3The Florida Legislature concluded the 2019 session on Saturday

May 4. Although there were quite a few bills introduced only a totalof 174 were passed by the House and the Senate and will be sent tothe Governor for review. Governor DeSantis has already signed into

law several bills of interest for guardians and they became law effective upon his signing:

SB124: Dependent Children. This law specifies the venue in proceedings for the appointment of aguardian for a child or young adult who has been adjudicated dependent and authorizes a court to receiveand consider any information provided by the Guardian Ad Litem Program and the child’s attorney adlitem.

SB182: Medical Use of Marijuana. This bill redefines the term “marijuana delivery device: and theterm “medical use.” It also restricts smoking of marijuana in enclosed indoor workplaces and requires aqualified physician to submit specified documentation that smoking is an appropriate route of administra-tion for a qualified patient.

SB 184: Aging Programs was also signed by the Governor but does not take effect until July 1, 2019.This bill transfers the powers, duties and functions of the Department of Elder Affairs relating to hospices,assisted living facilities, adult family-care homes and adult day care centers to the Agency for Health CareAdministration.

HB 19: Prescription Drug Importation Programs. This bill passed both House and Senate but hasnot yet been sent to the Governor. It requires The Agency for Health Care administration to establish theCanadian Prescription Drug Importation program and authorizes a Canadian supplier to export drugs intothis state under the program.

BILLS THAT WERE WITHDRAWN

SB192: Medicaid Eligibility. Fortunately this bill did not pass and was withdrawn. This bill wouldhave extended the loss of the 90 retroactive eligibility period for Medicaid approval that was enacted in2018. Since it did not pass, the approval period will revert to the previous 90 days retroactive period for non-pregnant adults. Effective date July 1, 2019.

Other bills that did not pass and were withdrawn are:SB 778: Program of All-Inclusive Care for the Elderly (PACE); SB452: Elder Abuse Fatality

Review Teams; SB 818: Mental Health; SB1188: Courts; and CS/CS/HB863: Physician Referrals

HURRICANE SEASON BEGAN JUNE 1st. ARE YOU PREPARED?As all residents of Florida must know by now, hurricane season begins June 1st and runs

until the end of November.

Neil Jacobs, administrator for NOAA, the National Oceanic and AtmosphericAdministration, says they predict 9 to 15 named storms, four to eight could be majorhurricanes of Category 3 or higher. This prediction does not indicate how many they thinkwill strike land - only how many they believe will form this year based upon indicators/signals they watch.
