In the said Notification, objections, suggestions, comments and views were sought from all those likely to be affected thereby before expiry of sixty (60) days from the date of publication of the said Notification; Whereas, objections, suggestions, comments and views received on the said proposals have been considered by the State Government; NOW THEREFORE, in exercise of the powers conferred by clause (b) of sub-section (2) of Section 5 of the Minimum Wages Act, 1948 (11 of 1948), and in supersession of Notification No. 05/DL dated 1/7/2010, the State Government hereby classify the categories of the workers and revise the rates of minimum wages as specified in the table and schedule annexed hereto, payable to the workers employed in the schedule employments mentioned in Para I above. 1. The revised rates are inclusive of Dearness Allowance, but exclusive of other concessions, if any,

enjoyed by the employees.

2. The rates of daily wages of workers at various altitudes shall be as under:- (a) Upto 8000 ft altitude - Worker shall be paid normal wages (b) From 8001 ft to 12000 ft - Workers shall be paid 50% more

than the normal wage. (c) From 12001 ft to 16000 ft - Workers shall be paid 75% more

than the normal wage. (d) From 16001 ft & above - Workers shall be paid double the

normal wage.

3. If a worker works without being absent during the period of 6(six) days consecutively in a week, he/she shall be given one paid holiday on either Sunday or any other Haat day.

4. No worker shall be required to work for more than nine hours in a day with break of one hour.

5. No person below the age of 14 (fourteen) years shall be employed in any work.

6. There will be no difference between wages for male and female workers.

7. Where a worker works for more than 8 hours in any day or more than forty eight hours in any week,

he/she shall in respect of overtime work, be entitled to wages at the rate of twice his/her ordinary rate of wages.

8. The minimum rates of wages are applicable to workers employed by contractors as well as workers

engaged in private masonry works like house building also.

9. If any question arises as to what particular work is Highly Skilled, Skilled, Semi-skilled or Un-Skilled, it may be referred to the Labour department, Government of Sikkim, whose decision shall be final.

10. These rates shall be effective from the 1st day of April, 2013.

EXPLANATION: Definition of categories:

(a) Un-Skilled Work” means work which involves simple operation requiring little or no skill or experience on the job.

(b) “Semi-Skilled Work” means work which involves some degree of skill or competence, acquired through

experience on the job, and which is capable of being performed under the supervision or guidance of skilled employee and includes unskilled supervisory work.

(c) “Skilled Work” means work which involves skill or competence acquired through experience on the job or

through training as an apprentice in a Technical or Vocational Institute and the performance of which calls for initiative and judgment.

(d) “Highly-Skilled Work” means work which calls for degree of perfection and competence in the

performance of certain jobs including clerical work acquired through intensive technical or professional training or adequate work experience for certain reasonable period and also required an employee to assume full responsibility for his judgment/decision involved in the execution of his job.

THE SIKKIM APPROPRIATION ACT, 2013

(ACT NO. 01 OF 2013)

AN ACT

to provide for the authorization of appropriation of money out of the Consolidated Fund of the

State of Sikkim to meet the amount spent on certain services during the Financial Year 2007-08

ended on 31st day of March, 2008 in excess of the amount authorized or granted for the said

services.

India as follows: -

Short title 1. This Act may be called the Sikkim Appropriation

Act, 2013.

Issue of Rs. 38,30,207/- out of the

Consolidated Fund of the State of

Sikkim for the Financial Year ended

on 31st March 2008.

2. The sum specified in column 5 of the Schedule

amounting to Rupees thirty eight lakh, thirty

thousand two hundred seven only shall be

deemed to have been authorized to be paid and

applied from and out of the Consolidated Fund of

the State of Sikkim, to meet the amount spent for

defraying the charges in respect of the services and

purposes specified in column 2 of the Schedule

during the Financial Year 2007-08 ended on 31st

day of March, 2008 in excess of the amount

authorized or granted for those services and

purposes for that year.

Appropriation 3. The sum deemed to have been authorised to be paid

and applied from and out of the Consolidated Fund

of the State of Sikkim under this Act shall be

appropriated and shall be deemed to have been

appropriated for the services and purposes specified

in the Schedule in relation to the Financial Year

2007-08 ended on 31st day of March, 2008.

Short title. 1. This Act may be called the Sikkim

Appropriation (Vote on Account) Act, 2013.

Issue of ` 1035,85,63,000/- out of

the Consolidated Fund of the State

of Sikkim for the Financial Year

2013-2014.

2. From and out of the Consolidated Fund of the

State of Sikkim, there may be withdrawn sums

not exceeding those specified in column 5 of the

Schedule amounting in aggregate to the sums of

rupees one thousand thirty five crore, eighty

five lakh, sixty three thousand only towards

defraying the several charges which will come

in course for payment during the Financial Year

2013-14, in respect of the services and purposes

specified in column 2 of the Schedule.

Appropriation 3. The sum authorised to be withdrawn from and

out of the Consolidated Fund of the State of

Sikkim by this Act shall be appropriated for the

services and purposes specified in the Schedule

in relation to the said year .

THE SIKKIM EARTHQUAKE REHABILITATION MANAGEMENT FUND ACT 2013

AN ACT

to provide fund for immediate relief, restoration and reconstruction of future

earthquake and for matters connected therewith or incidental thereto.

WHEREAS, it is expedient to create a fund for immediate relief, restoration and

reconstruction of future earthquake and for such purpose to levy and collect cess on

contract work and to provide for matters connected therewith or incidental thereto;

BE it enacted by the Legislature of Sikkim in the Sixty forth Year of the Republic

of India as follows: -

CHAPTER-I

Preliminary

Short title extent and commencement

1. (1) This Act may be called the Sikkim Earthquake

Rehabilitation Management Fund Act 2013.

(2) It extends to the whole of Sikkim.

(3) It shall come into force on such date as the State

Government may, by notification in the Official

Gazette, appoint.

Definitions 2. In this Act unless the context otherwise requires:-

(a) "Cess" means the cess levied and collected under

section 4;

(b) “Contractee” means any person or authority including

the Central/State Government, or any agency/

undertaking /body under such Government or a private

organization, or a firm or an individual who has been

awarded the work contract;

(c) “Fund” means the Sikkim Earthquake Rehabilitation

Management Fund established under sub-section (1) of

section 5;

(d) “Notification” means a notification published in the

Official Gazette;

( e) “Prescribed” means prescribed by rules made under

this Act;

(f) “State Government” means the Government of Sikkim.

(g) “Value of works contract” means total payment

received or receivable against execution of work

contract, including escalation, if any. However, it shall

not include tax and cess leviable under any other Act

enacted by the State Legislature.

(h) “Works Contract” means any work executed as per the

Sikkim Public Works Code and Manual or under any

other law for the time being in force within the territory

of the State of Sikkim.

Cess Authorities

Chapter II Authorities for the purpose of levy and collection of cess 3. (1) The State Government shall, by notification, appoint

an authority (hereinafter referred to as the prescribed

authority), and shall appoint such other person being the

officers of the State Government, to assist the prescribed

authority as the State Government may think fit for

carrying out the purposes of this Act .

(2) The prescribed authority and the persons appointed

under subsection (1) to assist him shall have jurisdiction

over the whole of Sikkim.

(3) The persons appointed to assist the prescribed authority

shall exercise such powers as may be delegated to them

by the prescribed authority.

(4) The prescribed authority and the persons appointed to

assist him under sub-section (1) shall be deemed to be

public servants within the meaning of section 21 of the

Indian Penal Code, 1860.

(5) No suit, prosecution or other legal proceeding shall lie

against the prescribed authority or the persons appointed

under subsection (1) to assist him for anything which is

in good faith done or intended to be done under this Act

or the rules made thereunder.

Incidence and levy of cess, rate of cess and payment of cess.

CHAPER -III 4. (1)There shall be levied and collected a cess for the

purposes of the Sikkim Earthquake Rehabilitation

Management Fund, at such rate not exceeding two

percent but not less than one percent of the cost of

contract works, as the State Government may, by

notification in the Official Gazette, from time to time

specify.

(2)The cess levied under sub-section (1) shall be

collected from every contractee in such manner and at

such time, including deduction at source in relation to

contract works of a Government or of a public sector

undertaking or advance collection through a local

authority where approval of such contract works by

such local authority is required, as may be prescribed.

(3)The cess leviable under sub-section (1) shall be

collected in such manner and at such time as the State

Government may prescribe by notification, including

deduction at source from payment made against

execution of works contract by paying authority of the

contractee.

(4) The amount deducted as cess at source shall be

deposited to the credit of the State Government within

15 (fifteen) days after expiry of month of such

deductions in such form or challan or through book

adjustment, as the case may be.

(5) It such paying authority fails to deduct, or having

deducted, fails to remit to the State Government the

amount deducted as cess, within the stipulated time the

State Government may impose penalty of such amount

as the state Government may by notification specify.

Authority to collect cess Establishment of Fund

5( 1) No person other than a contractor who is liable to pay

cess under this Act shall charge to any person any

amount towards cess or purporting to be cess under this

Act . The amount charged as cess shall not be more than

the amount the contractee is liable to pay.

(2) Nothing contained in sub-section (1) shall relieve a

contractee from his liability to pay the cess under this

Act .

CHAPTER - IV

Sikkim Earthquake Rehabilitation and Management

Fund

6. (1) There shall be established for the purposes of this Act

a fund to be called the Sikkim Earthquake Rehabilitation

Management Fund.

(2)The fund shall be under the control of the State

Government and shall be credited to the following:-

(a) any sum of money credited under section 7;

(b) any sum of money credited under section 8;

(c) any sum realized by the State Government in carrying

out its functions under this Act or in the administration

of this Act ;

(d) any fund provided by the Central Government for the

creation, development, maintenance or Earthquake

Rehabilitation Management.

(3) The balance to the credit of the fund shall not lapse at

the end of the financial year.

Crediting of cess to the fund

7. The proceeds of the cess levied under section 4 shall

first be credited to the Consolidated Fund of Sikkim and

the State Government may, if the State Legislature by

appropriation made by law in this behalf so provides,

credit such proceeds to the fund from time to time after

deducting the expense of collection, for being utilized

exclusively for the purpose of this Act .

Grants and loans by State Government

8. The State Government may, after due appropriation

made by the State Legislature by law in this behalf,

credit in the fund, by way of grants or loans such sums

of money as the State Government may consider

necessary.

Utilisation of fund

9. The fund shall be utilized for ;

(a) relief during earthquake;

(b) restoration of assets damaged by earthquake;

(c) reconstruction of assets damaged by earthquake;

(d) the purposes of such other projects as may be

prescribed.

Management of the Fund

Maintenance of Accounts

10. The State Government shall maintain proper accounts

and other relevant records in such form and in such

manner, as may be prescribed.

Administration of Fund

11. The State Government shall administer the fund and

take such decisions regarding relief, restoration and

reconstruction of earthquake related works

CHAPTER – VI

12. (1) The State Government may, by notification, make

rules for carrying out the purposes of this Act.

(2) In particular and without prejudice to the generality of

the forgoing powers, such rules may provide for all or

any of the matter which under any provisions of this Act

are required to be prescribed, or to be provided for, by

rules.

(3) E very rule made under this Act shall be laid, as soon as

may be after it is made, before the Sikkim Legislative

Assembly.

The draft of certain rules to amend the Sikkim State Employment Guarantee Fund Rules, 2012, which the State Government proposes to make in exercise of the powers conferred by sub-section (1) read with clauses (e) and (f) of sub-section (2) of section 32 of the Mahatma Gandhi National Rural Employment Guarantee Act, 2005 (42 of 2005) is hereby published as required by sub-section of that section of the said Act for information of all persons likely to be affected thereby and notice is hereby given that the said draft rules would be taken into consideration after expiry of a period of 30 (thirty five) days from the date of its publication in the Official Gazette. Any views or suggestion, which may be received from any person with respect to said draft rules before the expiry of the period so specified will be considered by the State Government.

DRAFT RULES

(1) These rules may be called the MGNREGA State Employment Guarantee Fund (Amendment) Rules, 2013.

(2) They shall come into force at once.

In the Sikkim State Employment Guarantee Fund Rules, 2012, (hereinafter referred to as the said rules), in sub-rule (1) of rule 1, for the words and figure “ Sikkim State Employment Guarantee Fund Rules, 2012”, the words and figure “MGNREGA State Employment Guarantee Fund Rules, 2011” shall be substituted. In the said rules, in sub-rule (1) of rule 2,-

for clause (c ), the following clause shall be substituted, namely:-

“(c) “State Fund” means the MGNREGA State Employment Guarantee Fund, Sikkim established under sub-section (1) of Section21 of the Act;

(i) for clause (f), the flowing clause shall be substituted, namely:-

“(f) “State Employment Guarantee Council” means the MGNREGA Rural Employment Guarantee Council Sikkim constituted by the State Government under section 12 of the Act;

(ii) in clause (m), after the words “Government of Sikkim”, the words “and the Comptroller and Auditor Government of India” shall be inserted. In the said rules, in rule 3, for the words “Sikkim State Employment Guarantee Fund (SSEGF)”, the words “MGNREGA State Employment Guarantee Fund, State of Sikkim” shall be substituted. In the said rules, in rule 10;-

(i) in sub-rule (1), for clause (c) and the entries relating thereto, the following clause and entries shall be substituted, namely:-

“(c) Miscellaneous receipt;” (ii) in clause (a) of sub-rule (2). For the words “Secretary for Rural Development,” the

words “State Council” shall be substituted; In the said rules, for the existing rule 12 and the entries relating thereto, the following rule and the entries shall be substituted, namely:-

“12. Fund will be utilized as per the provisions of MGNREGA, 2005 and administrative expenses should be within the prescribed limit and in the manner as specified in the instructions of Ministry of Rural Development issued from time to time and the fund shall not be utilized for payment of unemployment allowance, administrative and day to ay expenditure of the SEGC etc.” In the said rules, in rule 15, after sub-rule (2), the following sub-rule shall be inserted, namely:- “(3) The accounts of the State Fund shall be opened to audit by Comptroller and Auditor General”.

In exercise of the powers conferred by section 39 read with sub-section (2) of section 12 of the Sikkim Siddhesvara Dham Act,2011 (15 of 2011), the State Government hereby makes the following rules, namely:- Short title and commencement

1. (1) These rules may be called the Sikkim Siddhesvara Dham (Composition, term of office and procedure for conduct of business ) of the Sub-Committee Rules,2012.

(2) They shall come in to force on the date of their publication in the Official Gazette.

Definitions 2. In these rules, unless the context otherwise requires:- (a) ‘Act’ means the Sikkim Siddhesvara Dham Act,2011; (b) ‘Administrative Department’ means the Tourism and

Civil Aviation Department, Government of Sikkim. (c) Words and expression used but not defined in these rules,

but defined in the Act shall have the meaning respectively assigned to them in the Act.

Composition of the Sub-committee

3. The Committee shall constitute a Sub-committee under the Chairmanship of District Collector, South Sikkim as required under sub section (1) of the section 5 of the Act consisting of the following members, namely:-

(1) Superintendent of Police, Sikkim Police, South District, as Ex- officio member. (2) Superintending Engineer, Energy and Power Department, South District, as Ex officio member. (3) Superintending Engineer, Public Health Engineering Department, South District, as Ex-officio member.

Term of office 4. The person appointed as a member by virtue of an office shall

cease to be a member when he ceases to hold that office. Any subsequent changes will be notified by the Administrative Department after due approval of the Sikkim Siddhesvara Dham Managing Committee and the State Government.

Procedure for the conduct of the business of the Sub-committee.

5. (1) The sub-committee will arrange for the proper performance of the seva, puja and the day rituals, daily periodical nitis of the temple.

(2) The Sub-committee will provide facilities for the proper performance of worship by pilgrims.

(3) The Sub-committee will ensure safe custody of the funds, valuable securities and jewelleries and for the preservation and management of the properties vested in the temple.

(4) The sub-committee shall ensure maintenance of order and discipline and proper hygienic conditions in the temple of proper standard of cleanliness and purity in the offerings made therein.

(5) The sub-committee will ensure that funds of the specific and religious endowment are spent according to the wishes, so far as may be known, of the donor.

(6) The sub-committee will make provision for the payment of suitable emoluments to its salaried staff.

(7) The sub-committed will prepare and implement, with the prior approval of the state Government and remunerative scheme for establishment of retail shops for sale of commodities inside the temple or any other commercial undertaking in order to augment the resource and income of the temple.

(8) The sub-committee will take steps for resumption of any buildings or room situated within the premises of the temple from any person if he has ceased to render the service for the performance of which such building or room was allotted to him of if his service has become obsolete.

(9) The sub-committee will do all such things as may be incidental and conductive to the efficient management of the affairs of the temple and its endowments or to the convenience of the pilgrims.

Meetings of the Sub-committee

6. (1) The sub-committee shall meet at such time and at such place as may be appointed and decided by the Chairman of the Sub-

committee from time to time: Provided that the sub-committee shall meet at lease once in 3 (three) months.

(2) In the absence of the Chairman of the Sub-committee, the Chairman will designate an Ex officio member of the Sub-committee to act on his behalf with due approval of the Committee/Administrative Department.

(3) 7 (seven) members including the Chairman shall form the quorum at every meeting of the sub-committee.

(4) Not less than 5 (five) days notice for every meeting shall be given to each member of the sub-committee.

Whereas the Ministry of Rural Development, Government of India has issued guidelines

for increase in rate of pension under Indira Gandhi National Widow Pension Scheme, Indira

Gandhi National Disability Pension Scheme and the National Family Benefit Scheme.

Now therefore, the Governor of Sikkim is hereby pleased to notify the enhanced rate of

the following pension schemes and age limit as under:-

I. Indira Gandhi National Widow Pension Scheme-

(i) Central assistance Rs. 300/- + State assistance Rs. 400/-: i.e. total Rs. 700/- per

month to the age group of 40-79 years.

80 years and above shall remain unchanged.

The rate of other pension schemes provided hitherto shall remain unchanged.

This order shall be deemed to have come into force from 1st October, 2012 and the revised

norms under National Family Benefit Scheme from 18th October, 2012.

not being a purpose of the Union, namely for the construction of Water Supply Pipe Line by Water Security & PHE Department at Central Pendam block, East Sikkim, it is hereby notified that the pieces of land comprising cadastral plot nos. 1734/P, 1735/P, 1736/P, 1739/P, 1741/P, 1745/P, 1758/P, 1761/P & 1768/P and measuring more or less 0.0387 hectare is likely to be needed for the aforesaid public purpose at the public expense within the aforesaid block.

This Notification is made under the provision of Section 4(1) of L. A. Act, 1894 (Act I of 1894) to all whom it may concern.

A plan of land may be inspected in the Office of the District Collector East, Gangtok.

In exercise of the powers conferred by the aforesaid section, the Governor is pleased to authorize the Officers for the time being engaged in the undertaking, with their servants and workmen to enter upon and survey the land and do all other acts required or permitted by that section.

Power and function of District Planning Committee.

District Planning Committee shall consolidate the plans prepared by the Zilla Panchayats, the Gram Panchayats, the Nagar Panchayats and the Municipal Corporation in the district and prepare a draft development plan for the district as a whole.

1. Every District Planning Committee shall, in preparing the draft development plan:- (a) have regard to:-

(i) Matters of common interest between the Panchayat and Municipalities including spatial Planning, sharing of water and other physical and natural resources, the integrated development of infrastructure and environment conservation.

(ii) The extent type of available resources whether financial or otherwise. (b) Consult such institutions and organization as the Government may, be order

specify.

2. The Chairman of every District Planning Committee shall forward the development plan as recommended by the District Planning Committee to the State Government for consideration, approval and implementation.

3. The District Planning Committee shall review the progress of approval and implementation of the development plan.

4. The District Planning Committee shall represent the Panchayats and Municipalities in meetings and matters related to the development plans.

NOTICE UNDER SECTION 4(1) OF LAND ACQUISITION ACT, 1894 (ACT I OF 1894)

Whereas it appears to the Governor that land is likely to be needed for a public purpose

not being a purpose of the Union, namely for the Construction of Pipeline by Water Security & PHE Department at Middle Camp under Chuba block East Sikkim, it is hereby notified that the pieces of land comprising cadastral plot nos. 645/P, 646/P, 647/P, 648/P, 650/P/A, 650/P/B, 651/P, 652/P & 699/P and measuring area more or less 0.1113 hectares is likely to be needed for the aforesaid public purpose at the public expenses within the aforesaid block.

This Notification is made under the provision of Section 4(1) of L. A. Act, 1894

(Act I of 1894) to all whom it may concern.

A plan of land may be inspected in the Office of the District Collector East, Gangtok. In exercise of the powers conferred by the aforesaid section, the Governor is pleased to

authorize the Officers for the time being engaged in the undertaking, with their servants and workmen to enter upon and survey the land and do all other acts required or permitted by that section. And whereas, there is urgency to acquire land the Governor is further pleased to direct under section 17(4) of L. A. Act, of 1894 (Act I of 1894) that the provision of section 5-A of the Act shall not apply.
