“COMPARISON OF THE 2017 & 1999 FIDIC CONTRACTS”

(Red & Yellow Books)

OVERVIEW

The introduction of the 2017 2nd Edition of the FIDIC Rainbow Suite of Contracts is a very significant event in the development of Contracts for use in the international construction arena. There new Contracts are substantially larger (approx. 70% more text) & much more complex than the 1999 Contracts & so require careful assessment prior to consideration of their use

To enable professionals to evaluate the differences in the Contracts, ECV has created this comprehensive 2 day course of comparison of the Construction (Red Book) & Plant & Design-Build (Yellow Book) Con-tracts. The text of the Red & Yellow 2017 Contracts is 95% the same but over 50% different from the 1999 Contracts so although presented in the same format as the 1999 Contracts they may be considered as new Contracts

The course is presented in 8 sessions & includes details of the changes in principle as well as in presen-tation. The key changes in each of the 21 main Clauses (1999 Contract has 20 Clauses) are identified & flow charts are given where appropriate on the new procedures required. In addition special attention is given to the:

New requirements for the Parties in making claims & the much expanded requirements of the Engineer in seeking agreements or making determinations.

Requirement for a Dispute Avoidance/Adjudication Board (DAAB) as a full time Board

The tutor is provided by ECV Consultancy Ltd (ECV) in association with FIDIC. ECV specialises in training
