• Further ban the import of 16 types of solid waste, including scrap cars, smelting
slags, waste plastic (industrial resource) , and etc. Effect on December 31st,
2018

Law on Environmental Protection
• Distinguish between wastes and scraps
Wastes: Solid, liquid or gaseous substances discharged from production, living, service, or other activities.
Scraps: Products or materials discharged from production and consumption that can be used as secondary raw materials for production. Reusable wastes
• Waste import or transit is prohibited
• Scrap import is allowed
Scrap import permit, According to 01/2013/TT-BTNMT, primarily includes recyclable materials like scrap paper and metals
• Import for dismantling purposes is prohibited (second-hand machinery, equipment and vehicles)
Vietnam cracks down on illegal import of air conditioners
• In July 2017, cracked down on the illegal import of used air-conditioners. • As of July 2017, seized three cases of illegal import of used air-conditioners, more
than 1,000 old AC
Issues with Illegal Trade
Waste smuggling issues
• Discrepancy between actual transfer and document record;
• Discrepancy in legal systems and languages are exploited;
• Mixed loading to smuggle high valued commodities.
Difficulty with take-back
• Consignees, owners and carriers cannot be identified for some solid
waste cargos;
• It is difficult to ask criminals with convicted charges to carry out ship-
back;
• The custom has no authority to force them to ship back;
• Issues with take-back and disposal fees;
• Issues with take-back disposal technology.
