-n the barangay election of $ay 88A, petitioner was proclaimed by the 9arangay 9oard of 'anvassers as theduly elected Punong 9arangay of Poblacion, Tangalan, #klan on $ay !, 88A.Private respondent 0ernandeBfiled an election protest against the petitioner on $ay 4, 88A."owever, the petition was not accompanied bya certification of non) forum shopping re1uired under #dministrative 'ircular (o. !A)8A of the Supreme 'ourt.The following day, $ay 88A, the privaterespondent submitted to the $'T' his certification of non)forumshopping.On $ay 7/, 88A, petitioner filed a motion to dismiss the protest due to private respondents failuretostrictly comply with the 'ircular. The $'T' issued an order denying the motion to dismiss. The RT'of

#klan denied the petition for certiorari filed by petitioner for lack of merit.

The filing of the certification was within the period for filing an election protest. When petitioner wasproclaimed as the Punong 9arangay on $ay !, 88A, respondent has ten days from suchproclamation withinwhich to file the election protest. -n this case, when respondent filed hiscertificate of non)forum shopping on$y 8, 88A, it was within the reglementary period provided for in the Omnibus &lection 'ode, thus, he stillhas until $ay 7!, 88A to complete the re1uirements of his petition. #lso, the fact that the 'ircular re1uiresthat it should be strictly complied with merely under serves itsmandatory nature in that it cannot dispensedwith or its re1uirements altogether disregarded, but itdoes not thereby interdict substantial compliance with itsprovisions under 2ustifiable circumstances.There is nothing in the 'ircular that indicates that it does not applyto election cases. On the

contrary, it e*pressly provides that the re1uirements therein Cshall be strictly complied with in the

filing of complaints, petitions, applications or other initiatory pleadings in all courts and agenciesother than theSupreme 'ourt and the 'ourt of #ppeals.
