PursuanttoSQCL 49418-15 and 49-41 B-16, the South Dakota Public Utilities Commission will hold a public input hearing at th_e above .time and place on an application to construct approximately 10.42 miles of 345-kilovolt {kV} overhead transmission line, a substation, and associated facilities (Project) located entirely within Deuel County, South Dakota. The Project is ·proposed·by F/ying·Cow Wind, LLC (Applicant), a wholly-owned subsidiary of Roarillg Fork Wind, LLC, the joint venture formed by subsidiaries of its affiliate Renewable EnerQ_y :9ysterr1s Ameri_cas _Inc.,· 8.nd Vestas Wind Systems A/S; The ·starting point of-t~e transin.ission line for the Project is proposed to\be located iii Government Lot 2 of Section 34 in Township 114N, Range 47W, Nordeli Township. Following·the public inp~t heB~ng, the C6m_mission may schedule a formal evidentiary hearing conforming to SbCL Chapter 1-26 to consider any issues Taised by any interveniog party, the Commission's staff, or the Gom~ission itself. At such formal hearing, all parties, I, will have the opportunity to appear, preSent eviden_ce, _and cross-examine the other parties' _ witnesses and exercise all other rights afforded by SD Cl Chapters 1-26, 49-1, and 49-41 B ! ahd ARSD Chapters 20:10:01 and 20:10:22, including rights of 8.ppeal to the courts. Absent a contested issue, the Commission will schedule the matter for decision at a regular or ad hoc meeting of the .Commission.

For approval, th6 Applicant must show that the proposed Project will comply with all applicable laws and rules, will ndt pose a threat of serious injury to the environment nor to · the social and econ_omic condition of inhabita_nts or expected inhabitants in the siting area, will not substantially impair the health, sa_fety or welfare of the inhabitants, and will not unduly interfere with the orderly development of th9 region with ·due consideration having been given fo the views of governing bodies of affected local units of gove_mment. Based_ upon these factors, the Commission will decide whether the permit should be granted, denied, or granted upon sucli terms, conditions, or modifications of the construction, operation, or maintenanc~ as the Comniission finds appropriate.
