AND CHARLES BLOCK, JR. SUSTAINED The Commission has found that Robert A. Amato, William C. Boehmer, Jr. and Charles D. Block, Jr., salesmen in the New Orleans branch office of Brennan Ross Securities, Inc., formerly an NASD member, charged customers unfair markups in sales of the common stock of Barclays West, Inc. Amato was fined $20,000 and suspended in all capacities for four weeks by the NASD. Boehmer and Block were fined $5,000 each and suspended in all capacities for one week. Each of the applicants also was censured and required to requalify by examination as a registered representative following completion of his suspension. Applicants argued that, under Brennan Ross' internal procedures, the firm's traders (not applicants) were responsible for identifying excessive markups. The Commission found, however, that regardless of these internal procedures, various factors put applicants on notice of at least the possibility of improper pricing. Chief among these was that applicants were receiving commissions exceeding 20 percent which the Commission characterized as "represent[ing) a suspiciously high percentage of the prices paid by customers." The Commission also noted that, while the record supports the NASD's findings against all three applicants, "it paints an especially troubling picture" of the role played by Amato who was the firm's branch manager. The Commission has found that Robert A. Amato, William C. Boehmer, Jr. and Charles D. Block, Jr., salesmen in the New Orleans branch office of Brennan Ross Securities,Inc., formerly an NASD member, charged customers unfair markups in sales of the common stock of Barclays West, Inc. Amato was fined $20,000 and suspended in all capacities for four weeks by the NASD. Boehmer and Block were fined $5,000 each and suspendedin all capacities for one week. Each of the applicants also was censured and required to requalify by examination as a registered representative following completion of his suspension.

Applicants argued that, under Brennan Ross' internal procedures, the firm's traders (not applicants) were responsible for identifying excessive markups. The Commission announced that on February 3, 1993 the U.S. District Court for the Northern District of California entered a Final Judgment of Permanent Injunctionagainst defendants G. Alfred Roensch, Owen K. Stephenson, Pacific EquitiesCorporation, Arizona Investment Trust, Dallas Investment Trust and Phoenix Investment Trust. Defendants, without admitting or denying the allegations in the complaint,consented to the issuance of a Final Judgment that permanently restrains and enjoins all defendants from future violations Sections 5(a), 5(c) and 17(a) of the Securities Act of 1933, Section lOeb) of the Securities Exchange Act of 1934 and Rule 10b-5 promulgated thereunder. Roensch and Stephenson are permanently restrained and barred

from acting or serving as an officer or director of any issuer having a class of securities registered pursuant to Section 12 of the Securities Exchange Act of 1934 or requirFd to file reports pursuant to Section l5(d) of the Securities Exchange Act of 1934. Roensch and Stephenson are ordered pay disgorgement in the amount of six hundred fifty five thousand seven hundred and ten dollars ($655,710) plus interest through October 18, 1992 in the amount of one hundred thirty three thousand and eighty six dollars ($133,086) in the manner specified in the Final Judgment.

The complaint alleged that defendants participated in and effected a scheme to sell unregistered Electronic Medical Management, Inc. securities. As part of the scheme, defendants disseminated false and misleading corporate profiles of Electronic Medical Management, Inc. that, among other things, substantially overstated Electronic Medical Management, Inc. ORDER OF PRELIMINARY INJUNCTION ENTERED AGAINST LYNN OYLER AND DELTA STAR CORPORATION

On March 12, U.S. District Judge David Sam entered an order preliminarily enjoiningLynn R. Oyler and his company, Delta Star Corporation, from further violations of the registration and antifraud provisions of the Securities Act and Exchange Act. The Order also provides that a previously ordered asset freeze will continue in full force and effect and prohibits Oyler and Delta Star from transferring assets and destroying documents.

The Commission previously obtained a temporary restraining order and an order prohibiting the transfer of assets and the destruction of documents and other relief against Oyler and Delta Star. The Commission's complaint alleges that from at least July 1992 to the present, Oyler and Delta Star have engaged in a fraudulent scheme involving the offer and sale of interests in an offshore letter of credit program,representing that investors would receive a monthly return of 30%. The complaint also names Interfirst Equities Corporation, Bowen Bo Wagner and Fortune Plus ManagementCompany. [SEC v. Lynn R. COMPLAINT FILED AGAINST ROY LA BOLLE JR.

The Commission announced that on March 12 a complaint was filed in the U.S. District Court for the Northern District of Illinois against Roy Phillip La Bolle, Jr., a resident of Darien, Illinois. La Bolle was formerly employed by the Oak Brook office of PaineWebber, Inc. (PaineWebber), a broker-dealer registered with the Commission. The complaint seeks an Order of Permanent Injunction against La Bolle enjoining him from violations of the antifraud and books and records provisions of the federal securities laws and an Order requiring La Bolle to produce an accounting and to disgorge all ill-gotten gains.

The complaint alleges that La Bolle. while employed by PaineiJebber, engaged in excessive and unsuitable trading from December 1986 until June 1988, and engaged in unauthorized trading in 1988. In connection with these trades, it is alleged that La Bolle made material false and misleading statements to his clients regarding the values of their accounts and the risks related to trading index options and usingmargin in their accounts. COMPLAINT FILED AGAINST SHLOMO SELA

The Commission announced that on March 12 a complaint was filed in the U.S. District Court for the Southern District of Texas against Shlomo A. Sela, a resident of Houston, Texas. Sela was formerly a registered representative at the Houston Post Oak branch office of PaineiJebber, Inc. (PaineiJebber), a broker-dealer registered with the Commission. The complaint seeks an Order of Permanent Injunction against Sela enjoining him from violations of the antifraud and books and records provisions of the federal securities laws and an Order requiring Sela to produce an accounting and to disgorge all ill-gotten gains.

The complaint alleges that in 1987, Sela, while employed by PaineWebber, engaged in unsuitable trading in his customers' accounts by employing a risky options strategyand also engaged in excessive trading in these accounts. In connection with these trades, it is alleged that Sela made material false and misleading statements and omitted to disclose material facts to his customers about the value of their accounts-and the risks associated with Sela's trading strategy which involved the sale of puts using margin accounts. ACTION AGAINST LEONARD MEYERS

The Commission announced today that on February 26, 1993 the Honorable Jose A. Gonzalez, Jr., U.S. District Judge for the Southern District of Florida granted the Commission's Motion for a Summary Judgment as to the Amount of Disgorgement (SummaryJudgment) against defendant Leonard Meyers (Meyers) of Boca Raton, Florida. The Summary Judgment orders Meyers to disgorge $156,691, which represents the proceedsthat he unlawfully obtained pursuant to the fraudulent scheme described in the Commission's complaint. [SEC v.
