Legislative basis: INSPIRE Directive, Art. 17
• Member States shall adopt measures for the sharing of spatial data sets and services between its public authorities (gain access, exchange and use)
• The arrangements shall be open to: • Public authorities of other Member States • Institutions and bodies of the Community • Bodies established under international agreements (on
reciprocal and equivalent basis)
• Derogation: may limit sharing when this would compromise: the course of justice, public security, national defence or international relations
• For the purposes of public tasks that may have an impact on the environment!
Legislative basis: Implementing Rule (268/2010), based on INSPIRE Art. 17(8)
• Access to spatial data sets and services of the Member States by Community institutions and bodies
• Provided reasons for any limitation of sharing • Harmonised conditions:
• Using terminology of INSPIRE Directive • Allowed access to the contractors acting on behalf of C.i.&b. • Conditions applicable to the C.i.&b. (in compliance with IR
268/2010) shall be expressed in metadata (Conditions applying to access and use) of spatial data sets and services
• Transparency of other information: for evaluation and use, mechanisms for collecting, processing, quality control, etc.
• Response time to provide access: within 20 days, unless otherwise agreed
• Transitional provisions: 18 months ( 2011); 3 years (existing arr. 2013)

• INSPIRE country reports: based on INSPIRE Directive Art.(21) & Implementing Rule on monitoring and reporting (2009/442/EC)> every three years Member States shall send to the Commission a report
