PART 1—PRELIMINARY

101. Objectives

The main objectives of these Regulations are—

(a) to incorporate into the law of Victoria, as the Road Rules—Victoria, a modified version of the Australian Road Rules1;

(b) to establish rules to be observed by road users in matters not otherwise dealt with in the Road Rules;

(c) to revoke the Road Safety (Traffic) Regulations 1988 and certain other Regulations relating to traffic regulation;

(d) to provide for the installation, operation and maintenance of traffic control items;

(e) to make consequential amendments to various Regulations made under the Road Safety Act 1986 because of the introduction of the Road Rules.

102. Authorising provision

These Regulations are made under section 95 of the Road Safety Act 1986.

103. Commencement

These Regulations come into operation on 1 December 1999.

104. Revocation

The Regulations set out in Schedule 1 are revoked.

105. Definitions

(1) In these Regulations—

"Act" means the Road Safety Act 1986;

"AS 1742.11" means Australian Standard AS 1742.11 Manual of Uniform Traffic Control Devices: Part 11 Parking controls;

"bicycle carrier" means a device that can be attached to the rear of a motor vehicle to enable one or more bicycles to be carried by the vehicle, but does not include a trailer;

"Council" has the same meaning as in the Local Government Act 1989;

"event" means—

(a) a bicycle race; or

(b) a foot race; or

(c) a similar activity—

involving more than 30 competitors, but does not include speed trials within the meaning of section 68 of the Act;

"Extension corporation" has the same meaning as in the Melbourne City Link Act 1995;

"Extension road" has the same meaning as in the Melbourne City Link Act 1995;

"forest road" has the same meaning as in the Transport Act 1983;

"freeway" has the same meaning as in the Transport Act 1983;

"highway collection" means a collection of contributions by people who stand on or who move onto a road to solicit contributions from the occupants of vehicles that are stopped in compliance with traffic signals;

"Link corporation" has the same meaning as in the Melbourne City Link Act 1995;

"Link road" has the same meaning as in the Melbourne City Link Act 1995;

"main road" has the same meaning as in the Transport Act 1983;

"major traffic control item" means a traffic control item specified in Schedule 2;

"minor traffic control item" means a traffic control item other than a major traffic control item;

"municipal district" has the same meaning as in the Local Government Act 1989;

"road hump" means a section of raised pavement constructed or placed in or on and across or partly across a road to restrict the speed of vehicles along that road;

"Road Rules" or "RR" means the Road Rules—Victoria published in the Government Gazette (Periodical Gazette No. 2) on 28 October 1999, as those Rules have effect for the purposes of regulation 201(1);

"sign" means any mark or device, other than a traffic signal, erected, displayed or placed for the purpose of controlling, regulating, or warning road users;

"State highway" has the same meaning as in the Transport Act 1983;

"tourists' road" has the same meaning as in the

Transport Act 1983;

"traffic control item" means

(a) a sign; or

(b) a traffic signal; or

(c) a structure; or

(d) a device—

erected, displayed or placed for the purpose of controlling, regulating or warning road users;

"traffic signal" means any device, however operated, which uses lights or illuminated words or symbols to control, regulate or warn road users.

(2) Without limiting regulation 201(1), expressions used in these Regulations and in the Road Rules that are not defined in sub-regulation (1) or elsewhere in these Regulations have the same meanings as in the Road Rules, irrespective of any meaning that those expressions may have in the Act.

PART 2—ROAD RULES—VICTORIA

201. Incorporation of Road Rules into Victorian law

(1) The Road Rules are to be read and construed with these Regulations as if they formed part of them.

(2) Sub-regulation (1) does not make part of these Regulations anything printed with the Road Rules that those Rules expressly state not to be part of them.

(3) For the purposes of sub-regulation (1), the Road Rules have effect as if they were modified as set out in Schedule 4.

202. Application of Acts Interpretation Act 1901 of the Commonwealth

(1) The Acts Interpretation Act 1901 of the Commonwealth applies to the interpretation of the Road Rules except that—

(a) "Gazette" refers to the Victorian Government Gazette; and

(b) "Minister" refers to the responsible Minister of Victoria.

(2) This regulation does not prevent the Interpretation of Legislation Act 1984 from applying to the Road Rules to the extent that it can

do so consistently with the application of the Acts Interpretation Act 1901 of the Commonwealth.

PART 3—INSTALLATION OF TRAFFIC CONTROL ITEMS

301. Erection, installation of and interference with traffic

control item

(1) Subject to these Regulations, a person must not erect, display, place, maintain, interfere with, alter, deface or remove a traffic control item that is—

(a) on a road; or

(b) in the view of any person on a road.

Penalty: 6 penalty units.

(2) A person must not erect, display, place or maintain on a road, or in the view of a person on a road, anything which—

(a) purports to be, or is an imitation of, or is similar to, a traffic control item; or

(b) interferes with the effectiveness of a traffic control item; or

(c) prevents an approaching driver or other road user from clearly distinguishing the whole or any part of a traffic control item; or

(d) is intended to distract a driver or other road user's attention from a traffic control item.

Penalty: 6 penalty units.

302. Prohibition on erection of certain traffic control items after the commencement of Regulations

(1) A person must not, on or after the commencement of these Regulations, erect, display or place—

(a) on a road; or

(b) in the view of any person on a road—

a traffic control item specified in Schedule 3.

Penalty: 6 penalty units.

(2) A traffic control item specified in Schedule 3 that was erected, displayed or placed on a road or in the view of any person on a road before the commencement of these Regulations has effect and operates as a traffic control item for the purposes of the Road Rules.

303. Power of Corporation to erect traffic control items and signs for the purpose of traffic regulation

(1) The Corporation may, on a freeway, erect, establish, display, maintain or remove a traffic control item.

(2) The Corporation may, on a State highway, tourists' road, forest road or main road, erect, establish, display, maintain or remove a traffic control item other than a traffic control item that is—

(a) for the control of stopping or parking in accordance with Part 12 of the Road Rules; or

(b) associated with a children's crossing or a pedestrian crossing.

(3) Subject to regulation 303A, the Corporation may, on a road other than a declared road, erect, establish, display, maintain, or remove a traffic control item that is a reasonable likeness of one of the following diagrams—

(a) an Area speed-limit sign in Schedule 2 to the Road Rules;

(b) an End area speed-limit sign in Schedule 2 to the Road Rules;

(c) an End school zone sign in Schedule 2 to the Road Rules;

(d) an End shared zone sign at the end of rule 24 of the Road Rules;

(e) an End speed-limit sign in Schedule 2 to the Road Rules;

(f) a School zone sign in Schedule 2 to the Road Rules;

(g) a Shared zone sign in Schedule 2 to the Road Rules;

(h) a Speed-limit sign (Standard sign) in Schedule 2 to the Road Rules.

303A. Corporation to consult before erecting certain traffic control items on local roads

(1) If the Corporation proposes to exercise a power under regulation 303(3) to erect, establish or display a traffic control item of a kind referred to in regulation 303(3)(a) to (h), the Corporation must notify, in writing, the Council in whose municipal district the traffic control item is proposed to be erected, established or displayed.

(2) A Council that is notified under sub-regulation (1) of a proposal, has 21 days within which it may disagree, in writing, with the proposal.

(3) If, within the period referred to in sub-regulation (2), a Council disagrees with a proposal and the Corporation intends to proceed with the proposal, the Corporation must publish a notice in a daily newspaper circulating generally in the State, of its intention to do so.

(4) A notice under sub-regulation (3) must—

(a) set out the details of the Corporation's proposal and the reasons for the proposal; and

(b) include a statement to the effect that the relevant Council has disagreed with the Corporation's proposal; and

(c) specify where a copy of the Corporation's proposal can be obtained; and

(d) invite public comments and submissions on the proposal within 21 days of the date of publication of the notice.

(5) A person who intends to make a comment or submission on the proposal must make the comment or submission in writing to the Corporation.

(6) The Corporation must consider every comment and submission it receives on the proposal.

(7) The Corporation, as soon as practicable after making a decision on whether to proceed with the proposal, must publish notice of the decision in a daily newspaper circulating generally in the State.

304. Power of Councils to erect traffic control items and signs for the purpose of traffic regulation

A Council may, on a State highway, a main road, a tourists' road or a forest road within its municipal district, erect, establish, display, maintain or remove—

(a) a minor traffic control item that is for the control of stopping or parking in accordance with Part 12 of the Road Rules; or

(b) with the written consent of the Corporation

(and subject to compliance with any conditions imposed by it in giving its consent), any other minor traffic control item or a major traffic control item.

305. Power of Link corporation and Extension corporation to erect traffic control items

(1) The Link corporation may, on the Link road, erect establish, display, maintain or remove—

(a) with the written consent of the Corporation (and subject to compliance with any conditions imposed by it in giving its consent), a major traffic control item; or

(b) a minor traffic control item.

(2) The Extension corporation may, on the Extension road, erect, establish, display, maintain or remove—

(a) with the written consent of the Corporation (and subject to compliance with any conditions imposed by it in giving its consent), a major traffic control item; or

(b) a minor traffic control item.

306. Erection of traffic control items by other persons

A person responsible for the care and management of a road, other than a freeway, State highway,

main road, tourists' road or forest road, may erect, establish, display, maintain or remove on that road—

(a) with the written consent of the Corporation (and subject to compliance with any conditions imposed by it in giving its consent), a major traffic control item; or

(b) a minor traffic control item.

307. Certain traffic control items must conform with Australian Standard

A traffic control item erected, established, displayed or maintained under this Part that is a sign for the control of stopping or parking in accordance with Part 12 of the Road Rules must conform with AS 1742.11.

308. Police may erect signs

(1) A police officer, if it is reasonably necessary to do so, may erect, establish, display and maintain, or cause to be erected, established, displayed and maintained, for a period of not more than 7 days a traffic control item that is a sign of the kind referred to in the Road Rules other than a sign set out in Schedule 3 of the Road Rules.

(2) A sign erected in accordance with sub-regulation (1) operates and has effect despite any information to the contrary on any other sign.

309. Information on signs

(1) A sign that is erected, established, displayed or maintained by a relevant road authority or a police

officer under this Part may, by the use of words, figures, symbols or anything else, indicate any of the following—

(a) the times, days or circumstances when it applies or does not apply;

(b) the lengths of road or areas where it applies or does not apply;

(c) the persons to whom it applies or does not apply;

(d) the vehicles to which it applies or does not apply;

(e) other information.

(2) In this regulation—

"relevant road authority" means—

(a) the Council, public authority or other person legally responsible for the care and management of the road; or

(b) if the Corporation is so responsible, the Council in whose municipal district the road is situated; or

(c) in respect of the Link road, the Link corporation; or

(d) in respect of the Extension road, the Extension corporation.

310. Maintenance of traffic control items and traffic

signals

(1) A person who erects, establishes, displays a traffic control item in accordance with these Regulations may maintain or alter that item.

(2) Subject to sub-regulation (3), a person who has erected, established or displayed a traffic control item in accordance with the Road Safety (Traffic) Regulations 1988 may maintain or alter that item.

(3) A person must not alter a traffic signal without the written consent of the Corporation.

Penalty: 5 penalty units.

311. Manual operation of traffic signals

A police officer or an authorised person of the Corporation may, for the purpose of traffic control, manually operate a traffic signal.

312. Commercial advertising prohibited on traffic control items

(1) A person must not erect, establish, display or maintain on a road a traffic control item bearing a commercial advertisement.

Penalty: 5 penalty units.

(2) For the purposes of sub-regulation (1) the insignia of a non-commercial organisation is not a

commercial advertisement.

PART 4—ACTIVITIES ON ROADS

401. Obstructing roads

(1) A person must not drive or stop a vehicle on a road—

(a) to solicit employment or business from the vehicle; or

(b) to offer articles for sale from the vehicle—

if it results in, or is likely to result in, a concentration, standing or movement of vehicles or persons which causes, or is likely to cause, a danger or traffic congestion.

Penalty: 2 penalty units.

(2) A person must not stand on, or move onto, a road to—

(a) solicit contributions, employment or business from an occupant of a vehicle; or

(b) hitchhike; or

(c) display an advertisement; or

(d) sell or offer articles for sale; or

(e) offer to wash or clean, or wash or clean, the windscreen of a vehicle.

Penalty: 2 penalty units.

(3) A person in a vehicle must not buy, or offer to buy, an article from a person standing on a road.

Penalty: 2 penalty units.

(4) In this regulation, "road" includes any shoulder of the road but does not include a road related area.

402. Processions

(1) A person must not drive a vehicle on a road in an organised procession (other than a funeral procession) or a parade except with, and in accordance with, the permission of the relevant road authority.

Penalty: 2 penalty units.

(2) In this regulation—

"relevant road authority" means—

(a) the Council, public authority or other person legally responsible for the care and management of the road; or

(b) if the Corporation is so responsible, the Council in whose municipal district the road is situated; or

(c) in respect of the Link road, the Link corporation; or

(d) in respect of the Extension road, the Extension corporation.

403. Notice to be given and permission obtained for races and other events

(1) A person must not hold, or cause or permit to be held, or take part in, an event on a road unless the event is being held with, and in accordance with, the permission of the Chief Commissioner of

Police.

Penalty: 1 penalty unit.

(2) A person intending to conduct an event or series of events must make a written application to hold the event or events to the Chief Commissioner of Police at least 2 months before the date on which the event or series of events is intended to be held.

(3) An application referred to in sub-regulation (2) must specify—

(a) the day or days of the event; and

(b) the approximate number of competitors to be involved; and

(c) the starting and finishing times of the event in respect of each day; and

(d) the route to be followed.

(4) Following receipt of an application referred to in sub-regulation (2), the Chief Commissioner of Police may—

(a) give written permission to hold the event or events; and

(b) in giving permission require compliance with such conditions as he or she thinks are appropriate; and

(c) vary any arrangements for the conduct of the event or events as he or she thinks fit.

404. Events at night

A person must not hold, or cause or permit to be held, or take part in, an event on a road between sunset and sunrise unless permission given by the Chief Commissioner of Police under regulation 403 in respect of that event specifically provides that the event may be held at that time.

Penalty: 2 penalty units.

405. Exemptions for races and other events

(1) Rules 151, 234, 238 and 256 of the Road Rules do not apply to a competitor taking part in an event for which permission has been given under regulation 403.

(2) Except as provided by sub-regulation (1), permission to hold an event does not confer any special privilege, power or right on any marshal, official or competitor participating in the event or exempt such a person from complying with the Transport Act 1983, the Act or these Regulations.

406. Notice to be given and permission obtained for highway collections

(1) A person must not hold, or cause or permit to be held, or take part in, a highway collection unless the collection is being held with, and in

accordance with, the permission of the Chief Commissioner of Police.

Penalty: 1 penalty unit.

(2) A person intending to hold a highway collection must make a written application to hold the collection to the Chief Commissioner of Police at least 1 month prior to the date on which the collection is intended to be held.

(3) An application referred to in sub-regulation (2) must specify—

(a) the organisation or purpose that is intended to be benefited by contributions collected by the highway collection; and

(b) the date and time when the collection is intended to be held; and

(c) the locations where the collection is intended to be held; and

(d) the approximate number of people involved in the collection.

(4) Following receipt of an application made in accordance with sub-regulation (2), the Chief Commissioner of Police may—

(a) give written permission to hold the highway collection; and

(b) in giving permission, require compliance with such conditions as he or she thinks are appropriate; and

(c) vary any arrangements for the conduct of the collection as he or she thinks fit.

407. No highway collections at night

A person must not hold, or cause or permit to be held, or take part in, a highway collection between sunset and sunrise.

Penalty: 2 penalty units.

408. Exemptions for highway collections

(1) Subject to sub-regulation (2), a person who takes part in a highway collection held with the written permission of the Commissioner of Police does not have to comply with—

(a) rules 230(1) and 234 of the Road Rules; and

(b) regulation 401(2) (in so far as it relates to persons soliciting contributions on a road)—

if the person observes the conditions imposed by the written permission.

(2) A person taking part in a highway collection must obey any reasonable instructions given by a police officer.

(3) Except as provided by sub-regulation (1), permission to hold a collection does not confer any special privilege, power or right on a person participating in a highway collection or exempt such a person from complying with the Fundraising Appeals Act 1998, the Act or these Regulations.

PART 5—STOCK ON ROADS

501. Definitions

(1) In this Part—

"animal under control" means an animal on a road—

(a) in accordance with the provisions of a permit issued by a Council; or

(b) being moved within a municipal district in circumstances such that a local law provides that a permit is not required;

"temporary stock crossing site" means a place at which animals under control cross a road less than 52 times in any 12 month period.

(2) For the purposes of this Part a sign is to be taken to be similar to Diagram 1 or 2 set out in regulation 502 despite—

(a) the use of a reference to a particular kind of animal in place of the word "stock"; and

(b) the use of a picture of that kind of animal in place of the pictures of a cow and a sheep.

(3) For the purposes of this Part a sign is taken to be similar to Diagram 1 set out in regulation 502 despite the use of a different number in place of the number 5 and the use of the letter "m" (meaning metres) instead of the letters "km" (meaning kilometres).

502. Giving way to stock

(1) If a sign similar to Diagram 1 set out in this regulation is erected, established, displayed or

placed on a road to face the drivers of approaching vehicles, a driver of such a vehicle who passes the sign must take such action as is reasonably necessary to avoid a collision with any animal under control within the distance shown on the sign.

Penalty: 5 penalty units

BLACK: Cow, sheep and words.

WHITE: Background.

(2) If a sign similar to Diagram 2 set out in this regulation is erected, established, displayed or placed on a road to face the drivers of approaching vehicles, a driver of such a vehicle who is approaching or passes the sign must take such action as is reasonably necessary to avoid a collision with any animal under control at or near the sign.

Penalty: 5 penalty units.

503. Requirement to travel at a safe speed

A driver of a vehicle to whom regulation 502(1) or (2) applies must travel at a speed that would enable the driver to stop the vehicle safely if an animal under control were to move into the path of the vehicle.

Penalty: 5 penalty units.

504. Requirement to stop at a stock crossing

If a driver of a vehicle comes to a sign similar to Diagram 3 in this regulation at a place where animals under control cross a road, the driver must stop the vehicle at a reasonable distance from that place and must not proceed while an animal is crossing at that place.

Penalty: 5 penalty units.

505. Power to erect signs

Despite regulation 301 but provided the Guidelines for the Selection of Stock Crossing

Sites, and the Placement of Signs when Stock are on Roads, as published by the Roads Corporation from time to time, are followed by the person—

(a) a person accompanying an animal under control at a temporary stock crossing site may erect, display or remove signs similar to Diagram 2 set out in regulation 502 and signs similar to Diagram 4 set out in this regulation; and

PART 6—MISCELLANEOUS

601. Horse riding helmets to be worn

(1) If a rider, or other person being carried by a horse, is under the age of 18 years, he or she must, while riding or being carried by the horse, wear a securely fitted and fastened horse riding helmet of a type approved by the Corporation.

Penalty: 2 penalty units.

(2) Sub-regulation (1) does not apply to a person who—

(a) is exempt from wearing a riding helmet under sub-regulation (3); and

(b) is carrying written evidence of that exemption; and

(c) produces that evidence to a police officer or an authorised person when asked to do so.

(3) The Corporation may, in writing, exempt a person from the requirements of sub-regulation (1).

602. Display of dazzling or distracting lights

A person must not—

(a) erect, establish, place, maintain or display a light that may prevent a driver from clearly distinguishing the road ahead; or

(b) erect, establish, place, maintain or display a light or a light of a class which the

Corporation has declared by written notice published in the Government Gazette to be a danger or distraction to drivers or other road users.

Penalty: 3 penalty units.

603. Putting destructive material etc. on roads

A person must not—

(a) throw, drop, place, leave; or

(b) cause or permit to be thrown, dropped or placed—

on a road, destructive or injurious material or a substance or thing, likely to endanger a person, animal or vehicle.

Penalty: 3 penalty units.

604. Driving in a dangerous manner

A person must not drive on a road a vehicle (other than a motor vehicle) in a careless, dangerous or reckless manner.

Penalty: 5 penalty units.

605. Vehicles must not be driven with an empty bicycle carrier attached

A person must not drive on a road a motor vehicle that has an empty bicycle carrier attached to the rear of the vehicle.

Penalty: 1 penalty unit.

606. Buses at level crossings

(1) In addition to complying with Part 10 of the Road Rules, the driver of a bus must—

(a) on approaching a railway level crossing, stop the bus so that the nearest part of the bus is not less than 3 nor more than 12 metres from the nearest rail of the railway; and

(b) when proceeding across the railway level crossing, do so in a manner which avoids the need to change gear until the bus has completely cleared the railway.

Penalty: 5 penalty units.

(2) Sub-regulation (1) does not apply to a railway level crossing at which there are—

(a) gates, booms or barriers; or

(b) twin red lights.

701. Definition

In regulation 105(1) of the Road Safety (Vehicles) Regulations 19992, after the definition of "retractable axle" insert—

' "Road Rules" means the Road Rules within the meaning of the Road Safety (Road Rules) Regulations 1999;'.

702. Offence for travel by vehicle where posted mass or dimension limit would be exceeded

In regulation 808 of the Road Safety (Vehicles) Regulations 1999, for "(other than a no trucks sign referred to in regulation 402(27) of the Road Safety (Traffic) Regulations 1988)" substitute "(other than a no trucks sign referred to in rule 104 or a no buses sign referred to in rule 106 of the Road Rules)".

703. Revocation of provisions which overlap with Road Rules

Regulations 811, 812, 813, 814, 815, 817, 818(1) and (2) of the Road Safety (Vehicles) Regulations 1999 are revoked.

In regulation 703 of the Road Safety (General) Regulations 1999, for paragraph (c) substitute—

"(c) an offence is a prescribed offence if it is—

(i) committed on land or premises which are vested in or under the control of the public authority or person concerned and is—

(A) an offence under the Road Safety (Road Rules) Regulations 1999; or

(B) an offence under Division 1, 2, 3, 4 or 5 of Part 2, Part 4, Part 5 or Part 8 of the Road Safety (Vehicles) Regulations 1999; or

PARKING INFRINGEMENTS

1. In this Schedule—

(a) expressions used in this Schedule that are defined in the dictionary at the end of the Road Rules have the same meaning in this Schedule as in those Rules;

(b) "parking infringement" does not include a parking infringement constituted by a contravention of section 90E of the Act.

2. A $20 infringement penalty is prescribed for parking infringements arising from a vehicle being parked in a parking area—

(a) contrary to RR 205 (Parking for longer than indicated); or

(b) contrary to RR 207 (Parking where fees are payable); or

unless clause 4 or 6 of this Schedule applies to the parking infringement.

3. A $20 infringement penalty is prescribed for parking infringements arising from a vehicle being stopped contrary to RR 168(1) (No parking signs) unless clause 4 or 6 of this Schedule applies to the infringement.

4. A $60 infringement penalty is prescribed for parking infringements arising from a vehicle—

(a) being stopped contrary to—

(i) RR 173 (Stopping on or near a marked foot crossing (except at an intersection)); or

(ii) RR 174 (Stopping on or near bicycle crossing lights (except at an intersection)); or

(iii) RR 179 (Stopping in a loading zone); or

(iv) RR 180 (Stopping in a truck zone); or

(v) RR 181 (Stopping in a works zone); or

(vi) RR 182 (Stopping in a taxi zone); or

(vii) RR 183 (Stopping in a bus zone); or

(i) RR 167 (No stopping signs); or

(ii) RR 171 (Stopping at or near a children's crossing); or

(iii) RR 172 (Stopping on or near a pedestrian crossing (except at an intersection)); or

801. Infringement notices relating to revoked regulations

(1) If a parking infringement is committed against the Road Safety (Traffic) Regulations 1988 before the substitution of Schedule 3 to the Road Safety (General) Regulations 1999 by regulation 712, a parking infringement notice may be served in accordance with the Road Safety (General) Regulations 1999 for that parking infringement as if that Schedule had not been substituted.

(2) If a traffic infringement is committed against the Road Safety (Vehicles) Regulations 1999 before the substitution of Schedule 4 to the Road Safety (General) Regulations 1999 by regulation 712, a traffic infringement notice may be issued or served in accordance with the Road Safety (General) Regulations 1999 for that traffic infringement as if that Schedule had not been substituted.

(3) If a traffic infringement is committed against the Road Safety (Traffic) Regulations 1988 before the substitution of Schedule 4 to the Road Safety (General) Regulations 1999 by regulation 712, a traffic infringement notice may be issued or served in accordance with the Road Safety (General) Regulations 1999 for that traffic infringement as if that Schedule had not been substituted.

(4) The substitution of Schedule 3 to the Road Safety (General) Regulations 1999 by regulation 712 does not affect a parking infringement notice served in accordance with the Road Safety

(General) Regulations 1999 for a parking infringement committed against—

(a) the Road Safety (Traffic) Regulations 1988; or

(b) any regulation or local law under the Local Government Act 1989; or

(c) any other Act, rule, regulation or by-law that provides for such infringements—

before the substitution of that Schedule.

(5) The substitution of Schedule 4 to the Road Safety (General) Regulations 1999 by regulation 712 does not affect a traffic infringement notice issued or served in accordance with the Road Safety (General) Regulations 1999 for a traffic infringement committed against—

(a) the Road Safety (Traffic) Regulations 1988; or

(b) regulations 811, 812, 813, 814 or 815 of the Road Safety (Vehicles) Regulations 1999—

before the substitution of that Schedule.

(6) Without limiting sub-regulations (1), (2), (3), (4) and (5)—

(a) a notice referred to in those sub-regulations may be withdrawn; and

(b) the penalty shown is payable; and

(c) the procedures set out in Schedule 7 to the Magistrates' Court Act 1989 may be used for the enforcement of the amount payable—

as if Schedules 3 and 4 to the Road Safety (General) Regulations 1999 had not been substituted by regulation 712.

802. No change to demerit points already recorded against a person

(1) The substitution of Table 301 at the end of regulation 301 of the Road Safety (Drivers) Regulations 1999 by regulation 706(5) does not alter the number of demerit points incurred in relation to a relevant offence committed by a person and recorded, or liable to be recorded, in the Demerits Register against the person by the Corporation before the commencement of that regulation.

(2) In this regulation, "relevant offence" has the same meaning as in regulation 301(1) of the Road Safety (Drivers) Regulations 1999.

Regulation 201

MODIFICATION OF ROAD RULES

1. Rule 179(1) of the Road Rules is to be read as if for paragraph (a) there were substituted—

"(a) a public passenger vehicle, taxi or other commercial passenger vehicle licensed under the Transport Act 1983 that is dropping off, or picking up, passengers or goods; or".

2. Rule 306(b) of the Road Rules is to be read as if after "displaying a" there were inserted "magenta,".

3. Rule 307(3) of the Road Rules is to be read as if after paragraph (b) there were inserted—

"; and

(c) an inspector appointed under section 38 of the Occupational Health and Safety Act 1985.".

4. In the dictionary at the end of the Road Rules, the definition of "taxi" is to be read as if after "has the" there were inserted "same".

5. In rule 25(2) of the Road Rules, the reference to 60 kilometres per hour is to be read as a reference to 50 kilometres per hour.

6. Rule 20 of the Road Rules is to be read as if for the penalty at the foot of the rule there were substituted—

in the case of drivers of vehicles other than large vehicles, 10 penalty units.".

7. Rule 213 of the Road Rules is to be read as if after subrule (4) there were inserted—

"(5) Subrule (3)(a) and (4) do not apply to the driver of a vehicle acting in accordance with an exemption from the application of those subrules granted by the Corporation under subrule (6).

(6) The Corporation may exempt a driver of a vehicle or class of vehicles from the requirements of subrule (3)(a) and (4) subject to any conditions the Corporation thinks fit.".

1. General Information

The Road Safety (Road Rules) Regulations 1999, S.R. No. 120/1999 were made on 9 November 1999 by the Governor in Council under section 95 of the Road Safety Act 1986, No. 127/1986 and came into operation on 1 December 1999: regulation 103.

The Road Safety (Road Rules) Regulations 1999 will sunset 10 years after the day of making on 9 November 2009 (see section 5 of the Subordinate Legislation Act 1994).
