1. All horses are offered for sale according to the laws of the state of Utah. The right to bid is reserved by the seller unless otherwise announced.

2. Warranty. All horses are sold “as is”. It is the buyers responsibility to examine each horse and be aware of their physical condition. All horses are sold without warranty and with all faults.

3. Announcements. Buyer is bound by all announcements from auction podium at the commencement of the sale and at the time of sale of each individual horse. Announcements of any correction to the catalog will be made from the auction podium and take precedence over anything printed in the catalog.

4. Right to inspect. Any buyer in this sale, acknowledges that he has had the opportunity to inspect and examine by veterinarian or otherwise each horse that he has purchased and hereby accepts any horse he/she purchases with all defects and conditions “as-is” except those which are specifically warranted in these conditions by announcements from the auction podium.

5. Vet Check. You have the right and are encouraged to have a veterinarian of your choice examine any horse offered in the auction, prior to sale time.

6. Bidding. The highest bidder is the buyer. If any dispute arises between or among two or more bidders, the animal in dispute shall immediately be put up again for bid. If there is no increase in the amount bid, the animal will go to the highest bidders from whom the auctioneer recognized the last bid. In any dispute the auctioneer has sole authority and his decision is final.

7. Title. Title to and the risk of loss passes to the buyer when the animal is announced “sold” by the auctioneer. All buyers will sign and legibly fill out an acknowledgement of purchase brought to them by a ticket runner. Effective immediately from time of purchase the buyer assumes complete responsibility for the maintenance and care of the animal, feeding and watering (including buckets), unless arrangements are made with seller to care for the animal, at which time buyer is aware of the risks involved with leaving the animal in the care of the seller and does not the hold seller responsible for any and all accidents or neglect.

8. Payment. Terms of sale are cash, cashiers check, travelers check or personal check with proper identifi-cation.

9. Registration Papers. Smokey Mountain Ranch will send the registration papers with transfers to the appropriate breed association after the purchase checks clear the bank (or 21 banking days). Buyers may receive the registration certificate from the breed association between 6-8 weeks from time of sale. Buyers will pay current, appropriate transfer fees and registration fees, unless otherwise announced over the auc-tion podium.

10. Default. Any person giving insufficient check or stop payment on a check or draft will be prosecuted. Transfer of ownership on any animal is not nor will be complete until full payment is made to Smokey Mountain Ranch. The failure of any buyer to comply with these terms and conditions will constitute default by the buyer. At any time after the buyers default Smokey Mountain Ranch will have the option without notice to the buyer to (a) cause the animal which is the subject of the default to be resold at public or private sale and any deficiency together with expense of such re-sale will be paid by the buyer; or (b) compel the defaulting buyer to pay the purchase price of the animal; or (c) maintain an action for damages arising from such default. All accounts not paid within ten (10) days after demand will bear interest at a rate of 18% per annum. All court costs, filing fees, expenses of collection (including reasonable attorneys fees) and all expense of insuring, maintaining, transporting, or selling any animal incurred by the consignor or Smokey Mountain Ranch, arising from the buyers default, will be paid by the buyer.

11. Foals. All foals sold at the side of their dam will be guaranteed to be sired by the stallion as indicated.

12. Catalog Errors. We have made every effort to ensure that the catalog is accurate. However we do not assume any responsibility for errors in the catalog.

13. Liability Release. By attending the Smokey Mountain Ranch sale, attendants agree to release Smokey Mountain Ranch and its agents from any and all claims, suits, liabilities, damages or obligations, of what-ever nature or kind, no matter how arising, and whether now existing or occurring in the future, including those that may be said to have occurred or arisen by virtue of Smokey Mountain Ranch’s own partial or complete negligence on the premises of Smokey Mountain Ranch or involvement in any Smokey Mountain Ranch activity regardless of location.

Welcome to Smokey Mountain Ranch. Home to the largest herd of Mr. Gunsmoke bred horses in the nation. Our horses have the natural talent, ability, and desire to be some of the best reining, cutting, working cow horse, rope, and ranch horses around. We are located in Diamond Fork Canyon in Utah County, Utah. The ranch has a long history of ranching; beginning with sheep, then cattle, and now a large herd of registered Quarter Horses. The surrounding area is full of history enriched with stories of Indian and settler battles, Spanish explorers, Spanish gold, and old railroad towns. The ranch offers a unique mountain atmosphere but still within a convenient distance of the city lifestyle, only 50 miles south of Salt Lake City. Smokey Mountain Ranch's breeding program has focused on the legendary Mr. Gun Smoke crossed on such lines as Freckles Playboy, Gay Bar King, Doc Tom Tucker, King Fritz, Colonel Freckles, Senor George, Opie News Flash, High Brow Hickory, Poco Bueno and many others. This carefully selected choice of foundation line bred horses has resulted in horses that offer extreme athleticism, lots of cow sense, soft eyes, kind dispositions, and plenty of personality. The ranch herd consists of the largest band of Mr. Gun Smoke bred mares in the nation. 45 was an amazing horse. He was the quickest and the cowiest horse around. When he latched on to a cow and started to sink down to cut it was like a snake getting ready to strike. Then you better be hanging on because when he started working it was like riding a cat. He was a champion himself and the sire of many reining, roping, cutting, and reined cow horse champions.

Gunsmoke Eyes was trained but never shown due to a back injury. He was turned out to stud all his life. His offspring were great ranch and show horses. He was the sire to many reining, cutting, reined cowhorses, and roping champions.

If you are looking for a foundation built bulldog horse, Gunner is it. He is about as wide as he is tall. Don’t let his size fool you. He can spin around and turn quicker than any cutting horse out there. He was used on the ranch before he was turned out to stud. Gunner throws the same heavy muscling and solid feet on his colts.

Monarch was in reining training but was put out to stud before he was shown. He stops hard, spins fast, and lopes smooth. He has the typical “Gunsmoke” look and has thrown that on to his colts.

Monte is a very mellow horse. You can take him bareback up the mountain ponying the other stallions. He has been ridden by kids around his broodmare band without any problems. He is quick and cowy. Monte is a full brother to High Shootin Gun and is a grandson of both legendary stallions Mr. Gun Smoke and High Brow Hickory.

Gay Bars is a very gentle horse. He is usually the first one in the pasture to tag you around and want to be scratched. He is very mellow to ride and you can ride him bare back with a hay string. His mother was an excellent cutting horse for a tall Gay Bar King daughter. Gay Bars also doesn’t like bull elk near his mares.

Cowboy is a great horse to ride. He is a big stopper, is very cowy, and has been used in taking ‘dudes’ on trailrides at the ranch. He has a big hip and a big heart.

Fife was started and used on the ranch a little before he was turned out to stud. He was very easy to train. Fife is very smart, quick, and powerful. His offspring have been the same way. He is out of money earning parents. Playboys Ladybug was a top ten finisher in the NRCHA Snaffle Bit Futurity as a three year old. He is a full brother to Playboy’s Triumph 045, a multiple NRCHA champion and earner of nearly $5,000.

Pipers is an extremely athletic horse. He has no problem jumping fences our out of the barn if he really wants to. He is a very pretty moving horse and is the smoothest, quickest ride around. He is very cowy. He is a full brother to Smokin Tareyton.

Ranger was used on the ranch to gather cows and mares before he was put out to stud. He was very easy to start and did everything like it was no big deal. You can still jump on him up the mountain bare back and gather his mares. He is very cowy and knows how to travel the country. You can haul him in the trailer next to mares without a problem. He can pony the other studs off the mountain and when they walk too slow he just drags them. His colts have the same disposition and he has been about an 80% color producer.

Tarey is a very intelligent horse. We have nicknamed him “Music Man” because he has figured out how to play the pipe panel barn with his lips. He was easy to start. He is athletic and his babies are gorgeous. He is a full brother to Smokin Pipers.

Smokey Mountain Ranch is located near Spanish Fork in Utah County, Utah, about 50 miles south of Salt Lake City. Ranch headquarters are located at the mouth of Diamond Fork Canyon in Spanish Fork Canyon, just off of Highway 6.

From Salt Lake City: Go south on I-15 into Utah County. Take exit 258 (Price/Manti exit). This puts you on Highway 6 going east. Go 10.3 miles from the first traffic light (Burger King is on corner).Turn left into Diamond Fork Canyon. Go 200 yards and turn right on to graveled road by brown Forest Services signs. Follow graveled road across river and up the hill to the barn.From Las Vegas: Go north on I-15 into Utah County. Take exit 257 (Price Manti exit). Go through first light (Main St. in Spanish Fork). Stay right to stay on highway 6 to next traffic light. (Burger King is on corner). Follow the last three directions from above.From East of Utah on I-70: Travel west on I-70 to Green River, Utah. Take exit 157 toward Price/Salt Lake City on Highway 6. Go through Price. Go approximately 53 miles on Highway 6. Turn right into Diamond Fork Canyon (approximately 2 miles past Highway 89 South turnoff to Manti). Follow the last two steps in the first set of directions.

Please note the birthdate of the babies. Some may not be old enough to wean at sale time or if you would like to leave the foal on its mother longer you may do so free of charge. You may then pick up the foal or make arrangements to have the foal shipped to you after November 1, 2010 when we gather the mares again. All horses in the sale are eligible for the Smokey Mountain Ranch Incentive Fund. We will pay $5,000 to the highest placing Smokey Mountain Ranch horse in the NRCHA Snaffle Bit Futurity Open Finals. Free camping is welcome at the ranch. There is plenty of room for tents, campers and trailers.
