SECTION 1 – INSTRUCTIONS TO BIDDERS 1. General Instructions 1.1 In submitting a tender, the bidder accepts in full and in its entirety, the content of
this tender document, including subsequent Clarifications issued by the Contracting Authority, whatever his/her own corresponding conditions may be, which he/she hereby waives. Bidders are expected to examine carefully and comply with all instructions, forms, contract provisions and specifications contained in this tender document.
No account can be taken of any reservation in the tender as regards the tender document; any disagreement, contradiction, alteration or deviation shall lead to the tender offer not being considered any further.
1.2 The subject of this tender is the sale ‘tale quale’ of two (2) Suzuki Alto in two (2)
separate lots in accordance with Article 110 of SL 174.01 – General Financial Regulations by authority of Article 4.3.4 (Disposal of unserviceable and surplus stock) of Treasury Circular 6/2014.
1.3 The place from where the Suzuki Altos are to be removed is Millennia, underground
garage, Aldo Moro Road, Marsa, MALTA. 1.4 This is a lump-sum sale. 1.5 This call for tenders is being issued under an open procedure.
2. Timetable

3. Viewing/Inspection of Suzuki Alto
3.1 Prospective bidders may view the Suzuki Altos on the date and time indicated in Clause
2, at MEIB, Millennia, Aldo Moro Road, Marsa, MRS 9605, MALTA (underground garage). The Contracting Authority shall also address any queries regarding the tender document during the vehicles’ inspection/viewing.
Visits by individual prospective bidders during the tender period other than that scheduled in this tender document cannot be permitted.
4. Criteria for Award:
The tender will be awarded to the bidder quoting the highest price.

5. Cancellation of Tender
The Contracting Authority may cancel this tendering procedure if the offers received are deemed to be abnormally low when compared to its estimated price.
6. Submission of Tenders: The bidder’s submission must be typed in, or handwritten in indelible ink. The Price
tendered shall be excluding VAT however the successful bidder shall be liable to pay all applicable charges and/or taxes. The currency of the tender is the Euro (€).
The envelope must bear only: (i) the address of the Department of Contracts; (ii) the reference of the invitation to tender concerned i.e. (MEIB/236/2013 for Lot
1 and/or MEIB/236/2013/1 for Lot 2); (iii) the name of the bidder. The financial offer must be submitted in English and deposited in the Department’s tender box at MEIB, Millennia, Level 1, Aldo Moro Road, Marsa. MSR 9605 before the deadline for submission. Offers must be submitted: EITHER by recorded delivery (official postal/courier service) or hand delivered to: Millennia, Level 1, Aldo Moro Road, Marsa. MRS 9605. Malta. Late tenders shall not be considered.
Bidders can submit their bid for both Lots OR for one bid only. Bidders are to indicate the lot number for which they are making their submission on the bid envelope. Each bid is to be placed in a separate envelope. Details of respective lots are the following:-

MEIB/236/2013/1 - Lot 2 – Suzuki Alto chassis no:- MA3FFB21S00605245 - Offers below €550 will not be considered (GVN 521).
7. Contract Signature
The successful bidder will be invited to sign the Contract within five (5) working days from notification. Only this Contract will constitute an official commitment on the part of the Contracting Authority, and removal of the Suzuki Alto/s will not be effected until the Contract has been signed, the agreed sale price is paid and the relevant payment is honoured. Furthermore the vehicle/s cannot be mobilized until the transfer of vehicle is finalized by Transport Malta.

8. Payment and Removal
i. Full payment of the sum tendered is to be effected during office hours at the
Ministry for the Economy, Investment and Small Businesses, Millennia, Level 1, Aldo Moro Road, Marsa. MRS 9605, MALTA, within not more than five (5) working days from the date of last signature of the contract and prior to the removal of the Suzuki Alto/s. ii. Removal of the Suzuki Alto/s is to be completed within not more than ten (10) working days from date of last signature of the contract (during office hours - Monday to Friday between 0700hrs till 1600hrs) provided that the relevant payment is honoured. The Suzuki Altos shall be removed by the successful bidder at his/her own risk and expense. The Successful bidder will have to make good for any damages which may be caused to Government or third party property during the removal of items. iii. The awarded contract does not exonerate the Successful bidder from the obligations of obtaining any other permit/license that may be required under any law, principal or subsidiary, in force in Malta from time to time. iv. Failure to affect payment within the stipulated timeframes will entitle the Contracting Authority to consider the contract as having been abandoned (without the necessity of any prior legal proceedings) in which case the contract shall be awarded to the next highest bid and the difference in price shall be borne by the bidder whose offer was the highest. If no other bidder can be awarded the Contract, the Contractor shall be liable to pay a penalty of 10% of the value of the amount tendered in addition to any other damages and/or penalties which may be due. In such cases the Contracting Authority may dispose of the item as it deems fit.

2.0 Submission of Bids Bidders are to submit a lump sum price for the sale of the mentioned vehicle and can bid for both vehicles or for one vehicle only. The quoted price shall be exclusive of VAT and all other charges applicable. All taxes, fees and expenses, permits, towing charges etc. are to be borne by the bidder (both vehicles are currently immobile). All bids must be submitted in one original on the prescribed form. Bids are to be submitted without any commitment on behalf of the government. Bids received after the deadline will NOT be considered.

3.0 Site Visit
Prospective bidders are to register their attendance to the site visit by sending an email on [email protected]. 4.0 Eligibility of bidders
Public officers shall not be allowed to quote or to tender for the acquisition of the mentioned vehicle both in a direct and in an indirect manner. Natural persons, companies or undertakings who fall under any of the conditions set out in Regulation 126 of the Public Procurement Regulations, 2016 (Legal Notice 352 of 2016) are excluded from participating in this tender offer.
5.0 Clarifications and interpretation requests during tender publication period
Bidders requiring clarifications or interpretation of the bid document shall make a written request on email ([email protected]) by 23.45 hours of Thursday 10th January 2019. Any requests after this date will not be taken into consideration. The Contracting Authority is obliged to submit terms of reply to the requests for clarifications and interpretations by not later than Friday 11th January 2019. Any interpretations, corrections or changes to the bid documents by the Contracting Authority will be made by an official addendum. Interpretations, corrections or changes made in any other manner will not be valid, and bidders shall not rely upon such interpretation, corrections and changes.
6.0 Bid preparation costs
Applications shall bear all costs associated with the preparation and submission of the bid documents. The Ministry shall not reimburse any expenses associated with the preparation of the bid documents in the event that any or all offer/s is/are rejected.
7.0 Opening of bids
The Contracting Authority will open bids in public session as soon as the deadline for submission has expired. Any bidders or representatives who are present may be asked to sign a register evidencing their attendance. 8.0 Award Criterion
The sole award criterion will be the price. The contract will be awarded to the highest priced, subject to the following additional conditions:-
a. The Ministry reserves the right to accept or reject any bid and/or cancel the whole tendering
procedure and reject all bids. The Ministry reserves the right to initiate a new call for tenders, seek other forms of disposal in line with the Ministry’s procedures and
b. Cancellation may occur where:-
The tender procedure has been unsuccessful, i.e. when no financially worthwhile offer has been received or where there has been no response at all; and
There have been irregularities in the procedure, in particular where these have prevented fair competition.
Under no circumstances will the Ministry for the Economy, Investment and Small Businesses (MEIB) be liable for damages, whatever their nature (in particular damages for loss of profit) or in relation to the cancellation of the tender. 9.0 Award notification

Prior to the expiration of the period of validity of bids, the Contracting Authority shall notify the successful bidder, in writing, that his bid has been recommended for award. Unsuccessful bidders may be notified with the outcome of the evaluation process, and may be provided the following information:-
The name of the successful bidder;
The recommended price of the successful bidder;
Notification that the offer was the highest.
10.0 Period of validity of tender
The Ministry reserves the right to maintain the validity of tender for a period of 90 days after the deadline for submission of tender; The successful bid must maintain his bid for a further period of 90 days from the date of notification of award. 11.0 Payment to the Contracting Authority
The successful bidder/s shall pay to the Accounts Section, Ministry for the Economy, Investment and Small Businesses the sum that matches his/her bid. Payment shall be accepted by the Director Corporate Services Ministry for the Economy, Investment and Small Businesses and the relevant payment has to be honored prior to the collection of the vehicle. Furthermore the vehicle/s cannot be mobilized until the transfer of vehicle is finalized by Transport Malta.
12.0 Right of refusal The Contracting Authority reserves the right to refuse any offer, even the highest bid.
