    ADJOURN

    Executive sessions held during this meeting will generally take place in the City Manager’s office, at the discretion of the City Council.

    The City Council may retire to executive session any time between the meeting’s opening and adjournment for the purpose of consultation with legal counsel pursuant to Chapter 551.071 of the Texas Government Code; discussion of personnel matters pursuant to Chapter 551.074 of the Texas Government Code; deliberation regarding real property pursuant to Chapter 551.072 of the Texas Government Code; deliberation regarding economic development negotiations pursuant to Chapter 551.087 of the Texas Government Code; and/or deliberation regarding the deployment, or specific occasions for implementation of security personnel or devices pursuant to Chapter 551.076 of the Texas Government Code. Action, if any, will be taken in open session.

    This agenda has been reviewed and approved by the City’s legal counsel and the presence of any subject in any Executive Session portion of the agenda constitutes a written interpretation of Texas Government Code Chapter 551 by legal counsel for the governmental body and constitutes an opinion by the attorney that the items discussed therein may be legally discussed in the closed portion of the meeting considering available opinions of a court of record and opinions of the Texas Attorney General known to the attorney. This provision has been added to this agenda with the intent to meet all elements necessary to satisfy Texas Government Code Chapter 551.144(c) and the meeting is conducted by all participants in reliance on this opinion.

    Attendance by Other Elected or Appointed Officials:

    It is anticipated that members of other city board, commissions and/or committees may attend the meeting in numbers that may constitute a quorum of the other city boards, commissions and/or committees. Notice is hereby given that the meeting, to the extent required by law, is also noticed as a meeting of the other boards, commissions and/or committees of the City, whose members may be in attendance. The members of the boards, commissions and/or committees may participate in discussions on the same items listed on the agenda, which occur at the meeting, but no action will be taken by such in attendance unless such item and action is specifically provided for on an agenda for that board, commission or committee subject to the Texas Open Meetings Act.

Discussion and Take Appropriate Action on an Ordinance of the City of Woodcreek Adding, Amending, and Repealing Certain Sections of Chapter 30: Officials, Employees, and Organizations by Adding Sections 30.13 and 30.14,by Amending Sections 30.15, 30.16, 30.17, 30.18, Repealing 30.20 through 30.23 and Chapter 31 - Municipal Court by Amending Sections 31.01, 31.06 and 31.07 of the City of Woodcreek Code of Ordinances

    City Manager Lewis and City Attorney Wymore explained the reasons for the changes to this ordinance. Mayor Pro Tem Britner made a motion to accept the changes as shown and was seconded by Councilmember LeBrun. At discussion, Councilmember Pulley requested that Mayor Pro Tem Britner amend her motion to remove a sentence; she declined to amend the motion.

    A roll call vote was taken.

    Voting Yea: Mayor Pro Tem Britner, Councilmember LeBrun, Councilmember Alvord, Councilmember Scheel Voting Nay: Councilmember Pulley

    The motion carried with a 4-1-0 vote.

    4. Discussion and Take Appropriate Action on Authorizing City Staff to Award Tree Trimming and Canopy Clearing Services to the Lowest Responsible Bidder

    A motion was made by Councilmember Pulley to authorize this action and seconded by Mayor Pro Tem Britner.

    CALL TO ORDER

    The meeting was called to order at 2:00 PM.

    City Attorney Bud Wymore spoke about traffic enforcement for speeding.

    CONSENT AGENDA

    1. Approval of Mayor Whitehead’s 2021 Holiday Calendar for the City of Woodcreek

    A motion was made by Councilmember Rasco to approve the Consent Agenda. The motion was seconded by Councilmember LeBrun.

    A roll call vote was taken.

    Voting Yea: Councilmember Pulley, Councilmember Rasco, Councilmember LeBrun, Councilmember Brizendine, Councilmember Hambrick

    The motion passed with a 5-0-0 vote and the consent agenda was approved.

    2. Discussion and Take Appropriate Action on the Election of a Mayor Pro Tem, Pursuant to Local Government Code Sec. 22.037(b)

    Mayor Whitehead recommended Councilmember LeBrun to serve as Mayor Pro Tem. Councilmember Pulley made a motion to approve the recommendation which was seconded by Councilmember Hambrick.

    After discussion, a roll call vote was taken.

    3. Discussion and Take Appropriate Action on a Resolution of the City Council of the City of Woodcreek, Texas Designating Authorized Signatures for the City of Woodcreek’s Bank Accounts and Investment Vehicles

    Councilmember Hambrick made a motion to approve the Resolution and Designating Mayor Pro Tem LeBrun as an Authorized Signature. The motion was seconded by Councilmember Pulley.

    A roll call vote was taken.

    Voting Yea: Councilmember Pulley, Councilmember Rasco, Councilmember Brizendine, Councilmember Hambrick

    Mayor Whitehead read the Agenda Item and a presentation was made by Banks Chisum and Neel Morton.

    Mayor Whitehead read an email submitted by Jack Crum which requested that Lot 49026 not be developed. His email also requested a new sign.

    Robert Azar spoke about road & drainage concerns with additional development and requested tabling the PDD.

    Ken Strange spoke in support of Banks Chisum and his responses to drainage issues for another local site.

    Ray Don Tilley spoke in support of parts of the design, but against the impervious cover amounts.

    Laura Holbrook spoke to request that the city create an investors’ association. She also requested road repairs and drainage assistance.

    City Manager Lewis explained the public hearing and notification process. He noted that the Planning & Zoning Commission voted 3-1-0 to recommend to City Council to accept the PDD as presented, changing the zoning designation and approving the development.

    6. Discussion and Take Possible Action on Rezoning Lots 6, 7, 8 & 11, Woodcreek, Section 4-D, Map or Plat Recorded in Vol. 1, Page 160, P.R.H.C.T from the Zoning Designation of Four-Plex (4PLX) to the Zoning Designation of Planned Development District (PDD).     Councilmember Hambrick made a motion to approve the rezoning of Lots 6, 7, 8 & 11 which was seconded by Councilmember Brizendine.

    After discussion and input from City Attorney Wymore, a friendly amendment to the motion was suggested to combine Agenda Items 6 and 7.

Discussion and Take Appropriate Action on an Ordinance Changing the Zoning Classification of Lots 6, 7, 8 & 11, Woodcreek, Section 4-D, Map or Plat Recorded in Vol. 1, Page 160, P.R.H.C.T from the Zoning Designation of Four-Plex (4PLX) to the Zoning Designation of Planned Development District (PDD).     The motion carried with a 4-1-0 vote.

    8. Discussion and Take Appropriate Action on a Resolution of the City Council of the City of Woodcreek, Texas Designating the Clerk of the Court for the City of Woodcreek Municipal Court

    City Manager Lewis explained the recommendation for changing the Municipal Court Clerk.

    Councilmember Brizendine made a motion to appoint Maureen Mele as Clerk of the Court. The motion was seconded by Councilmember Hambrick.

    A roll call vote was held.

    Voting Yea: Mayor Pro Tem LeBrun, Councilmember Pulley, Councilmember Rasco, Councilmember Brizendine, Councilmember Hambrick

    AMENDMENT TO CHAPTER 50 OF THE CODE OF ORDINANCES

    WATER QUALITY ORDINANCE

    AN ORDINANCE AMENDING THE CITY OF WOODCREEK CODE OF ORDINANCES AT TITLE V ("PUBLIC WORKS''), CHAPTER 50 ("WATER QUALITY''), SECTION 50.37 ("IMPERVIOUS COVER"); PROVIDING FOR ENACTMENT,

    REPEALER, SEVERABILITY, CODIFICATION, AND EFFECTIVE DATE, AND FINDING PROPER NOTICE AND MEETING.

    WHEREAS, pursuant to Texas Local Government Code Section 51.001, the City has general authority to amend an ordinance that is for good governmentand order of the City;

    and

    WHEREAS, the City Council finds that addressing non-point source pollution control management policies which shall govern the planning, design,

    construction, operation and maintenance of drainage, erosion and

    water quality control facilities within city’s jurisdiction is for good government and order of the City ; and

    WHEREAS, the City Council further finds that amending the City Code to provide for additional measures to control and manage the quality of storm water runoff from points and surfaces within subdivisions is for good government and order of the City; and

    WHEREAS, the City Council finds that inground swimming pools can act as a rainwater

    and stormwater detention area, and that setting a limit as to the surface area of a swimming pool that may serve as impervious cover is for good government and order of the City

  • NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of

    Woodcreek:

    1. FINDINGS OF FACT

    The foregoing recitals are incorporated into this Ordinance by reference as findings of fact as if

    expressly set forth herein.

    2. ENACTMENT

    Chapter 50 ("Water Quality") of the Code of Ordinances of the City of Woodcreek is amended at

    Section 50.37 so as to read in accordance with Attachment A, which are attached hereto and

    incorporated into this Ordinance for all intents and purposes.

    3. REPEALER

    All ordinances, resolutions, or parts thereof, that are in conflict or inconsistent with any provision

    of this Ordinance are hereby repealed to the extent of such conflict, and the provisions of this

    Ordinance shall be and remain controlling as to the matters regulated, herein.

    4. SEVERABILITY

    Should any of the clauses, sentences, paragraphs, sections or parts of this Ordinance be deemed

    invalid, unconstitutional, or unenforceable by a court of law or administrative agency with

    jurisdiction over the matter, such action shall not be construed to affect any other valid portion of

    this Ordinance.

    5. CODIFICATION

    The City Secretary is hereby authorized and directed to record and publish the language of Chapter

    50, as amended by this Ordinance, in the City's Code of Ordinances.

    6. EFFECTIVE DATE

    This Ordinance shall be effective immediately upon its passage and the publication of caption of

    this ordinance as provided by law.

    7. PROPER NOTICE & MEETING

    It is hereby officially found and determined that the meeting at which this Ordinance was passed

    was attended by a quorum of the City Council, was open to the public, and that public notice of

    the time, place and purpose of said meeting was given as required by the Open Meetings Act,

    Texas Government Code, Chapter 551.

    Subject: Review of impervious cover calculation for swimming pools, Chapter 50, Water QualityOrdinance

    On September 18, 2020, the committee was asked to review the impervious cover ordinance asit relates to swimming pools in the City of Woodcreek.

    The Committee received input from Tom Hegemeier, P.E., of Doucet and Associates, Inc. andfrom Nick Dornak, Director of Watershed Services, The Meadows Center for Water and theenvironment, Texas State University. Their input was specifically requested by the Woodcreek CityCouncil. The committee met on October 5, 2020 and discussed the matter after reviewing the materialsand information available to the committee.

    It is the recommendation of the Committee that no change be made to the existing imperviouscover calculation of the horizontal water surface area of an in ground swimming pool. The committee’sanalysis follows below.

    Basis for the Recommendation

    In reaching its recommendation the Committee considered the importance of the followingfactors recognized in the existing Water Quality Ordinance, Impervious Barrier calculations:

    (1) to protect degradation and pollution of ground water resources-specifically aquiferprotection and supply;

    (2) the need to protect the springs and creeks that enhance the quality of life, property values,and critical aquatic habitat and

    (3) to control and manage the quality of storm water runoff and the sediment load in thatrunoff.

    Additional factors recognized by the Committee include:

    (1) the generally small lot sizes in the City of Woodcreek;(2) the unique hydrology and natural beauty of Woodcreek;(3) the lack of storm water infrastructure in the City of Woodcreek;(4) the critical interrelationship between surface water and groundwater;(5) the importance of Woodcreek to act consistently with adjacent communities which share

    the Wimberley Valley watershed. It was noted that the City of Wimberley incorporated thesame impervious cover allocation as the City of Woodcreek. The adjacent City of San

  • Marcos also incorporated the same one hundred percent impervious cover allocation for

    swimming pooi horizontal surfaces;(6) the acknowledgment that swimming pools do not allow for infiltration of rainwater;

    (7) the reality that swimming pools do not serve as a usable source of rainwater collection due

    to pollution from chemicals and/or salt water, both potentially detrimental on vegetation

    and soil; and(B) the recognition that swimming pools result in significant loss of water storage due to

    evaporation.

    As an alternative to changing the impervious cover calculation, the Committee encourages

    property owners wishing to add an in ground swimming pool to consider ways to decrease the existing

    impervious cover on their lots. Property owners could pursue steps such as the use of pervious payers

    to replace impervious parking, driveway, and pathway surfaces in order to meet the impervious cover

    limit.

    It should be noted that the Committee did not have any data available on the number of in

    ground swimming pools already constructed in the City; nor did it have data available to consider how

    many property owners would potentially pursue future construction of an in ground pool were the

    impervious cover computation be decreased from one hundred percent to fifty percent. The Council

    may wish to gather the above-noted data in the forthcoming comprehensive survey of the citizens of

    Woodcreek. In addition, the survey could query citizens’ interest in construction of a single community

    pool to be located where impact to the groundwater and hydrology of Woodcreek could be mitigated.

    Such an inquiry would necessarily also need to include follow-up questions on the citizens’ willingness to

    fund initial construction and maintenance of the pool amenity. Given the general perception, not yet

    subject to empirical data - that the demographics of the city are shifting to younger families, there

    might be interest in a community pool.
