3. IDENTIFICATION OF THE RIGHT THAT HAS BEEN INFRINGED

The local rights holders referred to In Annexure A (the "affected rights holders") are "qualified

persons' as defined in section {3)1 of the Copyright Act ga of 1978 (the ·Copyright Act") and either

(i) own the copyright in the sound recordings described in Annexure A (the "affected

recordings"); alternatively

(ii) have been granted the exclusive righ t by the owners of the copyright to use and to sub-license

the use of the copyright in the affected recordings to third parties in the Republic of South

Africa.

In terms of section 9 of the Copyright Act, these rights confer the exclusive right on the affected rights

holders to:

(a) make a record embodying the affected recording, whether directly Of indirectly;

(b) lel, offer or expose for hire by way of trade a reproduction of the affected recording, whether directly

or indirectly;

(c) broadcasllhe affected recording;

(d) cause the affected recording to be transmitted in a diffusion service, unless that service transmits a

lawful broadcast (including the affected record ing) and is operated by the Original broadcaster; and

(e) communicate the affected recording to the public.

4. THE MATERIAL OR ACTIVITY THAT IS THE SUBJECT OF UNLAWFUL ACTIVITY

Section 32(1) of the Copyright Act states that:

"Copyright shall be infringed by any person, not being the owner of the copyright, who, without Ine

licence of such owner, does or causes any other person to do, in the Republic, any act which the owner

has the exclusive right to do or authorise.'
