intended to define the term “immediate supervision” for the
purpose of physician supervision.
SUMMARY: The proposed rule amendment defines
“immediate supervision” to require a supervisor to be in the
same room as the physician being supervised.

The Agency has determined that this will not have an adverse
impact on small business or likely increase directly or indirectly

The Agency has determined that the proposed rule is not
expected to require legislative ratification based on the
statement of estimated regulatory costs or if no SERC is

its Board meeting, the Board concluded that this rule change
will not have any impact on licensees and their businesses or
the businesses that employ them. The rule will not increase any

64B8-4.025 Licensure Under Supervision. Unless
otherwise approved by the Board or its designee, or addressed
by Board Order, the following are provisions applicable to
Orders rendered by the Board when an applicant is certified for
licensure but said licensure is restricted or conditioned in such
a manner as to require a period of practice under supervision of
another licensee approved by the Board.

(2) Required Supervision.
(a) through (b) No change.
(c) Immediate Supervision. If an applicant is required to
work under the immediate supervision of another physician.
Respondent shall not perform designated procedures unless
under the immediate supervision of a board- certified physician
fully licensed under Chapter 458. F.S., who has been approved
by the Probationer's Committee. The physician providing
immediate supervision shall be physically located in the same
room with the applicant where the designated procedure is
performed.
(d)(c) If the terms of the Order include indirect or direct
supervision of the applicant's practice, the applicant shall not
practice medicine without an approved supervisor. If the terms
of the Order include immediate supervision. the applicant shall
not perform designated procedures unless under the immediate
supervision of an approved supervisor.

(3) Approval. The Board confers authority on the Chair of
the Credentials Committee to temporarily approve an
applicant's supervisor, practice plans, and designation of an area
of practice. To obtain this temporary approval, applicant shall
submit to the Board the information required in paragraph
(2)(e). Absent said approval, applicant shall not practice
medicine or perform designated procedures until a supervising
physician is approved. Temporary approval shall only remain
in effect until the next meeting of the Board. Final approval is
to be made by the Board.
(4) Change in Supervisor. In the event that applicant's
supervisor is unable or unwilling to fulfill his or her
responsibilities as a supervisor, the applicant shall advise the
Board of this fact within 24 hours of becoming aware of the
situation. Applicant shall submit to the Board the name of a
temporary supervisor for consideration. Applicant shall not
practice medicine or perform designated procedures pending
approval of this temporary supervisor by the Chair of the
Credentials Committee. Temporary approval shall only remain
in effect until the next meeting of the Board. Final approval is
to be made by the Board.

1. Indirect Supervision is supervision by a supervising
monitoring physician (monitor), as set forth in the Board’s
Order. Indirect supervision does not require that the supervisor
monitor practice on the same premises as the Respondent.
However, the supervisor monitor shall practice within a
reasonable geographic proximity to Respondent, which shall be
within 20 miles and shall be readily available for consultation.
The supervisor monitor shall be board-certified in the

64B8-8.0012 Probation Variables and Practice
Restrictions. In instances where a Respondent is placed on
probation or where practice restrictions are imposed by the
Board, the Board shall determine the terms and conditions of
Respondent’s probation or practice restrictions. The following
terms of probation are utilized by the Board to ensure that
Respondents are safely practicing medicine. Possible terms of
probation and restrictions on practice include, but are not
limited to:
(1) through (3) No change.
(4) Immediate Supervision Required. If immediate
supervision is required by the Board, Respondent shall not
perform designated procedures unless under the immediate
supervision of a board-certified physician fully licensed under
Chapter 458, F.S., who has been approved by the Probationer’s
Committee.
(a) The supervisory physician shall be physically located in
the same room with the Respondent where the designated
procedure is performed.
(b) Absent provision for and compliance with the terms
regarding temporary approval of a supervising physician set
forth in paragraph 64B8-8.011(7)(c), F.A.C., Respondent shall
cease performing the designated procedure[s] until the
Probationer’s Committee approves a supervising physician.
(c) Respondent shall have the supervising physician appear
at the first probation appearance before the Probationer’s
Committee.
1. Prior to approval of the supervising physician by the
committee, the Respondent shall provide to the supervising
physician a copy of the Administrative Complaint and the
Board’s Order filed in the case.
2. A failure of the Respondent or the supervising physician
to appear at the scheduled probation meeting shall constitute a
violation of the Board’s Order.
3. Prior to the approval of the supervising physician by the
committee, Respondent shall submit to the committee a current
curriculum vitae and description of the current practice of the
proposed supervising physician. Said materials shall be
received in the Board office no later than 21 days before the
Respondent’s first scheduled probation appearance.
(d) The responsibilities of a supervising physician shall
include:
1. Submit quarterly reports, in affidavit form, which shall
include:
a. Brief statement of why physician is on probation.
b. Description of probationer’s practice.
c. Brief statement of probationer’s compliance with terms
of probation.
d. Brief description of probationer’s relationship with
supervising physician.
e. Detail any problems which may have arisen with
probationer.
2. Should the Board determine that Respondent’s medical
records need to be reviewed, the Board shall set forth the
percentage of the records and type of records to be reviewed by
the supervising physician. The patient records shall be selected
by the supervising physician on a random basis at least once
every month.
3. Report to the Board any violation by the probationer of
Chapters 456 and 458, F.S., and the rules promulgated pursuant
thereto.

64B8-8.0021 Provisions Governing All Supervising
Supervisors or Monitoring Physicians.
(1) The supervisor/monitor shall be furnished with copies
of the Administrative Complaint, Final Order, Stipulation (if
applicable), and other relevant orders.

(2) The Respondent shall not practice or perform
designated procedures without a supervisor/monitor unless
otherwise ordered by the Board. The Respondent shall appear
at the next meeting of the Board’s Probation Committee with
his proposed supervisor or monitor unless otherwise ordered.
(3) After the next meeting of the Probation Committee,
Respondent shall only practice or perform designated
procedures under the supervision of the supervisor or monitor.
If for any reason the approved supervisor/monitor is unwilling
or unable to serve, Respondent and the supervisor/monitor shall
immediately notify the Board of Medicine Compliance Officer
and Respondent shall cease practice or cease performing
designated procedures until a temporary supervisor/monitor is
approved. The Chairman of the Probation Committee may
approve a temporary supervisor/monitor who may serve in that
capacity until the next meeting of the Probation Committee at
which time the Committee shall accept or reject a new proposed
supervisor/monitor. If the Probation Committee or the Board
reject the proposed supervisor/monitor, Respondent shall cease
practice or cease performing designated procedures until a new
supervisor/monitor is approved by the Probation Committee
and the Board.
(4) The supervisor/monitor must be a licensee under
Chapter 458, F.S., in good standing, without restriction or
limitation on his license. In addition, the Board may reject any
proposed supervisor/monitor on the basis that he or she has
previously been subject to any disciplinary action against his or
her license to practice medicine in this or any other jurisdiction.
The supervisor/monitor must be actively engaged in the same
or similar specialty area unless otherwise provided by the
Board. The Probation Committee or the Board may also reject
any proposed supervisor/monitor for good cause shown.
(5) Supervisors/monitors must serve as volunteers without
compensation but in instances where a licensee is unable to find
a volunteer supervisor/monitor, the licensee, with the approval
of the Board, may contract with a third party entity that provides
supervisors/monitors for a fee.

located in Tallahassee. The above referenced F.A.C. addresses
the requirement for proper handling and dispensing of food.
They are requesting to dispense bulk time/temperature control
for safety foods from an open air mobile food dispensing
vehicle.
The Petition for this variance was published February 14, 2018
in Vol. 44, No. 31, F.A.R. The Order for this Petition was
signed and approved on March 2, 2018. After a complete review
of the variance request, the Division finds that the application
of this Rule will create a financial hardship to the food service
establishment. Furthermore, the Division finds that the
Petitioner meets the burden of demonstrating that the
underlying statute has been achieved by the Petitioner ensuring
that each pan within the steam table is properly covered with an
individual lid; the steam table is enclosed within a cabinet with
tight-fitting doors, and is protected by an air curtain installed
and operated according to the manufacturer’s specifications that
protects against flying vermin or other environmental
contaminants; all steam table foods must be properly reheated
for hot holding at approved commissaries and held hot at the
proper minimum temperature per the parameters of the
currently adopted FDA Food Code; and steam table food is to
be dispensed by the operator with no customer self-service. The
Petitioner shall also strictly adhere to the operating procedures
and copies of the variance and operating procedures are to be
present on the MFDV during all periods of operation.

purpose of this hearing shall be to consider the Stipulation and
Settlement Agreement between Gulf Power Company, Office
of Public Counsel, Florida Industrial Power Users Group and
Southern Alliance for Clean Energy regarding the impacts of
the passage of the Tax Cuts and Jobs Act of 2017 and to take
action on any motions or other matters that may be pending at

prepare Miami Dade College for the upcoming 2018 hurricane
season commencing June 1 by pruning the trees and removing
tree stumps on the properties at all the College Campuses. This
will include the removal and disposal of any debris generated
with the work and all miscellaneous activities, tools, supplies,
and manpower for the complete execution of the work.
The College is NOT interested in receiving Bids for General
Contractors. The College will only consider Bids from
Landscaping, Arborist, Plant and Tree Vendors and/or related
business only.

REQUEST FOR QUALIFICATIONS
RFQ 18-14
The University of North Florida Board of Trustees, a public
body corporate, announces that professional services for
miscellaneous projects each not exceeding $2,000,000 in total
construction cost and studies each not exceeding $200,000 in
fees are needed for work to be located at the University of North
Florida, 1 UNF Drive, Jacksonville, FL 32224.
Project information
Projects included within the scope of these agreements include
renovations, alterations and additions that have a basic
construction budget estimate of $2,000,000 or less, or for
studies of which the fee for professional services is $200,000 or
less. The University plans to award between three and four
consultants for these projects. The awarded consultants will be
utilized on an as needed basis for the duration of the agreement.
The consultants awarded will not have an exclusive contract as
the University may have additional consultants under contract
during the same time period. The award of these agreements
shall be for an initial period of one year with an owner’s option
to renew for up to two additional one year renewal periods,
upon the agreement of both parties.

must be properly registered at the time of application to practice
its profession in the State of Florida. If the applicant is a
corporation, it must be chartered by the Florida Department of
State to operate in Florida.
3. Six complete copies of the above requested data bound and
in the order listed per the instruction. Applications which do not
comply with the above instructions may be disqualified.

Minority business participation is strongly recommended and
supported by the University of North Florida.
Blanket professional liability insurance will be required for this
project in the amount of $2,000,000 and will be provided as part
of the Basic Services (each, aggregate and per occurrence).
As required by §287.133, Fla. Stat., a consultant may not submit
a proposal for this project if it is on the convicted vendor list for
a public entity crime committed within the past 36 months. The
selected consultant must warrant that it will neither utilize the
services of, nor contract with, any supplier, subcontractor or
consultant in excess of $15,000 in connection with this project
for a period of 36 months from the date of their being placed on
the convicted vendor list.

On March 5, 2018, the State Surgeon General issued an Order
of Emergency Restriction Order with regard to the license of
Sebastian A. Fomenko, L.M.T., License # MA 82162. This
Emergency Restriction Order was predicated upon the State
Surgeon General’s findings of an immediate and serious danger
to the public health, safety and welfare pursuant to Sections
456.073(8) and 120.60(6) Florida Statutes (2017). The State
