Plea in SC seeking constitution of GST Appellant Tribunal NEW DELHI, JULY 22 (PTI) A petition has been filed before the Supreme Court seeking constitution of the Goods and Services Tax Appellate Tribunal.The petition, which is likely to come up for hearing shortly, said that even after four years of the Central Goods and Services Act coming into existence, the tribunal has not been constituted.It claimed that the citizen aggrieved are constrained to approach respective high courts in the absence of a Tribunal and the same is overburdening work of the high courts as well. In absence of an Appellate Tribunal, the litigants are not able to get justice within a reasonable period and the same is causing extreme hardship to the litigants across the country, the PIL, filed by advocate Amit Sahni, said. It said that the constitution of national and other benches of Appellate Tribunal has become an absolute necessity of the hour and the respondents cannot drag its constitution for an indefinite period. It further said that the period of limitation to file appeal before the tribunal, i.e., 90 days, cannot be extended by way of administrative order by the Centre in contravention of statutory provisions, and more particularly such extension cannot be given for an indefinite period. Fire breaks out in a building in Chennai Delhi HC seeks response from Centre on plea challenging new IT Rules NEW DELHI, JULY 22 (PTI) The Delhi High Court Thursday sought the Centre's reply on a plea challenging the new IT Rules for allegedly being in gross disregard of the fundamental rights of free speech and privacy of users of social media intermediaries such as WhatsApp, Instagram and Twitter. A bench of Justice Chief Justice D N Patel and Justice Jyoti Singh issued notice to the Centre on advocate Uday Bedi's plea contending that the new IT rules are unconstitutional and antithetical to the fundamental principles of democracy. Granting time to the Centre to file its counter affidavit, the court listed the plea for further hearing on September 13. In his petition, Bedi has argued that the social media intermediaries cannot be given the power to decide, on the basis of a complaint or otherwise, as to which information is liable to taken down. The petition states that the new Information Technology Rules themselves do not define how the social media intermediaries would voluntarily take action against a complaint without peeping into all conversations over the SMI platform and that it is not possible to trace the first originator of a message without decrypting all the private information that is stored, published, hosted or transmitted through the platform. While giving powers in excess of the powers given under the parent legislation, the IT Act, to voluntarily remove access to information that does not conform to Rule 3(1)(b), the Impugned Rules have allowed the social media platforms to place the users under constant surveillance which is a gross breach of the right to privacy, the petition reads. The rules also mandate that even if the person is not under any investigation for violation of the rules, the intermediary has to retain his or her data without any justification, which is a gross violation of the right to privacy of the user, the petition further said. Emphasising that no appellate procedure has been provided for under the rules against the decision of a Grievance Officer and/or the Chief Compliance Officer, Bedi, in his plea, has added that wide powers to restrict free speech of citizens have been placed in the hands of private individuals, which is shockingly disproportionate and completely unjustified. There is also no mandate that the author of the allegedly objectionable information has to be heard before deciding any complaint against him/ her, it is stated. Pegasus snooping allegations: Plea filed in SC NEW DELHI JULY 22 A petition has been filed before the Supreme Court seeking a court- monitored probe by a Special Investigation Team (SIT) into the reports of alleged snooping by government agencies using Israeli spyware Pegasus over journalists, activists, politicians and others. The petition, filed by advocate M L Sharma, said the Pegasus scandal was a matter of grave concern and a serious attack upon Indian democracy, judiciary and country's security and the 'widespread and unaccountable' use of surveillance is 'morally disfiguring'. 'Privacy is not about the wish to hide, as is often asserted. It is about having a space of one's own where our thoughts and being are not the instrument of someone else's purposes. It is an essential component of dignity and agency,' it said. The plea said the use Pegasus was not just eavesdropping on conversations but can be used to access the entire digital imprint of one's life as it renders helpless not just the owner of the phone hacked but everyone who is in contact with him. The petition, which is likely to come up for hearing in the coming days, said the national security implications of the revelations were 'enormous' as the 'explosive growth' of surveillance technology vendors is a global security and human rights problem. The PIL claimed that around 50,000 phone numbers were believed to be targeted by clients of the company, NSO Group, since 2016, that was leaked to major news outlets. 'Pegasus is not just a surveillance tool. It is a cyber weapon being unleashed on the Indian polity. Even if authorised (which is doubtful), the use of Pegasus poses a national security risk,' it said. It sought a direction to frame an SIT under the supervision of the top court for an investigation into the scandal and to prosecute all accused persons and ministers for buying of Pegasus and alleged snooping of citizens of India, including judges, opposition leaders, political persons, activists, advocates and others, for vested political interests since 2017. The plea further sought to declare buying of Pegasus software for snooping illegal and unconstitutional. Mohan Bhagwat's visit to Madurai:official transferred MADURAI JULY 22 A Deputy Commissioner of Madurai Corporation was abruptly transferred for having issued an order to repair and maintain roads and street lights during the visit of RSS chief Mohan Bhagwat to Madurai. The RSS chief is to participate in an RSS function for four days from July 22 to 26 at the Sai Baba Temple in Sathya Sai Nagar in the temple city. In a circular issued on July 20 Shanmugam, a Deputy Commissioner of Madurai Corporation, had listed four tasks to be carried out by the zonal officers of the area in view of Bhagwat's visit. He had instructed that roads along the VIP's route should be repaired, street lights be made functional, the route to be cleaned regularly and to avoid any other special work on the route during his travel time. Madurai CPM MP Su. Venkatesan had questioned under what government rules such an order had been issued since these protocols were followed only during visits of constitutional functionaries like President, Prime Minister, Governor and Chief Minister.After the MP's query, Corporation Commissioner Karthikeyan clarified that the arrangements listed in the circular were carried out during the visit of any VIPs under 'Z Plus' category security. It was a routine exercise and there was no need for a specific circular to be issued by the DC without the sanction of his superior officers. 'Since the DC is new to his posting he had issued the circular though there was no need for it,' he explained. He also pointed out that no special work was carried out with regard to the visit. Apparently the DC instead of communicating the orders orally had put it in writing in the form of a circular another official observed.However, within a few hours after the Commissioner's clarification, he issued an order 'relieving' the Deputy Commissioner from his post. On Thursday, the 78-year-old leader said on July 26, the BJP government will complete two years in Karnataka. "After this, I will follow whatever JP Nadda will decide. It is my duty to bring back BJP to power. I urge party workers and seers to cooperate," Yediyurappa said. Based on the instructions that the central leaders will give him on July 25, the chief minister said he will begin his work from July 26 after the two-year anniversary event. "Prime Minister Narendra Modi, Amit Shah (Home Minister) and our national President J P Nadda have a special love and faith towards me. You are aware that no position has been given to those who have crossed 75 years of age, but appreciating my work they have given me an opportunity despite me crossing 78 years," Yediyurappa said, as reported by news agency PTI. NDRF deploys 9 rescue teams in Maha after heavy rains MUMBAI, JULY 22 (PTI) The National Disaster Response Force (NDRF) has deployed nine rescue teams in Maharashtra, including four in Mumbai, after heavy rains caused flooding in some coastal areas of the state on Thursday.Mumbai, its neighbouring Thane and Palghar and other districts in the Konkan region have been witnessing heavy downpour since the last few days, leading to inundation at several places and disruption of rail and road transport services. Water level of many rivers has risen and crossed the danger mark at some places. CHENNAI JULY 22 A fire broke out in an five-story building near the Shanti Theatre in Anna Salai, Chennai on Thursday. Fire fighters who came in 4 fire trucks from Egmore are battling the blaze. Firefighters rescue workers working on the building with a giant crane. According to reports, the building is a five storey building in which the fire broke out on the third floor at 11 am. The fire personnel used giant skylifts to reach the window on the third floor through which they pumped in water. Fire and rescue services DGP Karan Singha and other fire service officials visited the place. Preliminary reports say that there are no injuries or casualities so far. The police department has also plunged into the spot to bring the situation under control as Anna Salai is a prime location in the Chennai city. KARUR, JULY. 22 Anti-corruption and vigilance bureau officials are conducting raids at more than 20 places in Chennai owned by former AIADMK minister MR Vijayabaskar on Thursday. MR Vijayabaskar was the Transport Minister in the last AIADMK regime. A case is pending in the Madras High Court alleging various irregularities and corruption in the transport sector. During the last regime, there were allegations that certain companies were illegally awarded tenders while competing companies competed in the procurement of GPS equipment for vehicles. The High Court also barred the order for the purchase of GPS devices. In this connection, the then opposition DMK raised serious allegations. However, MR Vijayabaskar denied the allegations. CM MK Stalin said that if the DMK comes to power, it would investigate allegations of corruption against AIADMK ministers and take appropriate action. Meanwhile, the Anti- Corruption and Surveillance Bureau of the police department is conducting raids on houses, companies and relatives' houses in Karur owned by the former transport minister. Similarly, a raid h is being carried out at Vijayabaskar's house in Raja Annamalaipuram, Chennai. Preliminary information has emerged that more than 50 policemen have been conducting raids in more than 20 places since early this morning (July 22). The raid is being carried out at Vijayabaskar's aides and supporters' homes and offices. More than 20 officers are involved in the investigation. No information was available on whether evidence of a corruption complaint was involved in the raid or whether any confiscation was made. Police are on high alert ahead of the raid. It is noteworthy that the Central Income Tax Department has registered a disproportionate assets case against MR Vijayabaskar for amassing assets in excess of his income during his tenure as minister. A 36-year-old man has killed his 32-year-old wife by smashing her head with a grinding stone in Odisha's Jajpur district, police said on Wednesday.

The accused returned home at Iswarpur village on Tuesday night in an inebriated state, and had a

heated argument with his wife over a petty issue, an offi cer said.

Bengal reports 869 new COVID-19 cases, 6 fresh fatalitiesKOLKATA,JUL22 West Bengal's COVID-19 tally rose to 15,20,468 on Wednesday as 869 more people tested positive for the disease, while six fresh fatalities pushed the state's corona-virus death toll to 18,027, a health bulletin said. The recovery rate among the coronavirus patients in the state im-proved to 98 per cent as 981 more people were cured of the disease, it said.The state now has 12,391 active cases, while 14,90,050 peo-ple have recovered from the disease to date, it said.

West Bengal has thus far tested over 1.52 crore samples for COVID-19, including 54,433 in the last 24 hours.

Only 87,601 people were vaccinated during the day, a health offi cial said.

Delhi likely to receive light rain

The Uttar Pradesh government on Wednesday said rural secretariats will be set at all gram panchayats in the state and a computer operator will also be posted there.

A decision in this regard was taken at a Cabinet meeting chaired by Chief Minister Yogi Adityanath, according to a statement issued here.

An alert Railway Police constable saved the life of a ten-year-old boy who fell on the tracks while alighting from a suburban train at Vasai Road station, the GRP said on Wednesday.

The incident took place at around 11.20 am on Tuesday, they said.

The boy, while getting down from a Virar-bound local train, slipped and fell into the gap between the platform and the tracks, the Goverment Railway Police said in a release.

As the train stopped, constable A S Thanabeer, who was on duty at the platform, rushed in and pulled out the boy and took him to a nearby hospital, the release said.

The swift action by the policeman saved the life of the boy, who was admitted to the hospital for treatment, it said. A video of the constable carrying the boy in his arms to the hospital has gone viral in social medial.Vasai Road is a distant suburb of Mumbai and falls on the suburban section of the Western Railway.

JAIPUR, JUL 22 (PTI) Rajasthan Chief Minister Ashok Gehlot

on Wednesday wrote to Prime Minister Narendra Modi demanding to increase the limit of benefi ciaries of the National Food Security Scheme (NFSA) on the basis of present population instead of the 2011 census.

The chief minister said in the last 10 years, the population of all the states of the country has increased and many families have come under the purview of food security. In order to ensure the food security of such needy families, it is necessary to re-fi x the ceiling of food security according to the estimated population of 2021.

In his letter, Gehlot wrote that under the food security scheme in the state, the ceiling of 4,46,00,000 people has been set by the Government of India on the basis of the 2011

census. For these benefi ciaries, 2,30,882 metric tonnes of food grains are being allocated per month.

In the last 10 years, a large number of families have become eligible for NFSA, he said.

According to a statement, the chief minister has urged the Centre to provide food security to 74 lakh more people in the state.

of the TN Self Reliance Farmers' Association, said that agricultural activities have been affected due to the unavailability of three-phase electricity.

The statement issued by him said the Government of Tamil Nadu has lifted the ban on three-phase power supply to agriculture from April 1. During the AIADMK regime, three-phase electricity was

provided for 14 hours, 6 hours at day time and 8 hours at night. The government was told that the supply of electricity only at such specifi ed times was a hindrance to the farmers.

So the ryots fi led a suit in the High Court to provide unrestricted three-phase electricity to agriculture. Meanwhile, the DMK has promised in its poll manifesto that 24 hours uninterrupted power supply will be provided to agriculture. Currently,

even three-phase power is not available for 14 hours. Besides, farmers are facing diffi culties due to untimely supply of electricity. Sowing and planting are affected by the unavailability of three-phase electricity as it is now the planting season.

The current three-phase electricity supply is not suffi cient for farmers. So the government should provide uninterrupted 24-hour power supply to help ryots.

district, the daily incidence of corona cases has continued to decline for the past 38 days. In this situation, the daily impact of the corona suddenly rose on Wednesday from 122 on Tuesday to 129 on Wednesday according to a list released by the health department yesterday.

Thus the number of corona victims in the district so far has risen to 92189. In a single day, 208 people recovered from the infection and returned home. Thus the number of persons recovered from corona has risen to 89550. The death toll is 623 so far.

called Construction Network of India (CNI) has been launched in Erode to bring together different types of entrepreneurs in the construction industry.

No deaths due to oxygen shortage in Tamil Nadu: MinisterCHENNAI, JULY 22 (PTI)

Tamil Nadu recorded no deaths due to oxygen shortage during the second wave of COVID-19, wave, State Minister for Health Ma Subramanian said on Wednesday.The Chief Minister M K Stalin took anti-COVID measures to ensure no such deaths, the Minister.

"In Tamil Nadu, no one succumbed to the virus due to shortage of oxygen.

That is the truth. There was a strong (COVID-19) regulation in place," the Medical and Family Welfare Minister told reporters at the Secretariat.

Subramanian was responding to a query on whether there were COVID-19 deaths for want of oxygen.

"There was shortage of oxygen in the State at the time when the Chief Minister assumed offi ce on May 7.

The oxygen available on that day was 230 metric tonne while the daily COVID-19 cases were 26,465," he said.

"Gradually, the cases rose to (the highest of) 36,184 cases on May 21 and the requirement for oxygen was over 500 metric tonne. At that time, efforts were made by the Chief Minister (M K Stalin) and we brought oxygen from Rourkela and Jamshedpur (via trains to meet the requirement)," he said.

"He (Chief Minister) took various measures and

ensured there was no huge impact nor loss of lives due to oxygen shortage," he said.

On the vaccines, Subramanian said there would not be any shortage of doses over the next three days as the State received 5.42 lakh doses today.

"Already, we have 6,27,470 doses in stock. This evening, we received 5,42,780 doses and we will be able to vaccinate people without any hurdles for the next three days," he said.He said the Centre has increased the allotment of doses to the

State by another fi ve lakh for this month.

"For July, the Centre allotted 72 lakh doses to Tamil Nadu and 17 lakh vaccines to private hospitals.

It has planned to send fi ve lakh more doses to the State.

That is satisfying news," he said.

Subramanian said the State government has planned to expand to other districts the free vaccination drive through private hospitals by utilising the corporate social responsibility funds of private companies."We launched the drive in Coimbatore yesterday (July 20)," he said.

"We will hold another meeting of private hospitals and companies from districts of Chennai, Kancheepuram, Vellore and Tiruvallur over the next two days", he said."There are also plans to take the vaccination programme to

Tiruchirappalli, Tirunelveli and other districts. It is a big initiative," he said.

The Minister said the Health Department in the State has so far received nearly two crore vaccines till date.

"Till date, 1,96,43,859 people have been vaccinated.

We need 12 crore doses to provide the double-shot for six crore people in the State.

We have received nearly two crore doses till date. We need 10 crore more of them," he said.

The Centre has told the Rajya Sabha that no deaths occurred due to lack of oxygen during the second wave of COVID-19 in the country.Following this, the Opposition Congress accused the Union Minister of State for Health Bharati Pravin Pawar of misleading Parliament of giving false information by stating there were no such fatalities.

Ponds and lakes are being upgraded in Coimbatore under the Smart City project. Parks, a bicycle path, a fl oating walkway and boating facilities have been made in the ‘Periyakulam’ pond in Ukkadam, Coimbatore. The

water hyacinths were removed and the pond was opened for public use at the end of last February. Now the plants have begun to overgrow again.

The plants have surrounded the fl oating walkway and a structure constructed for boating. Ecological activists say that

if they are not removed, the whole area will become unusable in the course of time and that it is due to the mixing of waste and garbage into the pond.

They also express the grief that it is not appropriate for the administration to turn it into a recreational ambience in a way that could harm the ecosystem in the pond without resolving these issues. Already, 11 ecological organizations in Coimbatore have sent a letter of condemnation to the Chief Minister to revamp the Smart City project and Noyyal river reconstruction project as the biodiversity is being affected in the ponds under the Corporation and the water storage area in the ponds is also declining.

Karnataka Health Minister Dr K Sudhakar on Wednesday said the teachers of government and private schools would be vaccinated against COVID-19 so that schools could be re-opened without the children getting the infection from the faculty. In tweets, Sudhakar said the State government wants early re-opening of schools. "The corona vaccine will be given on a priority basis to teachers and non-teaching staff of all government, aided and unaided private

schools in the State for the early re-opening of schools keeping the future of children in mind," the Minister said. The schools were shut this academic year in view of the COVID-19 scare though online classes were on. As health experts have expressed

apprehension over children getting infected if and when the third wave of COVID-19 strikes, the government intensifi ed the vaccination of adults to ensure they do not pass on the infection to the young. Currently, there is no vaccine for those below 18 years of age.

As part of COVID-19 management, the railway station here is to get a 'Smart Gate' to thermal-screen passengers entering the station.The Collector of Thrissur district Haritha V Kumar would inaugurate the gate on July 23.

The fully self-regulating gate would enable railway security personnel to avoid close contact with passengers thereby enhancing their safety, a press release said.

The Tamil Nadu government has warned temple trustees/executive offi cers of disciplinary action if any property belonging to religious institutions are fraudulently transacted or registered.Tamil Nadu Hindu Religious and Charitable Endowments (HR&CE) Commissioner J Kumaragurubaran directed the joint commissioners, executive offi cers and assistant commissioners in the department to remain vigilant and thwart attempts to fraudulently register temple properties. Issuing a set of instructions, in the wake of a Madras High Court order, he directed his subordinate offi cials that as per the judgment the religious institution shall approach the district registrar (administration) for conducting an enquiry under section 68 (2) of the Registration Act, 1908, if in

case any property belonging to it has been transacted/ registered fraudulently."The competent authority should immediately register a complaint before the district registrar concerned if any t ransact ion/ regis t ra t ion fraudulently involving the temple properties comes to the knowledge of the temple trustees/ executive offi cers, and submit an action taken report to the head offi ce," he said in the circular issued on July 19.
