01. CALL TO ORDER/ROLL CALL/PLEDGE OF ALLEGIANCE
Vice Chair Ryan called the SBDD Board Meeting to order at 8:15 a.m.; with Commissioner Minnaugh,
Commissioner Mersinger, Commissioner Goggin, Commissioner McCluskey, and Commissioner
Santana-Woodall present at the meeting; followed by the Pledge of Allegiance.
02. PUBLIC COMMENT
None.
03. APPROVAL OF MINUTES
Commissioner McCluskey moved for approval of the minutes of the February 28, 2019, South
Broward Drainage District Board meeting. Motion was seconded by Commissioner Santana-Woodall
and it was carried unanimously.
04. DIRECTOR=S REPORT
A. PROCLAMATION FOR APRIL AS WATER CONSERVATION MONTH
District Director Hart read a Proclamation from SBDD, declaring the month of April as “Water
Conservation Month”. Commissioner Mersinger moved for approval of the Proclamation for
April as Water Conservation Month. Motion was seconded by Commissioner Minnaugh and
it was carried unanimously.
B. CONTRACT AWARD(S):
1. SBDD Tree Removal & Trimming Project in Pembroke Pines and SWR
District Director Hart stated that SBDD advertised for bids for the Tree Removal & Trimming
at six (6) locations in Pembroke Pines and SWR. SBDD received three (3) bids ranging in

price from $42,775.00 to $62,950.00.
The bid documents allow the District the option of awarding the contract on a split basis.
The lowest bid for each of the 6 sites varies among the bids.
SBDD has consulted with each bidder to determine their interest and agreement to contract for
the work on a split basis. The low bid for site #2 submitted by Custom Tree Care was submitted
incorrectly, and is not a valid bid. Therefore, the low bid for each of the six sites varies between
EDJ Tree Service LLC (EDJ) and Aquatic Control Group, Inc. (ACG).
Both EDJ and ACG have agreed to contract and perform the work on a split basis; and it is
recommended that the bid be awarded on a split basis as follows:
1. EDJ Tree Service LLC in the amount of $27,803.00 as the lowest responsive,
responsible bidder for Site Nos. 1, 2, 3, and 5.
2. Aquatic Control Group, Inc. in the amount of $11,735.00 as the lowest responsive,
responsible bidder for Site Nos. 4 and 6.
SBDD has reviewed the bids submitted by EDJ, and ACG, and has determined that each
Contractor is qualified to perform the work and both bids meet all requirements. SBDD is
familiar with both Contractors and has been satisfied with their past work on similar type
projects.
The work covered under this project is included as part of the District’s 2018-2019 budget; and
funding for the project will come from the SBDD General Operating account.
District Director Hart commented that the total bid amount for both sites is just under the
budget amount of $40,000.00; however, the District has already expended some funds under
this line item as the District’s cost-share for the NRCS grant that has been completed; but he
is still recommending the award of the bid, and stated that there are additional funds within
that overall category to fund the project.
District Director Hart requested approval to award the contract for Tree Removal & Trimming
in Pembroke Pines and Southwest Ranches on a split basis as noted above. The total of the
two contracts will be $39,538.00, and funding for this project will come from the SBDD
General Operating Account as part of the 2018-2019 Budget.
Commissioner Minnaugh moved for approval to award the SBDD Tree Removal & Trimming
in Pembroke Pines and SWR on a split basis as recommended. Motion was seconded by
Commissioner McCluskey.
Commissioner Mersinger asked District Director Hart if the District has contacted the
homeowners and if they are in concurrence. District Director Hart replied yes; as a common
practice, the homeowners are always contacted to get their concurrence and have them sign a
form.
The question was called and it was carried unanimously.

C. REQUEST TO TRANSFER UNASSIGNED FUNDS TO SBDD CIP COMMITTED
ACCOUNT
District Director Hart stated that based on the Annual Financial Statements for the fiscal year
ending September 30, 2018, SBDD has a total of $1,696,663 in unassigned or undesignated
funds. He said that these funds are available to the District as revenues for future year budgets
as an Appropriation of Fund Balance; or for designated purposes as approved and directed by
the Board. For example, a portion of the unassigned fund balance could be designated for
future Capital Improvement Projects (CIP) and transferred to the District’s Capital
Improvements Fund.
SBDD’s adopted Financial Policy requires the District to maintain an adequate balance of cash-
on-hand in the General Operating account at the beginning of each fiscal year to allow the
District to operate on a loan free basis during the first three months of the fiscal year (October
– December), which is the time period when cash reserves are typically at their lowest, and
projected tax revenues have not yet been received.
District Director Hart said that this is part of the District’s policy, that the Board previously
approved to make sure that the District has that cash balance in the General Operating account
in order to operate the District without having to take out a line of credit or a loan.
Based on a cash flow analysis through the end of Fiscal Year 2019/2020, the District will have
adequate cash-on-hand to fund both the General Operating Budget and the District’s Capital
Improvement projects.

With this reallocation of funds, the District’s 5-year CIP will be funded through fiscal year
2022/2023.
Approval of this agenda item will reallocate a portion of the District’s unassigned funds to
provide additional funding in the amount of $550,000 to the District’s CIP Committed Account
and to extend funding of the CIP through fiscal year 2022/2023.
District Director Hart requested approval to reallocate a total of $550,000 in unassigned funds
to the SBDD CIP Committed Account from the SBDD General Operating Account.
Commissioner McCluskey moved for approval to transfer unassigned funds to SBDD CIP
Committed Account as recommended by District Director Hart. Motion was seconded by
Commissioner Santana-Woodall and it was carried unanimously.
D. SBDD RESOLUTION NO. 2019-01 – REAFFIRMING SBDD’S OPPOSITION TO
WELL DRILLING IN THE FLORIDA EVERGLADES
District Director Hart stated that at the previous Board meeting, Vice Chair Ryan discussed
that he had attended a function at Holiday Park in the Everglades regarding proposed oil
drilling by Kanter Real Estate LLC; and the Board suggested that District Director Hart
reaffirm and update their previous Resolution where SBDD had opposed the oil drilling.
District Director Hart stated that Proposed Resolution 2019-01 is a reaffirmation of South
Broward Drainage District’s (SBDD) opposition to the proposition by Kanter Real Estate LLC
to drill an exploratory well in the Florida Everglades, approximately 5 miles west of the
western boundary of the SBDD’s jurisdictional limits in close proximity to the South Florida
Water Management District’s L-67A Levee Canal for the purpose of assessing the feasibility
of extracting oil from the geological substrate under the Florida Everglades.
He said the Resolution recognizes the importance of the Florida Everglades as a diverse
ecosystem and habitat to thousands of plants, birds, reptiles, mammals, and marine life. It also
references the Biscayne Aquifer as the main source of Broward County’s drinking water supply
and the hydraulic connectivity between the Florida Everglades and Biscayne Aquifer, and the
Everglades’ important role as a major source of recharge to the Biscayne Aquifer.
It identifies some of the potential environmental impacts from well drilling operations in the
Florida Everglades, including dewatering, disposal of wastewater, and well stimulation
procedures such as hydraulic fracturing and acidization.
The Resolution states that the District has serious concerns regarding the potential for adverse
environmental impacts from the proposed Kanter Well Site installation, maintenance and
operations and expresses the District’s continued opposition to the proposed Kanter Well Site
and any similar, future well sites proposed within the limits of the Florida Everglades or the
Biscayne Aquifer and any well stimulation procedures within the geological substrate of South
Florida.
District Director Hart requested approval of SBDD Resolution 2019-01 – Reaffirming SBDD’s
opposition to Oil Drilling in the Florida Everglades.

District Director Hart then updated the Board on the status of Kanter Real Estate’s permit
application for oil drilling in the Florida Everglades. He said that the District Court of Appeals
reversed the states denial of Kanter’s state permit. He said that Kanter applied for a DEP
permit to drill the well, and the state denied the permit; and they appealed to the First District
Court of Appeals and were overturned; and were told that the state had to issue the permit; and
then DEP asked for a hearing of the full court of appeals, and they were denied the request. As
it stands today, the ruling by the First District Court of Appeals is what stands; which requires
the state to issue the permit. Both Broward County and the City of Miramar have expressed
their desire and their intent to continue to oppose. District Director Hart said that he is not sure
what their remedy, or course of action would be, but he is sure that they are going to take
whatever action they need to take to try and prevent the drilling. He said having this
reaffirmation/opposition is important from a standpoint of showing the County and the City
that the District is in opposition to it, and reaffirming what was previously stated.
Commissioner Minnaugh moved for approval of SBDD Resolution 2019-01 – Reaffirming
SBDD’s opposition to Oil Drilling in the Florida Everglades. Motion was seconded by
Commissioner McCluskey.
Commissioner McCluskey commented that this is a no brainer to him. He said that the District
Court chose to ignore the evidence the City, State, and County presented; and it doesn’t really
cover fracturing, because fracturing is illegal in Broward County. Kanter Real Estate has two
lobbyists; one is advocating the passage of the permit, and the other is trying to sell the land to
somebody, anybody, which tells him quite a bit.
Commissioner Mersinger suggested that the Resolution be sent to Governor Ron DeSantis,
Senator Rick Scott, Senator Marco Rubio, and Congresswoman Debbie Wasserman Schultz.
District Director Hart said that it will also be sent to the Members of the Broward Delegation of
the Florida Legislature, the Director of the Florida Dept. of Environmental Protection, and the
Director and Chief Resilience Officer of the Broward County environmental Planning and
Community Resilience Division.
Vice Chair Ryan commented that he and Commissioner McCluskey attended a meeting the
other day where Mr. Schwartz showed a presentation on why this should not happen, and the
detrimental effects that this will have on the water supply. He said that Kanter Real Estate
would still need to go to the County Commissioner for zoning and land use plan changes. He
said there is not too much empathy at the Broward level for that. He said he also received
feedback on the Resolution we sent.
Commissioner Goggin commented that he is in agreement that this not happen, and that they
wake up, and that we get this shut down.
The question was called and it was carried unanimously.
E. REQUEST TO PURCHASE TELEMETRY EQUIPMENT FOR THREE (3) BASIN S-8
SLUICE GATES FROM DATA FLOW SYSTEMS, INC. IN THE TOTAL AMOUNT OF
$41,358.00
District Director Hart said that District staff is currently working to complete the automation
of the final three (3) sluice gates located along Griffin Road and serving the S-8 Drainage
Basin. He said that with the completion of these gates, the District will have the ability to

operate all of the S-8 sluice gates remotely, and without having to send staff out into the field
during extreme weather events.
The automation of the remaining sluice gates is part of the District’s 5-year Capital
Improvement Plan (CIP), with a combined budget of $135,000: $90,000 in FY 2018/2019 and
$45,000 in FY 2019/2020. Based on the preliminary budget estimate for all three gates, the
District can complete all three gates in FY 2018/2019 for a total cost of $130,000.
Each gate will include a telemetry system to allow SBDD to operate the gates remotely. The
total cost of the telemetry systems for all three gates is $41,358.00; and the vendor/supplier is
Data Flow Systems, Inc. (Data Flow). Data Flow is a sole source vender/supplier of SBDD’s
telemetry equipment, and all of SBDD’s automated pump stations and sluice gates are
controlled by Data Flow equipment and have been since the inception of the District’s
telemetry system. Data Flow is giving the District a $3,600 credit for ordering the telemetry
systems for all three gates at the same time.
District Director Hart commented that going back to the budget amount of $130,000, there are
other components of performing the work for the gates. He said the District has to do some
excavation work out in front of the gates to get the canal cleaned out and lowered; and that
work can be done under the dredging line item; we’re doing some stabilization work on the
canal banks to accommodate installation, and we have a line item for erosion control; so the
whole $130,000 is not coming out of CIP. He said that between all of the funding sources that
the District has, he feels that it’s very achievable this year to get the last three gates completed.
He is very anxious to get those completed sooner than later.
District Director Hart requested approval to purchase the telemetry equipment for the three (3)
remaining sluice gates in the S-8 Basin for a total amount of $41,358.00 from Data Flow
Systems, Inc. as a sole source vender/supplier. He said that approval of this agenda item will
allow the District to complete the automation of the remaining three sluice gates in the S-8
Basin with funding as noted above.
Commissioner Minnaugh moved for approval to purchase telemetry equipment for three (3)
Basin S-8 sluice gates from Data Flow Systems, Inc. as recommended in the total amount of
$41,358.00. Motion was seconded by Commissioner McCluskey and it was carried
unanimously.
Commissioner Mersinger commented that this is one of the reasons SBDD doesn’t have the
issues that others do; because we put money back into maintenance and improvements.
F. UPDATE BY SOUTHWEST BROWARD THEATERS HOLDING LTD ON
PROPOSED CONTRACT FOR SALE AND PURCHASE OF A 1.7 ACRE LAKE
PARCEL LOCATED IN THE “BRITANNIA” PLAT (148-7), TOWN OF DAVIE,
FLORIDA.
District Director Hart said that in April 2017, the SBDD Board of Commissioners approved
the sale of 1.7 acres of surplus land to SW Broward Theaters Holdings, Ltd. for $150,000 plus
reimbursement of all of SBDD costs; and the proceeds from the sale would be to improve
SBDD Basin S-8. The surplus land was a portion of an existing lake, and the sale was to
include the entire portion of the lake parcel (10.17 acres).

Ms. Nectaria Chakas, Attorney on behalf of Southwest Broward Theater Holdings, Ltd.
(SWBTH) updated the Board on where things stand with the purchase and sale agreement for
that surplus land in the Town of Davie. She said that the last time they were before the Board,
the Board approved the sale of 1.7 acres of lake area for $150,000; and they have been in
negotiations on the contract with Attorney Bell and the Real Estate Transactional Council for
SWBTH.
In the summer, SWBTH had two public participation meetings, which is something that the
Town of Davie requested. Ms. Chakas said that some of the land they were planning on using
for parking was located on Town of Davie land. She commented that the public participation
meetings were very well attended. There were some definite concerns on traffic, and other
things that sometimes come along with expansion of shopping centers, etc., but that none of the
concerns had to do with drainage; because of the concerns of the residents, the Town of Davie
withdrew their parcel from consideration; which means that they have to go back and redesign
the plan.
She stated that there is still very strong interest in purchasing the land and it is not something
that the owners are backing away from, but what they are evaluating are different site plan
options that don’t include parking on the Town of Davie parcel; and because they had so much
parking on that parcel, it is a major redesign of their plan, and the owners want to keep their
options open.
Ms. Chakas said that the other issue is that the primary liaison for the project is no longer
involved with the project; and at this point, the owners are evaluating their options and seeing
how they can respond to some of the concerns they heard from the residents; and the contract
for purchase and sale between SBDD and SWBTH which previously had contemplated some
site plan contingencies, etc. She said that at this point, they are leaving everything open, and
considering all their options, including waiving site plan contingencies.
Commissioner Mersinger wanted clarification on the sale price. Ms. Chakas explained that she
understood her confusion; that $75,000 was the initial offer, but that when SWBTH came to the
District for approval it was negotiated to $150,000.
Vice Chair Ryan asked if the District will see a proposed layout of the site plan when they
redesign it. Ms. Chakas replied yes, the site plan will have to come before the District for
drainage approval.
Commissioner McCluskey asked how many parking spots were lost to the Town of Davie. Ms.
Chakas said that the Town of Davie had about 260 spaces on it. Commissioner Santana-
Woodall asked if they are looking to do a garage. Ms. Chakas said that is one of the options.
Commissioner Minnaugh wanted clarification on the cover page of the memorandum, where it
states that the surplus land was a portion of an existing lake, and the sale was to include the
entire portion of the lake which was 10.7 acres. She said she did not recall that. Ms. Chakas
explained that the lake right now is all owned by SBDD; and that the previous plan shows them
filling in 1.7 acres of that to place buildings on top; so the purchase price was built upon what
they were actually going to fill and place buildings on. She said that because SBDD was going
to transfer 1.7 acres, the District said that they did not want to be in the business of owning these
lakes; to just go ahead and deed the entire lake over, and SWBTH can maintain them in
perpetuity. That was really the extra land that was being transferred, but SWBTH was only

planning to develop on 1.7 acres. Commissioner Minnaugh commented that SWBTH will not
be using the 1.7 acres unless it’s for a big garage. Ms. Chakas said that SWBTH still intends
on using the SBDD lake. It’s actually using a little less than 1.7 acres, but we are not asking for
a reduction on the purchase price.
G. OTHER
District Director Hart updated the Board on the following CIP items:
Grapple Truck - District Director Hart commented that the District has been in contact
with the vendor who is assembling the District’s grapple truck. It’s being assembled in
Kansas. He said that the vendor is coming down to take a look at the District’s existing
truck so they can see exactly what the District is looking for; and he is hoping to get it
by the end of April, but it’s on track for the beginning of June.
Commissioner Minnaugh asked if the grapple truck will be transported or will they drive
it. District Director Hart said they will drive it.
Pumps & Gear Drives – District Director Hart said that both, the S-8 and the S-7 pumps
and gear drives are completed 100%; and that the total cost came in well under the budget
amount.
Telemetry – SBDD has started the site work at all three locations. District Director Hart
said now that they have gotten approval by the Board, they will go ahead and order the
telemetry. We have already ordered the motors, and are obtaining pricing for the fence
and electrical, and are pushing hard to get all three gates in operation by June 1st.
University Park Pump Station - District Director Hart commented that the University
Park pump station is an old structure that had an old pump and has not been in operation
for over 15 years. The District’s plan was to strip out all the old equipment, which has
been accomplished. He said much of the work was done in-house. A top slab has been
ordered with a hatch to be in place over the top of the structure; and should be complete
within the next 60 days. The estimated cost is $10,750.00; budget amount was $60,000.
Much of that was due to staff completing the demo work in-house.
Commissioner Mersinger asked if the District will be utilizing that pump station for
anything. District Director Hart replied no, we are reconnecting the pipe from one end
to the other, and leaving the shell in place and putting a new top on it with a hatch in
order to get access to it, if they ever need to.
Commissioner Goggin commented that there are fittings going in. District Director Hart
said that there are pipes in and pipes out. Commissioner Goggin noted that if there are
flanges or something similar, then some maintenance would have to be done. District
Director Hart said if they took the whole structure out, they would have had to connect
the pipes, but the cost of that, would far exceed what it would cost to just take out the
equipment, and place a new top on it.
Tree Contract – District Director Hart said that with the approval of the tree contract,
which includes another stretch along 184th Avenue, that they are making tremendous
progress in getting that whole easement cleared out; and once that work is done, they

will start to excavate a portion of that canal.
County-Wide Flood Mapping Project – District Director Hart commented that the
County-Wide Flood Mapping Project is moving along very well. He said that he believes
that we will have the base data, which is existing conditions, within the next 60 days.
The County picked the storm that they will calibrate the model on, and they are using the
storm from last June. They will run the model and see what the model stages comes up
with, and then compare the actual stages, etc. District Director Hart stated that this will
be very important for the District; to be able to compare it with the District’s models.
Skid Steer – The Skid Steer is being used quite often and has been a real important
purchase for the District.
Water Level Recorders – District Director Hart commented that the District is evaluating
a new prototype for water level recorders. He said it is going a little slow, but we have
to make sure that it is evaluated properly. Due to the unavailability of the current system,
SBDD will be using a new system, which requires a new setup.
Fire Suppression – District Director Hart stated that he applied for a grant for a fire
suppression system, but he does not believe that we will be successful, due to where we
are in the Tier II group. He said that in order for the District to get funding,
approximately 70 projects above us would all have to be completely funded; and if there
is still funding available, then they would move forward with the other projects; but
SBDD will continue trying.
Water Matters Day – District Director Hart said that there was a good turnout. He
thanked the Board members that helped out; and commented that next year we will need
more people helping out. SBDD received an Emerald Award along with the Town of
SWR; and there were some nice statements made about the District. District Director
Hart said that he was happy to represent the District. Vice Chair Ryan and District
Director Hart thanked Pam Walsh for such a great job organizing, and preparing
materials for the Water Matter’s Day.
05. ATTORNEY=S REPORT:
Attorney Bell commented that nothing is really going on in the legislature, that he is aware of, but there
is one item that is trying to get through, and he doesn’t believe it’s going anywhere. Commissioner
Mersinger commented that there are over 1600 Bills filed and only a hand full make it through the
process.
Attorney Bell said that District Director Hart was elected Vice Chair of the Technical Advisory
Committee to the Water Advisory Board of Broward County.
06. APPROVAL OF LEGAL BILLS
Commissioner Minnaugh moved for approval of the legal bills. Motion was seconded by Commissioner
McCluskey and it was carried unanimously.

07. BOARD MEMBERS QUESTIONS/COMMENTS
Commissioner Minnaugh commented that the interest rates for our CDs are the highest that the District
has been able to get on a CD in a very long time; and she thanked Susan Iratzoqui for that, because
Susan was the one who called around and was able to achieve this.
Commissioner Santana-Woodall invited the Board to the Relay for Life Race on April 5th, 2018 at 7:00
p.m. She said they will have some additional events this year. The Police & Fire will be playing a kick
ball game starting a 6:00 pm, and whoever raises the most money will get points; and there will also be
a “Taste of Relay” which is $8, and you can try different food venders that have donated food for Relay.
Commissioner Mersinger said she went to Tallahassee for Broward Days and had a good meeting. She
said there were no major issues for the District. She said that the Town of SWR put up quite a few
projects; and she suggested that the District partner up with the Town on a couple of projects, so that
the District can have a better chance of getting some funding from the State in order to get SBDD
projects done.
