1 BE IT ENACTED BY THE PEOPLE OF GUAM:

2 Section 1. §431 07 of Article 1, Chapter 43 of Title 5, Guam Code

3 Annotated, is hereby amended to read as follows:

4 "§43107. Quarterly Attendance Report Required. The

5 chairman of each board or commission shall submit a quarterly report on the

6 attendance of the members of the board or commission to I Maga 'lahi (the

7 Governor) and I Liheslatura (the Legislature), and shall also post the

8 attendance reports on the agency, board, or commission website."

I. OVERVIEW

The Committee on Youth, Cultural Affairs, Procurement, General Government Operations and Public Broadcasting convened a public hearing on Thursday, March 3, 2011 at 10:00 a.m. in the Public Hearing Room of I Liheslatura. Among the items on the agenda was the consideration of Bill No. 74-31(COR) "An act to amend §43107 ofTitle 5 Guam Code Annotated, relative to the quarterly attendance report of board and commission members."

Public Notice Requirements

All legal requirements for public notices were met, with requests for publication sent to all media and all senators on February 25, 2011 via email and fax. Notices of the hearing were published in the Marianas Variety Guam edition on February 25, 2011 and March 1, 2011. Copies of the hearing notices are appended to the report.

II. SUMMARY OF TESTIMONY AND DISCUSSION

Vice Speaker B.J.F. Cruz announced the agenda then called on individuals to testify for Bill No. 74-31 (COR). Finding nobody present to testify, Senator Cruz considered Bill No. 74-31 (COR) duly heard without testimony and concluded the hearing.

III. FINDINGS AND RECOMMENDATIONS

The Committee on Youth, Cultural Affairs, Procurement, General Government Operations and Public Broadcasting finds that passage of Bill No. 74-31(COR) would strengthen information dissemination by including the Legislature when submitting the quarterly attendance report of board and commission members.

AN ACT TO AMEND §43107 OF TITLE 5 GUAM CODE ANNOTATED, RELATIVE TO THE QUARTERLY ATTENDANCE REPORT OF BOARD AND COMMISSION MEMBERS.

BE IT ENACTED BY THE PEOPLE OF GUAM:

2 Section 1. §43107 ofTitle 5 Guam Code Annotated is hereby amended to read as

3 follows:

4 "§43107. Quarterly Attendance Report Required. The chairman of each

s board or commission shall submit a quarterly report on the attendance of the members

6 of the board or commission to the Governor and the Legislature."
