Executive summary
This report is prepared under the Health System Improvement Project ("Health-3 project")" based on the
results of the resettlement audit conducted in February and September 2016. The purpose of the audit is to
identify potential resettlement impact that may have taken place due to the project activities. In case such
impact identified, to propose mitigation measures.
The project implementation started in 2012 and is expected to be completed in 2018. For the entire period
of implementation more than 170 medical facilities across Uzbekistan are to be reconstructed.
This report covers review of the District Medical Units (DMU) and City Medical Unites (CMU) included
into the Health System Improvement Project (Health -3) for the period of 2012-2016.
Going forward, during the project implementation due diligence activities will be done to identify
potential instance of resettlement and, to avoid or minimize resettlement impact.
Initially the project did not trigger the World Bank policy on Involuntary Resettlement (OP 4.12), as no
resettlement was envisioned. In April 2015, it came to the attention of the project team that some
resettlement impact may have taken place. In August 2015, some preliminary data on structures on the
territory of medical facilities in 6 districts of 4 regions1 were received. In December 2015, Central Project
Implementation Bureau (CPIB) sent additional official inquires to municipality (khokimiats) of regions,
where the project takes place, in order to obtain data on structures located in the territory of DMUs/CMUs
and adjacent territory, which might have been affected by the project activity. As the result, all the
Regional Project Implementation Bureaus provided the information about the structures relocated or may
be potentially relocated under the project. Detailed information of the schedule of project implementation,
including number of DMU/ CMU and regions covered by the project, is presented in Section I.
The table below (table 1) presents the potential resettlement impact on the project area based on the
results of the data provided by the Regional Project Implementation Bureaus.
According to the data obtained by the mentioned inquires it was identified that there were 17 DMUs /
CMUs in 7 regions2 of Uzbekistan with the potential resettlement impacts resulted by the project
activities. Total number of structures located there that may potentially be affected by the project was 88
units. According to the data obtained in December 2015, the number of structures that may potentially be
relocated was 82 units. The other 6 structures were not in the scope of potential resettlement impact. The
resettlement audit carefully reviewed these 82 instances where structures may potentially be affected by
the project.

In addition, to obtain detailed information on potential resettlement impact of the project in September,
2016, Consultant with the support of CPIB made requests to Regional Project Implementation Bureaus
and municipalities for any additional information or potential changes that may have taken place.
Additional information was received partially and incorporated into this report.

The data analysis in this audit was based on the information provided by the municipalities, site visits of
13 districts in 7 regions of Uzbekistan3 and review of other relevant project documentation, including
cadaster plans, master plans, decrees, regulations etc. During the site visit, a detailed visual assessment of
the DMU/ CMU territory and adjacent areas was done. The potentially project affected structures may be
private commercial structures / small business entities / enterprise (pharmacies, shops, public cafeteria
places and etc.) as they are often located on or adjacent to the DMU/CMU campus.
Audit was carried out in two stages.
Stage 1 - February 2016: Assessment of the territory of seven DMU / CMUs located in 6
districts of 4 regions.4
Stage 2 - September 2016: Assessment of the territory of the DMU/CMU that participate in the
project between 2012 and September 2016. That covers 10 DMU/CMUs located in 7 districts of 4
regions5.
The cut-off date after which no project affected persons can be determined on the territory of DMUs
/CMUs is February 15, 2016.
The findings of the audit are summarized in the table below.

During the site visit of 82 potentially impacted private commercial structures, Consultant de facto
identified 118 private commercial structures located either on or adjacent the territory of medical facilities
covered by the project and that may potentially be / have been affected by the project. In total, 109 private
commercial structures of 118 identified structures are located outside the territory of the medical
facilities. The obtained cadastral plans and letter of local authorities showed that there is no project
impact on these structures. To date, no resettlement impact due to project activities has taken place.
Only 2 private commercial structures located in Chust DMU, Namangan region and Karmana DMU,
Navoi region may be affected by the project in 2017. At this stage of project implementation there is no
exact date and approved decree on the potential relocation of these structures. In case of relocation these
structures will be resettled in compliance with the requirement of the World Bank policy on Involuntary
Resettlement (OP 4.12).

Introduction
The Health System Improvement Project (Health -3) follows the two preceding projects Health -1 and
Health 2. The project is aimed to improve access to quality health care at the primary level and DMU, and
strengthen the Government’s public health response to the rise in NCDs.
Project implementation (Health System Improvement Project (Health -3)) started in 2012. More than 170
medical facilities and structures are scheduled to be reconstructed under the project. The expected project
closing date is on December 31, 2018. The reconstruction of medical facilities is carried out under the
annual State investment program that is financed by the GoU and approved by Decree of the President of
the Republic of Uzbekistan for each year. Therefore, each year a list of CMUs/DMUs is identified to be
included in State investment program. Provision of medical equipment to already renovated medical
facilities is financed by the WB. Since reconstruction of the DMUs/CMUs is (a) “directly and
significantly related to the Bank-assisted project;” (b) “necessary to achieve its objectives as set forth in
the project documents;” and (c) “carried out contemporaneously with the project,”6 these medical
facilities are considered to be associated facilities and the WB resettlement policy (OP 4.12) applies to
them.

some resettlement impact may have taken place. Hence, this resettlement audit was carried out.
This audit was carried out in two stages:

2. Stage 2 - September 2016: Assessment of the territory of the DMU/CMU that participate in the

Improvement Project (Health -3) for the period of 2012-2016.

Methodology of the audit
Objectives of the Audit:
To identify potential resettlement impact that may have taken place due to the project activities.
To determine the compliance of resettlement actions of resettlement policy with World Bank OP
4.12 (Involuntary Resettlement).
During the audit Consultant interacted with the representatives of the CPIB, local khokimiyats and other
stakeholders. Data obtained from official documents of local authorities and cadaster department were
provided to the CPIB. Copies of these documents are given in the present report in Annex 2.
From the methodology point of view, audit is based on the following methods:
Analysis of the documents, including cadaster plans, master plans, decrees, regulations etc.;
Consultations with the representatives of the CPIB, local khokimiyats and owners of the entities
located in or around the CMU/DMU campuses;
Field visits – inspection of the project implementation territory, analysis and observation.

Chapter I: Information about the project
1.1 Project description
Within the scope of the State Program on Reforming of Healthcare System the Republic of Uzbekistan is
implementing of full-scale restructuring of Primary Healthcare by improving of infrastructure and
furnishing with modern basic equipment, capacity building of medical personnel and deploying of new
finance and management reforms which would promote improvement of management innovation.
World Bank provided support in reforming of Primary Healthcare in the country. The Health System
Improvement Project (Health -3) follows the two preceding projects Health -1 and Health -2.
Main Project objectives are to:
(1) improve access to quality health care at the primary and DMU level;
(2) strengthen the Government’s public health response to the rise in NCDs.
The Project design envisages the following four components and their subcomponents:
Component 1: Improving Health Service Delivery
1.1. Hospital Services Improvement.
1.2. Primary Health Care Development.
1.3 Clinical Quality Enhancement.
Component 2: Strengthening Health Financing and Management Reforms.
2.1. Improvement of Health Facilities Financing System
2.2. Improvement of Health Facilities Management System
2.3. Informatization of Health Management System
Component 3: Institutional Strengthening for NCD Prevention & Control.
3.1: Health Promotion and NCDs Prevention
3.2: Strengthening Health Surveillance Systems
Component 4: Project Management.
Initially the project did not trigger the World Bank policy on Involuntary Resettlement (OP 4.12), as no
resettlement was envisioned. The Government of Uzbekistan financed reconstruction of medical facilities.
As a result of such reconstruction works some commercial organizations may have been relocated or are
expected to be relocated. As these medical facilities are considered to be associated facilities to the World
Bank-financed project, any resettlement has to be carried out with application of protective measures of
WB OP 4.12.
1.2 Current status of project implementation
Project implementation (Health System Improvement Project (Health -3) started in 2012. The planned
period of implementation is 2012-2018.
The total amount of medical facilities to be reconstructed upon the project is 391 units. 47% (182 units) of
them have been reconstructed up to 2016. 53% of medical facilities are expected to be included into the
program on reconstruction for 2016-2018.

During the project implementation Consultant found out that the structures that may be potentially
affected or have been affected by the project implementation are referring to small business entities /
enterprise (pharmacies, shops, public cafeteria places and etc.). These commercial structures can be
located in the territory of the medical facility or adjacent territory to it.

1.3 Main project stakeholders
The main agencies, which are involved in ensuring the effective work of the health care system in
Uzbekistan, are the following institutions:
(i) Ministry of Health of the Republic of Uzbekistan, Central Project Implementation Bureau
– Executive Agency of the Project;
(ii) Khokimiyats of regions and cities of RUz;
(iii) DMU/CMUs of regions and cities of RUz.

information or potential changes that may have taken place. Additional information was received partially
and incorporated into this report.

According to the data obtained by the mentioned inquires it was identified that there were 17 DMUs /
CMUs in 7 regions10
of Uzbekistan with the potential resettlement impacts resulted by the project
activities. Total number of structures located on or near the campuses of the medical facilities that may
potentially be affected by the project was 88 units. All of them are private commercial structures those
located in the territory or the adjacent territory of the medical facilities. These structures are private
commercial structures, in particular small business entities / enterprise (pharmacies, shops, public
cafeteria places etc.). The number of structures that may potentially be relocated was 82 units. The other 6
structures were not within the scope of potential impact.
Information on these structures is confirmed by the documents (letters) submitted to the CBIP and
followed up by site visits. Consequently, resettlement audit carefully reviewed these instances where 82
structures may potentially be affected by the project.
Consultant notes that during further project implementation, these structures will be monitored to ensure
that they indeed are not relocated.
2.2 Field assessment of project areas
The field assessment included site visits of 13 districts in 7 regions of Uzbekistan with the potential
resettlement impacts resulted by the project activities. During the site visit, a detailed visual assessment of
17 DMUs / CMUs territory and adjacent areas was done.
The field assessment was carried out in two stages:

Stage 1 - February 2016: Assessment of the territory of seven DMU / CMUs located in 6 districts
of 4 regions. In particular, Andijan (Ulugnor, Khanabad and Shakhrikhan districts), Namangan
(Chust district), Samarkand (Samarkand city) and Bukhara (Jondor district) regions.
Stage 2 - September 2016: Assessment of the territory of the DMU/CMU that participate in the
project between 2012 and September 2016. That covers 10 DMU/CMUs located in 7 districts of 4
regions. In particular, Andijan (Pakhtaabad, Bulakbashi), Djizzak (Zaamin, Arnasay, Galaaral
districts), Navoi (Karmana district) and Syrkhandarya (Baysun district) regions.
The cut-off date after which no project affected persons can be determined on the territory of DMU/CMU
is February 15, 2016
Based on the letters received and documentary evidences, the total number of structures located there that
may potentially be affected by the project was 88 units. Out of them, 82 structures that may potentially be
relocated. The potentially project affected structures are private commercial structures / small business
entities / enterprise (pharmacies, shops, public cafeteria places and etc.).
During the site visits Consultant identified more structures - 118 private commercial structures- located
inside / adjacent to the medical facilities. The obtained cadastral plans and letter of local authorities
showed that there is no project impact on these structures. Only 2 private commercial structures - one
located in Chust DMU, Namangan region and one in Karmana DMU, Navoi region may be affected by
the project in 2017. At this stage of project implementation there is no exact date and approved decree on
the potential relocation of these structures. In case of relocation these structures will be resettled in
compliance with the requirement of the World Bank policy on Involuntary Resettlement (OP 4.12). No
resettlement due to project activities has taken place to date.
The table below presents the results of resettlement impact identified during the site visits.

2.2.1 Detailed information on visited sites
Andijan region:
In the territory of Andijan region, reconstruction and capital repair of district medical facilities (CDH and
CDMP), scheduled to be equipped under the project, are being implemented in the territory of four
medical facilities of three project districts. In particular: Ulugnor DMU, Khanabad DMU, Shakhrikhan
DMU.
The consultant jointly with the director of the Health III Project of Andijan HMD, Mr. G. M. Teshabayev
visited these sites, included in the Investment Program for Andijan region.
According to the results of the visits, Consultant identified that there is no resettlement impact on
structures in visited medical facilities. Civil works will not impact the structures located inside / adjacent
to the medical facilities. In particular:
Ulugnor DMU: In the territory of DMU of Ulugnor district during the visit no commercial
structures, belonging to private structures or private business were found out. It is confirmed by
the current cadastral plan (Reference #11-255 dd. 03.03.2016) and by a letter from municipality
(khokimiyat) of Ulugnor district, Andijan region (#01/22-85), according to which in the territory
of Ulugnor DMU there are no structures, which will fall under the project activities. (Copies of
the documents are given in Annex 2.1.2 A-C).
Installation and construction / civil works under Investment Program was completed; work on
landscaping is in the process. (Picture 1-6 of territory of Ulungur DMU is given in the Annex
2.1.2 D).
Shakhrikhan DMU. During the visit to Shakhrikhan DMU territory, the meeting with the
representatives of self-governmental bodies was arranged. In the area of Shakhrikhan district the
consultant visited the territory of three separately located structures of the DMU:
1) District hospital of Shakhrikhan district.
2) Maternity complex of Shakhrikhan district.
3) Multi-field polyclinic of Shakhrikhan district.
According to the current cadastral plan (Reference # MS-117 dd. March 4, 2016) and a letter
from khokimiyat of Shakhrikhan district, Andijan region (#07/20-151 dd. 05.03.2016) indicated
commercial structures are located beyond the territory of considered medical facilities, covered
by the project. Particularly:
1) District hospital of Shakhrikhan district: 3 private commercial structures, related to
private enterprise (2 private pharmacies and one private diagnostic center), located in the
adjacent territory of Shakhrikhan district hospital. These facilities are located beyond the
district hospital, as it is confirmed by the current cadastral plan.
2) Maternity complex of Shakhrikhan district: in the territory of maternity complex there are
no facilities, related to private enterprise/ private business. Three commercial structures
(one facility of public cafeteria – kebab house, one pharmacy, one facility of public
cafeteria – somsa khona) are located near the fence. All these structures are located
beyond the maternity complex; it is confirmed by the current cadastral plan.
3) Polyclinic of Shakhrikhan district: in the territory of multi-field polyclinic stranger small
facilities/commercial structures were not found.

In accordance with the data given, indicated structures, located in the adjacent territory of
DMU, will not impact the architectural aspect of the facilities and will not be affected by the
project activities.
Copies of the documents and pictures of DMUs are given in the Annex 2.1.3 A-D.
Khanabad DMU: During the visit to Khanabad DMU, the meeting with the representatives of
self-governmental bodies was arranged as well. In the territory of Khanabad DMU there was one
private commercial structure found, related to private enterprise - adjacent small building (private
selling spot) – at the stop of public transportation, which is in the adjacent territory of DMU
(approximately in the distance of 4 meters).
According to the current cadastral plan (Reference # АМ-60 – 05 dd. March 4, 2016, see Annex 2.1.4 C)
and a letter from Khakimiyat of Khanabad city, Andijan region (#01/05-89 dd. 04.03.2016, see Annex
2.1.4 A-B) in the territory of Khababad DMU there are no structures, located directly in the territory of
the facility. One private commercial property, related to private enterprise (a shop), is located in the
adjacent territory of DMU. In accordance with the current cadastral plan, this property is located beyond
the DMU and is not affected by the project activity. Copies of the documents and picture of DMU are
given in the Annex 2.1.4 A-C.
These medical facilities were inspected in February 15-17, 2016.
On September 06, 2016, Consultant also inspected two district medical facilities: Pakhtaabad and
Bulakbashi region.
The consultant jointly with the director of the Regional PIB Health III Project of Andijan, Mr. G. M.
Teshabayev visited these sites, included in the Investment Program for Andijan region.
According to the results of the visits, the following outcomes were obtained:
Pakhtaabad DMU: In the territory of DMU of Pakhtaabad district during the visit no
commercial structures, belonging to private structures or private business were found out.
There are 9 private commercial structures located outside of the territory of DMU. These
structures are not affected by the project works on reconstruction of medical facility.
It is confirmed by the current cadastral plan dated July 24, 2015 and by letter from municipality
(khokimiyat) of Pakhtaabad district, Andijan region (#XM/04-238), according to which in the
territory of Pakhtaabad DMU there are no structures, which will be relocated under the project
activities. (Copies of the documents and pictures of the territory of DMU are given in Annex
2.1.5 B-D).
Bulakbashi DMU: Consultant inspected three medical facilities in the Bulakbashi district, in
particular Bulakbashi district hospital, Bulakbashi polyclinic (including infectious department)
and Emergency point.
Bulakbashi district hospital. There are 6 private commercial structures (pharmacies) located
outside of the territory of hospital. One of them (pharmacy) is located inside the territory of
DMU. These structures are not affected by the project works on reconstruction of medical
facility.

It is confirmed by the current cadastral plan and by letter from municipality (khokimiyat) of
Bulakbashi district No Y/R -976-04, dated August 11, 2016 and No 833/01-5 dated December 16,
2015. (Copies of the documents and pictures of the territory of DMU are given in Annex 2.1.6 B-
D).
Bulakbashi polyclinic (including infectious department). There are 2 private commercial
structures (pharmacy and dental clinic). These structures are not affected by the project works on
reconstruction of medical facility.
Bulakbashi emergency point. There are 6 private commercial structures (pharmacies) located
outside of the territory of medical facility.
In accordance with the data obtained by the results of audit, there are no private commercial structures in
the territory of Pakhtaabad and Bulakbashi district. All the identified private commercial structures are
located in the adjacent territory of DMUs and will not be affected by the project activities.
Hence, in the territory of Andijan region there are no structures that would be affected by the project.
Civil works will not impact the structures located inside / adjacent to the medical facilities, no
resettlement impact is observed in this region.
Bukahra region:
On February 24-25, 2016, the consultant jointly with the director of the Health III Project of Bukhara
HMD, Mr. S. K. Rakhimov visited of structures, included in the Investment Program for Bukhara region,
specifically Jondor DMU.
During the visit of the Jondor DMU, the consultant noticed many ruinous buildings or buildings at the
stage of demolishing, and not demolished private commercial structures in the adjacent territory of DMU
and in the territory of Jondor DMU. According to data received by the project team in August 2015, there
were 25 private commercial structures in the territory of Jondor district DMU. This information was
provided by the Jondon Khokimiyat.
According to the obtained official data from Khokimiyat of Jondor district, 21 structures are outside the
Jondor DMU, specified in current cadastral plan. Rehabilitation of these structures is included in the
project of reconstruction and rehabilitation of city and its streets.11
It is confirmed by the official letter of
the Khokimiyat of Jondor district No.02/785 dated 14 April 2016. DMU border in the place of
construction works is determined by the poles for future fence which at this stage of reconstruction works
are installed for delimitation of the territory of medical institution and the adjacent territory. The specified
borders correspond to the existing cadastral plan of the medical institution. (Figure 81 Annex 2.2.2 D).
Four private commercial structures, which will not be involved in the project, are located in the territory
of Jondor DMU. One building of dairy products for children, two pharmacies and one building of
diagnostic center are referred to these structures. It is due to the fact that, these 4 structures are distant
enough from the facilities under reconstruction. These four structures do not disturb the construction
activity, and in the future will not affect the architectural aspect of the structure of DMU/city. It is

confirmed by the official letter of the Khokimiyat of Jondor district No.02/785 dated 26 April 2016. (See
Annex 2.2.2 A).
Hence, there are no structures in the territory of Jondor DMU, which will be affected by the project
activity and be scheduled to resettlement/ land acquisition. Consultant identified that there is no
resettlement impact on structures in visited medical facilities. Civil works will not impact the structures
located inside / adjacent to the medical facilities.
Djizzak region
On September 7-8, 2016, Consultant jointly with the director of the Regional PIB Health III Project of
Djizzak region and representatives of DMUs inspected the following medical facilities:
Zaamin DMU: According to the data provided by the local authorities in December 2015, there
were 2 structures located in the territory of the DMU. During the audit Consultant identified 8
private commercial structures located outside the territory of Zaamin DMU. There is no private
commercial structure located inside the DMU.
According to the cadastral plan No 1308 0102 010138 dated January 24, 2015 these private
commercial structures are located outside the medical facility. The reconstruction works are in
progress and these structures do not prevent the works on reconstruction. Thus, these structures
will not be affected by the project activities. (Copies of the documents and pictures of the
territory of DMU are given in Annex 2.3.2 A, D).
Mirzachul DMU: According to the results of audit Consultant obtained the following
information:
There are 3 private commercial structures located in the boundary territory of the medical facility,
in particular pharmacies and public cafeteria place. Two of these structures are located in the
internal side of the wall of DMU and one commercial structure is located outside of the wall of
DMU.
According to the letter from local authorities No 01-622 date September 7, 2016 these 3 private
commercial structures do not impact the DMU and will not be affected by the project activities.
(Copies of the documents and pictures of the territory of DMU are given in Annex 2.3.5 A, C, D).
Arnasay DMU. Consultant identified one private commercial structure located outside of the
DMU. There is no private commercial structure located inside the DMU. It is confirmed by the
cadastral plan and letter from local authorities No 01-303 dated September 08, 2016. (Copies of
the documents and pictures of the territory of DMU are given in Annex 2.3.2 A, D).
There is no structure in Arnasay that will be affected by the project activities.
Galaaral DMU: Consultant found out 5 private commercial structures located outside the DMU.
There is no private commercial structure located inside the DMU. It is confirmed by the cadastral
plan and letter from local authorities No 02-716 dated September 8, 2016. (Copies of the
documents and pictures of the territory of DMU are given in Annex 2.3.3 A, C, D).
Thus, results of conducted audit in Djizzak region Consultant identified that there is no resettlement
impact on structures in visited medical facilities. Civil works will not impact the structures located inside
/ adjacent to the medical facilities. No private commercial structures will be demolished or relocated
because of project activities.

Namangan region:
On February 15-17, 2016 the consultant jointly with the director of the Health III Project of Namangan
HMD Mr. D. Kadirov visited the facilities involved in the Investment Program for Chust DMU of
Namangan region. 12
Chust DMU: During the Chust DMU territory visit, a meeting was held with the representatives
of self-governmental bodies. At the time of the visit, there were 21 private commercial structures
on the territory of Chust DMU. 20 of them are located in the adjacent territory of DMU, and one
property (a public cafeteria) is located in the territory of Chust DMU in the distance of 10-15
meters from the DMU fence. This cafeteria will be affected by the project, because department
for infectious deseases is to be built on the place of this property in 2017. At this stage of project
implementation there no approved decree on the investment plans for 2017. This DMU is
expected to be included in 2017. In case of relocation these structures will be resettled in
compliance with the requirement of the World Bank policy on Involuntary Resettlement (OP
4.12).
According to official documents – letter from municipality (khokimiyat) of Namangan region
Chust district (№ 01-06/203 dd. March 24, 2016; see Annex 2.7.2 A) – there is one structure in
the territory of Chust DMU – a public cafeteria, which is demolished to allow construction of
infectious department of this DMU.

by civil works. The copies of the documents are given in Annex 2.7.2 A, C, D.
Hence, in the territory of Chust DMU one structure will be affected by the project and will be scheduled
to resettlement/ land acquisition.
Samarkand region:
On February 24-25, 2016 the consultant jointly with the director of Health III Project of Samarkand
HMD, Mr. D. H. Tagayev visited the territory of family polyclinic #12 of Samarkand, involved in
Investment Program for Samarkand CMU. During the visit to Family polyclinic #12 of Samarkand, the
meeting with the representatives of self-governmental bodies took place.
There are no private commercial structures on the territory of the family polyclinic #12 in Samarkand.
However, Deputy of Khokim on reconstruction of Samarkand informed that there were private
commercial structures in the adjacent area behind the fence. These structures were relocated under the
city streets reconstruction project. It is confirmed by the current cadastral plan, presented by the Chief
Directorate of Architecture and Construction of Samarkand (letter # 493 dd. March 2, 2016). Copies of
documents and DMU pictures are given in Annex 2.9.2 B-D.
Hence, in the territory of Samarkand there are no structures, which will fall under the project activity and
be scheduled to resettlement/ land acquisition.
Navoi region

On September 14, 2016 Consultant inspected Karmana DMU in Navoi region on September 14, 2016.
According to the audit results, there are 5 private commercial structures, 4 structures of which are located
outside the territory of DMU. These are private pharmacies. The last private commercial structure is
located in the territory of DMU and will be demolished. It is building of physiotherapy services. The
planned period of relocation is 2017-2018. At this stage of project implementation there is no approved
decree on the investment plans. It is only expected that the new construction will take place in 2017-2018.
In case of relocation these structures will be resettled in compliance with the requirement of the World
Bank policy on Involuntary Resettlement (OP 4.12).
This is confirmed by the cadastral plan and letter from local authorities No 01-03/1041 dated September
14, 2016 (See Annex 2.6.2 A-C).
Surkhandarya region
Consultant visited the Baysun DMU on September 9, 2016. There are 15 private commercial structures
(pharmacies, shops, public cafeteria, hairdressing salon etc.) located outside the territory of DMU.
During the 2017-2018 it is planned to carry out the reconstruction of polyclinic in the territory of DMU
and complete the equipping the medical facility.
Taking into account the results of audit, Consultant found out that Consultant identified that there is no
resettlement impact on structures in visited medical facilities. Civil works will not impact the structures
located inside / adjacent to the medical facilities. It is confirmed by the cadastral plan and letter from the
local authorities.
At present, there 2 private commercial structures located in Chust DMU, Namangan region and Karmana
DMU, Navoi region that may potentially be impacted by the civil works under the project. However, at
this stage there are no approved decrees for investment for upcoming years. In case of relocation these

2.3 Field assessment of project areas on in other regions
Since the list of medical facilities to be included in the State Investment Program is done on annual basis,
there is no confirmed information about DMUs and CMUs that will be included in the program in 2017
and 2018. Hence, potential resettlement impact is not possible to determine. However, the project will
carry due diligence during the project implementation in 2017 and 2018 to assess potential resettlement
impact once the list of facilities is known.

Chapter III: Grievance redress mechanism
The Grievance Redress Mechanism (GRM) is described in detail in the enclosed document titled
“Grievance Redress Mechanism report.” It provides a detailed Grievance Redress Mechanism (GRM)
designed to cover grievances and claims from those ones affected by the Project in the past, present and
future and from the persons, who may be potentially affected by the Project.
This document provides detailed information on the principles, efficiency of GRM functioning, as well as
the levels and place (authority) for submission and examination of grievances, where aggrieved persons
may apply with their claims and get respective answers, explanations or information about resources on
their claims.
The main objective of GRM within the project is provision of the timely and convenient resolution of the
grievances received from the project affected persons. GRM is the process which gives the right to any
interested person to address with the grievance or the proposal while the construction works and after the
implementation of the project.

Chapter IV: Public consultations
The public consultations on results of resettlement audit were conducted in all sites covered by this audit.
The meetings were held at district khokimiyats. During the meetings, participants were informed on the
results of audit, including potential consequences of resettlement and mitigation measures, land
acquisition, detailed information on grievance redress mechanism and contact information of the
responsible institutes and specialists under the Project. The announcements and brochures containing
relevant information were distributed. Representatives of relevant state organizations (including district
and regional representatives of health care), khokimiyats, makhalla committees and other local authorities
as well as project –affected person (owners of private business) took part in the consultations. Based on
the results of the meetings respective minutes/reports were prepared (Annex 3).
The total number of attendants of the public consultations is 118 persons.

Conclusions
Activity for the project implementation was started in 2012 and continues up to the present. The project is
scheduled to close on December 31, 2018.
While at appraisal no resettlement impact was expected, during project implementation there was a
potential that some private structures on and near the territory of medical facilities may be impacted. The
audit was carried out to assess whether such impact may have taken place. To date, no resettlement
impact due to the project activities has taken place. This report covers review of the DMUs / CMUs
included into the reconstruction under Health System Improvement Project (Health -3) for the period of
2012-2016.
During the project implementation due diligence activities will be done to identify potential instance of
resettlement and minimize resettlement impact.
Initially the project did not trigger the World Bank policy on Involuntary Resettlement (OP 4.12), as no
resettlement was envisioned. In April 2015, it came to the attention of the project team that some
resettlement impact may have taken place. In August 2015, some preliminary data on structures on the
territory of medical facilities in 6 districts of 4 regions were received. In December 2015, Central Project
Implementation Bureau (CPIB) sent additional official inquires to municipality (khokimiyats) of regions,
where the project takes place, in order to obtain data on structures located in the territory of DMUs/CMUs
and adjacent territory, which might have been affected by the project activity. As the result, all the
Regional Project Implementation Bureaus provided the information about the structures relocated or may
be potentially relocated under the project.
According to the data obtained by the mentioned inquires it was identified that there were 17 DMUs /
CMUs in 7 regions of Uzbekistan with the potential resettlement impacts resulted by the project activities.
Total number of structures located there that may potentially be affected by the project was 88 units.
According to the data obtained in December 2015, the number of structures that may potentially be
relocated was 82 units. The other 6 structures were not in the scope of project impact.
The resettlement audit carefully reviewed these 82 instances where structures may potentially be affected
by the project.
According to the result of audit there are 118 private commercial structures, located inside / in the vicinity
of medical facilities. Only 2 private commercial structures may potentially be relocated due to civil works
under the project.
These structures are the following:
1. Namangan region, Chust DMU: one commercial structure (public cafeteria) located in the
territory of Chust DMU will be affected by the project, because infectious department is to be
built on the place of this property.
2. Navoi region, Karmana DMU: one private commercial structure located in the territory of DMU
will be demolished. It is building of physiotherapy services.
To date, no resettlement impact has taken place under the project. The identified resettlement impact in
two sites may not occur, if these medical facilities are not included in the investment plans for 2017
and/or 2018.

reconstruction works at the objects covered by the Project implementation “Health-3” was created.
During the analysis of preliminary assessment 1 object in Ulugnar RMU (private pharmacy) was moved
and was rendered full assistance by local Khokimiyat in this view. At the objects subject to inclusion into
the Investment program for 2016-2018, movements at Shakhrikhan and Buklakbashi RMU were
observed.
Information in electronic and written form according to the Annex No.No. 1,2 and 3 was submitted to the
CBPI “Health-3”.

Polyclinic of Shakhrikhan district.
At present 3 (three) commercial structures related to private business – 2 private pharmacies and one
private diagnostic center, are located near to District hospital of Shakhrikhan district. These structures are
located in the adjacent territory out of the territory of the hospital. This fact is confirmed by the cadastral
plan of the district hospital (see Annex 1) with the marked the border of the hospital and structure of
private business activity which are located beyond the fence of the DMU. All the private structures are
numbered. Information about them is included into the Annex 2 of the letter. There are no private
commercial structures in the territory of Maternity complex of Shakhrikhan district as well. 3 commercial
structures are located near to the fence of DMU, especially one cafeteria structure (kebab house), one
pharmacy and one cafeteria structure (somsakhona). All these structures are located out of the territory of
Maternity complex of Shakhrikhan district. This fact is confirmed by cadastral plan of the facility of
Maternity complex of Shakhrikhan district (Annex 3) with the marked borders of DMU and private
commesrical structures located out of the territory of DMU. All these structures are numbered and
information on them is included into the Annex 3.
No structures are located in the territory of Polyclinic of Shakhrikhan district.
We also inform you on that these structures located near the medical facility will not impact the
architectural aspect of the facilities and will not be affected by Health System Improvement Project
("Health-3 project")".

Based on Decree of Khakim of Samarkand city №1078 dd July 4, 2014 additional reconstruction of
building of the Family Polyclinic #12 of Samarkand city is allowed.
Private sales and domestic buildings, located at the address 56, Andijan str., Samarkand city are not
included in the documents of cadastral plan, registered on January 11, 2005 by the Central registration
office of Main Department “Samarkandviloyatdavlatkadastr”, issued to Family Polyclinic #12 (Cadastral
Plan of FP #12 in Annex).
In connection with implementation of reconstruction work in Andijan street, for the reason that sales
commercial shops, located at the address Andijan str. 56, did not meet architectural and planning
requirements and rules (absence of parking for private automobiles), and the construction projects were
implemented without correlation to General City Plan, based on applications from owners of these
commercial shops, by Decree of Khakim #16 dd. February 12, 2015, based on approved General City
Plan the land was allocated in this adjacent territory and buildings were newly constructed, they operate at
present. No complaints were received from these entrepreneurs (attached: copies of cadastral books of
sales commercial sites, located in Andijan street, 56).
Based on information given above, hereby we inform you that 5 sales commercial sites located in Andijan
street, 56 were not included in the territory of polyclinic #12, and they are not included there after the
resettlement as well.

Objective of consultations:
i. To conduct public hearings for detailed information of all interested people and people under the
project impact on World Bank protective measures and Legislation of the Republic of
Uzbekistan, particularly regarding issues on environmental protection and involuntary
resettlement of commercial enterprises in the Health III Project framework in Andijan region
(Ulugnor DMU, Shakhrikhan DMU, Namangan region (Chust DMU)).
Information on conducted consultations in Andijan region:
Involving staff, representatives of makhalla committee of nearby commercial structures and other core
groups, public hearings were conducted in order to explain requirements of the World Bank (OP 4.01,
4.12). In particular, there were considered issues on transaction, allocation and transfer of land, as well as
implementation of Environmental Project Management Plan (EPMP). Special attention is paid to GRM
under the project framework.

1. Regional Director G. M. Teshabayev presented objectives and tasks of the Health III Project. He
told about upcoming work under this project, about financial resources.
2. The consultant on ecology issues of CPIB, M. Muminova а М. performed presentation on WB
requirements (ОР 4.01 and ОР 4.12) and Legislation of Uzbekistan on environmental issues
during the construction and after it. The detailed EPMP was presented, noise, dust, warehouse
and waste management, effluent water issues were considered. There was also presented a form
of keeping records of citizens’ complaints, regarding issues on DMU reconstruction. Issues on
transparency of the information on DMU reconstruction.
3. Detailed information on resettlement issues, RUz regulatory legislation and social protection
measures of the World Bank according to 4.12.

Information on conducted consultations on Namangan region:
Together with the head of Namangan regional department S. Muminov, we held a meeting with the
regional Khokim H.H. Bazarov and with the Deputy of Khokim T.T. Dadabaev, where questions on
private facility relocation were discussed - catering site (cafe), which is located on the territory of Chust
DMU. The object is registered as a pharmacy, but functions as a site of catering.
According to the approved project of reconstruction at the dislocation place, construction of the infectious
department of the central district hospital is planned. The importance of the issue of migration was raised
and the early resolution of the issue, taking into account the requirements of the legislation of Uzbekistan
and the World Bank's Operational Policy.
Once again it was emphasized that the affected person will receive compensation according to the World
Bank's requirements.
GRM was discussed in details for all parties, stakeholders or persons under the impact of project activity.
It was agreed that in order to ensure compliance with the Republic of Uzbekistan and the World Bank's
policy on involuntary resettlement, an independent assessment of the value of property and payment of
compensation, the provision of new places of deployment of the object should be conducted before June
1, 2016.

Key statements:
1. CPIB Heath III Project Coordinator R. G. Mukhamediyarova gave information on objectives and
tasks of the project on health system improvement (Health III), as well as on directions of the
loans aimed at improvement of medical services in Samarkand region.
2. Project specialist D. Ortikova gave a presentation on Legislation of the Republic of Uzbekistan
and requirements of the World Bank on environmental protection issues during the construction
work and measures on social protection of resettled persons and sites. The detailed framework
document was presented on involuntary resettlement results on independent audit of
reconstruction of family polyclinic #12, located in the territory of makhalla named after G.
Gulom.
3. The Consultant of the Project M. Malinovskaya jointly with the Samarkand RPIB Health III
Director D. Kh. Tagayev conducted review of the territory of family polyclinic#12, Samarkand
city, included in the Investment Program on Samarkand CMU. During the review period of the
territory of family polyclinic #12 there were not found private commercial sites. However,
Deputy of Khokim on construction of Samarkand city, informed that in the nearby territory,
beyond the existing fence there were located commercial sites. These sites were resettled under
the reconstruction of the city streets.
4. This is confirmed by the existing cadastral plan presented by the General Directorate of
Architecture and Construction of Samarkand (letter number 493 dd. March 2, 2016).
5. Thus, in the city of Samarkand there are no objects that would have an impact of the project and
subject to resettlement / land acquisition.
6. The issues on management of appeals and grievance redress procedures were discussed. Also the
form on record keeping of citizens’ appeals regarding sites resettlement issues, located near the
family polyclinic. Issue on transparency of grievance redress were discussed.
6. At the end of the presentation, questions were asked and answers were given.
During the discussion, representatives of private organizations and displaced members of the
makhalla committee agreed with the results of the audit. All sites listed in the report received
allotments and at the time of the public hearing, it was revealed that all five sites gained ground
and they are implementing the construction work, one of the displaced object (pharmacy) has
completed the construction work, the rest ones are in the process of construction.
The chairman of makhalla committee noted that the level and quality of construction work is
high.
Question: Davron Turakulov, owner of the barberry asked if he could get material support from
the project for construction work and equipment.
Answer: Deputy of head of the CHD, Samarkand city, I. R. Mamurov and chief physician of the
polyclinic D. S. Sabirova replied, that loans of the project cannot be used for private sites support
and suggested to use credit loans, offered by Khokimiyats.
It was decided:
1. Authority of family polyclinic in the person of the chief physician D. S. Sabirova will keep a
record of the citizens' appeals of the near located makhalla in a special record book.
2. Chairman of makhalla committee named after G.Gulom, O. M. Gafurov will take personal
control over the completion of construction work on the displaced private facilities.
