The IPR of any customization done on the application/ new application (Portal) / code etc. will also be owned by the State CET Cell.

As per our discussion with reference

to the response to TCS queries from

Maharashtra State Cell CET,

regarding IPR/source code

ownership (points mentioned

below), we would like to convey that

the iON Digital Assessment Platform

Solution is a TCS owned product and

hence the source code/ solution

software rights cannot be handed

over to customer. This includes the

registration / application forms

customized for the customer as well.

We will be handing over the data for

the end to end assessment along

with any biometric, cctv etc. data

from conducting the exams.

The State CET Cell will not require the IPR for the examination software from TCS if the TCS will configure the forms or system to meet all the requirements of the State CET Cell within their solution without any new code being written or customization being done. If the IPR of the solution is not with TCS, the source code and IPR and other documents specified in the RFP will be shared by TCS with the State CET Cell. Also, as a requirement of the State CET Cell, to deal with RTI and Court Cases, which can come up even after 10 years or more after the contract period is over, the bidder will be required to retain the data including timestamp, IP address and audit trails as specified in the RFP. All the data related to examination lifecycle including candidate registration, photograph, signature, grievances, results etc. will have to be provided by the bidder to State CET Cell in an accessible format which will be decided in consultation with the State CET Cell.

System Study Conduct System Study, Gap Analysis and BPR required. Preparation of SRS, System Design Document (SDD) and its finalizations, State CET Cell’s Sign off on the Software Requirement. Submit the SRS (Software Requirement Specification) document to the State CET Cell for signoff.

not applicable in our case.
