SPECIAL USE PERMIT (SUP 18-007) – DOGTOPIA DOGGIE DAYCARE FACILITY
WITH OVERNIGHT BOARDING AND OUTDOOR PLAY AREA
PLANNING COMMISSION HEARING OF: June 19, 2018
I. GENERAL INFORMATION
A. APPLICANT: Derrick Reinhart 17414 Emiline Street Omaha NE 68136
B. PROPERTY OWNER: Henri Jung 4031 S 176th Circle Omaha, NE 68130
C. SUBJECT PROPERTY LOCATION: Subject property is located in the Sugar Creek Neighborhood Center just southwest of 189th and Harrison Street.
D. LEGAL DESCRIPTION: Lot 1, Sugar Creek Neighborhood Center.
E. SUBJECT PROPERTY SIZE: approximately 1.91 acres
F. EXISTING FUTURE LAND USE AND ZONING DESIGNATIONS: Future Land Use Designation: Low to Medium Density Residential Zoning: BG (General Business District)
G. REQUESTED ACTION(S): To approve a Special Use Permit to allow for an outdoor play area, for use during
daytime hours, in conjunction with a dog daycare, boarding, and grooming facility in the BG Zoning District.
H. PURPOSE OF REQUEST: Pursuant to Sarpy County Zoning Regulations, Section 20.2.10 Veterinary clinics,
animal hospitals, and animal daycare with outdoor runs and boarding are required to get a Special Use Permit.
II. BACKGROUND INFORMATION
A. EXISTING CONDITION OF SITE: The site is currently unimproved but is developed with streets and infrastructure.

C. RELEVANT CASE INFORMATION: The BG district allows a variety of uses such as those in this commercial
development. The area currently has two childcare facilities, and a convenience storage facility. An animal care facility, that is not a Veterinary Clinic, is required to be licensed and
inspected by the Nebraska Department of Agriculture. A copy of their license will need to be filed with Sarpy County Planning Department for the permanent record.
D. APPLICABLE REGULATIONS: Sarpy County Zoning Regulations:
- Section 20 regarding the BG (General Business) District uses - Section 41 regarding Special Use Permits
III. ANALYSIS / STAFF COMMENTS
A. COMPREHENSIVE PLAN:
The Comprehensive Plan designates the area as Low to Medium Density Residential which allows for neighborhood commercial centers such as where this facility is located.
B. TRAFFIC AND ACCESS: Proposed access to the subject property is from Edna Street and a right-in right-out
from 189th Street.
C. OTHER AGENCY REVIEW/COMMENTS: The application was sent to area jurisdictional agencies or departments that may
have an interest. At the time of this staff report, no comments or objections to the application had been received.
D. PUBLIC NOTIFICATION AND COMMENTS: Notice of the public hearing for this application was published in area newspapers,
notification letters also were sent out to property owners within 300 feet of the subject property and the subject property was posted with a sign indicating a zoning action was pending on it.
E. GENERAL COMMENTS: The Operational Plan states that the facility will provide daycare, overnight
boarding, and grooming services. The applicant has provided additional information stating that they will be licensed for 100 to 150 dogs for daycare and 100 dogs for overnight boarding. Once they have been in business for a while, they expect a daily average of 60 dogs for daycare and/or boarding. Holidays may be a higher number. The Operational Plan indicates the hours of outside playtime will be Monday
through Friday 8 am to 6 pm and Saturday and Sunday 10 am to 5 pm. The proposed outdoor play area will be 25’ x 80’ and is adjacent to the north side
(rear) of the building. The outdoor play area will be constructed with a high quality turf installed 1 to 2
inches above grade to allow for airflow as well as drainage and cleaning. This type of carpet like turf assists with absorbing sound. The area will be enclosed with an 8-foot vinyl fence to serve as the enclosure as well as a noise barrier. Noise should never be an issue, as dogs will always be supervised when outdoors.
If they are barking or making too much noise, they will be brought inside to the indoor play area.
IV. PLANNING COMMISSION RECOMMENDATION
MOTION: SPECIAL USE PERMIT
V. STAFF RECOMMENDATION
Staff recommends APPROVAL of a Special Use Permit to allow a dog daycare facility with overnight boarding and outdoor play area in a General Business Zoning District located at 18920 Edna Street as specifically described in the Operational Plan and this staff report as it is in conformance with the Sarpy County Zoning Regulations. Staff makes this recommendation with the condition that the applicant provide the Sarpy County Planning & Building Department with a copy of their Boarding Kennel Facility License as issued by the State of Nebraska Department of Agriculture Bureau of Animal Industry.
