SUMMARY
FAILED LeadershipUnlike years past when Governor Cuomo, Dean Skelos,and Shelly Silver exchanged high fives in the red room,this years silence spoke volumes about the quality of the2013 session.
With the advent of coalition government in the Sen-ate, people who care about the environment enteredthe year with high hopes for a productive legislativesession. We believed that environmental and publichealth protections stood a better chance of passage withIndependent Democratic Conference (IDC) Senator JeffKlein leading a so-called group of moderate Democratsalongside Republican Senator Dean Skelos conference,which has historically been difficult to move on issues
ranging from climate change to protecting children fromtoxic chemicals.
They promised to end the Senates dysfunction, and wehad every reason to believe them.
How wrong we were.
Instead, for the second year in a row, the Senate did notdeliver a single Super Bill to Governor Andrew Cuomofor his signature. On issue after issue, Senators Skelos
and Klein refused to allow simple votes on legislationand stymied proposals advanced by anyone other thanmembers of the majority coalition. Oftentimes, it ap-peared they were not only at political war with themainline Democratic Conference, but each other.
Worse, even good bills sponsored by members of theruling Independent Democratic and Republican confer-ences died in Senator Mark Grisantis EnvironmentalConservation Committee the graveyard of good envi-ronmental and public health legislation.
The GREEN GulfOnce again the Assembly worked hard to move goodpolicy with Assemblyman Bob Sweeney putting ourenvironment and health ahead of the wall of corporatemoney that consistently shuts down good legislation inthe Senate. In all, the Assembly passed 26 good bills to
just 11 passed by the Senate.
As importantly, Speaker Sheldon Silver led the Assemblyto shut down every bad bill passed by the Senate, in-cluding legislation to invalidate critical regulations thatprovide basic health, safety, and environmental protec-tions. Three of these bills earned 3-smokestacks underEnvironmental Advocates rating system because theirenvironmental impact would have been so severe; thiswas the highest number of 3-smokestack bills passed bythe Senate in five years.
While we applaud the Assembly for continuing to leadon environmental issues, they must also step up theirefforts to ensure their initiatives make it through bothhouses and are signed into law by the Governor.
Senate GRAVEYARDWe saw two forms of gridlock during the session: failureto lead and failure to negotiate.
Failed leadership was seen in two bills that died in theSenate despite having more cosponsors than were need-ed for passage. Senator Philip Boyle worked tirelessly onbehalf of the Child Safe Products Act garnering co-sponsorship from an incredible 37 senators, including threemembers of the IDC and seven republicans. Legislationrequires just 32 votes to pass. The bill went nowhere.
Unrelenting public pressure brought 34 cosponsors,including the IDC and several Republicans, onto a billthat would close a gaping loophole in existing regula-tions and require drilling companies to properly dispose
of their hazardous waste. The bill went nowhere.

A failure to compromise sunk Governor Cuomos planto make our state a leader in the development of clean,renewable energy and in the process create thousandsof jobs and lessen climate-altering emissions by plac-ing the NY-Sun Initiative in statute for 10 years. Bothhouses passed versions of the bill, but they were unableto reconcile their differences, so when the final gavel fellNew Yorkers were left with nothing. It is now on Gov-
ernor Cuomos shoulders to take action.
Real World CONSEQUENCESDespite promises of reform, the Senate failed to passany campaign finance plan that would finally break thelegislative logjam that stalls common-sense solutions toreal world problems.
It seems to have been lost on Senators Skelos and Kleinthat New Yorks environmental dangers are real. When
climate change delivers a steady rain of devastating andunpredictable storms, there are consequences. Whenmanufacturers are allowed to load up childrens prod-ucts with deadly chemicals, there are consequences.And when a legislative body fails to deliver on any of itspromises, there will be consequences.

Honorable Mention: ROBERT K. SWEENEY
In a sea of disappointment, one legislator in particular stood out for his ongo-ing commitment to our environment.
As Chair of the EnvironmentalConservation Committee, Assembly-member Sweeney (DLindenhurst)continued to cement his role as achampion for New Yorks air, land,and water. He was the lead sponsor on
three of the four environmental com-munitys 2013 Super Bills, and was instrumental in passing them through hisChamber. The Assemblyman also shepherded a number of other environ-mentally beneficial bills to the floor for a vote including bills to keep mercuryout of landfills and a bill to include future climate risks in municipal planningefforts.
Two Ends of the SPECTRUM
In 2013, state legislators seemed more interested in gamesmanship and politicalpower plays than working together to get anything accomplished an extremelydisappointing turn of events following the devastating toll that Superstorm Sandyand other severe weather events had on many communities statewide.
As a result, EPL/Environmental Advocates is unable to provide anyone with thedistinction of 2013 Legislator of the Year. This years legislative session broughtno substantive action on issues of climate change, fracking, or childrens health.For the second year in a row, none of the environmental communitys Super Billswere sent to the Governor. And the one area of potential achievement the solarenergy development failed due an impasse between the Senate and Assembly
leaving the two houses unable to sort out nominal disagreements.

OIL SLICK AWARDEE: Jeffrey Klein
When Senator Klein (D-Bronx) arranged his ascension to hiChambers co-presidency, he promised to end the dysfunctio
that has consumed the Senate for years.
Instead, he: prevented common-sense legislationfrom makin
its way through the legislative process; refused to use his leadership position to prevent the
roll back of hard-fought environmental protections from coming to the floor;
voted for several bad bills which could kill protec-tions that Senator Klein and his colleagues voted infavor of in previous years.
We had high hopes going in to 2013 that bipartisan leadershwould finally break the legislative logjam that has stalled somany initiatives in the past. Unfortunately, the 2013 legislatisession ended with one of the most dismal environmental recordin history.
Senator Klein recieves the 2013 Oil Slick Award due to hislack of commitment to public health and environmentalprotection. The Senator seems more interested in power andpress releases, than sound public policy. We hope that in 201he will act as the leader he promised to be.

Legislators earn between 1 and 3 points respectively
for votes in support of bills rated by EnvironmentalAdvocates of New York as 1, 2, or 3 tree bills. Tree-rated bills are those that will benefit the environment.Legislators earn between 1 and 3 points respectivelyfor votes against bills that are given a rating of1, 2, or3 smokestacks. Smokestack-rated bills are those thatwill harm the environment.
Legislators earn points for supporting Super Bills the environmental communitys top legislativepriorities as follows:
Co-sponsoring: Lawmakers receive half-credit (1.5points of a 3-tree bill) for Super Bills they sponsor orco-sponsor. However, if a Super Bill is voted on, the
vote is counted in the score, and credit is not given forco-sponsorship. Members who request to be added asco-sponsors also receive co-sponsorship credit.
Becoming law: If a Super Bill is passed by bothhouses and signed into law, all legislators who votedfor it receive 3 points plus 2 bonus points.
Incompletes: Legislators who miss more than 20percent of votes receive a score of incomplete (INC).
