WHEREAS it is enacted, inter cilia, by section 2 ofthe Suitors' Fund Act, 1964, that the Act shall comeinto operation on a date to be fixed by Proclama-tion, and that it shall not be necessary to proclaimthat the whole Act shall come into operation onone day, but the several sections of the Act may beproclaimed to come into operation on such daysas are respectively fixed by Proclamation; andwhereas it now appears to me desirable and ex-pedient that sections 8 to 17, inclusive, of the saidAct shall come into operation: Now, therefore I,the Lieutenant-Governor, acting with the adviceand consent of the Executive Council, do hereby fixthe 2nd day of August, 1965, as the day on whichsections 8 to 17, inclusive, of the Suitors' Fund Act,1964, shall come into operation.

AT a meeting of the Executive Council held inthe Executive Council Chamber, at Perth, this 7thday of July, 1965, the following Orders in Councilwere authorised to be issued:

Land Act, 1933-1963.ORDER IN COUNCIL.

WHEREAS by section 33 of the Land Act, 1933-1963, it is made lawful for the Governor to directthat any reserve shall vest in and be held by any

municipality, body corporate, or other person orpersons to be named in the order in trust for thelike or other public purposes to be specified insuch order; and whereas it is deemed expedientas follows:—

Corres. 2251/60.—That Reserve No. 27465 (Kala-munda Lot 468) should vest in and be held by theShire of Kalamunda in trust for the purpose ofRecreation (excluding use of the land for PublicCamping and Caravan Park).

M.W.S. 60803/65.WHEREAS by section 7 (a) of the MetropolitanWater Supply, Sewerage and Drainage Act, 1909-1963, it is provided that the Governor may, byOrder in Council, alter or extend the boundariesof the Metropolitan Water, Sewerage and Drain-age Area, or of any District, or Metropolitan MainDrainage District; and whereas it is desirable thatthe boundaries of the Metropolitan Main Drain-age District No. 1 as at present defined shouldbe extended: Now, therefore, His Excellency theLieutenant-Governor, by and with the advice andconsent of the Executive Council and in exerciseof the powers conferred by the said Act, dothhereby order and declare as follows:

In accordance with the provisions of the Metro-politan Water Supply, Sewerage and DrainageAct, 1909-1963, it is hereby notified that all landsituated within such portions of Metropolitan MainDrainage District No. 1, as extended by this Orderin Council, shall be rated for Metropolitan MainDrainage as from the 1st day of July, 1965.

M.W.S. 806931/65.WHEREAS by the Metropolitan Water Supply,Sewerage and Drainage Act, 1909-1963, it is pro-vided that, subject to the provisions of the Act,the Metropolitan Water Supply, Sewerage andDrainage Board shall, with the approval of theGovernor, have power to construct, provide andextend Water Works, Sewerage Works and Metro-politan Main Drainage Works; and whereas thepreliminary requirements of the said Act havebeen complied with, and plans, sections andestimates in respect of the works hereinaftermentioned have been submitted to and approvedby the Lieutenant-Governor in Council: Now,therefore, His Excellency the Lieutenant-Governor,with the advice and consent of the ExecutiveCouncil, does hereby empower the MetropolitanWater Supply, Sewerage and Drainage Board toundertake the construction of the following worksunder the said Act, namely:

P.W.W.S. 1059/61, M.W.S. 60891/65.WHEREAS by section 8 of the Country AreasWater Supply Act, 1947-1964, and by section 7 ofthe Metropolitan Water Supply, Sewerage andDrainage Act, 1909-1963, it is enacted that theGovernor may, by Order in Council, from time totime alter or extend the boundaries of a countrywater area and of the Metropolitan Water, Sewer-age and Drainage Area, or of any District thereof;and whereas it is desirable to alter the boundariesof the said areas and of the Metropolitan Waterand Sewerage District, as hereinafter described:Now, therefore, the Lieutenant-Governor, by andwith the advice and consent of the Executive Coun-cil, and in exercise of the powers conferred by thesaid Acts, doth hereby order and declare as fol-lows:—

That the boundaries of the Goldfields andAgricultural Country Water Area are herebyaltered by excising therefrom, and that theboundaries of the Metropolitan Water, Sewer-age and Drainage Area and of the Metropoli-tan Water, Sewerage District are herebyextended by adding thereto, the land describedin the schedule hereto.

shall submit plans, descriptions, books of referenceand estimates of the proposed works to the Gov-ernor for approval; and that if they are approvedthe Governor may forthwith, by Order in Council,empower the Minister to undertake constructionof the proposed works: Now, therefore, His Excel-lency the Lieutenant-Governor, by and with theconsent of the Executive Council, doth herebyapprove of the plans, descriptions, books of refer-ence and estimates marked on Plan P.W.D., W.A.41723, for the construction of the Yealerin g Exten-sion and Reticulation of the Great Southern TownsWater Supply and hereby empowers the Ministerto undertake the construction of the said works.

Local Government Act, 1960.ORDER IN COUNCIL.

Corres. 2388/65 (R1280).WHEREAS by section 288 of the Local Govern-ment Act, 1960, it shall be lawful for the Governor,on request of the Council, by notice in the Gov-ernment Gazette, to declare any lands reserved, oracquired, for use by the public or used by thepublic as a street, way, public place, bridge, orthoroughfare, under the care, control and man-agement of a Council, or lands comprised in aprivate street, constructed and maintained to thesatisfaction of a Council as a public street, andif the Council thinks fit, that the Governor shalldeclare the width of the carriage way and foot-paths of the public street; and whereas the Townof Albany has requested that certain lands namedand described in the schedule hereunder, whichhave been reserved for a street within the Townof Albany be declared a public street: Now, there-fore, His Excellency the Lieutenant-Governor, byand with the advice and consent of the ExecutiveCouncil, doth hereby declare the said lands tobe a public street, and such lands shall, from thedate of this order, be absolutely dedicated to thepublic as a street within the meaning of any lawnow or hereafter in force.

Workers' Compensation Act, 1912-1964.

ORDER IN COUNCIL.

WHEREAS it is enacted, inter alia, by section 13of the Workers' Compensation Act, 1912-1964, thatit shall be obligatory for every employer to obtainfrom an incorporated insurance office approvedby the Minister a policy of insurance for the fullamount of the liability to pay compensation underthe Act to all workers employed by him, but thatif an employer proves to the satisfaction of theMinister that such employer has established afund for insurance against such liability and hasdeposited at the Treasury securities charged withall payments to become due under such liability,the Governor may, by Order in Council, exemptsuch employer from the operation of that section;and whereas Australian Iron & Steel Pty. Limited,a company incorporated in the State of New SouthWales, having its registered office in the State ofWestern Australia at T. & G. Building, 37 St.George's Terrace, Perth, being an employer withinthe meaning of the section has, duly, in accord-ance with the Act and the regulations made there-under, made application for exemption from theoperation of the section, and has satisfied theMinister that it has established a fund for insur-ance against the said liability, and has depositedat the Treasury a security, to wit, a bond for£5,000, charged with all payments to become dueunder the said liability: Now, therefore, His Excel-lency the Lieutenant-Governor, acting with theadvice and consent of the Executive Council andin exercise of the powers conferred by the Act,doth hereby exempt Australian Iron & Steel Pty.Limited from the operation of section 13 of theWorkers' Compensation Act, 1912-1964, for a periodterminating on the 25th day of January, 1957.

APPLICATIONS are invited, under section 116 ofthe Land Act, 1933-1963, for leasing Swan Loca-tion 5283 for the purpose of a "tractor testingground," for a term of 21 years and subject tothe following conditions:

(a) The commencing rental shall be nine hun-dred pounds (£900) per annum.

(b) The rental shall be subject to review atintervals of five (5) years during the termof the lease.

(c) The land shall be used for the specificpurpose within three months of com-mencement of the lease and so used con-tinuously thereafter to the satisfaction ofthe Minister for Lands or his represen-tative.

(d) The lease shall become forfeitable if theland is not so used for a longer periodthan three months at any time during theterm of the lease.

(e) The Shire of Kalamunda shall have theright to excavate and take sand andgravel from the existing pits on the re-serve, compatible with the effective opera-tion of the lease. In the event of dispute,the Minister for Lands or his representa-tive shall be the arbiter.

(f) The lessee shall take all reasonable stepsas required by the Shire of Kalamundato control noise and dust, in particular theplanting of quick growing trees, and theeffective silencing of machines under test.

(g) Native flora shall not be destroyed unlesssuch destruction is necessary for use ofthe demised land for the purpose of thelease.

(vii) The lease shall be forfeited if the lesseeceases to operate for any period in excessof three months.

Metropolitan Region Town Planning Scheme—Mitchell Freeway

NOTICE is hereby given, and it is hereby declared, that the piece or parcel of land described in the Schedule hereto—beingin the Perth Town District—have, in pursuance of the written consent under the Town Planning and Development Act,1928-62 given pursuant to the powers contained in the Metropolitan Region Town Planning Scheme Act, I959 and declarationunder the Public Works Act, 1902-196I, of His Excellency the Lieutenant-Governor, acting by and with the advice of theExecutive Council, dated the 7th day of July, 1965, been compulsorily taken and set apart for the purposes of the followingpublic work, namely :—Metropolitan Region Town Planning Scheme—Mitchell Freeway.

And further notice is hereby given that the said piece or parcel of land so taken and set apart is shown marked off onPlan P.W.D., W.A. 42009, which may be inspected at the Office of the Minister for Works, Perth.

And it is hereby directed that the said land shall vest in the Metropolitan Region Planning Authority for an estate infee simple in possession for the public work herein expressed, freed and discharged from all trusts, mortgages, charges, obliga-tions, estates, interests, rights-of-way, or other easements whatsoever.
