ident ificat ion and neutralizat ion of negat ive information and psychologicalinfluences, training protect ion from such impacts, rehabilitat ion of people affected by negat ive information and psychological warfare (Art. 12); cert ificat ion tools andtechniques of information-psychological security (Art icle 13); on the examinat ion in order to ensure information-psychological security (Art icle 14).

Development of the concept of the legislat ion in the field of information-psychological security was started in 1990 in a parliamentary committee of the SupremeSoviet of the USSR on problems of nat ional security under the leadership of Yu.A.Ryzhova.

In order to prepare the draft law were held Conference on information and psychological security in years. In criminal law, some protect ion from attacks on mental health is provided. Safe state - a complex phenomenon. It includes physical, mental, genet ic, reproduct ive, intellectual and spiritual health and provided a system of economic, polit ical,environmental, information, legal and other measures. Since we are talking about protect ing the interests of cit izens of the state, such measures have to get clearancein the legislat ion governing the protect ion of the individual and establishing responsibility for an attack on her. If the physical security of the person - the life and physicalhealth already have a certain social and legal protect ion (health, social security, the responsibility for violence to life, health, etc.), many other characterist ics(psychological, genet ic, reproduct ive, intellectual and spiritual ) either do not yet become the subject of legal regulat ion, or they are only part ially covered.

It is known that the next in importance, after the physical, the mental health component is. Internat ional Act on Economic, Social and Cultural Rights (Art icle 12)provides for the right of every cit izen not only the physical, but also mental health, obliging States to take measures towards the full realizat ion of this right. Meanwhile,significant steps in this direct ion in Russia have not yet taken, and sufficient guarantees no psychological protect ion. Legislat ion does not provide, in part icular, in a directstatement of responsibility for unauthorized impact on the human psyche, there is no compensat ion for the mental health and psychological care system and therehabilitat ion of injured. Not developed and the concept of psychological safety, which could be constructed legislat ion on this issue.

There is another mental condit ion arising from exposure to sometimes not covered under any threat or under decept ion. We are talking about states result ing frompsychophysical and psycho paranormal influences. This so-called state-managed (hypnotic) and subst ituted (zombie) consciousness, which are increasingly becoming thesubject of public attent ion, including the media.
