SBCAG STAFF REPORT SUBJECT: Rincon Multi-Use Trail Project MEETING DATE: January 17, 2019 AGENDA ITEM: 4I STAFF CONTACT: Fred Luna RECOMMENDATION: 1. Adopt Resolution 19-09 (Attachment A1) amending the FY 2018-19 Overall Work Program (OWP) (Amendment A2) and Budget (Amendment A3) to reflect the usage of Regional Surface Transportation Program (RSTP) Highway 101 reserve funds for the Rincon Multi- Use Trail Project; 2. Approve and authorize the Executive Director, Marjie Kirn, to execute these amendments to the OWP and Budget; and 3. After adoption of Resolution 19-09, approve and authorize the Chair to execute Amendment No. 1 (Attachment B) to the Memorandum of Understanding (MOU) with the City of Carpinteria to add $250,000 in RSTP funds for the environmental, detailed design, right of way, utility and railroad coordination phases of the Rincon Multi-Use Trail project and to extend the period of performance for two years for a revised period of performance of April 1, 2016 through December 31, 2020. DISCUSSION: The Rincon Multi-Use Trail will close a gap in the California Coastal Trail between Rincon Beach County Park and the south end of Carpinteria Avenue within the City of Carpinteria. The trail is approximately 0.9 miles long and begins in the City of Carpinteria, and ultimately ends at the Rincon Beach County Park. The trail utilizes land owned by the City of Carpinteria and the County of Santa Barbara, two of the project proponents. Part of the trail will be constructed on currently owned Caltrans right of way, which then will be transferred to the City of Carpinteria. When completed the trail will provide direct access to the 4-mile bike/ped path that begins at Rincon State Park/Bates Road and continues south past Mussel Shoals adjacent to Highway 101. The City of Carpinteria, acting as the CEQA lead agency, approved an environmental document in May 2015. The project was identified by the California Coastal Commission as a balancing project for the City of Carpinteria’s Local Coastal Program Amendment (LCPA) that was necessary as a result of the Highway 101 HOV (Phase 4) and Linden Casitas (Phase 3) improvements. Furthermore, the Coastal Development Permit (CDP) issued to Caltrans for the Linden Casitas project by the City of Carpinteria in November 2015 included a condition of approval which required the completion of the Rincon Trail project as a coastal access “mitigation” project for Highway 101 improvements.

Previous Funding Up to 2016, the Rincon Trail project had only received smaller grants to complete preliminary engineering and environmental. Subsequent phases were unfunded such as design, right of way and construction. In 2016, an opportunity for construction funding arose through the Active Transportation Program (ATP). SBCAG partnered with Caltrans, City of Carpinteria and the County of Santa Barbara to submit an application for ATP funds for construction. The California Transportation Commission approved the ATP Cycle 3 application for $6.83 million. With construction funding in hand, SBCAG has continued to work with the City of Carpinteria to fund design and right of way. Part of the funding was identified in 2017 when the City of Carpinteria received a $150,000 Coastal Conservancy grant. The remaining estimated budget for design and right of way at the time was achieved when SBCAG re-programmed funding from construction to design and right of way in the amount of $802,000. The $952,000 total funding was identified as sufficient at the time to fully fund design and right of way phases. New Funding Request The City of Carpinteria’s design team, in an effort to reduce construction and right of way costs, presented a revised alternative to the project development team (PDT) in summer of 2017. Alternative 2, as it was called along with the original alignment (Alternative 1) are shown in Figure 1 below. Alternative 2, based on criteria considered by the PDT and prepared by the City’s design team would avoid railroad right of way, reduce utility conflicts, and eliminate about $1.0 million in proposed retaining walls. However, the new alignment would require additional environmental studies, which would result in a CEQA re-evaluation by the City and delay the NEPA process, which was required by Caltrans because of the federal funding nexus for construction from ATP.

With the information in hand regarding reduced costs but schedule implications, the PDT approved the new Alternative 2 and the City solicited contract services for the design, right of way and environmental re-evaluation from the consultant team that was on board. During the CEQA re-evaluation, the City identified some new biological and cultural resources that required additional study and the preliminary engineering work exceeded previous budget estimates due in part to complex geotechnical testing and assessment required as a result of the extensive earthwork needed for Alternative 2.

In all, the City is seeking approximately $250,000 to cover the additional environmental review (CEQA/NEPA), preliminary engineering and additional geotechnical costs. SBCAG has asked the CTC about reprogramming the ATP funding in design and right of way from SB1 to cover costs for revising environmental and preliminary engineering, but this is not an option. Furthermore, the design and right of ways from ATP cannot be accessed until NEPA is complete. As a result, the City is seeking funding from the Highway 101 reserve of Regional Surface Transportation Program funding (RSTP). The SBCAG board has come to recognize the link between the Highway 101 improvements and the coastal access projects and has approved use of the RSTP reserve on the Santa Claus Lane Bikeway. There are no other funding sources available to fund the need for the Rincon Project that would be immediately available to keep the project moving forward. Staff has met with the City to discuss this matter and consequently, SBCAG staff is recommending that $250,000 from the RSTP reserve (for Highway 101) be allocated to the project. The remaining components of design, right of way and construction are fully funded. On December 6, 2018, the Transportation Technical Advisory Committee (TTAC) of SBCAG met and recommended approval to the SBCAG board. On January 9, 2019, the South Coast Subregional Planning Committee (SCSPC) also recommended approval of three actions before the board.

Resolution and Memorandum of Understanding Amendment Approval of the funding requires that SBCAG’s Overall Work Plan (OWP) and Budget for FY 18-19 be amended. Resolution 19-09 has been prepared and is included as Attachment A1 to document this change. Attachment A2 includes the modified OWP Work Element 5826 for “US 101 Local Project Support” to show the revised funding. Attachment A3 includes the revised budget and funding table showing the revised “State” funding for the RSTP contribution identified in bold/italics. Approval of the funding by the SBCAG would also require an amendment to the Memorandum of Understanding first entered into by SBCAG and the City of Carpinteria in November 2017. Amendment No. 1, provided as Attachment B, has been developed to include the $250,000 in additional funding for design and right of way from RSTP and also provide some additional changes such as the revised point of contact for the City of Carpinteria and distinction between federal and non-federal funding for this project. COMMITTEE REVIEW:

1. On December 6, 2018, TTAC recommended for approval the additional RSTP funding.

2. On January 9, 2019, the South Coast Subregional Committee recommended approval of the three recommendations.

US 101 LOCAL PROJECT SUPPORT

Objective

To assist local agencies with the planning, project development and funding of potential local coastal development permit projects that are related to the Measure A funded US 101 HOV project. Projects include the Cabrillo Blvd. \ UPRR Underpass Bridge Replacement, the Olive Mill Road Intersection Improvements and the San Ysidro Road Intersection Improvements.

Previous and Ongoing Work

• Development and execution of a funding agreement with City of Santa Barbara forCabrillo Project.

• Serve as Project Development Team (PDT) member for feasibility study on CabrilloProject by City of Santa Barbara and for Intersection Control Evaluation (ICE) studies forOlive Mill and San Ysidro projects for City of Santa Barbara and County of SantaBarbara, respectively.

• Development and execution of a funding agreement for the Olive Mill and San Ysidroprojects with the County and City of Santa Barbara, respectively.

Tasks

1. Administer various funding sources through Caltrans for each of the local projectsincluding, but not limited to: preparing requests for authorization, programming changes,coordinating reimbursable costs submitted by local agencies, preparing invoices.

2. Participate on PDT teams for each of the projects which includes reviewing deliverables,and coordinating work being developed by the US 101 HOV team members.

3. Work with local agencies on the development and monitoring of Memorandum ofUnderstandings to guide the process for advancing each of the local projects.

4. Participate in local agency consultant selection processes
