    STUDENT CODE OF CONDUCTStudentrightsandresponsibilities:studentconduct

    PURPOSE ThepurposeofpoliciesaboutstudentconductanddisciplinearetoprovideguidelinesfortheeducationalenvironmentofBrookhavenCollege.Thisenvironmentviewsstudentsinaholisticmanner,encouragingandinviting them to learn and grow independently. Such an environmentpresupposesbothrightsandresponsibilities.Freeinquiryandexpressionare essential parts of this freedom to learn, to grow, and to develop.However, thisenvironment alsodemands appropriateopportunities andconditionsintheclassroom,onthecampus,andinthelargercommunity.Studentsmustexercisethesefreedomswithresponsibility.

    DEFINITIONS Denitionstobeusedinthispolicyareasfollows:

    1. DesignatedadministratororDAshallmeananadministratorortheofcerorofcersdirectlyresponsibleforstudentaffairsatBrookhavenCollege.SeePolicyDNA.

    POLICY DNA: PERSONNEL POSITIONS: QUALIFICATIONS AND DUTIES TheDistrictdirectorofhumanresourcesisresponsibleforensuringtheaccuracyandcompletenessofalljobdescriptionsandisauthorized

    to promulgate procedures to evaluate current and new jobs. (Refer toCompensationGuidelinesforadditionalinformation.)

    CONTRACTUAL DUTIES In additiontosuchdutiesasmaybespecically describedintheemployees position description and employment agreement, eachcontractualemployeeshallalsohavethefollowingduties:

    FACULTY MEETINGS 1. FacultymeetingsareregardedasavitalDistrict-to-college,andcollege-to-college communication link. Attendance at such meetingsis mandatory. Faculty members are required to arrange personal andprofessional commitments so that attendance at such meetings ispossible.

    COMMITTEE ASSIGNMENTS

    2. Committeeworkis essentialtothe operationof an effectiveeducationalprogram. All faculty and administrative staffmembers areexpected to participate in assigned committees and to carry out thespecicpurposesforwhichthecommitteeswereestablished.Contributionsofinstructionalpersonnelthroughcommitteeactivitiesareconsideredtobeoneessentialaspectofthecontractualcommitment.

    COMMENCEMENT EXERCISES 3. Eachcollegeisresponsibleforsettingupdeadlinesandprocedureswhichwillinsurethatproperacademicregaliaissecuredforgraduationexercises.TheBrookhavenCollegePresidentordesigneewillcoordinatethecommencementexercises.

    EXTENDED-DAY ASSIGNMENTS 4. Membersof thefull-timefacultymay be required to serveintheeveningand/orweekendprogramasapartoftheirbasiccontractualduties.

    OFFICE HOURS 1. Afull-timefacultymembershallmaintainpostedofcehoursofnotlessthanvehoursperweek(ormoreifprescribedbytheCollegePresident)beingnormallynotlessthanonehourperday,MondaythroughFriday. Ofcehoursforstudentconferencesshallbescheduledattimesreasonablycalculatedtomaximizeavailabilityof thefacultymembertohisorherstudents.

    2. A student shall mean one who is currently enrolled atBrookhaven College. This includes credit, non-credit, and dual creditstudents,regardlessofmethodofdelivery.Thesepoliciesandregulationsshall also apply to any prospective or former student who has been

    acceptedforadmissionorreadmissiontoanycomponentinstitutionwheorsheisonthecampusofanycomponentinstitution.

    3. College-sponsoredactivitymeansanyactivityonoroffcamwhichisinitiated,aided,authorized,orsupervisedbythecollege. 4. AcollegeorinstitutionmeansBrookhavenCollege. 5. Collegepremisesmeansbuildingsorgroundsowned,leaoperated,controlled,orsupervisedbythecollege.

    6. Published college regulation or policy means standardconductorrequirementslocatedinthe: a. Collegecatalog. b. Board of Trustees policies and administrative procedmanual. c. Studenthandbook. d. Anyotherofcialpublication.

    RESPONSIBILITY Each studentshall be chargedwithnoticeand knowledgeofcontents and provisions of Brookhaven Colleges/DCCCDs poliprocedures,andregulationsconcerningstudentconduct.

    Allstudentsshallobeythelaw,showrespectforproperlyconstit

    authority, and observe correct standards of conduct. In additionactivitiesprohibitedbylaw(seepoliciesFLBA,et.seq.),thefollowingtypofbehaviorshallbeprohibited:

    1. Intentionallycausingphysicalharm to anyperson on colpremisesorat college-sponsoredactivities,orintentionallyorrecklecausingreasonableapprehensionofsuchharmorhazing.

    2. Unauthorized use, possession, or storage of any weaponcollegepremisesoratcollege-sponsoredactivities.

    3. Intentionally initiating or causing to be initiated any freport,warning,orthreatofre,explosion,orotheremergencyoncolpremisesoratcollege-sponsoredactivities. 4. Intentionallyinterferingwithnormalcollegeorcollege-sponsactivities,includingbuttolimitedto,studying,teaching,research,co

    administration,orre,security,oremergencyservices.

    5. Knowingly violating the terms of any disciplinary sancimposed in accordance with Brookhaven College/District poliregulationsandprocedures.

    6. Unauthorized distribution or possession for purposesdistributionofanycontrolledsubstanceorillegaldrugoncollegepremoratcollege-sponsoredactivities.

    7. Intentionallyormaliciouslyfurnishingfalseinformationtocollege.

    8. Sexualharassment.

    9. Forgery, unauthorized alteration, or unauthorized use of

    collegedocumentorinstrumentofidentication.

    10. Unauthorizeduseofcomputerhardwareofsoftware.

    11. Scholasticdishonestyshallconstituteaviolationoftheserandregulationsandispunishableasprescribedby BrookhavenCollDCCCDBoardofTrusteespolicies.Scholasticdishonestyshallincludenotbelimitedto,cheatingonatest,plagiarism,andcollusion. Cheatingonatestshallinclude: a. Copyingfromanotherstudentstestpaper. b. Using test materials not authorized by the peadministeringthetest. c. All forms of academic dishonesty, including cheatfabrication,facilitatingacademicdishonesty,plagiarism,andcollusio

    Plagiarismshallbedenedastheappropriating,buying,receivingasagift,orobtainingbyanymeansanothersworkandtheunacknowledgedsubmissionorincorporationofitinonesownwrittenwork.

    Collusion shall be dened as the unauthorized collaborationwithanotherpersoninpreparingwrittenworkforfulllmentofcourserequirements.

    12.Intentionally and substantially interfering with the freedomof expression of others on college premises or at college-sponsoredactivities.

    13. Theftofpropertyorofservicesoncollegepremisesoratcollege-sponsored activities; having possession of stolen property on collegepremisesoratcollege-sponsoredactivities.

    14. Intentionallydestroyingordamagingcollegepropertyorpropertyofothersoncollegepremisesoratcollege-sponsoredactivities.

    15.Failure to comply with the direction of Brookhaven Collegeofcials, including campus security/safety/police ofcers, acting inperformanceoftheirduties.

    16.Violation of published college regulations or policies. Such

    regulationsorpoliciesmayincludethoserelatingtoentryanduseofcollegefacilities,use ofvehiclesand mediaequipment,campusdemonstrations,misuseofidenticationcards,andsmoking.

    17. Useorpossessionofanycontrolledsubstanceorillegaldrugoncollegepremisesoratcollege-sponsoredactivities.

    18. Unauthorizedpresenceonoruseofcollegepremises.

    19. Nonpaymentorfailuretopayanydebtowedtothecollegewithintentto defraud.(AppropriatepersonnelatBrookhavenCollegemaybedesignatedbycollegeorDistrictofcialstonotifystudentsofdishonoredchecks, library nes, nonpayment of loans, and similar debts. Suchpersonnelmaytemporarilyblockadmissionorreadmissionofastudentuntilthematterisresolved.Ifthematterisnotsettledwithinareasonabletime,suchpersonnelshallreferthemattertotheDesignatedAdministrator

    forappropriateactionunderthiscode.Suchreferraldoesnotpreventorsuspendproceedingwithotherappropriatecivilorcriminalremediesbycollegepersonnel.)

    20. Useorpossessionofanalcoholicbeverageoncollegepremiseswiththeexceptionof: a. specic beverage-related courses within the El CentroCollegefoodserviceprogram,or b. ac oursethatrequirestheu seofalcoholandisapprovedby theTexas Commission on LawEnforcement OfcersStandardsandEducation.

    DISCIPLINE Any student violatingthis policy shallbe subject to disciplinsanctionsincludingsuspension,inaccordancewithFMbelow.

    A violation meansan act or omission which is contrarypublishedcollegeregulationorpolicy.

    Sanctionsforviolationsofprohibitedconductfor(1)through(6)resultinexpulsion;for(7)through(13)mayresultinsuspension;forthrough(20)mayresultinsanctionsotherthanexpulsionorsuspensi

    Repeatedoraggravatedviolationsofanyprovisionofthiscodealsoresultinexpulsionorsuspensionorintheimpositionofsuchlepenaltiesasareappropriate.

    Aggravated violationmeans a violation which resulted or foreseecouldhaveresultedinsignicantdamagetopersonsorpropertyorwotherwiseposedasubstantialthreattothestabilityandcontinuancnormalcollegeorcollege-sponsoredactivities.

    DISCIPLINE AND PENALTIES InterpretationofRegulations:Disciplinaryregulationsatthecolaresetforthinwritinginordertogivestudentsgeneralnoticeofprohibconduct.Theregulationsshouldbereadbroadlyandarenotdesignedenemisconductinexhaustiveterms.

    InherentAuthority:Thecollegereservestherighttotakenecesandappropriateactiontoprotectthesafetyandwell-beingofthecamcommunity.

    STUDENT PARTICIPATION Studentsareaskedtoassumepositionsofresponsibilityinthecollegejudicialsysteminorderthattheymightcontributetheirskillsandinsightsto the resolution of disciplinary cases. Final authority in disciplinarymatters,however,isvestedintheBrookhavenCollegeadministrationandintheDCCCDBoardofTrustees.

    STANDARDS OF DUE PROCESS Studentswho allegedly violate BrookhavenCollege/Districtpolicyare entitled to fair and equitable proceedings. The focusof inquiry indisciplinaryproceedingsshallbetheguiltorinnocenceofthoseaccusedofviolatingdisciplinary regulations. Formalrulesof evidenceshall notbeapplicable,norshalldeviationsfromprescribedproceduresnecessarilyinvalidate a decision or proceeding, unless signicant prejudice to astudentrespondentorthecollegemayresult.

    ACCOUNTABILITY Students maybeaccountable to both civilauthorities andtothecollegeforactsthatconstituteviolationsoflawandthiscode.Disciplinaryaction at the college shall normally proceed during the pendency ofcriminalproceedingsandshallnotbesubjecttochallengeonthegroundthatcriminalchargesinvolvingthesameincidenthavebeendismissedorreduced.StudentswhoparticipateinacollegecoursethroughtheR.JanLeCroyCenterforEducationalTelecommunicationsaresubjecttothecode

    ofstudentconductandareassignedacollegeforthatpurpose.

    DISCIPLINARY PROCEEDINGS INVESTIGATION,CONFERENCE AND COMPLAINT When the Brookhaven College Designated Administrator receivesinformation that a student has allegedly violated a published collegeregulationor policy, theDesignatedAdministratorshall investigatetheallegedviolation,whichmayincludeadiscussionwithastudent.Aftercompleting the preliminaryinvestigation, the Designated Administratormay:

    1. Dismiss the allegation as unfounded, either before or afterconferringwiththestudent;or

    2.Proceedadministratively,whichincludesasummons,conference,anddisposition.

    3.Uponappeal,prepareacomplaintbasedontheallegedviolationforuseindisciplinaryhearingsalongwithalistofwitnessesanddocumentaryevidencesupportingtheallegation. 4. The Designated Administrator will notify the individual wholedthecomplaintofthedispositionofthecomplaint.IftheDesignatedAdministrator dismisses the allegation, the individual may appeal, inwriting,tothePresidentofBrookhavenCollegewithinveworkingdaysafterdisposition. The Brookhaven College President or a designee may suspend astudentimmediatelyandwithoutpriornoticeforaninterimperiodpendingdisciplinary proceedings, when there is evidence that the continuedpresenceofthestudenton collegepremisesposesasubstantialthreattohimselforherself,toothers,ortothestabilityandcontinuanceofnormalcollegefunctions.Astudentwhoissuspendedonaninterimbasisshallbe

    givenanopportunitytoappearbeforethepresidentoradesigneewithinveworkingdaysfromtheeffectivedateoftheinterimsuspension.AhearingwiththePresidentshallbelimitedtothefollowingissuesonly:

    1. The reliability of the information concerning the studentsconduct,includingthematterofhisorheridentity;and

    2. Whethertheconductandsurroundingcircumstancesreasonablyindicatethatthestudentscontinuedpresenceoncollegepremisesposesasubstantialthreattohimselforherself,toothers,ortothestabilityandcontinuanceofnormalcollegefunctions.

    Afterthehearing,theBrookhavenCollegePresidentordesigneemodifytheinterimsuspensionasreasonabletoprotectthestudent,puandcollege.

    No person shall search a students personal possessions forpurposeofenforcingthiscodeunlessthestudentspriorpermissionbeenobtainedorunlessalawenforcementofcerconductsthesearchauthorizedbylaw.

    SUMMONS TheBrookhavenCollegeDesignatedAdministratorshallsummstudentregardinganallegedviolationofthiscodebysendingthestualetter.Thelettershallbesentbycertiedmail,returnreceiptrequesaddressedtothestudentathisorherlastknownaddressasitappeintherecordsoftheAdmissions/RegistrarsOfceorshallbedelivpersonallytothestudent.

    Thelettershalldirectastudenttoappearataspecictimeandpnot less than ve working days afterthe date ofthe letter, unlessstudentcanshowgoodcauseasprescribedbelow.Thelettershalldescbrieythe allegedviolationandcitethepublishedcollegeregulatiopolicywhichallegedlyhasbeenviolated.

    TheDesignatedAdministratorhas authorityto placea studen

    disciplinaryprobationifthestudentfails,withoutgoodcause,tocomwitha letter ofsummons, orto apply sanctionsagainst the studenprovidedinthiscode.

    DISPOSITION Ataconferencewithastudentinconnectionwithanallegedviolaofthiscode,theDesignatedAdministratorshallprovidethestudentwacopyofthiscodeanddiscussadministrativedispositionoftheallviolation. 1. If astudent acceptstheadministrative disposition,the stushallsigna statementthatheorsheunderstandsthecharges,hisorrighttoahearingortowaivesame,andthepenaltyorpenaltiesimpoandthatheorshewaivestherighttoappeal.Thestudentshallreturnsigned formby 5 p.m.of theday following administrative dispositFailuretoreturnthisform,waivesthestudentsrighttoappeal. 2. If a student refuses administrative disposition of the all

    violation, the student is entitled to a hearing as provided herein.DesignatedAdministratorshallnotethedateofrefusalinwritingandstudentshallacknowledgeinwritingsuchdate.

    3. Administrativedispositionmeans: a. The voluntary acceptance of the penalty or penaprovidedinthiscode. b. OtherappropriatepenaltiesadministeredbytheDesignAdministrator. c. Without recourse by the student to hearing procedprovidedherein.

    The Designated Administrator shall prepare an accurate, wrisummary of each administrative disposition and send a copy tostudent(and,ifthestudentisaminor,totheparentorguardianofstudent),tothedirectoroftheBrookhavenCollegePoliceDepartment

    thecomplainant,andtootherappropriateofcials.

    DISCIPLINE AND PENALTIES:DISCIPLINE HEARINGS PROCEDURE HEARING COMMITTEE WhenastudentrefusesadministrativedispositionofaviolationstudentisentitledtoahearingbeforethestudentdisciplinecommiThe hearing request must be made to the President of BrookhaCollegeinwriting,onorbeforethesixthworkingdayafterthedatrefusal of administrative disposition.The committee shallbe compofequalnumbersofstudents,administrators,andfacultyofthecollThecommitteeanditschairshallbeappointedbythePresidentforehearingonarotatingbasisoronthebasisofavailability.Thecommitchairwillbeselectedfromtheadministrationorfaculty.

    Thechairman of thecommittee shallruleonthe admissibilityofevidence, motions, and objectionsto procedure, buta majority of thecommitteemembersmayoverridethechairmansruling.Allmembersofthecommitteeareexpectedtoattendallmeetingsandareeligibletovoteinthehearing.

    Thechairmanshallsetthedate,time,andplaceforthehearingandmaysummonwitnessesandrequiretheproductionofdocumentaryandotherevidence.

    The Designated Administrator shall represent the college beforethe student discipline committee and present evidence to support anyallegationsofviolations.

    NOTICE Thecommitteechairmanshallnotifythestudentofthedate,time,andplaceforthehearingbysendingthestudentaletterbycertiedmail,return receipt requested,addressedto thestudent at hisor heraddressappearing in the Admissions/Registrars Ofce records. The letter shallspecifyahearingdatenotlessthanvenormorethan10workingdaysafterdateoftheletter.Ifastudentisunder18yearsofage,acopyofthelettershallbesenttotheparentsorguardianofthestudent.

    Thechairmanmayforgoodcausepostponethehearingsolongasall

    interestedpartiesarenotiedofthenewhearingdate,time,andplace.

    CONTENT OF NOTICE Thenoticeshalladvisethestudentofthefollowingrights:

    1. Toaprivatehearingorapublichearing(asheorshechooses).

    2. Toappearaloneorwith legalcounselifthealleged violationsubjectsthestudenttoexpulsionorsuspension.Theroleoflegalcounselislimitedasprovidedinthecode.

    3. Tohaveaparentorlegalguardianpresentatthehearing.

    4. Toknowtheidentityofeachwitnesswhowilltestify.

    5. Tocausethecommitteetosummonwitnesses,andtorequirethe

    productionofdocumentaryandotherevidencepossessedbythecollege.

    6. Tocross-examineeachwitnesswhotesties.

    FAILURE TO COMPLY WITH NOTICE Astudentwhofailstoappearafterpropernoticeandwithoutgoodcause will be deemed to have pleaded guilty to the violation pendingagainstthestudent.Thecommitteeshallimposeappropriatepenaltyandnotifythestudentinthesamemannerasthenoticeofhearing.

    ROLE OF LEGAL COUNSEL Legalcounselwhorepresentsastudentinahearingwheretheallegedviolation subjects the student to expulsion or suspension is limited toadvisingandassistingthestudent.Thislimitationmeansthatlegalcounselshall not cross-examine witnesses, make objections,testify, or performothersimilarfunctionsgenerallyassociatedwithlegalrepresentation.The
