i) Within si3ty days of receipt of notice from the contractor of his intention torefer the dispute to ar6itration the Chief 2n*ineer shall send to the contractor a list of three officers of the ran> of ser in* Superintendin* 2n*ineer&hi*her (from the panel of Ar6itrator appro ed 6y the ;o ernment) =ho ha e not 6eenconnected =ith the =or> under this contract# The contractor shall =ithin thirtydays of receipt of this list select and communicate to the Chief 2n*ineer thename of one officer from the list =ho shall then 6e appointed as the solear6itrator# f contractor fails to communicate his selection of name =ithin thestipulated period the Chief 2n*ineer shall =ithout delay select one officer from the list and appoint him as the sole ar6itrator# f the Chief 2n*ineer failsto send such a list =ithin si3ty days as stipulated the contractor shall send asimilar list of ser in* Superintendin* 2n*ineers of the rri*ation !epartmentto the Chief 2n*ineer =ithin thirty days# The Chief 2n*ineer shall then selectone officer from the list and appoint him as the sole ar6itrator =ithin thirtydays# f the Chief 2n*ineer fails to do so the contractor shall communicate to

the Chief 2n*ineer the name of one officer from the list =ho shall then 6e thesole ar6itrator#

ii) The 2mployer shall ha e the authority to chan*e the ar6itrator on anapplication 6y either the contractor or the 2n*ineer rein* order re5ectin* the application or acceptin* to chan*e thear6itrator or simultaneously appointin* a technical officer as Ar6itrator under the contract# The ne= ar6itrator so appointed may enter upon the referenceafresh or he may continue the hearin*s from the point these =ere suspended6efore the pre ious ar6itrator#

iii) The reference for ar6itration shall 6e made 6y the claimant party =ithin onehundred t=enty days from the date of decision of the Superintendin*2n*ineer as referred to in Clause (i ) a6o e failin* =hich the decision of Superintendin* 2n*ineer shall 6e final and 6indin*# f the claim pertains torates or reco eries introduced in the final 6ill the reference to the ar6itrator shall 6e made =ithin si3 calendar months from the date of payment of thefinal 6ill to the contractor or from the date a re*istered notice is sent to thecontractor to the effect that his final 6ill is ready 6y the 2n*ineer (=hosedecision in this respect shall 6e final and 6indin*) =hiche er is earlier#
