GettinG Ready foR a Sale

The hardest part is establishing the asking price based on true market value. Take into account recent sales of comparable properties and expert guidance from Mallorca Sotheby’s International Realty. In order to sell you need viewings and at the right price your property will receive more visitors - you only need one to put in that all-important offer. A margin for negotiation should be built into the asking price, but not too much as this will simply deter viewings. When presen-ting your home for sale, eliminate any ‘objection factors’ for buyers by keeping it clean and doing any necessary repainting or repairs.

Sale aGReed

Once a sale has been agreed, or even before to be efficiently prepared, pass the following docu-ments to your lawyer:

Original Escritura (Title Deeds)

Copies of your last IBI/Basura receipts

Copies of your last utility bills (water, gas and electricity)

Copy of your last community fee alongside the name/address of the administrator

Copy of your last income tax declaration (if you are a resident of Spain and therefore exempt from 3% retention)

feeS / taxeSThere are various costs associated with selling and these can be broadly explained as follows:

Lawyer’s Fees – generally 1% of sale price, negotiable with more expensive properties. Increment on the Value of the Land (Impuesto Municipal Sobre el Incremento del Valor de los Terrenos or Plusvalía) – This is a municipal tax on the increase in value of the land alone since the last sale of the property/land. The figure can be a few hundred or many thousands of euros depending on the amount of land in question and when it last changed hands. The tax is based on the cadastral value, payable upon completion and should not be confused with Capital Gains Tax.

Capital Gains Tax (CGT) – A non-resident seller is subject to a 3% retention in anticipation of any possible CGT. If the resultant liability is less than 3%, this retention can be reclaimed from the tax office (providing you are up to date on all your other taxes). CGT on the net profit of a sale (ha-ving deducted costs/fees of both purchase and sale, initial purchase price and statutory inflati-onary allowance) is calculated at 19% (from 1 January 2010, up from 18%). Fiscal resident sel-lers are exempt from CGT if the property is their main or only place of residence and has been for three years and the full sale price is to be invested

into another property (again as a main residence for at least three years following the sale) either two years before or after the sale.

Estate Agent Fee – It is customary that the seller pays the estate agent’s fee; for Mallorca Sotheby’s International Realty this varies from 3.75% to 5% of the sale price (plus IVA at 18%). This fee includes the cost of our professional services as well as global exposure - both online, in print and elsewhere.

Mortgage Cancellation – if there is finance on the property, the lender will charge an early can-cellation fee of approximately 1% of the value of the mortgage.

feeS / taxeS

A good rule of thumb is to add 10% to the ag-reed purchase price to cover all of your buying fees / taxes – slightly more if a mortgage is requi-red. Here’s a rough breakdown:

New Build / Off-plan Property – 8% VAT (IVA) is payable with each instalment (recently up from 7%) plus 1% AJD (actos jurídicos documenta-dos or ‘stamp duty’). For land plots, commercial premises or garage spaces where the vendor is a company, this figure rises to 18% VAT (IVA) plus 1% AJD.

Resale Property – Transfer tax is payable upon completion at the rate of 7% for the first 400.000 and 8% thereafter.

Notarial and Land Registry Fees – Fixed by law on a sliding scale.

Lawyer’s Fees – Normally 1% of purchase price.

Mortgage Fees – There will be a lender’s set-up or arrangement fee (based on a percentage of property value) as well as a fee for the valuation.

onGoinG CoStS

Keys in hand, there will obviously be a range of ongoing costs to consider dependent on your lifestyle and how the property is both used and owned. Follows some guidelines:

IBI (Impuesto Bienes Inmuebles) – This is an annual real estate tax levied by the lo-cal town hall based on the cadastral value (valor

catastral) of your property - usually much lower than the market value. The actual percentage charge varies from town hall to town hall.

Refuse Collection (Basura) – Again, an annual tax levied by the local town hall based on the cadastral value.

Property Owners’ Tax (Impuesto Sobre la Renta) – Even if a property is not rented out, as a non-resident you will still be liable for an imputed ‘income’ tax. The tax base (your imaginary ‘income’) is 2% of the cadastral value of the property (or 1.1% if the cadastral value has been revised since 1 January 1994) and the tax rate on that ‘income’ is 24%. If the property is your only worldwide home you will be exempt. If your property is actually rented out you will be liable to tax at 24% of the actual gross rental income with no deductions allowed.

Community Fees – Properties in a development with shared communal facilities and staff such as cleaners are run by the Community of Property Owners (Comunidad de Proprietarios). All pro-perty owners are members of the Community and you must pay your share of expenses. Fees vary dramatically from a few hundred euros a year for a small apartment to many thousands for a large villa enjoying luxurious on-site servi-ces such as spas and golf courses.

Insurance – You will need to contract insurance on ‘continente’ (everything fixed in the house from pillars to doors, electrical installation to ga-rages) and ‘contenido’ (contents from furniture to jewellery). If you rent out the home, you will also need public liability insurance.

ChooSinG a home

Your instincts, combined with a bit of guidance from Mallorca Sotheby’s International Realty, should bring you to your ideal home without too much difficulty but here are some thoughts to bear in mind:

• The right property is also a valuable asset so, alongside personal preferences, keep half an eye on the day you may come to sell and consider in-vestment attributes such as location, local ame-nities, quality of finish and architectural design.

• Make sure you build up your knowledge of pro-perty values in the area so that you have a good basis for negotiation and end up paying a fair price for your home.

• If the property is under construction, the deve-loper must supply proof of planning permission, licenses, a ten-year build guarantee and protec-tion for stage payments in the event of incom-pletion.

• In all cases, new build or resale, ensure that it’s clear what is included in the price from kitchens to furniture – and if it’s all in good working or-der.

When you buy property in Spain in your own name, you must apply for an NIE number - Nú-mero de Identificación de Extranjero – a tax identifier for foreigners. This number must exist before the public deed can be signed and can take three to four weeks to receive.

ReSeRvation depoSit

Once commercial terms have been agreed bet-ween the parties, a reservation deposit is usually paid by the buyer. This takes the property off the market and keeps it reserved for the buyer by the seller for an established period during which the lawyers will draft and agree the private contract (see below).

pRivate ContRaCt

The formal private contract will be signed once the legal position of the property has been che-cked by the lawyers. If irregularities are revealed, the transaction will normally not go through and any reservation deposit paid will be returned to the buyer. If no irregularities are revealed, then the contract will be signed and a further depo-sit is paid – generally 10% (to include the reser-vation deposit). The vendor is prevented from

selling elsewhere and the buyer will forfeit the deposit if they do not follow through to comple-tion.

Completion and eSCRituRa

Upon completion, Spanish law dictates that a deed of conveyance „escritura pública“ must be signed by both parties under notarial supervisi-on. Here, the balance of the purchase price is paid and vacant possession of the unencumbe-red property granted. Power of attorney can be given to your lawyer or other individual if you cannot be present.

land ReGiStRy and utilitieS

The deed of conveyance must then be lodged at the property registry to assure legal title. This can be done either by yourself, your lawyer or by the notary office. Now is also the time to switch
