PLANNING SCHEMES 11.1 What is a planning scheme?

Aplanningschemeisastatutorydocumentwhichsetsoutobjectives,policiesandprovisionsrelatingtotheuse,development,protectionandconservationoflandintheareatowhichitapplies.Aplanningschemeregulatestheuseanddevelopmentoflandthroughplanningprovisionstoachievethoseobjectivesandpolicies.

Mattersthataplanningschememayprovideforaredescribedinsection6ofthePlanning and Environment Act 1987 (theAct).

TheActrequiresthataplanningscheme:

• mustseektofurthertheobjectivesofplanninginVictoriawithintheareacoveredbythescheme

• mustcontainaMunicipalStrategicStatement(MSS),iftheschemeappliestothewholeorpartofamunicipality

• maymakeanyprovisionwhichrelatestotheuse,development,protectionorconservationofanylandinthearea(section3oftheActdefinesthemeaningoftheseterms).

1.2 What are the Victoria Planning Provisions?

TheActdistinguishesbetweentheVictoria Planning Provisions(VPP)andaplanningscheme.TheVPPisadocumentcontainingacomprehensivesetofplanningprovisionsforVictoria.Itisnotaplanningschemeanddoesnotapplytoanyland.Itisastatewidereferenceused,asrequired,toconstructaplanningscheme.ItisastatutorydevicetoensurethatconsistentprovisionsforvariousmattersaremaintainedacrossVictoriaandthattheconstructionandlayoutofplanningschemesisalwaysthesame.

Inpreparingandmaintainingtheplanningscheme,acouncildrawsfromtheVPPintwoessentialways:

1. ItmustincludeprovisionswhicharemandatoryinallplanningschemesinVictoria.TheseincludetheStatePlanningPolicyFramework(SPPF),the‘particularprovisions’applyingtospecifiedcategoriesofuseanddevelopment(suchascarparkingandadvertisingsigns),the‘generalprovisions’andthe‘definitions’.

2. ItmayincludeprovisionswhicharerelevanttoorgiveeffecttoitsMSSandlocalplanningpolicies(LPPs).Theseprovisionswillincludetherelevantstatestandardzonesandoverlaystobeappliedinthescheme.Someofthesezonesandoverlaysincludelocalprovisionsasschedulestothezoneoroverlay.

Inthesimplestterms,aplanningschemeisconstructedbytakingtheVPPasabasictemplate.Intothisisinsertedthelocalvisionandpolicyframework(theMSSandLPPs).Thezonesandoverlaysneededtoimplementthesearethenselectedandappropriatelocalprovisionsarewrittentosupportthezonesandoverlays(theschedules).

1.3 What is a zone?

Theplanningschemezoneslandforparticularuses,forexample,residential,industrial,businessorother.Thezonesarelistedintheplanningschemeandeachzonehasapurposeandsetofrequirements.Thisinformationdescribesifaplanningpermitisrequired,andthemattersthatthecouncilmustconsiderbeforedecidingtograntapermit.Azonemayalsospecifyinformationthatmustbesubmittedwithaplanningpermitapplication.Thezonealsocontainsinformationrelatingtolanduses,subdivisionofland,constructionofnewbuildingsandotherchangestotheland.

Azonesetsoutlandusecontrolsinthreesections:

• Section1:Landusesthatdonotrequireaplanningpermit.

• Section2:Landusesthatrequireaplanningpermit.

• Section3:Prohibiteduses.Someusesarenotallowedonlandinazonebecausetheymayconflictwithotheruses;forexample,industryisprohibitedintheGeneralResidentialZone.

1.4 What is an overlay?

Theplanningschememapmayshowthatapieceoflandhasanoverlayaswellasazoneaffectingit.Notalllandhasanoverlay.Somelandmaybeaffectedbymorethanoneoverlay.Ifanoverlayapplies,thelandwillhavesomespecialfeaturesuchasaheritagebuilding,significantvegetationorfloodrisk.TheHeritageOverlay,forexample,appliestoheritageplacesofnaturalorculturalsignificanceanddescribestherequirementsthatapply.

Theoverlayinformationwillindicateifaplanningpermitisrequiredfortheconstructionofabuildingorotherchangestotheland.Forexample,ifaHeritageOverlayapplies,aplanningpermitisrequiredtodemolishanexistingbuilding.TheHeritageOverlayrequirescounciltoconsider,beforeitgrantsthepermit,whetherthedemolitionofthebuildingwilllessenthesignificanceoftheheritageplace.Anoverlaymayspecifyinformationwhichmustbesubmittedwithanapplicationforaplanningpermit.

Useoflandreferstousinglandforaparticularpurpose(suchasadwellingorashop)andmaynotinvolvebuildinganything.

Developmentincludestheconstruction,alterationordemolitionofabuildingorworksandthesubdivisionorconsolidationofland.

Insomezones,thedevelopmentoflandandtheproposednewusebothrequireapermit.Forexample,intheMixedUseZone,apermitisrequiredtoconstructabuildingandtouseabuildingforindustry.Inotherzones,theusemaynotrequireapermit,butapermitmayberequiredtoconstructthebuilding(thedevelopment)fortheuse.Inthissituation,councilcanonlyconsidertheeffectsofthenewbuilding(suchasheight,visualbulkandsoon)andnotthechangeintheuseoftheland.

1.6 Whoandwhatisaffectedbyaplanningscheme?

PlanningschemesmayapplytoallprivateandpubliclandinVictoria.Aplanningschemeisbindingonallmembersofthepublic,oneveryVictorianminister,governmentdepartment,publicauthorityandcouncil.

Thelandtowhichaplanningschememayapplyincludeslandcoveredbywater(suchaslakesandsomecoastalwaters)andareasaboveorbelowground(suchasairrightsandexcavations).

ExemptionsmaybeprovidedbyaGovernorinCouncilOrderpublishedintheGovernment Gazette.

Currentexemptionsundersection16oftheActapplytoanumberofministers.Exemptionsalsoapplytospecificsitesandprojects,suchaspartsofAlbertPark.

Wheretheyhavebeenexemptedfromanylegalneedtocomplywithplanningschemerequirements,asamatterofpracticetheministersconcernedshouldconsultfromanearlystagewithrelevantplanningauthoritiesonproposedworks.Thisconsultationfosterscooperativeinvolvementoflocalgovernmentinstateplanninganddevelopmentmatters.Consultationneedstobeeffectiveandthereforeshouldbemorethanthemerecirculationofproposals.

Undersection52(i)oftheCommonwealthConstitutionandtheCommonwealth Places (Administration of Laws) Act 1970(Vic)andsubjecttotheCommonwealth Places (Application of Laws) Act 1970(Cth),theCommonwealthhasexclusivelegislativepowerinrelationtoplacesacquiredbytheCommonwealthforapublicpurpose.Thereforeaplanningschemedoesnotapplytoa‘Commonwealthplace’.WhetheraparticularCommonwealthagencyisconsideredtheCommonwealthmaydependonitsgoverninglegislation,fundingandlevelofcontrol.Forexample,bodiessuchastheTelstraCorporation,AustraliaPostalCommissionandAustralianBroadcastingCorporationaresubjecttoaplanningscheme.

AnyrequirementinaplanningschemeseekingtoregulatetheuseordevelopmentofCommonwealthlandisinoperative.LanddisposedofbytheCommonwealthcanonlybesubjecttoplanningcontrolsifanamendmentispreparedandapprovedafterdisposal.CommonwealthlandisidentifiedasCAonplanningschememaps.

1.6.1 Existinguses

AplanningschemecannotpreventthecontinuationofalawfullyexistinguseundertheActiftheexistingusewasestablishedbeforetheplanningschemecameintooperation.

Clause63oftheplanningschemeprovidesthatanexistinguserightisestablishedifanyofthefollowingapply:

• theusewaslawfullycarriedoutimmediatelybeforetheapprovaldate

• apermitfortheusehadbeengrantedimmediatelybeforetheapprovaldateandtheusecommencesbeforethepermitexpires

• apermitfortheusehadbeengrantedforanalternativeuse,whichdoescomplywiththescheme,andtheusecommencesbeforethepermitexpires

• proofofcontinuoususefor15yearsisestablished

• theuseisalawfulcontinuationbyautilityserviceproviderorotherprivatebodyofausepreviouslycarriedonbyaminister,governmentdepartmentorpublicauthority,evenwherethecontinuationoftheuseisnolongerforapublicpurpose.

Thisdoesnotapplytoalawfuluseofland:

• whichhasstoppedforacontinuousperiodoftwoyears

• whichhasstoppedfortwoormoreperiods,whichtogethertotaltwoyearsinanyperiodofthreeyears,or

• inthecaseofaseasonaluse,whichdoesnottakeplacefortwoyearsinsuccession.

Forexistinguserightsestablishedthroughausehavingbeenlawfullycarriedoutimmediatelybeforetheapprovaldate,therelevant‘approvaldate’is:

• thedatewhentheplanningschemecommencedoperation;or

• thedatewhenanamendmenttotheplanningschemecommencedoperationwhichwouldhavehadtheeffectofrestrictingorprohibitingtheuse.

Itissometimesnecessarytotraceanexistingusebackthroughpriorplanningschemesorprovisionsovermanyyearstodetermineitslawfulness.However,toavoidcumbersomeinvestigations,planningschemesdeemanexistingusetohavebeenlawfullyestablishedifproofofcontinuoususefor15yearsisestablishedinaccordancewithClause63.11oftheplanningscheme.

Existinguserightsapplytoland,nottotheownersorotherswithaninterestintheland.Itisalsoimportanttonotethattheserightsapplyonlytotheuseofland,notdevelopment.Whatisallowedtocontinueistheusethatwaslawfullycarriedoutimmediatelypriortotheapprovaldateoftheamendmentorschemethatprohibitedtheuse.Inthissituation,theuseisconfinedtothesamespecificuse,notbythelandusedefinitionssetoutintheplanningscheme.

TheprinciplesofestablishingtheusetowhichexistinguserightsapplyarebasedonthoseappearingincasessuchasShire of Perth v O’Keefe (1964) 10 LGRA 147 and City of Nunawading v Harrington [1985] VR 641.

TheActallowsplanningschemestorequirethatexistingusescomplywithacodeofpracticewhichhasbeenapprovedbyParliament.Forexample,planningschemescurrentlyrequiretheuseoflandfortimberproductiontocomplywiththeCode of Practice for Timber Production.

PLANNING SCHEMES1.6.2 Who administers the planning scheme?

Theadministrationandenforcementofaplanningschemeisthedutyofaresponsibleauthority.InmostcasesthiswillbeacouncilbutitcanbetheministeradministeringtheActoranyotherpersonwhomtheplanningschemespecifiesasaresponsibleauthorityforthatpurpose.Forexample,intheMelbournePlanningScheme,theMinisterforPlanningistheresponsibleauthorityforlandinanumberofareasincludingtheMelbourneCasinoArea,MelbourneDocklandsArea,FlemingtonRacecourseandtheRoyalMelbourneShowgrounds.

Acouncilwillusuallyactasbothplanningauthorityandresponsibleauthority.

Iftheresponsibleauthorityforparticularlandorparticularmatterschangesatanytime(forwhateverreason),the‘old’responsibleauthorityimmediatelylosesitspowersandmattersofacontinuingnaturecanbedecided(withoutanyneedtostartagain)bythe‘new’responsibleauthority.Relevantdocumentsmustbetransferredtoassistthe‘new’responsibleauthority.

Ifthechangeisduetoanalterationinadministrativeboundaries,aplanningschemeamendmentwilleventuallybeneededtotransferthecontroloveraffectedlandtoanotherplanningscheme.

1.6.3 Wheremustaplanningschemebeavailableforinspection?

TheActrequiresthecouncilandtheresponsibleauthoritytomaintainanup-to-datecopyoftheplanningscheme,incorporatingallamendmentstoitandalldocumentslodgedwiththoseamendments.(Inmostcasesthecouncilisalsotheresponsibleauthorityforthescheme).Theplanningschememustbemadeavailablefreeofchargeforpublicinspectionduringofficehours.AsimilarbutmoreextensiverequirementappliestotheministeradministeringtheAct,whomustmakeavailableupdatedcopiesofalloperativeschemesinVictoria.Thesedocumentsareavailableonlineat planningschemes.dpcd.vic.gov.auand(forallschemesthatapplyintheregion)atthedepartment’srelevantregionaloffice.

Regulation25requiresthatbeforedecidingonapermitapplicationtheresponsibleauthoritymustmakeavailableforinspectionfreeofchargeatitsofficesacopyofanydocumentwhichitconsidersundersection60(1A)(g)oftheAct.Iftheresponsibleauthorityisnotthecouncilforthemunicipaldistrictinwhichthelandislocated,theresponsibleauthoritymustgiveacopyofthedocumenttothecouncilforthepurposeofmakingthedocumentavailableforinspectionfreeofchargeatthecouncil’soffices.

Undersection60(1A)(g)oftheActaresponsibleauthoritymayconsideranystrategicplan,policystatement,codeorguidelinewhichhasbeenadoptedbyaminister,governmentdepartment,publicauthorityorcouncilbeforedecidingonanapplication.

Inanycasewherethereissomedoubtwhetheradocumentcomeswithinthescopeofthisrequirement,theresponsibleauthorityshouldmakesureitisavailable.

1.6.4 Whenmustaplanningschemebereviewed?

AplanningauthoritywhichisamunicipalcouncilmustreviewitsplanningschemenolaterthanoneyearaftereachdatebywhichitisrequiredtoapproveaCouncilPlanundersection125oftheLocal Government Act 1989;orwithinsuchlongerperiodasisdeterminedbytheMinisterforPlanning.

Theobjectiveofthereviewistoenhancetheeffectivenessandefficiencyoftheplanningschemeinachieving:

• theobjectivesofplanninginVictoria,and

• theobjectivesoftheplanningframeworkestablishedbytheAct.

1.6.5 What must the review evaluate?

Thereviewmustevaluatetheplanningschemetoensurethatit:

• isconsistentinformandcontentwiththedirectionsorguidelinesissuedbytheMinisterundersection7(seeSection1.7)

• setsouteffectivelythepolicyobjectivesforuseanddevelopmentofland

• makeseffectiveuseofstateprovisionsandlocalprovisionstogiveeffecttostateandlocalpolicyobjectives.

Whenthereviewiscompleted,theplanningauthoritymustreportitsfindingstotheministerwithoutdelay.

1.7 WhatistheMinisterialDirectionontheformandcontentofplanning schemes?

Undersection7(5)oftheAct,theformandcontentofallplanningschemespreparedunderPart3ofthePlanning and Environment (Planning Schemes) Act 1996andanyamendmenttoaplanningschememustcomplywiththeMinisterialDirectionontheFormandContentofPlanningSchemes.

Thestrategicfoundationofeachschemeismadeupoftwocomponents,theSPPFandtheLocalPlanningPolicyFramework(LPPF).Theapplicationofzones,overlaysandlocalprovisionsmusthaveareadilydiscerniblebasisinboththestateandlocalplanningpolicyframeworks.

1.8.1 State Planning Policy Framework

EveryplanningschemeincludestheSPPF.TheframeworkcomprisesgeneralprinciplesforlanduseanddevelopmentinVictoriaandspecificpoliciesdealingwithsettlement,environment,housing,economicdevelopment,infrastructure,andparticularusesanddevelopment.Toensureintegrateddecisionmaking,planningauthoritiesandresponsibleauthoritiesmusttakeaccountofandgiveeffecttothegeneralprinciplesandthespecificpoliciescontainedintheSPPF.

1.8.2 Local Planning Policy Framework

TheLPPFsetsalocalandregionalstrategicpolicycontextforamunicipality.ItcomprisestheMSSandspecificlocalplanningpolicies.

TheLPPFmustbeconsistentwiththeSPPFandshould,wherepossible,demonstratehowbroaderstateplanningpolicieswillbeachievedorimplementedinalocalcontext.

IfthereisaninconsistencybetweentheSPPFandtheLPPF,theSPPFprevails.

Municipal Strategic Statement

AnMSSisapartoftheLPPFandisastatementofthekeystrategicplanning,landuseanddevelopmentobjectivesforthemunicipalityandthestrategiesandactionsforachievingthoseobjectives.ItpromotestheobjectivesofplanninginVictoriatotheextentthattheSPPFisapplicabletothemunicipalityandlocalissues.TheMSSestablishesthestrategicplanningframeworkforthemunicipalityandencapsulatessignificantplanningdirections.TheSPPFandMSSprovidethestrategicbasisfortheapplicationofthezones,overlaysandparticularprovisionsintheplanningschemeanddecisionmakingbytheresponsibleauthority.

TheMSSprovidesanopportunityforanintegratedapproachtoplanningacrossallareasofacouncil’soperationsandshouldclearlyexpresslinkstothecouncil’scorporateplan.TheMSSisdynamicandenablescommunityinvolvementinitsongoingreview.TheMSSshouldbecontinuallyrefinedastheresponsibleandplanningauthoritydevelopsandrevisesitsstrategicdirectionsinresponsetothechangingneedsofthecommunity.

TheMSSmustbetakenintoaccountwhenpreparingamendmentstoaplanningschemeormakingdecisionsunderthescheme.

Local Planning Policy

AnLPPsetsouttheguidingprinciplesoftheplanningschemeandisoneofthetoolsavailableforimplementingobjectivesandstrategiesintheMSS.

AnLPPisapolicystatementofintentorexpectation.Itstateswhattheresponsibleauthoritywilldoinspecifiedcircumstances,ortheresponsibleauthority’sexpectationofwhatshouldhappen.AnLPPgivesaplanningauthorityanopportunitytostateitsviewofaplanningissueanditsintentionsforanarea.LPPsprovideguidancetodecisionmakingonaday-to-daybasiswherethisisnotachievableintheVPPzonesandoverlays.

AnLPPhelpsthecommunitytounderstandhowaproposalwillbeconsideredandwhatwillinfluencedecisionmaking.Overtime,theconsistentapplicationofpolicyshouldachievethedesiredoutcome.

LPPsmustbetakenintoaccountwhenpreparingamendmentsormakingdecisions.

StandardzonesforstatewideapplicationareincludedintheVPP.Thesezonesareusedinallplanningschemes,asrequired.Animportantfeatureofthezones,whichisreflectedinthefirstpurposeofeachzone,isthattheyaretobeadministeredtoimplementtheSPPFandLPPF,includingtheMSSandLPPs.

Eachplanningschemeincludesonlythosezonesrequiredtoimplementitsstrategy.Thereisnoabilitytovarythezonesortointroducelocalzones.AdditionalzonescanonlybeintroducedbyanamendmenttotheVPP.Somezoneshaveschedulesthatprovideforlocalcircumstances,suchastheMixedUseZone,theRuralLivingZoneandthePublicConservationandResourceZone.RefertoSection1.8.12forashortsummaryofeachzone.

1.8.4 Overlays

Inadditiontotherequirementsofthezone,furtherplanningprovisionsmayapplytoasiteorareathroughtheapplicationofanoverlay.Bothareequallyimportant.Aswiththezones,standardoverlaysforstatewideapplicationareincludedintheVPP.Eachplanningschemeincludesonlythoseoverlaysrequiredtoimplementthestrategyforthatmunicipality.Generally,overlaysapplytoasingleissueorrelatedsetofissues(suchasheritage,anenvironmentalconcernorflooding).Wheremorethanoneissueappliestoland,multipleoverlayscanbeused.Overlaysmusthaveastrategicjustification.Manyoverlayshaveschedulestospecifylocalobjectivesandrequirements.Mostoverlaysmakerequirementsaboutdevelopmentratherthanlanduse.Overlaysdonotchangetheintentofthezone.RefertoSection1.8.13forashortsummaryofeachoverlay.

1.8.5 Particularprovisions

Particularprovisionsarespecificprerequisitesorplanningprovisionsforarangeofparticularusesanddevelopments,suchasadvertisingsignsandcarparking.TheyapplyconsistentlyacrossthestateandthereisnoabilitytoincludeinplanningschemesparticularprovisionswhicharenotintheVPP.Unlessspecifiedotherwise,theparticularprovisionsapplyinadditiontotherequirementsofazoneoroverlay.Someparticularprovisionshaveschedulesforlocalrequirements.

1.8.6 General provisions

Generalprovisionsareoperationalrequirementswhichareconsistentacrossthestate.Thegeneralprovisionsincludematterssuchasexistinguserights,administrativeprovisions,ancillaryactivitiesandreferralofplanningpermitapplications.Somegeneralprovisionshaveschedulesforlocalrequirements.

1.8.7 Schedules

Schedulesareusedtoidentifytheneeds,circumstancesandrequirementsofindividualmunicipalitiesinspecificcircumstances.TogetherwiththeLPPF,schedulesarethemeansofincludinglocalcontentinplanningschemes.Theycanbeusedtosupplementor‘fine-tune’thebasicprovisionsofastate-standardclause,zoneoroverlayinaplanningscheme,adaptingittolocalcircumstancesandlocallydefinedobjectives.ThismeansthatschedulesareakeytoolforimplementingobjectivesandstrategiesintheMSS.

AirportEnvironsOverlay(Clause45.02andschedules)Thisoverlayisappliedtolandthatissubjecttohighlevelsofaircraftnoiseandsetsoutrequirementstorespondtothosenoiseconditions.TheAustralian Noise Exposure Forecast(ANEF)definesareasofhighaircraftnoiselevels.WhereANEFcontoursdonotexist,AustralianStandardAS2021–2000,Acoustics – Aircraft Noise Intrusion – Building Siting and Construction,givesguidancefordetermininganappropriateboundary.

MelbourneAirportEnvironsOverlay(Clause45.08andschedules)ThisoverlayseekstoensurethatlanduseanddevelopmentinthevicinityofMelbourneAirportiscompatiblewiththeoperationoftheairportandthatexposureofnewdwellingsandothernoise-sensitivebuildingstoaircraftnoiseisminimisedthroughappropriatenoiseattenuationmeasures.

Theoverlaycontrolsrestrictdevelopmentorrequirespecialconsideratontobegiventoparticularusesthatmaybesensitivetonoiseinareasthatareforecasttobeaffectedbymoderatetohighlevelsofaircraftnoise.
