Licensing Program
Application Section
The Application Section of the LicensingDivision has two units. The ApplicationProcessing Unit receives and reviewsapplications for licensure and/or registration ofthe 14 health professional boards and 1 taskforce. The 16,824 applications received duringthis fiscal year were reviewed along withsupporting documentation to determine anapplicant's eligibility for examination and/orlicensure.
The Application Support Unit fills requests forapplications and copies of laws and rules forthe 15 health professional boards and taskforces. This unit sent out 30,369 applicationsduring this fiscal year.
Board Support Section
The Board Support Section is responsible forproviding administrative support to the 15boards within the Bureau of Health Services.Some of the duties include scheduling meetingdates and locations, preparing and mailingagenda materials to the board members prior toeach meeting, and taking and transcribingminutes for each meeting.
In addition to the above, the following functionsare also handled by this section:

requiredC Respond to Freedom of Information Act
(FOIA) requests for copies of licensingfiles
C Microfilm all licensure/registration fileupdates
During FY 98/99, 450 FOIA requests wereprocessed through this section.

The Program Operations Section has two units,the Credentials Unit and the Computer Unit.These units are responsible for the followingfunctions:

Controlled Substances Advisory Commission
The Controlled Substances AdvisoryCommission was established by Public Act 60of 1988, to monitor indicators of controlledsubstance abuse and diversion and torecommend actions to address diversion and torecommend actions to address identifiedproblems of abuse and diversion. OFFICIAL PRESCRIPTION PROGRAM
The Controlled Substances AdvisoryCommission (CSAC) continued their emphasisto cultivate greater understanding of theOfficial Prescription Program (OPP).
The CSAC completed its development of thefeedback form for patients. The form wasdeveloped to facilitate receiving informationfrom the end user of the OPP form. The

patient feedback form was made available topatients and caregivers. The OPP began toreceive comments almost immediately frompatients.
The OPP continued its emphasis on greaterunderstanding of the OPP by giving numerouseducational presentations to professionalgroups. The presentations covered the type ofdata collected, length of time data is stored,how the data is evaluated and used, and theextent of the use of the data in disciplinaryproceedings against health professionals. Thepresentation also covers why the program cameinto existence and the effectiveness of theOPP.
The CSAC reviewed the data for 1997. The1997 data shows declines in the number ofprescriptions issued for meperidine andhydromorphone. Oxycodone prescriptionnumbers rose from 1996. Further evaluatiuonof the oxycodone prescriptions shows theincrease in prescriptions for oxycodone isentirely due to the single entity oxycodoneproduct.
The 1997 data shows increases for morphine,fentanyl and dextroamphetamine. The datashowed a 265% increase in the number ofprescriptions for amphetamines. Amphetamineand dextroamphetamine combined account forapproximately 25% of the prescriptionssubmitted to the program.
The monthly average of official prescriptionforms utilized in 1997 continued to increase,averaging approximately 27,500 per month.
The 1997 data does not includemethylphenidate which was removed from therequirement to be on the official form in 1994.

Health Professional Recovery Committee
The Health Professional Recovery Committee(HPRC) was created by P.A. 80 of 1993,effective April 1, 1994. Section 333.16167describes the Committee’s duties as follows:
“Sec. 16167. The committee shall do all of thefollowing: (a) Establish the general components of the healthprofessional recovery program and a mechanism formonitoring health professionals who may be impaired. (b) Subject to sections 16169 and 16170 and inconjunction with the health professional recoveryprogram consultants described in section 16168, developand implement criteria for the identification, assessment,and treatment of health professionals who may beimpaired. (c) In conjunction with the health professional recoveryprogram consultants described in section 16168, developand implement mechanisms for the evaluation ofcontinuing care or aftercare plans for healthprofessionals who may be impaired. (d) Develop a mechanism and criteria for the referral ofa health professional who may be impaired to aprofessional association when appropriate for thepurpose of providing assistance to the healthprofessional. In developing criteria under this subdivision,the committee shall require that a referral be made onlywith the consent of the health professional. (e) Annually report to each board and the physician'sassistants task force created under this article on thestatus of the health professional recovery program. Thecommittee shall include in the report, at a minimum,statistical information on the level of participation in theprogram of each health profession. The committee mayinclude in the report recommendations for changes in thehealth professional recovery program and forparticipation by the boards and the physician's assistantstask force, professional associations, substance abusetreatment and prevention programs, and other appropri-ate agencies.”
The health profession boards and the Directorof the Department of Consumer & IndustryServices appoint members in accordance withsection 16165 of the Michigan Public HealthCode.

Michigan Board of Chiropractic
The Michigan Board of Chiropractic wasoriginally formed with the enactment of PublicAct 145 of 1933. On September 30, 1978, thisauthority was transferred to the Public HealthCode, Public Act 368 of 1978, as amended.
The practice of chiropractic as defined in thePublic Health Code means that discipline withinthe health arts which deals with the nervoussystem and its relationship to the spinal columnand its inter-relationship with other bodysystems.
The Public Health Code mandates certainresponsibilities and duties for a healthprofessional licensing board. Underlying allduties is the responsibility of the board topromote and protect the public's health, safety,and welfare. This responsibility is implementedby the Board by ascertaining minimal entry levelcompetency of health practitioners and verifyingcontinuing education during licensure. TheBoard also has the obligation to takedisciplinary action against licensees who haveadversely affected the public's health, safety,and welfare. The Michigan Board of Chiropractic consists of9 voting members: 5 chiropractors and 4 publicmembers.

Michigan Board of Counseling
Public Act 421 of 1988, amended the PublicHealth Code, Public Act 368 of 1978, asamended, creating the Michigan Board ofCounseling.
The Public Health Code defines the practice ofcounseling to mean the rendering to individuals,groups, families, organizations, or the generalpublic a service involving the application ofclinical counseling principles, methods, orprocedures for the purpose of achieving social,personal, career, and emotional developmentand with the goal of promoting and enhancinghealthy, self actualizing and satisfying lifestyleswhether the services are rendered in aneducational, business, health, private practice,or human services setting.
The Public Health Code mandates certainresponsibilities and duties for a healthprofessional licensing board. Underlying allduties is the responsibility of the Board topromote and protect the public's health, safety,and welfare. Michigan Board of Dentistry
The Michigan Board of Dentistry was originallyformed with the enactment of Public Act 122 of1919. This Act regulated the practice ofdentistry and dental hygiene in the State ofMichigan, including providing for examination,licensing and regulation of persons practicingdentistry and dental hygiene; authorizing dentalassistants; and providing for the discipline ofoffenders against the Act.
On September 30, 1978, this authority wastransferred to the Public Health Code, PublicAct 368 of 1978, as amended, and includedcertification of specialists in the fields oforthodontics, endodontics, prosthodontics,pediatric dentistry, periodontics, oral andmaxillofacial surgery, and oral pathology.
The practice of dentistry, as defined by thePublic Health Code, means the diagnosis,treatment, prescription, or operation for adisease, pain, deformity, injury, or physicalcondition of the human tooth, teeth, alveolarprocess, gums or jaws, or their dependenttissues, or an offer, undertaking, attempt to do,or holding oneself out as able to do any ofthese acts.
The practice of dental hygiene, as defined bythe Public Health Code, means practice at theassignment of a dentist in that specific area ofdentistry based on specialized knowledge,formal education, and skill with particularemphasis on preventive services and oral healtheducation.
Practice as a dental assistant, as defined by thePublic Health Code, means assistance in theclinical practice of dentistry based on formaleducation, specialized knowledge, and skill atthe assignment and under the supervision of adentist.
The Public Health Code mandates certainresponsibilities and duties for a healthprofessional licensing board. Underlying all
duties, is the responsibility of the Board topromote and protect the public's health, safety,and welfare. This responsibility is implementedby the Board of Dentistry by ascertainingminimal entry level competency of healthpracti-tioners. The Board also has theobligation to take disciplinary action againstlicensees who have adversely affected thepublic's health, safety, and welfare. The Michigan Board of Dentistry consists of 15voting members: 7 dentists, 2 dentists whohave been issued a health profession specialtycertification, 2 dental hygienists, 2 registereddental assistants, and 2 public members.

Michigan Board of Marriage and Family Therapy
The Michigan Board of Marriage and FamilyTherapy was created under Article 15 of PublicAct 299 of 1980, as amended, the OccupationalCode, to license and regulate the practice ofmarriage and family therapy in Michigan. PublicAct 126 of 1995 transferred the authority of theBoard of Marriage and Family Therapy to thePublic Health Code, Public Act 368 of 1978, asamended. Part 169 defines the practice ofmarriage and family therapy as the providing ofguidance, testing, discussions, therapy,instruction, or advice that is intended to avoid,eliminate, relieve, manage or resolve marital orfamily conflict or discord, to create, improve, orrestore marital or family harmony, or to preparecouples for marriage.
The Michigan Board of Marriage and FamilyTherapy consists of 9 voting members: 6marriage and family therapists and 3 publicmembers.

Michigan Board of Medicine
The Michigan Board of Medicine was originallyformed with the enactment of Public Act 237 of1899. This act provided for the examination,regulation, licensing and registration ofphysicians and surgeons in the State ofMichigan, and for the discipline of offendersagainst the Act. On January 8, 1974, a newMedical Practice Act, Public Act 185 of 1973,became effective. This Act continued in effectuntil September 30, 1978, when the Board'sauthority was transferred to the Public HealthCode, Public Act 368 of 1978, as amended.
The practice of medicine, as defined in thePublic Health Code, means the diagnosis,treatment, prevention, cure or relieving of ahuman disease, ailment, defect, complaint, orother physical or mental condition, byattendance, advice, device, diagnostic test, orother means, or offering, undertaking,attempting to do, or holding oneself out as ableto do, any of these acts.
The Public Health Code mandates certainresponsibilities and duties for a healthprofessional licensing board. Underlying allduties is the responsibility of the board topromote and protect the public's health, safety,and welfare. This responsibility is implementedby the Board by ascertaining minimal entry levelcompetency of medical doctors, and requiringcontinuing medical education during licensure.The Board also has the obligation to takedisciplinary action against licensees who haveviolated the Michigan Public Health Code.

Michigan Board of Nursing
The Michigan Board of Nursing was originallycreated with the enactment of the NursePractice Act, Public Act 319 of 1909, andauthority was transferred to the “NursingPractice Act of 1967" by Public Act 149 of1967. On September 30, 1978, authority wasagain transferred to the Public Health Code,Public Act 368 of 1978, as amended.
The Michigan Public Health Code defines thepractice of nursing in Michigan and empowersthe Board to establish qualifications for nurselicensure; to establish standards for educationand approve nurse education programs;develop and implement criteria for assurance ofcontinued competency; and take disciplinaryaction against licensees when the health,safety, and welfare of the public has beenadversely affected.
The Public Health Code establishes the Boardof Nursing to consist of 23 members: 9registered nurses (RNs), 1 nurse midwife, 1nurse anesthetist, 1 nurse practitioner, 3licensed practical nurses (LPNs), and 8 publicmembers. Of the 9 registered nurses: 3 musthave a master's degree with a major in nursingand be engaged in nursing education, 1 in lessthan a baccalaureate program; 1 in abaccalaureate or higher program and 1 in alicensed practical nurse program; 3 must havea baccalaureate degree in nursing and beengaged in nursing practice or nursingadministration; and 3 must be non-baccalaureate registered nurses engaged innursing practice or nursing administration. The3 licensed practical nurses must havegraduated from a state-approved program ofpractical nurse education.
The enactment of the Public Health Codepermitted LPN board members to act upon allmatters except those that relate to standardsfor the education and training of RNs.
Decisions on such matters are concurred insolely by a majority of the RN and public boardmembers.
During this fiscal year, the Board met to grantlicenses, mete out disciplinary sanctions,review and approve nurse educationprograms, and to carry out all other mandatesof the Code relating to the licensing andregulating of RNs and LPNs.

Michigan Board of Optometry
The Michigan Board of Optometry wasoriginally formed with the enactment of PublicAct 71 of 1909. On September 30, 1978, thisauthority was transferred to the Public HealthCode, Public Act 368 of 1978, as amended.
On March 26, 1984, the Governor signedPublic Act 42 which allowed optometrists to becertified to administer topical oculardiagnosticpharmaceutical agents to the anterior segmentof the human eye. On July 13, 1985, the ruleswhich would allow the board to certifyoptometrists for diagnostic agents werepromulgated.
The Public Health Code mandates certainresponsibilities and duties for a healthprofessional licensing board. Underlying allduties is the responsibility of the board topromote and protect the public's health, safety,and welfare. This responsibility is implementedby the Board by ascertaining minimal entrylevel competency of health practitioners andverifying continuing education during licensure.The Board also has the obligation to takedisciplinary action against licensees who haveadversely affected the public's health, safety,and welfare.

The Michigan Board of Osteopathic Medicineand Surgery was originally formed with theenactment of Public Act 162 of 1903. This Actregulated the practice of osteopathic medicineand surgery in the State of Michigan; providedfor the examination, licensing and registrationof osteopathic physicians and surgeons; andprovided for the discipline of offenders againstthe Act. Michigan Board of Pharmacy
The Michigan Board of Pharmacy was originallyformed with the enactment of Public Act 134 of1885. On March 28, 1963, the authority of theBoard to regulate the practice of pharmacy andto prescribe its powers and duties; and toprescribe penalties for violations of the act, wastransferred to Public Act 151 of 1962. OnSeptember 30, 1978, authority was transferredto the Public Health Code, Public Act 368 of1978, as amended.
The Public Health Code, Public Act 368 of1978, as amended, defines the practice ofpharmacy as a health service, the clinicalapplication of which includes theencouragement of safety and efficacy in theprescribing, dispensing, administering and useof drugs and related articles for the preventionof illness and the maintenance andmanagement of health.
Professional functions associated with thepractice of pharmacy include the interpretationand evaluation of prescriptions; drug productselection; compounding, dispensing, safestorage, and distribution of drugs and devices;maintenance of legally required records;advising the prescriber and the patient asrequired regarding contents, therapeutic action,utilization, and possible adverse reactions andinteractions of drugs.
The Public Health Code, by section 17722,grants authority to the Board of Pharmacy toregulate, control, and inspect the character andstandards of pharmacy practice and of drugsmanufactured, distributed, prescribed,dispensed, and administered or issued in thisState and procure samples, and limit or preventthe sale of drugs that do not comply with thissection's provisions; prescribe minimum criteriafor the use of professional and technicalequipment in reference to the compoundingand dispensing of drugs; grant pharmacylicenses for each separate place of practice ofa dispensing prescriber who meetsrequirements for drug control licensing; andgranting licenses
to manufacturer/ wholesaler distributors ofprescription drugs. The Public Health Codemandates certain responsibilities and duties fora health professional licensing board.Underlying all duties is the responsibility of theBoard to promote and protect the public'shealth, safety, and welfare. This responsibilityis implemented by the Board by ascertainingminimal entry level competency of healthpractitioners and verifying continuing educationduring licensure. The Board also has theobligation to discipline licensees who haveadversely affected the public's health, safety,and welfare.
The Michigan Board of Pharmacy consists of11 voting members: 6 pharmacists and 5public members.

Michigan Board of Physical Therapy
The Michigan Board of Physical Therapy wasoriginally formed with the enactment of PublicAct 164 of 1965. On September 30, 1978, thisauthority was transferred to the Public HealthCode by Public Act 368 of 1978, as amended.The practice of physical therapy, as defined inthe Public Health Code, means: "theevaluation of treatment of an individual by theemployment of effective properties of physicalmeasures and the use of therapeutic exercisesand rehabilitative physical or mental disability.It includes treatment planning, performance oftests and measurements, interpretation ofreferrals, instruction, consultative services, andsupervision of personnel. Physical measuresinclude massage, mobilization, heat, cold, air,light, water, electricity, and sound."
The Public Health Code mandates certainresponsibilities and duties for a healthprofessional licensing board. Underlying allduties is the responsibility of the board topromote and protect the public's health, safety,and welfare. This responsibility is implementedby the Board by ascertaining minimal entrylevel competency of health practitioners. TheBoard also has the obligation to takedisciplinary action against licensees who haveadversely affected the public's health, safety,and welfare.

Michigan Task Force onPhysician's Assistants
The Committee on Physician's Assistants wasformed with the enactment of Public Act 420 of1976, signed by the Governor on January 9,1977. The Act regulated the practice ofphysician's assistants in the State of Michigan,providing a system to determine and approvethe qualifications of physician's assistants,creating a committee on physician's assistants,prescribing its powers and duties, andprescribing penalties. On September 30, 1978,this authority was transferred to the PublicHealth Code, Public Act 368 of 1978, asamended and became the Task Force onPhysician's Assistants.
The practice as a physician's assistant, asdefined in the Public Health Code, means thepractice of allopathic or osteopathic medicineunder the supervision of an allopathic orosteopathic physician.
The Public Health Code mandates certainresponsibilities and duties for a healthprofessional licensing board. Underlying allduties is the obligation of the Board or TaskForce to promote and protect the public'shealth, safety, and welfare. This responsibilityis implemented by the Task Force byascertaining minimal entry level competency ofhealth practitioners. The Task Force also hasthe obligation to take disciplinary action againstlicensees who have adversely affected thepublic's health, safety, and welfare.
The Task Force on Physician's Assistantsconsists of 9 voting members: 5 physician'sassistants, 1 physician member from each ofthe Boards of Medicine and OsteopathicMedicine and Surgery, and 2 public members.

Michigan Board of Podiatric Medicine and Surgery
The Michigan Board of Podiatric Medicine andSurgery was originally formed with theenactment of Public Act 115 of 1915. OnSeptember 30, 1978, this authority wastransferred to the Public Health Code, PublicAct 368 of 1978, as amended.
The practice of podiatric medicine and surgery,as defined in the Public Health Code, meansthe examination, diagnosis, and treatment ofabnormal nails, superficial excrescensesoccurring on the human hands and feet,including corns, warts, callosities, and bunions,and arch troubles or the treatment medically,surgically, mechanically, or by physiotherapy ofailments of human feet or ankles as they affectthe condition of the feet. It does not includeamputation of human feet, or the use oradministration of anesthetics other than local.
The Public Health Code mandates certainresponsibilities and duties for a healthprofessional licensing board. Underlying allduties is the responsibility of the Board topromote and protect the public's health, safety,and welfare. Michigan Board of Psychology
The Michigan Board of Psychology wasoriginally formed with the enactment of PublicAct 257 of 1959. On September 30, 1978, thisauthority was transferred to the Public HealthCode, Public Act 368 of 1978, as amended.
The Public Health Code defines the practice ofpsychology as the rendering to individuals,groups, organizations, or the public of servicesinvolving the application of principles, methods,and procedures of understanding, predicting,and influencing behavior for the purposes ofthe diagnosis, assessment related todiagnosis, prevention, amelioration, ortreatment of mental or emotional disorders,disabilities or behavioral adjustment problemsby means of psychotherapy, counseling,behavior modification, hypnosis, biofeedbacktechniques, psychological tests, or other verbalor behavioral means. The practice ofpsychology does not include the practice ofmedicine such as prescribing drugs, performingsurgery, or administering electro-convulsivetherapy.

Sanitarian Registration
The Michigan Board of Sanitarians wasoriginally formed with the enactment of PublicAct 174 of 1963. On September 30, 1978, thisauthority was transferred to the Public HealthCode, Public Act 368 of 1978, as amended.Executive Order No. 1996-2, effective May 15,1996, transferred all the statutory authority,powers, duties, functions and responsibilities ofthe Board of Sanitarians under Part 184 of thePublic Health Code, being Sections 333.18401et seq. of the Michigan Compiled Laws, fromthe Department of Commerce to the Director ofthe Department of Consumer & IndustryServices by a Type III transfer as defined bySection 3 of Act No. 380 of the Public Acts of1965, as amended, being Section 16.103 ofthe Michigan Compiled Laws. Underlying allduties is the responsibility of the Department topromote and protect the public's health, safety,and welfare. This responsibility is implementedby the Department by ascertaining minimalentry level competency of registeredsanitarians. The Department also has theobligation to take disciplinary action againstregistrants who have adversely affected thepublic's health, safety, and welfare.
Sanitarian means an individual who hasspecialized education and experience in thephysical, biological and sanitary sciences asapplied to the educational, investigational andtechnical duties in the field of environmentalhealth.

Michigan Board of Veterinary Medicine
The Michigan Board of Veterinary Medicinewas originally formed with the enactment ofPublic Act 156 of 1956. On September 30,1978, this authority was transferred to thePublic Health Code, Public Act 368 of l978, asamended.
The practice of veterinary medicine, as definedin the Public Health Code, means prescribingor administering a drug, medicine, treatment ormethod of procedure; performing an operationor manipulation; applying an apparatus orappliance; or giving an instruction ordemonstration designed to alter an animal fromits normal condition; curing, ameliorating,correcting, reducing, or modifying a disease,deformity, defect, wound, or injury in or to ananimal; diagnosing or prognosing, or both, adisease, deformity or defect in an animal by atest, procedure, manipulation, technique,autopsy, biopsy, or other examination.
