Sub:- Tender No.18/OT/Rev-03/2009-2010, Secunderabad Division - Electrical Maintenance Department - Comprehensive maintenance of UPS for two years, installed at PRS and UTS counters in twin cities and at various locations in the Division.

1. The President of India invites Open Tenders through the Senior Divisional

Electrical Engineer (Maintenance), South Central Railway/SC, to carryout the above work, as detailed in the tender document enclosed.

2. Sealed Tenders for the above Tender notice No.18/OT/Rev-03/2009-2010 will be received in the Tender hall of DRM/MG/HYB/SC upto 15.00hrs IST on 20-10-2009 and will be opened at 15.15hrs. on the same day. If the stipulated day of opening the tender happens to be holiday, the tenders will be opened on the next working day at the same time and place.

3. All tenders must be accompanied with Schedule of work attached duly filled in and signed complete with technical details, drawings and descriptive literature of the equipment offered and a list of electrical works executed by them in the past giving the value against each, without which no tender will be considered. No un-sealed tender will be accepted.

Any Tenderer who does not comply with this condition, is liable to be rejected.

4. The offer must be firm and not subject to fluctuations in rate of exchange and be in terms of rupees. No import license will be arranged by this Administration.

5. The president of India is not bound to accept the lowest or any tender nor assign

any reasons for not doing so and the President of India reserves the right to accept any tender in respect of the whole or any portion of the items specified, percentage reduction in total cost, if the order for the entire work is placed on you, may also be indicated.

6. A sum of Rs.10,590/- as Earnest money should be deposited in the favour of

Sr. Divisional Finance Manager / S.C.Rly / Secunderabad in the form of Demand Drafts / Deposit Receipts / Pay orders either on the State Bank of India or any of the Nationalised Banks. No confirmatory advice from the Reserve Bank of India will be necessary. (or) Cash Receipt obtained from the Divl.Cashier(Pay)/BG, South Central Railway, Secunderabad, after paying the specified amount. No interest will be allowed on this deposit and President of India reserves the right to confiscate this deposit, if the successful tenderer failed to put in the security deposit required by the terms and conditions of the tender. Tenders unaccompanied by Earnest Money will summarily rejected. Standing or Permanent Earnest Money deposit not valid. No Bank Guarantee for EMD is accepted. The Deposit Receipts submitted by the firms should invariably worded as follows failing which the EMD will be treated as invalid “Sr. Divisional Finance Manager / S.C.Rly / Secunderabad followed by the name and place of the contractor”

7. The quoted percentage in the schedule should include for all the materials to be provided in the work to be done by the contractor in the whole as described in the tender document and the schedule attached.

8. The above rates should be inclusive of sales tax, Excise & Octroi duty etc. and the

tenderer shall furnish their APGST Registration number. 9. The tenderer shall submit their latest ITCC along with their tender papers. 10. The period of contract is Twenty Four Months from the date of issue of letter of

acceptance. 11. No alterations in the rates specified in the Tender shall be allowed unless it has

been initialed by the Tenderer before submission of his tender. 12. The tenderer may visit the site if necessary and ascertain himself the nature and

quantum of work involved and the information as regards the local conditions, storage facilities etc.

13. The tenderer shall keep the offer open for a minimum period of 90 days from the

date of opening of tender within which period the tenderer cannot withdraw his offer, subject to the period being extended from time to time. Any contravention of the above condition will make tenderer liable for forfeiture of his earnest money.

14. In all matters of dispute, the decision of the Senior Divisional Electrical Engineer

(M)/SC shall be final and binding. 15. Tender should be submitted for the entire work. 16. The submission of tender will be deemed to imply that this memorandum and all

documents enclosed have been studied and under stood and the tenderer is aware of the full scope of the work to be done and the conditions affecting the execution.

17. No free passes will be issued to the contractor by Railway Administration. 18. The tenderer shall not increase their quoted rates in case the Rly. Administration

negotiates for reduction in rates, Such negotiations shall not amount to cancellation or withdrawal of the original offer and the rates originally quoted will be binding on the tender.

19. The contract is liable to be cancelled or terminated forthwith if it comes to the

knowledge of the Railway Administration that the contractor or the person who is in employment under the contractor is a retired Engineer of a Gazetted Rank or a retired Gazetted officer employed in the executive or Administrative offices of the Electrical Department of the Railway Administration and that he has not obtained the previous permission of the President of India within two years of his retirement and the contractor shall be liable to make good any loss or damage resulting from such cancellation or termination.

20. If the tenderer deliberately gives wrong information in his tender or creates such

circumstances for the acceptance of his tender the Rly., reserves the right to reject such tender at any stage.

21. The contractor shall be responsible for any damage to property and for any injury

or loss caused to the work or workman to persons, animals or things in the course of the work carried out of under the direction of the contractor or his agents.

22. The contractor shall set out the work and responsible for the same and attend at

his own cost and to the satisfaction of Senior Divisional/Assistant Electrical Engineer (Maintenance) / Secunderabad any errors which may arise through in-accurate setting out.

23. The successful tenderer shall sign an Agreement for the execution of work as tendered by him and acceptable by the Railways.

24. The Tenderer should sign one copy of the General Conditions of the Contract

(form enclosed) as a token of acceptance without which, the tender cannot be considered.

25. The documents submitted along with the tender to fulfill the Eligibility

criteria should be an attested copy of certificate obtained from Junior Administrative Grade Officer of Electrical Department of Railways / Superintendent Engineer of State Govt. or Equivalent grade officer in quasi Govt. Department / Public Sector undertakings in Central Govt.

26. Tenderers shall also fill up the proformas enclosed to the tender document

given as Annexures – "A", "B", "C" & "D", which is mandatory.

GENERAL CONDITIONS OF THE CONTRACT

I/We have gone through the General Conditions of the Contract governing the performance of the works covered by this tender, and I/We have kept myself / ourselves fully informed of the provisions of these General Conditions.

SPECIAL CONDITIONS OF CONTRACT (PART – I) 1. These special conditions of contract are to be read in conjunction with General

conditions of contract (GCC) of S.C.Rly for Electrical Engineering works. A copy of the same is kept in Sr.DEE/M/SC office for tenderer’s reference.

2. The successful contractor shall nominate and furnish the name & address (Mobile

Phone Numbers) of the qualified supervisor who is going to supervise the work at site.

3. Railway supply materials when issued, the contractor has to submit an indemnity

bond to the value of the material before collecting the same. 4. Insurance coverage is required for the contractor’s supply materials during the

contract period, from the date of receipt at site. 5. The contractor shall be responsible for all the repairs and rectification of damages to

the installations erected ‘OR’ any other under erection due to Rly accidents, thefts, pilferage ‘OR ‘ cause without delay until the installations are handed over to Rlys. after completion.

6. The works must be carried out most carefully without any infringement of the Indian

Rly Act ‘OR’ the General and Subsidiary rules in force on Rlys. 7. Before quoting, the tenderers are advised to ascertain the quantum of work involved,

if required, site inspection can be under taken. 8. The unit prices indicated/quoted in the price schedule shall include the prices of

materials including all incidental charges for transport, handling (loading/unloading) storage at site and arranging despatch by rail direct from manufacturers factory and completing all formalities in this respect such as submission of forwarding notes, arranging placement of wagons, collection of RRs, All insurance permits, bankers charges for GB, indemnity bonds etc., as also shunting charges, if any levied by the Railway.

The prices shall include all taxes, duties, levy’s etc., applicable on the works contract.

9. PRICE VARIATION : Price variation on supply of material and erections will not be

allowed during the execution of contract works. 10. No advance payment against supply of materials will be made.

11. Payment for T&P items under price schedule will be made at any time during the contract period against scheduled items if available in the price schedule.

12. Materials statement (Rly supply items) is to be submitted by the site representative of Rlys. and final reconciliation statement is to be submitted with final bill.

13. Security deposit (SD) : Security deposit is to be paid by the successful contractor in

token for the due fulfillment of contract. The amount of security deposit required to be remitted is as under : a. The security deposit shall be 5% of the contract value. b. The rate of recovery will be at the rate of 10% of the bill amount till the full

security deposit is recovered. c. Security deposit will be recovered only from the running bills of the contract and

no other mode of collecting SD such as SD in form of instruments like BG, FD etc., shall be accepted towards deposit.

d. The Security Deposit shall be released only after the expiry of the maintenance period and after passing the final bill based on "No claim Certificate". No interest will be payable upon this security deposit.

Note : The contractor shall abide to the latest GCC. 14. Performance Guarantee : The Performance Guarantee shall be submitted as given

under : a. The successful bidder should give a performance guarantee in the form of an

irrevocable bank guarantee amounting to 5% of the contract value. b. The Performance Guarantee should be furnished by the successful contractor after

the letter of acceptance has been issued, but before signing of the agreement. The agreement should be signed within 15(fifteen) days from the issue of LOA and Performance Guarantee should also be submitted within this time limit. This Guarantee shall be initially valid upto the stipulated date of completion plus 60 days beyond that. In case, the time for completion of work gets extended, the contractor shall get the validity of performance guarantee extended to cover such extended time for completion of work plus 60 days.

c. Performance Guarantee shall be released after the physical completion of the work based on the "Completion Certificate" issued by the competent authority stating that the contractor has completed the work in all respects satisfactorily.

d. Where ever the contracts are rescinded, the security deposit will be forfeited and the Performance Guarantee will be encashed and the balance work will be got done separately.

e. The balance work shall be got done independently without risk and cost of the original contract.

f. The original contractor shall be debarred from participating in the tender for executing the balance work. If the failed contractor is a JV or a partnership firm, then every member/partner of such a firm would be debarred from participating in the tender for the balance work either in his/her individual capacity or as a partner of any other JV/partnership firm.

Note : The contractor shall abide to the latest GCC.

15. Programme Chart & Progress Report : The contractor(s) shall furnish to the Sr.Divl.

Electrical Engineer (M) Sec-bad. the programme schedule for the month in consultation with site engineer and also separate monthly progress of the work to Sr.Divl. Electrical Engineer (M) Sec-bad regularly.

16. PAN No. and experience certificate : The Tenderer should submit a copy of PAN

identification & Experience certificates, attested by Gazeeted officer along with their offer.

17. Present work load : Tenderer/Contractor shall furnish the present load of work under

execution duly stating the type of work, approximate cost, place of work etc., 18. Taxes : The contractor and all personnel employed by him shall pay such taxes like

income tax as per payable under statutory laws of India and the purchaser will not accept any liability for the same. Deduction of Income tax at source as per provision of finance and income tax act in-force may be made from the contractor /sub-contractor and the amount so deducted may be credited to the Central Govt.

19. Guarantee/Maintenance Period : The tenderer shall give guarantee/Maintenance

period for the work carried out for a period of one year from the date of completion of the total work against defective workmanship or any substandard material used. The contractor should make good at his own expenses any defects in the equipment/installation during the maintenance / guarantee period. Incase the contractor fails to attend within 21 days period, the same will be got attended by the representative of Sr.DEE/M/SCR/Secunderabad at the risk of the contractor and the charges there on will be recovered from any amount due to the contractor including the security deposit. All replacement and repairs that the Railway shall call upon the contractor to deliver or perform under this warranty shall be delivered and performed by the contractor within a period of 21 (twenty one) days promptly from the date of receipt of advice to that effect from the Engineer. In case where such replacement, repair, execution and/or installation takes place during the warranty period, the provision of this warranty clause shall apply to that portion to replace or renew until the expiration of 12 ( twelve) months from the date of such replacement, repair, execution and/or installation. This extended period shall herein after be referred to as “Extended Warranty period”

20. Period of operation : The work shall be completed within Twenty Four Months from the date of issue of letter of acceptance.

21. Terms of payment : 100% Payment will be made against the items in Schedule-B. The contractor shall submit his/their bills for payment for a minimum period of Three months for the completed portion of work. NOTE : The successful contractor shall furnish Name of the Bank & Account

No. for issue of Accounts Payee cheques for Payments. 22. All the terms and conditions stipulated are binding on the contractor. In all the

matters of dispute, the decision of the Sr.Divl.Elecl.Engineer/M/S.C.Rly/ Secunderabad shall be final.

23. All items required for satisfactory execution of the works contemplated are covered in

the tender schedules. If contractor feels that any item is required for satisfactory completion of the work over and above these schedules, he may quote for the same duly giving necessary justification for the same.

24. Eligibility criteria : (A). The tenderer/site supervisor shall possess electrical license.

25. Released material during undertaking the work shall be returned to the

concerned Section Engineer (M) with proper accountal. 26. In the event of any reduction in the quantity to be executed for any reasons

whatsoever the contractor shall not be entitled to any compensation but shall be paid only for the actual amount of work done.

The contractor is bound to notify the engineer at least seven days before the

necessity arises for the execution of any item in excess of 25% of the quantity provided in the agreement.

In case of increase in quantity if an individual item (for NS items) or the total

value of the schedule (for SSR items) by more than 25% is considered as unavoidable, negotiation shall be conducted with the existing contractor for arriving at reasonable rates.

The limit for varying quantities for minor value items (i.e. item whose original

agreement value is less than 1% of the total original agreement value) shall be 100%.

27. All the works should be carried out as per the instructions of Engineer at site. 28. Power supply will be arranged by Railways free of cost. The successful contractor

shall have to tap from the nominated Railways point ie. Distribution Board by suitable size cable for their M&P required during execution of the tendered work under the guidance of Rly. Site Engineer.

29. The contractor shall comply with the provision of EPF & MP Act, 1952 and

obtain code number from the concerned authorities whenever workmen employed by him are 20 or more. He shall also indemnify Railways from and against any claim, penalities, recoveries under the above Act and Rules. Contractors to get the codenumber under the EPF so as to enable the PF Commissioner to extend the social security benefits to the workmen engaged by the Railway contractors. The first month’s bill will be released only after code number is taken from the PF office and a copy of coverage intimation produced. Subsequently for each month, bill will be released only on submission of challans & 12A. Monthly return copy in proof of remittance of PF dues for every month.

30. Employment of Electrical Engineering Graduates/Diploma-holders:

The contractor shall employ the following technical staff during the execution of this work. i) One graduate engineer when the cost of the work to be executed is Rs.15

lakhs and above. ii) One qualified diploma holder (over-seer) when the cost of the work to be

executed is more than Rs.5 lakhs but less than Rs.15 lakhs. These technical staff shall be available through out the period when the work is in progress and not merely be available for taking instructions. In case the contractor fails to employ the technical staff as aforesaid, he shall be liable to pay a reasonable amount not exceeding a sum of Rs.5000/- (five thousand only)for each month of default in case of graduate engineer and Rs.3000/- (three thousand only)for each month of default in case of diploma holder (overseer). The decision of the Railway engineer-in-charge as to the period for which the required technical staff was not employed by the contractor and as to the reasonableness of the amount to be deducted on this account shall be final and binding on the contractor.

SPECIAL CONDITIONS OF CONTRACT ( PART – II )

1.0. These Special conditions of the contract Part-II are to be read in conjunction with Part-I of Tender Document.

2.0. Periodicity of Service :

2.1. The period of contract shall be for Two Years from the date of issue of Letter of Acceptance. The period is liable to be curtailed with one month notice, if the repair, maintenance and break down attention are not satisfactory.

2.2. The contractor shall take minimum four visits in a year (equally scattered

i.e. one visit is a must in every three months to each location) for preventive maintenance of each and every UPS and the report shall be submitted as per the specimen proforma enclosed in the tender document, for individual UPS.

2.3. In addition to the above (Sl.No.2.2), the contractor shall attend break

down calls intimated by the Railways and there will be no limit to such calls during the CMC period.

3.0. Spare, Tools & Testing instruments

3.1. All the tools and testing instruments required for routine checking, testing and attending to breakdowns shall be arranged by the successful contractor at his cost.

3.2. The maintenance charges include the cost of spares used, traveling

expenses and daily allowances etc., of the contractor’s engineer and the. Railway will not entertain any claims on this account.

3.3. The contractor will carry required routine spares along with him for

preventive maintenance to ensure minimum down time without any additional cost. In addition to these spares, contractor will also arrange other spares, if required without any additional charges.

3.4. In the event of major repairs necessitating removal of the UPS system or its parts taken by the contractor to his service centre. The contractor shall try to repair those parts in minimum time so that down time can be reduced. During this period it is the responsibility of the contractors to make necessary stand by arrangements by himself so that the Railway working shall not affect the system functioning.

3.5. Break down calls shall be attended within 4 – 5 hours after receipt of

failure intimation from the Railways representative, failing which, the cost for attention per location as per CMC , will be deducted from the bill .

4.0. Name, Address & Contact Phone Numbers of the Service Engineers :

4.1. The contractor shall arrange minimum of 3 ( Three) Service Engineers placed at 3 (Three) locations i.e. at Secunderabad, Vikarabad & Kazipet to attend the failures/CMC calls with in the short period of time of complaint.

4.2. Contractor shall furnish to the Railways, the names and Mobile Nos. of the

Service Engineers at the above locations, responsible for coordinating with the Railways to whom the complaint / break down calls can be lodged round the clock i.e. even after Office Hours /Sundays/Holidays.

4.3. Contractor shall furnish the name and other details along with photographs

to this office to enable to issue identification card to the Service Engineers who are authorised to attend the maintenance works, so as to facilitate verification by the local Railway representative. This card is deemed to be used for only to carry out the UPSs maintenance work.

4.4. The contractor shall depute only competent and efficient staff for

preventive maintenance and for the breakdowns.

5.0. Maintenance, Operation and Shifting of UPS by owner :

5.1. In case UPS system is required to be shifted / change of makes are made by the owner from the existing location to else where during the contract period, the contractor shall have no objection. The service contract shall become valid for change of make / shifting to the new location.

5.2. In case of bad maintenance, resulting in damage to UPS & Consequential

damage to other systems, the loss is to be borne by the contractor.

5.3. The contractor has to submit the probable preventive maintenance schedule for the UPSs provided at the various locations and acknowledgement for the work done should be produced to the Railway Site Engineer (i.e. SSE/ELEC/PRS/SC).

5.4. In case of unsatisfactory performance by of any of the UPS in any

location, penalty will be imposed on pro-rata basis on the CMC charges. 6.0. Terms & Conditions :

6.1. Necessary record for maintenance / details of repairs carried out should be maintained in the prescribed proforma enclosed and the same is to be produced for the inspection as and when required by the Railway Engineer or Railways Representative. These Preventive / Breakdown call reports of the work done by the contractor shall be got duly signed by the Railways Engineer or Railways Representative and finally got certified by the Sr.Section Engineer / PRS & Asst.Dvil.Elec.Engg/PRS and the same are to be submitted along with the bill to Sr.DEE/M/SC for arranging payment.

6.2. The successful contractor shall attend all the installations at each of the

location proposed under maintenance once in three months as a preventive measure and the same is to be recorded in a register kept under the concerned Station Incharge at various stations.

6.3. The Service Engineers responsible for maintenance work, shall also

intimate their day-to-day movement to the Electrical Controller who will be available round the clock in the control office at Sanchalan Bhavan./Secunderbad.

6.4. The Service Engineer at Secunderbad should report to SSE/PRS/SC

every day at 08.00 hrs and should take instructions to carryout the day to day work after entering in the Register available at PRS and also follow the instructions over phone in case of emergency, regarding the complaints. Similarly the Service Engineers located Kazipet and Vikarabad should also take instructions from SSE/Elec/ PRS/SC over phone, as regards to complaints / CMC due and the same is to be recorded in the register in the format given, which will be subjected to inspection as and when called for.

7.0. Laws and Acts Governing the contract :

7.1. The contract shall be governed in all respects by the prevailing labour laws.

7.2. The contract shall be governed by the Indian Electricity Act and Indian

Electricity Rules.

7.3. The contractor shall observe all procedures, perform all acts and abide by all the provisions contained in the prevailing labour laws.

7.4. The contractor shall take all precautionary measures in order to safe guard

his staff safety and will be responsible for all actions, suits, claims, demands, charges and expenses arising in connection with him in the Railway premises and shall indemnify the owner from all such claims etc.

Annexure to Tender Notice No. C/E/29/BG/Elec/18/OT/Rev-03/2009-10 1.0 Tender documents can be obtained on any working day between 10.00 hrs. to 17.00 hrs. for the above Tender Nos. from the office of the

Sr.Divl. Electrical Engineer /M/S.C.Rly / Secunderabad, 5th Floor, Sanchalan Bhavan, Secunderabad after paying the specified amount with the Divl. Cashier/Pay/BG/S.C.Rly/Secunderabad or with the concerned Station Manager/Superintendent, on submission of the original money receipt in this office.

2.0. All the tenderers should necessarily furnish the required Earnest Money Deposit alongwith their tenders favouring Senior Divisional

Finance Manager, S.C.Rly Secunderabad in the form of Deposit Receipts, Pay Orders, DDs from State Bank of India OR any of the Nationalised Banks. No confirmatory advice from RBI will be necessary.

3.0 Tender forms are not transferable and cost of tender documents is not refundable. No cash payment, money orders / bankers cheque / will be accepted by this office for the purchase of tender forms.

4.0 The tender notice is available at http://tenders.gov.in web site. 5.0 The following conditions are to be followed for submission of tender documents, down loaded from website.

(i). The tenderers can download the tender document from the web site. Necessary cost of tender document specified above against

each tender is to be paid in the form of separate DD along with EMD as given under clause 3 above. Failing of which, tender will be rejected.

(ii). Only the original computer printout of the Tender documents downloaded from the website must be submitted. Photocopies are

not acceptable. Tenders submitted in photocopies of down loaded documents is liable to be rejected. If during the process of the tender finalisation, it is detected that Tenderer has submitted tender documents after making any changes / additions / deletions in the tender documents down loaded from website, his offer will be summarily rejected and the Earnest Money deposited by the Tenderer shall be forfeited by the Railways.

(iii). Tenderers are free to download the tender document from the web site at their own risk and cost for the purpose of perusal and to

use the same as tender document. If so desire, for submitting their offer. If the offer of any tenderer who has submitted the tender document downloaded from the website is accepted, the contract agreement will be prepared based on the master copy of the document and will be binding on the contractor. The Railway does not own any responsibility for any alteration / omission in the contents of the tender form uploaded on the website. No claim on this account will be entertained. The Administration will not own any Responsibility, if website is not opened for downloading / uploading the tender documents due to any technical snag.

(iv). Tender document will be available for sale from this office and for downloading from website at least 15 days prior to the date of

tender opening.
