Radio Record Reps amp Harassment Sexual harassment of the type that brought down Fox News CEO Roger Ailes has been the subject of much attention Less understood are the dynamics at play between companies For instance the landscape inhabited by reporting radio stations and record label promotion staffers seeking their favor In more than a dozen off-the-record background-only and not-for-attribution discussions with female and male regional record reps label executives and radio pros Country Aircheck has found an environment where a small number of PDs and MDs may be putting themselves and their companies at risk with unwelcome sexual advances language and behavior Further because of the highly charged business relationships at stake record companies may be knowingly sending female employees into problematic environments Ground Level When yoursquore in it you donrsquot realize how bad it is says a male former label executive who asked not to be named But itrsquos bad And it goes deeper than anyone probably wants to admit Irsquom no saint and things get pretty loose in this business Therersquos no filter People say and do things that looking back arenrsquot okay I was part of that in some way I knew about things I never did anything about Itrsquos unspoken but itrsquos really prevalent Even the artists know They see it Speaking on condition of anonymity a female regional recalled her rookie stint in record promotion The first time I called [a station decision maker] he asked if he could lick my [genitals] she says I hung up called my boss and said Im not doing this I cant deal with that Given another person at the station to call on the rep began a very professional relationship (continued on page 9)

that eventually soured after that married radio exec made repeated propositions during CRS I had to call the front desk and ask them to put privacy on my phone so he couldnt keep calling she says The next day I told my boss what happened and he said Oh you can handle it I started to cry because I knew this was beyond okay Its like something we read about in our womens magazines where hes going to show up some day with a knife It was not comfortable and I couldnt laugh it off In numerous conversations current and former regionals described unwanted advances touching and innuendo though all stressed the vast majority of female rep to male programmer interactions are completely professional

One former label executive put the number of reporting stations to which hed be reluctant to send a new female rep in the high single digits Others estimate the number of stations where a PD or MD has a poor reputation ranges from just a handful to as much as 10-15 of the panel The number of creepy radio folks is minimal a female regional says And lets face it there are a couple of women who get a little creepy For the most part there are good people out there who do stuff for the right reasons Its just that handful Label Response Record company radio promotion looks to be an increasingly egalitarian field with the percentage of female staffers steadily increasing from 37 in 2010 to 44 this year On the other hand with reporting stations still overwhelmingly programmed by men mdash 91 have a male PD mdash the opportunities for a sexually charged dynamic have increased Like most of corporate America and even the legal system

record companies and their HR efforts are focused on harassment from an internal perspective Policing

encounters between employees and counterparts at other companies typically isnt on the radar You want to know how we handled it says one male label staffer no longer in promotion The way we handled it is we never handled it Everyone was too scared There was maybe an uncomfortable laugh when it was pointed out I know of many occasions where if one female rep had gone sideways it could have brought a whole company down But they donrsquot because if they do radio wonrsquot talk to them The label canrsquot have reps that radio is afraid to talk to So it keeps going and itrsquos not fair Itrsquos a no-win situation Theres always an option says another male label executive If you know theyre heading into an uncomfortable situation you can send someone else to cover or the VP can go with them You can make sure theyre not left alone with the person I would never knowingly send a rep into an uncomfortable or contentious situation Its like a lot of other life situations ndash be smart use your head Party People Radio companies may not be aware of problematic behavior Record people dont really want to tell us

about things that happen because theyre afraid theyll get outed says a male radio executive The PD will hear about the label complaining and there will be ramifications with airplay I would never burn the source but I understand theres that fear For his part he asserts zero tolerance for programmers behaving unprofessionally If I hear that stuff I put people on notice he says noting over-imbibing is something hes had to address Ill call the PD and say I dont know if this is true or not but youre getting quite the rep for [a certain behavior] If it is true you need to knock it off or youre going to get fired If its not true you need to go above and beyond to change minds and attitudes Perhaps unique to the music space the working environment is what civilians might consider a party Dinner and drinks backstage at a show with more drinks lines can get blurred A female promotion rep recalls being startled in her greener days I remember going to dinner [with a programmer] and all of a sudden I was like Oh he thinks its a date she says I went to the bathroom called my boss and said I will never come back here for dinner It will be lunch only and you will be coming with me Itrsquos probably worse because itrsquos the music business a male former label rep says Wersquore all having fun Wersquore up late drinking and having a good time Yeah he stood on the table and said something he shouldnrsquot but he was drunk Oh you know-so-and-so Hersquos so dirty One male promotion executive says the party atmospheres boundaries are well-defined at his company We talk about it all the time Part of our job is being good hosts but its also knowing where the line is We dont want any of our people to be drunk in front of radio people regardless of how comfortable or close they may be Thats just unprofessional Legally Speaking Nashville attorney Anne Martin with Bone McAllester Norton concentrates her practice in part on employment law representing employers and employees Its not that unusual a situation although I think there are parts of it that are unique to the industry she says The sort of captive power [radio executives] have in being the client and because theres a small number of customers if you have a poorly behaving or unreasonable customer the choice of just not doing business with them doesnt exist For radio companies employees who are out of line with staffers from other companies are a significant risk according to

Martin If the programmer is doing that to people outside of their business there is some likelihood its also occurring internally she says Under Title 7 of the Tennessee Human Rights Act because theres not an employer-employee relationship there isnt necessarily liability But it does trigger an obligation for that employer to do something about it because theyre now on notice that theyve got a problem employee As for labels once theyve been notified of a problem they may have liability If they find out about it they have an obligation not to put her at risk Martin says And also not to retaliate against her If they take her off that account or restrict her role that could be seen as retaliation According to Los Angeles-based discrimination attorney Gloria Allred whose clients include alleged victims of Bill Cosby speaking up is as important as it is difficult Fear is the main weapon that is used to continue to victimize women she says They live in fear of taking any action and then the sexual harassment just continues In some states including California companies can be sued when an employee subjects a sales person to sexual harassment It really depends what the facts are Allred says If a person is physically sexually harassed there may be other legal action that can be taken against the harasser Fear of getting a reputation for stirring up trouble shouldnt dissuade anyone from seeking advice Consult with an attorney to see what seems to make sense under the circumstances Allred says We do a lot of confidential settlements and because it is confidential future employers or other PDs would not know about what the facts were that led to the settlement or even that there was a settlement Martin agrees that lawsuits arent necessarily the best solution Filing a charge with the EEOC or filing a lawsuit is not a great way to resolve problems she says We have the best [legal] system in the world but its risky expensive time-consuming and public Its disruptive to your life and your profession Employers really should have a good leadership chain HR department open door policy and management structure so people feel they can complain and give the employer an opportunity to fix it Do everything you can internally before going externally Tough Choices Martin is mindful of just how difficult the situation can be Employers are looking at their revenue streams the persons role in the company how much power they have how replaceable they are how important the customer is how delicate the relationship is whether managers on the radio station side are

reasonable adults who will take it seriously ndash all of those things will affect [the process] she says Most employers want to do the right thing and people who run companies are just people Even the good ones struggle Its complicated Likewise speaking up is a tough call for someone whos being mistreated If you dont stand up for yourself it may not be your fault but youre essentially perpetuating [sexual harassment] she says noting the offender will likely continue their behavior until someone calls them out But when you have a career bills to pay a family to raise and youve worked hard to get where you are thats a hard decision to make The female regional who received a terrible response on her first call to a station says experience has been a great teacher I have guys who will float it out there half joking but now I immediately nip it in the bud she says I got to the point where Id laugh and say something like You know were not dating right They laugh theyre immediately comfortable and theres no weirdness She has other suggestions for her peers Make friends with other regionals Meet for lunch not dinner or at least try to have somebody else with you There are great reps male and female who will insist on sharing a dinner with you Everybody watches out for one another And always listen to your gut If youre wrong ndash great If youre not wrong and youre in a situation where its really awkward and youre not able to deal with that person anymore its a drag The world of radio promotion hasnt had its Fox News moment yet And the female reps Country Aircheck spoke with seem to have ways for coping with a few overly entitled bad apples But that doesnt mean they should have to Its a fun business and should be but that doesnt give anybody the right to take liberties a male label executive says This is still a business and were all still people How we treat each other needs to reflect that ndashJess Wright Chuck Aly
