COMMISSIONER GRUNDFEST APPOINTS LEGAL ASSISTANTS

Anthony Ain and Max Berueffy have been named counsel to Commissioner Grundfest Mr Ain was formerly an associate in the washington DC office of Fried Frank Harris Shr iver s Jacobsen He has co-authored articles on a variety of securities law topics as well as the recently published six-volume treaties The Law of Financial Services which he wrote with Harvey Pitt and David Miles Mr Ain attended The Whar-ton School He received his JD from the University of Pennsylvania Law School and his BA in government from Cornell UniVersity Mr Ain replaces Bernard Black who left the Commission to teach law Mr Ains appointment is effective today

Mr Berueffy has been with the Commission since March 1987 in the Office of the General Counsel (OGC) As a staff attorney with the appellate branch of OGC he participated in the preparation of the Commissions amicus briefs filed in the Supreme Court in Basic Inc v Levinson and Pinter V Dahl Mr Berueffy wrote with Daniel Goelzer an article on recent legislative attempts to define insider trading Insider Trading The Search for a Definition 39 Ala L Rev 491 (1988) He received his JD from the university of california at Davis and his BA in classical languagesfrom Grinnell College Mr Berueffy replaces Nancy Morris who moved to the Division of Investment Management Mr Berueffys appointment was effective August 22

ADMINISTRATIVE PROCEEDINGS

PROCEEDING INSTITUTED AGAINST WILLIAM E FRITZ

The Commission instituted public administrative proceedings under Section 203 (f) of the Investment Advisers Act of 1940 against William E Fritz formerly the portfoliomanager and an officer and shareholder of a registered investment adviser Simultane-ously Fritz submitted an Offer of Settlement which the Commission accepted The Order to which Fritz consented without admitting or denying the findings contained therein bars him from association with any broker dealer investment adviser invest-ment company or municipal securities dealer As part of Fritz undertakings contained in his Offer of Settlement he agreed to disgorge $5666750

Among other things the Commission found that Fritz willfully aided and abetted viola-tions of the antifraud provisions of the Securities Exchange Act when as portfoliomanager of the Marshall and Ilsey Growth Fund he agreed with Richard M Cannistraro to purchase for the fund a number of shares of both Liquidation Control Inc and Toxic Waste Containment Corp In return Cannistraro arranged to have an account opened at Monarch Funding Corp in the name of Fritz brother-in-law which account was guaran-teed by Cannistraro to make a profit in the trading of the two securities (ReIIA-1139)

PROCEEDING INSTITUTED AGAINST BRIAN J LAREAU

The Commission instituted public administrative proceedings against Brian J Lareau former registered representative of EF Hutton amp Company Inc (Hutton) The Order Instituting Proceedings alleges that Lareau among other things (1) opened customer accounts at Hutton using false names and social security numbers (2) assisted custo-mers in structuring transactions in order to evade currency transaction reports and (3) pleaded guilty in US v Brian J Lareau Cr No 88-037-B DRI to falsification of social security numbers on customer accounts and causing other financial institu-tions to fail to file currency transactions reports in conjunction with the Bank Secrecy Act A hearing will be scheduled to take evidence on the staffs allegationsand to afford an opportunity to present any defenses thereto (ReI 34-26038)

CIVIL PROCEEDINGS

GARY M WOZNIAK ENJOINED

The Chicago Regional Office announced that on August 15 Judge George LaPlata Eastern District of Michigan granted the Commissions Motion for Partial Summary Judgment and entered a permanent injunction against Gary M Wozniak The Order enjoins Wozniak from further violations of the antifraud provisions of the securities laws

The August 28 1987 Complaint alleges that as part of a fraudulent scheme Wozniak offered and sold securities to investors requiring them to make their checks payableto a personal bank account of wozniak for the purchase of securities Thereafter de-fendant failed to process the orders and thus misappropriated hundreds of thousands of dollars On August 28 1987 the Court entered a Temporary Restraining Order against Wozniak freezing his assets requiring him to provide an accounting to the Court and enjoining him from further violations of the antifraud provisions of the securities laws Wozniak was preliminarily enjOined from such violations on February4 (SEC v Gary M Wozniak Civil Action No 87-60283 EDMI s Divl (LR-11854)
