    Road Trac Ac 1994 (WVW 1994)

    1 Trac Conduc

    1.1Rules o Conduc

    Article 5

    I is an oence or any road user o ac in such manner

    as o cause a hazard (or a poenial hazard) on he public

    highway or o obsruc oher road users in any way.

    Article 6

    All paricipans in rac are orbidden o behave in

    such a way ha a rac acciden atribuable o hem

    occurs in which anoher person is killed or susains

    serious physical injury or physical injury such ha

    emporary illness occurs or ha person is prevened

    rom engaging in normal aciviy.

    Article 7

    1 I is an oence or any person involved in a road

    acciden o any kind o leave he scene o he

    acciden.

    2 Persons are only permited o leave he scene oan acciden as soon as:

    a. he opporuniy has arisen o esablish he

    ideniy o he person or persons involved;

    b. he opporuniy has arisen o esablish he

    ideniy o he moor vehicle involved;

    c. i is clear ha no person or persons susaining

    injuries in he acciden has or have been le ahe scene o he acciden in need o reamen.

    Article 8

    1 I is expressly orbidden o drive or allow a driver

    o operae a moor vehicle, when he is under he

    infuence o a subsance, wheher used alone or incombinaion wih anoher subsance, which he

    knows, or should reasonably be expeced o know,

    may compromise his driving abiliy o such an

    exen ha he is no o operae a moor vehicle.

    2 I is expressly orbidden o operae a moor vehicle

    or allow a driver o operae a moor vehicle when

    one has consumed alcoholic beverages o he

    poin ha:

    a. upon analysis he alcohol level in his breah

    appears o be greaer han 220 micrograms per

    lire o exhaled breah and/or

    b. upon analysis he alcohol level in his blood

    appears o be greaer han 0.5 milligrams per

    millilire o blood.

    3 Conrary o subsecion 2 above, he driver o a

    moor vehicle which requires a drivers licence,

    should he dae o rs issue o said licence no ye

    be ve years ago and should his dae o rs issue

    have been on or aer 20 March 2002, is orbidden

    o operae or be permited o operae a moorvehicle when he has consumed alcoholic

    beverages o he poin ha:

    a. upon analysis he alcohol level in his breah

    appears o be greaer han 88 micrograms per

    lire o exhaled breah and/or

    b. upon analysis he alcohol level in his blood

    appears o be greaer han 0.2 milligrams permillilire o blood.

    o exhaled air, or

    b.his or her blood is shown in a es o conain

    more han 0.2 milligrams o alcohol per

    2 Trac Regulaions

    2.1Road posiioning

    Article 8

    Article 9

    Pedesrians may use he public carriageway i hey

    orm a column or i hey are aking par in a march

    Article 10

    areas:

    a. or moor vehicles: 50 km/h;

    b. or mopeds and vehicles or he disabled,

    equipped wih an engine:

    1 on a bicycle pah and/or bicycle/moped pah:

    30 km/h

    2 on he road: 45 km/h

    c. or vehicles or he disabled, equipped wih anengine, on he pavemen or oopah: 6 km/h.

    Article 21

    Elsewhere he ollowing speed limis apply:

    a. or moor vehicles on moorways 120 km/h, on

    main roads 100 km/h and on all oher roads

    80 km/h;

    b. or mopeds and vehicles or he disabled,equipped wih an engine:

    maximum weigh exceeds 3500 kg, lorries and

    buses oher han T100 buses, 80 km/h;

    b. or moor vehicles wih railers, 80 km/h;

    c. or agriculural or oresry racors and moor

    vehicles wih limied speed, as indicaed in

    Aricle 1.1 o he Regulaions, 25 km/h;

    d. or microcars, 45 km/h;

    e. or moor-assised bicycles, 25 km/h.

    2 Conrary o he rs par, secion b, moor vehicles

    oher han hose indicaed in he rs par,

    secions a and c, pulling a railer wih a permited

    maximum weigh no exceeding 3500 kg on

    is o allow passengers o board or o aligh;

    g. on a road marked wih a coninuous yellow line.

    ParkingArticle 24

    1 Drivers may no park heir vehicles:

    a. On, or a a disance o less han ve meres rom,

    a road juncion;

    b. in ron o enrances/exis;

    c. direcly on he carriageway o a major roadouside a buil-up area;

    3 on days or a imes when parking is shown on

    he ocial parking noice o be prohibied;

    e. on a road marked wih a coninuous yellow line;

    . wihin an area specically designaed or he

    loading or unloading o goods;

    g. in parking bays reserved or permi-holders as

    shown by he sign E9, unless hey hemselves

    have such a permi or he bays in quesion.

    2.11Parking bicycles and mopeds

    Article 27Bicycles and mopeds may be parked on he

    pavemen, on oopahs, a he side o he road

    or wherever an ocial sign indicaes ha i is

    permited.

    2.12

    Signalling

    Article 28

    Drivers may only sound heir horns or signal wih

    heir headlamps o give warning o emergency

    siuaions.

    Article 29

    1 Drivers o moor vehicles used by police and re

    brigades, moor vehicles in use wih emergency

    medical assisance services, and moor vehicles

    o oher assisance services designaed by he

    Miniser use blue revolving, fashing or blinking

    lighs and a wo-one horn o indicae ha hey

    are perorming urgen duies.2 The drivers indicaed in he rs par may use

    fashing headlighs during he day in addiion

    o he lighs indicaed in ha par.

    3 Rules may be esablished by means o miniserial

    regulaions regarding such blue revolving, fashing

    or blinking lighs and fashing headlighs.

    Article 301 Drivers o vehicles used or work o be indicaed

    will use yellow or green revolving, fashing or

    lighs. The driver o he rs or only vehicle o reach

    he sie o perorm he assigned duies may use

    blue revolving, fashing or blinking lighs insead.

    2 Miniserial regulaions are issued o se he rules

    relaing o he use o yellow or green roaing,

    blinking or fashing lighs and he road works

    and circumsances when such signals are used.

    Article 30a

    1 Drivers o moor vehicles indicaed in Aricle 29,

    par one, may use addiional indicaors under

    circumsances o be indicaed.

    2 Rules may be esablished by miniserial regulaions

    regarding he indicaors menioned in he rs par

    and he circumsances in which hey are used.

    Article 30b

    Aricles 29 o 30a inclusive do no apply o Belgian

    and German moor vehicles in use wih police and

    re brigades, in use wih services or rs-line

    emergency assisance and moor vehicles o Belgianand German assisance services, designed in or under

    aricle 29, par one, provided such vehicles each use

    signals in accordance wih he legal regulaions

    applicable o hem in heir own counries.

    Article 31

    Signals may no be given in oher cases or by oher

    means han permited in or under he rulesesablished in he aricles included in his secion.

    2.13Using lighs while driving

    Article 321 Drivers o moor vehicles, mopeds, moor-

    assised bicycles, disabled vehicles equipped wih

    combusion engines or disabled vehicles equipped

    wih elecric moors and having enclosed bodies

    will use dimmed lighs during he day, i visibiliy

    is seriously resriced, and a nigh. Drivers o

    disabled vehicles equipped wih elecric moors

    and no equipped wih enclosed bodies will hen

    use he lighs indicaed in Aricle 5.18.43, par one,

    o he Vehicles Regulaions.

    ron, unless he rider is wearing a whie or yellow

    ligh on his or her ches.

    3 A cycle wih more han wo wheels having wo

    ron wheels mus carry wo whie or wo yellow

    lighs a he ron, symmerically atached o he

    le and righ o he cenre.

    4 A cycle mus be equipped wih a red rear ligh

    carrier a he rear, unless he rider or a passenger

    vehicles are capable o being driven a speeds

    greaer han 60 km/h.

    2 Main highways may only be used by drivers, whose

    vehicles are capable o being driven a speeds

    greaer han 50 km/h.

    Article 431 Drivers are no permited o execue U-urns or o

    reverse heir vehicles while driving on moor ways

    or main highways.

    2 Drivers are no permited o sop on he

    carriageway o a moorway or a main highway.

    3 Excep in emergencies, road users are no permited

    4 Subsecion 2 above does no apply i he pedesrians

    and he drivers o invalid carriages are prevened

    rom crossing by eiher a red or a fashing amber

    pedesrian crossing ligh.

    2.20Emergency vehicles

    Article 50

    Drivers o moor vehicles and moped riders mus

    may give arm signals), when hey pull away, inend

    o overake oher vehicles, join or leave he main

    carriageway or i hey wish o change lanes or carry

    ou any oher sideways changes o heir road posiions.

    Article 56

    Wihin buil-up areas, drivers mus give bus drivers

    sucien opporuniy o pull away rom a bus sop

    i he bus driver signals his inenion o do so.

    This does no apply o drivers o vehicles orming

    par o a miliary convoy.

    2.25Unnecessary noise

    Article 57

    Drivers o moor vehicles and riders o mopeds and

    moor-assised bicycles mus ensure ha heirvehicles do no cause unnecessary noise.

    2.26Warning riangles

    Article 581 Saionary moor vehicles wih more han wo

    apply i a fashing hazard ligh is shown.

    2 The warning riangle mus be placed on he road in

    a clearly visible manner a a disance o approxi-

    maely 30 meres rom he vehicle. I mus be

    exposed o he hazard.

    2.26aSeas

    Article 58a

    1 While paricipaing in rac passengers are carried

    only i seaed in seas.

    2.27Sea bels and child saey sysems

    Article 59

    1 Drivers o passenger cars, commercial vehicles,

    hree-wheeled moor vehicles wih enclosed

    bodies or microcars and heir passengers will use

    he sea bels available o hem. Passengers under

    18 years o age and less han 1.35 m all will use a

    suiable child saey sysem bearing an approval

    mark as indicaed in Aricle 22, par our, o he ac.

    I he seas inended or passengers are equipped

    wih sea bels, no more passengers may be carried

    han here are sea bels.2 Passenger cars, commercial vehicles, hree-

    wheeled moor vehicles wih enclosed bodies or

    microcars no equipped wih a sea bel or child

    saey sysem as indicaed in he rs par may no

    be used o ranspor passengers under 3 years o

    age, and passengers aged 3 o 18 years, who are less

    han 1.35 m all, will be ranspored in seas oherhan he ron seas.

    3 Passengers younger han 18 years o age may no be

    placed in a rear-acing car sea in a ron passenger

    sea equipped wih an airbag, unless his airbag

    has been disengaged or is auomaicallysucienly disengaged.

    4 Subsecion 1 above does no apply o passengers

    using a wheelchair. These passengers shall be

    ranspored in a wheelchair which is secured in he

    vehicle by means which ensure he sabiliy o he

    wheelchair and he saey o he occupan. These

    passengers shall use a sea bel inegraed ino he

    vehicle or a foor-mouned vehicle resrain sysem,

    unless he consrucion o such sysem is one

    approved by Our Miniser.

    5 The rs par, second senence, and he second

    par do no apply or ranspor in axis. In axis

    where no child saey sysem is presen, passengers

    under 18 years o age and less han 1.35 m will be

    ranspored in seas oher han he ron seas.

    6 The rs par, where applicable o drivers, and he

    ourh par do no apply during paid ransporaion

    o passengers under he 2000 Passenger Transpor

    Ac and demand-driven public ranspor in axis,

    oher han in cases in which an agreemen is madeas indicaed in Aricle 84, par hree, o said ac,

    or oher han during axi ransporaion in a axi

    congured or wheelchair ranspor in accordance

    wih he requiremens relaing o his in he

    Vehicles Regulaion.

    7 The auomaic sea bel, he seabel or he child

    resrain sysem mus be used in such a way hahe proecive uncion o hese does no have or

    and over and people under he age o 18 who under

    he circumsances do no need o use a child resrain

    sysem, may, i required, use a device designed oplace he diagonal porion o he sea bel over he

    shoulder. Our Miniser may provide addiional

    requiremens or such a provision.

    8 Drivers o he vehicles as saed in subsecion 1 are

    orbidden o ranspor passengers younger han 12

    years o age and passengers in wheelchairs by means

    oher han se orh in his Aricle.

    Article 59a

    1 Conrary o Aricle 59, subsecion 1 and 8 above,

    drivers o a passenger bus and heir passengers

    aged 3 and older mus use he seabel or child

    resrain sysem provided on he bus when hey

    are seaed on he bus and he vehicle is driving in

    ra c.

    2 Passengers in a moving bus shall be inormed o

    he mandaory use o resrain sysems as named

    in subsecion 1 above whenever hey are seaed and

    he vehicle is driving in ra c. This announcemen

    shall be made in one o he ollowing ways:

    a. by he driver, conducor, our leader or personacing as group leader;

    b. by audiovisual means;

    c. by writen insrucions or he ollowing

    picogram:

    Use o he picogram will be hrough clear

    applicaion on every sea.

    3 Conrary o Aricle 59a, subsecion 1, passengers inbuses permiting sanding passengers are no

    sysems.4 Bus drivers are orbidden o ranspor passengers

    younger han 12 years o age in a manner oherwise

    han ha se orh in his Aricle.

    Article 59b

    1 Conrary o Aricle 59, subsecion 1 and subsecion

    8, a hird passenger older han 3 years o age and

    less han 1.35 meres all may be ranspored oher

    han in he ron passenger sea in passenger and

    hired vehicles, when aer insallaion o wo child

    resrain sysems i is no possible o insall a hird

    child resrain sysem, and hese wo resrain

    sysems are in use, and provided his passenger

    uses a seabel. Aricle 59, subsecion 7, applies.

    2 Conrary o Aricle 59, subsecion 1, senence 2, and

    subsecion 8, in incidenal cases and over shor

    disances, passenger vehicles and vans may

    ranspor passengers aged 3 or older and less han

    1.35 meres all in he ron passenger seas, when

    hese passengers use a seabel. This does no apply

    o passengers whose paren is he driver or heowner or holder o he vehicle.

    2.28Saey Helmes

    Article 60

    The rider and pillion rider o mopeds, microcarswihou an enclosed comparmen, moor cycles

    2 The rs secion above does no apply in he case o:

    a. he rider and pillion rider o a moor-assised

    bicycle;

    b. he rider and rear passenger o a moor-assised

    railer bicycle;

    c. he rider and pillion rider o a ype o moped

    designaed by he Diens Wegverkeer (Road

    Transpor Oce), which is no a microcar, or a

    moor cycle wih a sea proeced by a saey cell

    and ted wih sea bels. The designaion may

    disinguish beween he rider and he passengers

    as ar as he validiy o he rs secion applies.

    Rules have been se by miniserial ruling relaing

    o he requiremens a moped or moor cycle

    mus mee in order o be so designaed. In each

    case he rules relae o he requiremens ha he

    saey cell and sea bels mus mee;

    d. he driver or passengers o a microcar wihou

    an enclosed comparmen, or a hree-wheeledmoorised vehicle, whose sea in his microcar

    or moor vehicle is equipped wih saey bel

    mechanisms in compliance wih guideline

    97/24/EC, as applicable on he dae when he

    vehicle came ino use, and wih saey bels which

    comply wih ha sipulaed in Aricle 5.2.47, sub

    ve and six, o he Vehicle Regulaions.3 Riders are orbidden o ake as passengers children

    A person driving a moor vehicle, moped, moor-

    assised bicycle or disabled persons vehicle equipped

    wih an engine may no hold a mobile phone while

    driving.

    2.31

    Conveyance o persons in or onrailers and in loading space

    Article 61b

    1 I is orbidden o convey persons in he open or

    closed loading space o a moor vehicle or moped

    and in or on a railer behind a moor vehicle or

    moped.2 The rs par does no apply:

    3 Road Signs

    3.1General provisions

    Article 62

    Road users are required o observe all road signs

    giving orders or conaining prohibiions.

    Article 63

    Trac symbols have prioriy over rac rules,

    inasmuch as such rules are incompaible wih said

    symbols.

    Article 63a

    Temporary rac symbols on he road surace have

    prioriy over oher rac symbols applied in ha

    locaion o he road surace, inasmuch as such rac

    symbols are incompaible.

    Article 63b

    1 Where rac symbols indicaing a maximum

    4 Signals by auhorisedpersons

    4.1Obligaions on he par o road users

    Article 82

    1 Road users are required o ollow insrucions

    given verbally or by means o gesures by:

    5 Special Regulaions orDisabled Drivers

    5.1Exempions or disabled drivers

    Article 85

    1 Drivers o moor vehicles wih more han wo wheels

    displaying a valid and clearly legible disabled

    drivers parking badge are exemped rom he

    resricions governing parking in a parking disk

    zone (Aricle 25). Similarly, disabled drivers

    wishing o park or up o hree hours are exemped

    rom he ban on parking on a single unbroken

    yellow line and where parking is orbidden by he

    sign E1, and also rom he parking resricions on

    recreaion areas (Aricle 46). In his later case, hey

    mus clearly display in heir vehicles a parking disk

    showing he ime a which hey commenced

    parking.
