RULES AND REGULATIONS
FOR THE UTILIZATION OF THE CLUB HOUSE AND ITS RECREATIONAL
FACILITIES AT ‘JADE GARDEN’ SADAHALLI VILLAGE, DEVANAHALLI TALUK,
BANGALORE NORTH
PREAMBLE
‘THE CLUB JADE’ and connected recreational facilities (hereinafter referred to as ‘the
Club’) is managed by the JADE GARDEN PLOT OWNERS WELFARE ASSOCIATION
(hereinafter the JGPOWA) a registered association of plot owners registered under The
KARNATAKA SOCIETIES REGISTRATION Act, 1960 at Sadehalli Village, Devanhalli
Taluk, Bangalore North adjoining the project called as ‘The JADE GARDEN Layout’
situated in the said village.
The “RULES AND REGULATIONS” herein below embody the terms and conditions of
membership of the Club and utilization of the recreational facilities available therein.
The Managing Committee, however, reserves the right to amend or modify these rules,
from time to time to such extent and in such manner, as it may deem necessary.
RULES AND REGULATIONS
1. MANAGEMENT
The JGPOWA shall constitute a Managing Committee consisting of such number
of persons, as they may deem fit and proper, for the management and
administration of ‘the Club’, in accordance with these rules, subject to
modifications by the Managing Committee from time to time.
2. MEMBERSHIP AND TYPES OF MEMBERS

No person other than a member shall, except as provided in these “RULES AND
REGULATIONS”, utilize ‘the Club’ or its recreational facilities. Subject to the
“RULES AND REGULATIONS” prescribed herein, the following class of persons
shall be eligible for membership of ‘the Club’ and the utilization of ‘the Club’ and
its recreational facilities –
a. PERMANENT MEMBER/S
Any individual, firm or corporate body, owning a site in the JADE GARDEN
Layout established by M/s. Raj Trust in Sadahalli Village, Devanhalli Taluk,
after having paid in full, the consideration thereof, shall, by virtue of the
ownership of the site, be eligible to become a member of ‘the Club’. The
membership shall however be coterminus with the ownership of the site and
shall automatically cease upon the transfer or alienation of the site.
b. INVITEE MEMBER/S
Such person/s, invited by the Managing Committee, at its discretion, for
admission to the membership of ‘the Club’.
c. SUBSCRIPTION MEMBER/S
Such individuals or institutions like Nationalized Banks, Public or Joint Sector
Banks, Partnership Firm, Public or Private Limited Company, not owning any
site in the JADE GARDEN Layout, whom the Managing Committee may
admit on payment of a specified subscription fee, as a member of the ‘the
Club’.
d. TEMPORARY MEMBER/S
Such person/s whom the Managing Committee may admit as member at its
discretion for such specified period of time as may be decided from the
Managing Committee from time to time.
e. DEPENDENT MEMBER/S
Dependent members shall include the spouse of the member and two (2)
unmarried children not exceeding 25years of age of the member.

3. TERMS TO MEMBERSHIP
a. The admission of any person to the membership of ‘the Club’ shall, however,
be subject to the sole discretion of the Managing Committee.
b. If a Partnership Firm or a Company becomes a member of the ‘the Club’
under sub Rule 2, such Firm or Corporate Body shall nominate the person to
whom the utilization of ‘the Club’ and its recreational facilities are to be
extended, and, except as hereunder provided, no other person shall be
eligible to ‘the Club’ and its facilities.
c. The services and facilities offered by ‘the Club’ shall also be available to
such nominated dependent member of a member’s family, nominated by the
member in writing.
d. Upon the termination of the membership of a PERMANENT MEMBER
consequent to the transfer or alienation of the ownership of the site in the
JADE GARDEN Layout, the transferee or alienee shall -
i. Bring to the notice of the Managing Committee such transfer or
alienation; and
ii. On payment of all dues of the previous member and the membership
fee and the other charges, be eligible, at the discretion of the Managing
Committee, to the membership of the ‘the Club’ to the same extent and
in the same manner as the transferor was originally eligible.
e. In the event of the death of the Permanent Member, his/her successor or
where there are more than one successors, the successor nominated by the
remaining successors shall be eligible for the membership of ‘the Club’.
4. SUBSCRIPTION FEES, ENTRANCE FEES AND FACILITY CHARGES
a. A person intending to become a member of ‘the Club’ shall pay such sum
towards entrance fee, as may be determined by the Managing Committee

from time to time. Such entrance fee shall, however, not be applicable to
Permanent Members or Invitee Members.
b. Each and every member of ‘the Club’ shall be liable to pay the monthly
subscription fees and facility charges at such rates as the Managing
Committee may determine from time to time.
c. The facility charges may be paid separately for each facility that the member
is entitled to utilize or collectively for all the facilities as may be decided by
the Managing Committee at its discretion and from time to time.
d. The monthly subscription fees and facility charges shall be payable each
member in advance and in such manner as the Managing Committee may
decide from time to time.
5. PROCEDURE FOR ADMISSION
a. Any person, partnership firm, company or other institution wishing or
intending to become member of ‘the Club’ shall obtain an application form
from the office of ‘the Club’.
b. Every person, partnership firm, company or other institution seeking
membership of ‘the Club’ shall submit an application in the prescribed form,
along with the prescribed entrance fee, if any, to the Managing committee, at
office of the ‘the Club’.
c. The Managing Committee shall scrutinize the application and conduct an
interview of the said applicant to admit him/her/them/it as a member of ‘the
Club’. However, such interview may be at the discretion of the Managing
Committee.
d. Upon the admission of such person, partnership firm, company or other
institution to the membership of ‘the Club’, the Managing Committee shall
issue or cause to be issued, a membership card specifying:
i. The name of the member;
ii. The address of the member;

iii. The designation of the member, if any; and
iv. Such other particulars as may be deemed necessary by the Managing
Committee.
e. If the member, or where the member is a partnership firm, company or other
institution, the person nominated by it, intends to extend the utilization of ‘the
Club’ and its recreational facilities to any dependent member of his/her
family, the name of such dependent member shall be indicated to the
Managing Committee and the Managing Committee shall conduct an enquiry
and subsequently, if it deems fit, include the name of such person nominated
to be a dependent member by the member and issue a separate card to the
nominated person.
f. No person other than a member or a dependent member, whose name is
mentioned in the card or to the extent provided in these rules, a guest of such
member, shall be eligible to the utilize of ‘the Club’ and its recreational
facilities.
6. ENTRY TO ‘the Club’ AND UTILIZATION OF ITS RECREATIONAL FACILITIES
a. No person shall be allowed to enter into the premises of ‘the Club’ or to the
utilization of the recreational facilities therein except during the timings
notified by the Managing Committee as may be changed from time to time.
b. The members or the authorized users eligible for utilization of ‘the Club’ and
its recreational facilities shall be allowed entry into the premises of ‘the Club’
only upon displaying the identity card issued by the Managing Committee for
such purpose or by displaying the authorization letter issued by the Managing
Committee.
c. No dogs or pets are allowed inside ‘the Club’ or where its recreational
facilities are situated.

d. All vehicles brought into the premises of ‘the Club’ by members or
authorized users shall be parked only in the parking spaces permitted or
reserved by Managing Committee for such utilization.
7. UTILISATION OF ‘the Club’ AND THE RECREATIONAL FACILITIES
a. Access to ‘the Club’ and its recreational facilities shall be available for
utilization to the members and other authorized users by the Managing
Committee during such timings as may be notified by the Managing
Committee from time to time.
b. The members and the authorized users eligible to utilize the ‘the Club’ and
its recreational facilities shall utilize it in a reasonable manner commensurate
with the rights of the members and the authorized users to such utilization.
c. Every person entering the premises of ‘the Club’ for utilization of the
recreational facilities therein shall do so at his/her/their/its own risk. The
Managing Committee shall not be responsible for any loss or injury to any
person using ‘the Club’ and the recreational facilities nor shall the Managing
Committee be liable in any manner to him/her/their/its successor/s or legal
representative/s.
d. The Managing Committee shall not be responsible for the safety of money,
valuables or clothing or any items/objects brought into the premises of ‘the
Club’ or its recreational facilities by any member or authorized users.
8. PENALTY FOR CONTRAVENTION OF THE RULES
a. The membership of any member or any authorized user to the utilization of
‘the Club’ and its recreational facilities may be suspended permanently or for
such period as may be determined by the Managing Committee, in case of
the following events:
i. If a member or authorized user is found guilty by a competent court or
tribunal of offence/s involving moral turpitude;

ii. If a member or authorized user commits three consecutive defaults in
the payment of the subscription fees or facility charges;
iii. If a member or authorized user persistently fails to comply or neglects
compliance of any of the ‘RULES AND REGULATIONS’ in spite of
repeated reminders, notices and warnings regarding the same.
iv. If a member or authorized user creates nuisance or conducts
himself/herself/itself/themself in a disorderly manner or in a manner
detrimental or prejudicial to the interests of ‘the Club’ or its members or
is found to be behaving in an improper, indecent or objectionable
manner.
b. No suspension under Rule No. 8(a) shall be ordered except after the
issuance of a notice to the concerned member or authorized user to ‘Show
Cause’ against the proposed suspension and giving the said member or
authorized user the opportunity of being heard.
c. The decision of the Managing Committee with regard to the suspension shall
be final and binding on the concerned member or authorized user.
d. Without prejudice to the above, the Managing Committee shall also have the
right to recover the dues of subscription fees and facility charges with interest
at the rate of twenty one percent from the date of such default.
8. GUEST
a. Any person who is not a member shall, at all times, not be allowed to enter
‘the Club’ premises unless introduced and accompanied by a member.
However, the Managing Committee reserves its right to allow
his/her/their/its entry into the premises of ‘the Club’.
b. Members may introduce their guests to ‘the Club’ only on payment of
entrance fees for admission of the guests as may be fixed by the
Managing Committee from time to time.

c. A member shall be allowed to introduce a maximum of only ten (10)
guests (adults) per day.
d. A member shall not be allowed to introduce the same guest for more than
two days in a week.
e. A member shall be responsible for the compliance of the ‘RULES AND
REGUATIONS’ of the ‘the Club’ of his/her/their/its guests’.
f. If a guest does not comply with the ‘RULES AND REGUATIONS’ of the
‘the Club’ or misbehave or behaves in an improper, indecent or
objectionable manner, the member introducing the guest and the said
guest shall be duly and immediately contacted and it shall be the duty of
such member to ensure that said guest immediately vacates the premises
of ‘the Club’. The Manager of ‘the Club’ or the person for the time being
in charge of the administration of ‘the Club’ shall have all powers to deal
with the situation immediately, in the event of non-cooperation or non-
compliance of ‘RULES AND REGULATIONS’ either by a member or by a
guest.
g. The Managing Committee shall fix the admission charges for each visit of
the guests, as may be changed from time to time. The admission charges
for admission of guests shall be exclusive of charges fixed for participation
in the other activities, games and facilities of the different sections of the
‘the Club’.
9. CLOSURE FOR MAINTENANCE AND RENOVATION
a. The Managing Committee reserves to itself the right to partially or completely
close the premises of ‘the Club’ for routine repairs or maintenance or for any
other justifiable reason, whenever necessary, to ensure safety and comfort of
all members and authorized users.
b. Except wherein demanded or warranted by the situation/circumstances, the
Managing Committee shall notify all members or authorized users in advance

about the closure of ‘the Club’ for such repair work or routine
manintenance/renovation undertaken.
TERMS OF USAGE OF ‘the Club’
1. Only members who do not owe any dues to the JGPOWA shall be allowed to
utilize the Club and its recreational facilities.
2. All the facilities in ‘the Club’ are available for the usage of all members of
JGPOWA all through the year on payment of the specified subscription fees and
facility charges as may be fixed by the Managing Committee from time to time.
3. On prior request and subsequent permission granted by the Managing Committee,
the members can avail of the premises for their personal and private parties / get–
together / events subject to a payment of a nominal charge towards “AFTER-
EVENT-CLEANING CHARGES” depending on the number of invitees to such
personal and private parties / get–together / events. The members who wish to
organize the personal and private parties / get-together / events also have the
option of blocking a particular area/specified area for the said personal and private
parties / get-together / events subject to a payment of an additional nominal
charge and also subject to availability of the said area/s.

Get-Together / Events
1. If ‘the Club’ is alleged to have been misused for commercial / outsiders / paid
public parties / paid events etc., and the Managing Committee having been
misguided by the member using ‘the Club’ for such personal and private parties /
get-together, the Managing Committee reserves the right to immediately stop the
event and penalize the erring member and take appropriate action for such willful
misrepresentation/wrongdoing. The decision of the Managing Committee in this
regard shall be final and binding.
2. Corporate parties / get-togethers / events are chargeable on a commercial basis
and rates for the same shall be fixed by the Managing Committee on case-to-case
basis.
3. All prices and terms are subject to change from time to time and all members are
requested to enquire from the office of ‘the Club’ about the latest copy of the
‘RULES AND REGULATIONS’.
4. Any applicable taxes shall be in addition to the rates fixed for utilization of ‘the
Club’ and its facilities for personal and private parties / get-together / events.
5. All members agree to abide by the ‘RULES AND REGULATIONS’ of ‘the Club’
as amended by the Managing Committee from time to time.

a member for his/her/their/its personal and private parties / get-together / event shall be
applicable:
