Morgan, P.A. recently represented an individual, who was involved in a modest automobile accident, after which, the client underwent a surgical procedure. Both the insurance companies involved originally argued that the surgery was not related to the automobile accident and neither wanted to pay our client for the procedure. e initial disclosed insurance limits were $10,000.00 in liability coverage from the person who caused the accident, and $100,000.00 in underinsured motorist coverage available from our client’s insurance policy. When the full claim for payment was presented for our client, the insurance company of the person who caused the accident offered the $10,000.00 policy limit, and our client’s insurance company offered $42,000.00 from a claimed $100,000.00 underinsured motorist policy limit. e Law Offices of Justin G. Morgan, P.A. thoroughly reviewed all the case issues and discovered that our client’s insurance company had not accurately disclosed that the underinsured motorist policy should actually provide $200,000.00 in coverage. Upon learning of the inaccurate disclosure, the firm, on behalf of our client, filed a complaint against the insurance company with the State of Florida. In order to avoid a lawsuit, our client’s insurance company immediately agreed to pay the $200,000.00 underinsured motorist policy limit. Attention to detail is an integral part of the legal process. The Law Offices of Justin G. Morgan, P.A. recently represented an individual, who was involved in a modest automobile accident, after which, the client underwent a surgical procedure. Both the insurance companies involved originally argued that the surgery was not related to the automobile accident and neither wanted to pay our client for the procedure. The initial disclosed insurance limits were $10,000.00 in liability coverage from the person who caused the accident, and $100,000.00 in underinsured motorist coverage available from our client’s insurance policy.

When the full claim for payment was presented for our client, the insurance company of the person who caused the accident offered the $10,000.00 policy limit, and our client’s insurance company offered $42,000.00 from a claimed $100,000.00 underinsured motorist policy limit. The Law Offices of Justin G. Morgan, P.A. thoroughly reviewed all the case issues and discovered that our client’s insurance company had not accurately disclosed that the underinsured motorist policy should actually provide $200,000.00 in coverage. The auto insurance policy required by Florida law does NOTHING for your pain and suffering if you are severely injured in an accident and does not fully protect you in case of someone else’s negligence. Florida drivers, who cause an auto accident, are not required to purchase the insurance which pays for the medical expenses, lost wages, or pain and suffering to the individuals that they have injured. Florida law only requires $10,000 Personal Injury Protection (PIP) and $10,000 Property Damage (PD). PIP pays only 80% of your medical bills and 60% of your lost wages up to $10,000, minus any deductible you have.

According to a recent study by the Insurance Research Council on the number of uninsured motorists, Florida ranks eight highest among states, with an uninsured driver rate of over twenty percent. The result is that Florida drivers are at risk every time they operate an automobile that they will be involved in an accident caused by an individual who does not have adequate insurance coverage available to settle a claim nor sufficient personal assets to satisfy a judgment.
