NOTIFICATION

In exercise of the powers conferred under section 8 of Sikkim (Repeal and Miscellaneous

Provision) Act, 1985 read with Rule 4 of the Sikkim Trade License and Miscellaneous (Provision)

Rules, 2011, the Chief Municipal Officer, Gangtok Municipal Corporation is hereby authorized to issue

and cancel Trade License and Hawker License within Gangtok Municipal Corporation Area and the

Gram Panchayats are hereby authorized to issue and cancel Trade License and Hawker License to

the local applicants in the rural areas falling within their respective Gram Panchayat Units.

In case of any policy decision relating to issue of Trade License and Hawker License, the

authorized Officers are to refer the matter to the Secretary, Urban Development & Housing Department

as he being the Competent Authority under relevant Act and Rule regarding the issue and cancellation

of Trade License and Hawker License.

The Trade License fees and Hawker License fees shall be levied as per the Schedule I, II and III

of the Sikkim Trade License and Miscellaneous (Provision) Rules, 2011.

This shall come into force with immediate effect.

NOTIFICATION

In pursuance of clause 8 of the Public Distribution System ( Control ) Order, 2001,read withparagraph 6 of the Annexe to the Public Distribution Control Order, 2001, the existing Monitoring Cellof the Food and Civil Supplies and Consumer Affairs Department shall ensure monitoring of PublicDistribution System including the Fair Price Shops as under, hereby:-

(i) sale of essential commodities as per the entitlement of ration card holders atthe retail issue prices fixed by the State Government under the Public DistributionSystem;

(ii) display of information on a notice board at a prominent place in the shop ondaily basis regarding a) list of BPL and Antodaya beneficiaries, b) entitlement ofessential commodities, c) scale of issue, d) retail issue prices, e) timings ofopening and closing of the fair price shop, f) stock of essential commoditiesreceived during the month, g) opening and closing stock of essential commodities,h) the authority for redressal of grievances/ lodging complaints with respect toquality and quantity of essential commodities under the Public DistributionSystem;

(iii) maintenance of records of ration card holders ( APL, BPL and Antodaya), stockregister, issue or sale register;

(iv) furnishing of copies of specified documents, namely, ration card register, stockregister, sale register to the office of the Gram Panchayat or Nagar Palika orVigilance Committee or any other body authorized by State Government for thepurpose;

(v) display of samples of food grains being supplied through the fair price shop;

(viii) opening and closing of the fair price shop as per the prescribed timings displayedon the notice board.

NOTIFICATION

In exercise to powers conferred by clause (7) of the Public Distribution System (Control)Order, 2001 read with paragraph 5 of the Annexe to the Public Distribution Control Order, 2001, theState Government hereby appoints the District Civil Supplies Officers of each district as the ‘DesignatedAuthority’ to issue, renew or cancel licenses of Fair Price Shops in their respective districts afterproper checking and verification. The ‘Designated Authority’ shall also lay down the duties andresponsibilities of the Fair Price Shop owners as follows:

1 (i) Sale of essential commodities as per the entitlement of ration card holders at the retailissue prices fixed by the Food and Civil Supplies and Consumer Affairs Departmentunder the Public Distribution System;

(ii) Display of information on a notice board at a prominent place in the shop on daily basisregarding a) list of BPL and Antodaya beneficiaries, b) entitlement of essentialcommodities, c) scale of issue, d) retail issue prices, e) timings of opening and closingof the fair price shop, f) stock of essential commodities received during the month, g)opening and closing stock of essential commodities and h) the authority for redressalof grievances/ lodging complaints with respect to quality of essential commodities underthe Public Distribution System;

(iii) Maintenance of records of ration card holders (APL, BPL and Antodaya), stock register,issue or sale register;

(iv) Furnishing of copies of specified documents, namely, ration card register, stock register,sale register to the office of the Gram Panchayat or Municipality or Vigilance Committeeor any other body authorized by State Governments for the purpose;

(v) Display of samples of food grains being supplied through the fair price shop;

(vi) Production of books and records relating to the allotment and distribution of essentialcommodities to the inspecting agency and furnishing of such information as may becalled for by Designated Authority;

(vii) Accountable of the actual distribution of essential commodities and the balance stockat the end of the month to the Designated Authority of the Food and Civil Supplies &Consumer Affairs Department with a copy to the Gram Panchayat;

(viii) Opening and closing of the fair price shop as per the prescribed timings displayed onthe notice board.

2. Further, the “Designated Authority “ shall after necessary checks and verification eliminatebogus ration cards and also ensure delivery of one copy of allocation order made to the FairPrice Shops simultaneously to Gram Panchayats, Vigilance Committees and the MonitoringCell of the department for monitoring the functions of the Fair Price Shops, and such ordersshall specify:-

i. Number of Ration Cards and units under the areaii. Balance in handiii. Allocation made for each month in respect of a Fair Price Shop

3. The “ Designated Authority “ while making monthly allocations to the Fair Price Shops shallalso take into account the balance stock, if any, lying un-distributed with the Fair Price Shopowners for the subsequent allocations.

1. In the said notification, after clause ‘F’, the following clause shall be inserted, namely:-

“G. Repair, renovation and restoration of water bodies and water quality managementwithin the jurisdiction of their districts in accordance with the guidelines issued by theMinistry of Water Resources.”

2. In the said notification, for the existing clause ‘G’ and the entries relating thereto, the followingclause shall be substituted, namely:-

“ H. Any other relevant subject which needs attention of District Level with regard to thewater quality monitoring as well as water bodies/water resources with reference to theguidelines issued by the Ministry of Water Resources”.
