Que.1: Who has to pay property tax? Which properties are liable to property tax?
Ans. Person./ Institutes who own / possess land / building within limits of MC , SAS Nagar have to
pay property tax. Property Tax is applicable to all properties and open lands within Municipal
Corporation limits. However the following type of building and land exclusively used for
following purpose are exempted from property tax.
(i) Religious purposes, religious rites – religious ceremonies, religious festivals
(ii) Cremation grounds , burial grounds;
(iii) Gaushalas, stray animals care centers;
(iv) Historical and heritage buildings, so notified by the State Government, Central Government
or United Nations Educational , Scientific and Cultural Organization;
(v) Registered charitable and philanthropic organizations exempt from payment of the tax
under the Income Tax Act, 1961 ( Central Act. No 43 of 1961);
(vi) The building and land owned used by the Corporation;
(vii) The building and land used for Schools and Colleges owned or aided by the Government ;
(viii) The building and land of Hospitals or Dispensaries owned by the Government;
(ix) Parking space( only in respect of multi- storey flats/ buildings); and
( x) Land used for agricultural or horticultural purposes;

Apart from above the building and land owned by the following categories of persons
shall be exempted from the imposition of tax to the extent indicated against each:

Que-2: Who is responsible to make assessment of his property and file the self assessment return/ pay
tax?
Ans:- Owner of the property is responsible to make the self assessment of his property , file the return
and pay the tax. In case of someone is power of Attorney holder of any property , he can file the
return and pay tax.
Que-3: Can any person who is not the owner / power of attorney holder of any property file the self
assessment of behalf of the owner / power of attorney holder
Ans: No.
Que.4. Which space is considered for assessment of Property Tax; carpet area or built- up area?

Ans. Property Tax is assessed on the basis of area of plot in Sq. yards and built-up area of building /
property in Sq. feet.
Que-5: What is the rate of tax on property?
Ans: The tax payable on land and building shall be leviable as under:

(iv) One percent of the rateable value, in case the
Five Hundred square yards.
1. Residential building under Three per cent of the rateable

Provided that if the land is vacant or the building is unproductive, the rate of tax shall be
0.20 per cent of the rateable value;
Que.6: How Property Tax is assessed?
Ans: Property Tax is assessed by the owner / possessor of land / building through self assessment
system . For assessing the Property Tax the assessee has to consider the under mentioned factor
and adopt the following procedure .
a) For self Residential / Commercial / Industrial / Institutional property (excluding flats for
residential purpose).
i) Area of the plot in Sq. yards.
ii) Built-up area of the property
iii) Type of Property- Residential / Commercial / Industrial / Institutional
iv) Collector rate of the Property ( Plot) as on 1st January of the assessment year eg. For
financial year 2013-14 , the collector rate applicable on 1st January 2014 will be
applicable .
v) Cost of construction per Sq.foot. as on the first January assessment year e.g. for 2013-
14. , the cost of construction for R.C.C structure is Rs. 500/- pre Sq.foot and Rs.
300/- per Sq. feet, if structure is shed/ Kacha .
vi) Give 10% depreciation on the cost of construction .
vii) Add cost of plot and cost of construction after depreciation .(v-vi)
viii) Take 5% of cost of plot and cost of construction after depreciation (i.e of vii).
ix) To calculate the final tax multiply the amount given at Sr. no. vii by the rate of property
tax and divide by 100 eg. In case of self occupied residential property rate of tax is
0.5% , in case of self occupied commercial property is rate of tax is 3% etc.
b) Self occupied flats –
i) Total covered / carpet area
ii) Collector rate of property per Sq.feet.
iii) Multiply i and ii which will give total value of the property .
iv) Now take 5% of total value (iii) above ) of property.
v) Multiply iv by the rate of tax applicable and divide by 100 . The amount so arrived at will
be amount of property tax
c) Rented Property
i) Take annual rent of the property.
ii) To arrive at the amount of property tax take applicable percentage of total the amount of
annual rent .That will be the amount of property tax payable.
Que-7: Is a widow or handicapped person whose property tax calculation is below 5000/-( below
exemption limit) required to file property tax return?
Ans:- Yes,he/she has to file the return , but need not to pay property tax if assessed amount is below
5000/-

Que-8: Are freedom fighter who are receiving Pension as such from the Central Government or the State
Government rr both, as the case may be and B.P.L person required to file the self assessment
property tax return .
Ans: Yes, such person have to file return each financial year .Such a return should be supporeted by
relevant document in respect of entitlement of exemption.
Que.9: How can I pay the property tax?
Ans. As the property tax is based on self assessment . It is the duty of the owner / possesser of property
to do the self assessment of his property as per the details given above . After making the self
assessment of property , the tax can be paid in the office of Municipal Corporation or on line
www.mcmohali.org or www.netpnb.com.
Que-10:What is the last date of payment of property tax without any interest or penalty?
Ans. Property tax can be paid upto 31st December of concernd financial year without any penalty or
interest .
Que-11 :Is any penalty levied if property tax is not paid by 31st December of the concerned year?
Ans:- i)Where the tax calculated is not fully paid by 31st December of relevant financial year and is paid
on or before the 31st March of that financial year, a penalty of 25 per cent of the remaining
amount of tax calculated by the assessee shall be payable.
ii) If tax is not fully paid by the 31st March of the relevant year , in addition to any action
contemplated under the Act, every owner or occupier, as the case may be , shall be liable to pay
penalty at the rate of fifty per cent on the amount of tax unpaid plus interest at the rate of eighteen
per cent per annum to be calculated with effect from the first April of the next financial year upto
the date the payment of such amount of tax is made.
iii) If no return is filed or wrong particulars are given in the return filed ,the owner or the occupier ,
as the case may be, shall be liable to pay the penalty and the interest in the manner provided
under sub para (ii ) of this question as given above.
Que-12: How much penalty or fine is payable in case of non-payment of Tax on due dates?
Ans. This issue is under consideration of State Government .
Que-13: Is there any schemes that gives rebate on Property Tax?
Ans: i) On payment of entire amount of property tax of the current year by 30th September, 10 %
rebate is given on the amount of Property tax.
ii) Educational Institurions other than Govt. and Govt. aided are exempted from annual tax
to the extent of 50% of the tax assessed .
Que-14:Which documents are required for assessment for property tax .
Ans: i) Ownership document such as sale deed.

ii) Approved plan of building .
iii) Rent deed in case of rented property
iv) Identity proof of the assessee and proof of residence .
v) Death certificate of husband in case of widow.
vi) Proof of benefit of deduction under section 80 U of Income Tax Act, 1961 in case of
Handicapped persons .
vii) B.P.L certificate/ card in case of BPL family .
viii) Proof of being freedom fighter in case of freedom fighter.
ix) Proof of being a charitable and philanthropic organization exempted from payment of tax
under Income Tax Act, 1961 in case of charitable and philanthropic organization
Que-15 :Whom should Citizen approach in case of any query?
Ans: In case of any question or query one should approach Superintendent Property Tax.
Que:16: What Should an assessee do if his rented property is vacated by a tenant after he has paid
property tax for the entire year . For example for the year 2014-15, assessee pays the tax in the
month June 2014 and his rented property is vacated in August 2014 .
Ans:- In the case where the property is rented out after filing the self assement return, the assessee has
to file supplementary return to pay the tax on the rent he will receive from the tenant . In case
where rented property is vacated in the middle of financial year after its tax has been paid for
the entire year, Assessee should give an application to Municipal Corporation in this regard
mentioning the details of property and tax paid .On receipt of such application official of
Municipal Corporation will verify the claims made in the application . If claims are found to be
true and correct , further action will be taken by Municipal Corporation as per the directions of
Govt.( execess amount of tax could be adjusted in the tax of nest year)
Que:17; Does Municipal Corporation prepare any list of properties within its limits. If so can it be
amended in case of change of title of property due to various regions such as sale, division
among family member , in the name of legal heires of a deceased person etc.?
Ans: Yes, Municipal Corporation is preparing a list of all the properties falling its limits .This list can
be amended by the Commissioner of Municipal Corporation at any time by :
a) Inserting therein the name of any person whose name ought to be inserted; or.
b) Inserting therein any land or building previously omitted ;pr
c) Striking out of the name of any person not liable for the payment of taxes on land and
buildings; or
d) Inserting or altering an entry , in respect of any building erected , re – erected, altered or
added to, after the preparation of the property list.
Que:18: What is the procedure for getting the property list amended?
Ans: Affected person should give an application in this regard to Municipal Corporation. Such an
application should be supported by relevant documents such as sale deed ,Will , affidavit and
other documents which may vary from case to case.
Que:19:What is the grievances redressal system in case of any dispute regarding property tax ?

Ans:- Any person having any grievance regarding property tax can file an appeal within 30 days form
the date of filing of return / occurrence of grievance before the Commissioner ( at present the
appealing authority at M.C , SAS Nagar is Additional Commissioner ( Tech) .
Que-20: In which kind the property tax is accepted ?
Ans: i) Property tax is accepted in the form of cash / cheque / D.D
ii) Property tax can also be paid online .
Que-21:Where can one get No Due Certificate in respect of Property tax?
Ans: No Due Certificate can be obtained in respect of property tax from the office of Municipal
Corporation by submitting an application for this purpose . Municipal Corporation will issue the
No Due Certificate within 7 days from the receipt of such application.
Que-22: Which Areas of Sahibzada Ajit Singh Nagar cum under the jurisdiction of Municipal
Corporation ?
Ans: Sector-53 to 80 and Villages Mohali, Shai Mazra, Madanpura, Kumbra, Sohana , Matour fall
within the limits of Municipal Corporation and property tax is to be paid on all the properties
located in this area.

ii) Every person who intends to occupy such a building or part thereof shall apply for
permission in Form D.
iii) The local authority may decline to give permission unless a certificate in Form „E‟
duly signed by a Licensed Architect / Building Designer and Supervisor has
been submitted.
iv) When permission to occupy a part of the building has been given, separate
permission shall be necessary for occupation of such other parts as may be
subsequently completed.
v) Applicant shall remove or destroy, any temporary building, which might have been
erected, and the debris from the site and adjoining road or vacant site
before the occupation certificate is issued.
vi) Partial occupation certificate may be granted for partially constructed building with
one habitable room, one water closet and one bathroom.
vii) Every person newly erecting or re-erecting a building shall on its completion give notice of such completion to the local authority in Form F. If the building is not completed within two years of the date of sanction, the notice shall be accompanied by a completion plan on tracing cloth in duplicate with two Ferro prints of the part of the building completed, up to date.

Ans) Property tax bill and the receipt of payment do not imply that the construction has
received building permission and it is authorized.
Que:-7 What is self certification of building plans for residential plots ( except Group Housing and
independent floors ) on a residential site?
Ans:- It is a scheme introduces by government to ease the construction of residential houses .Any one
who want to construct a house should :
1. Appoint an" Architect " empanelled with this corporation for the purpose of self certification of
building plans , as an " Architect on Record" for submission of building plan and supervision of the
construction thereof .
2. Architect on record can make an application of self certification in writing to the competent authority
along with the copies of requisite information/ documents with the certification that the building
plan, information, ownership etc submitted is correct and is in consonance with the applicable
regulation. and comply with the provisions of master plan and all the requirements/ regulations of
other acts applicable within Municipal limits .
Que:-8 Is it necessary to get sanction order in the form building under self certification system?
Ans:- No, sanction order in the form of building permit will not be necessary in case of those plot where
building plans are deemed sanctioned on the certification of an Architect/ Building Designer and
Supervisor that building plan conform to the building bye-laws.

Ans:- a) Proof of empanelment under the Self Certification Scheme with the concerned Municipal Authority/
Improvement Trust.

Ans:- The "Architect on Record" shall furnish progress certificates at the stage excavation DPC,
roof level and completion . However after submitting the DPC report, the applicant shall have to
wait for a period of fifteen days prior to going ahead with further construction.
Que:-13 What should the owner of building do if after submission of application / during the
construction of building the appointment of the " Architect on Record" is annulled
Ans:- a) The owner shall intimate the Competent Authority through registered post within seven
days of annulment and also about the appointment of new " Architect on Record".
b) The "Architect of Record" shall intimate the Competent Authority through registered post
within seven days of annulment and regarding the construction raised so far to be
as per the Building Plan deemed sanctioned on the certification of the "Architect of
Record".
c) The newly appointed "Architect on Record" shall intimate the Competent Authority within seven
days of his appointment that the construction already raised is as per the Building Plan deemed
sanctioned on the certification of the "Architect on Record".

Que:-13 Who is held responsible if any violation of building plan is reported?
Ans:- If the " Architect on Record" submits a wrong report while certifying Building Plan or if any
construction or violation is reported to exist at site or conceals any fact or falsely justifies or
misstates regarding completion of building , he will be held responsible for such
omission/ commission and can be penalized , as deemed fit by the Municipal Authority after
fiving an opportunity of being heard, under intimation to the Government. The unauthorized
construction will either be demolished by the owner or by the concerned Authority at the risk and
cost of the owner , if the same is neither sanction able nor compoundable.
Que:-14 Has it become necessary to adopt self certification scheme for all residential building plans?

After household collection, garbage is carried to the secondary points. From secondary points

Ans. Yes, Even for cutting of a single tree, permission of Divisional
Engineer(Horticulture), GMADA is necessary. DE (H), GMADA may give
permission to cut a tree in GMADA area. You can submit an application in
GMADA in the name of DE(H), GMADA, Shahibzada Ajit Singh Nagar.

Ans. A) If ownership lies with GMADA:- on receipt of application, JE/ SDE
will visit the site and submit the report. DE ( Horticulture will give its
verdict after the visit. If the tree is required to be removed the girth
and species of tree will be sent to the Department of the forest,
Punjab for its assessment. On the receipt of assessment of plant
from Department of the forest, Punjab, the case will be sent to the
Estate officer for the auction of the tree as per GMADA rules.
B) If a plant has been planted by the owner himself it can be removed
only after the report of SDE (H) and the approval of DE (H) GMADA.

parks / green belts for private functions but the applicant should give in
writing that after the function they will clean and up keep the parks /

limit of corporation.

Ans. Decision on first appeal must be given within 30 days, from the date of receiving the along
