Project proponent has provided Sewage Treatment Plant for treatment which is located about 60 mtr from HFL of River Indrayani. As per consent to establish condition STP location shall be beyond 100 mtr from HFL.

In view of above we may issue SCN for refusal of consent to establish as PP has installed STP at 60 meters from HFL and not complied c to E condition.

Resubmission 

• The  application  for  consent  to  establish  was  discussed  in  CC  meeting  held  on 13/03/2014, during discussion  it was decided to  issue SCN  for refusal of consent to operate as applicant has failed to comply with the consent to establish condition no 15 i.e location of STP more than 100 mtrs from Indrayani River. 

•  Applicant  has  submitted  reply  on  22/04/2014  in  reply  applicant  stated  that  “Our project boundary is 155 m from the Indrayani River and location of STP is 275 m from the  same  which  is  certified  by  our  architect.”  Applicant  has  submitted  architect certificate along with letter.

• As applicant has submitted architect certificate, we may consider part operate with BG and part operate affidavit.

Construction Status

SRO reported that, During the visit, it was observed that the construction work of residential complex was found completed and more than 80% occupancy were observed.

The construction work of commercial building (phase –II) was found under construction. The construction work upto fifth floor completed. The construction work of upper floor is going on.

The case was discussed in CC Dated 13/3/2014 and it was decided to issue SCN for refusal of consent to 1st operate ,as PP has not submitted BUA of part operate and C to E & EC is expired.

SCN issued on 26/3/2014 and PP has submitted reply of SCN which is received in HQ Dated 19/4/2014. In which applicant has submitted architect certificate mentioning constriction area of Commercial Bldg No.1 is approx.2,34,094 Sq.Mtrs.

Now industry has applied for consent to establish for change in product mix by rearranging existing acetic acid quantity for MPO, Perfumery Material Base and Ammonium Sulphate (Salt). Cooling tower effluent increase by 10 CMD. However, process waste water quantity, Air emissions, Hazardous waste will remain same. DG set of 500 KVA will be added to take care of power failures in emergency only. Industry has submitted BG of Rs. 5 lacs towards O & M of PCS, valid up to 30.06.18 as per existing consent condition. The CI of the factory as per last consent is Rs. 30.43 crore. Additional investment of Rs. 29.3 crore towards replacement of old equipment, infrastructure developments, up-gradation of pollution control facilities etc. Industry has also submitted that old turbine will replace with advanced technology steam turbines so as to achieve 0.6 MW to 0.75 MW as mentioned in covering letter. Industry has paid necessary fees towards consent to establish for above additional investment. Industry has submitted Performa for assessment/computation of pollution load before & after the proposed change in product mix in prescribed format. Also industry has submitted No increase in Pollution load certificate from ICT Mumbai dtd. 14.03.2014.

• During visit, construction of approx 45,000 sq.meters ( Built up area) is completed and remaining construction work will be completed in two months. ,

• STP of capacity 650 CMD completed.

• Provided rainwater harvesting, vermin composting for treatment of solid waste.

• Query letter was issued by SRO Thane-II MPC Board on 18.2.2014 for

want of additional information and clarification wrt Survey Nos as there is change in S.No shown in EC and Consent to establish granted and S.No shown in consent to operate application.

• The reply is submitted by project ( M/s. HDIL) proponent on 21.3.2014 stating that, they have applied for part consent and by oversight S.No. 217 and 226 are shown in consent application and requested to delete these two S.Nos.

• M/s. Housing Development and Infrastructure Ltd., has also stated in

their reply dated: 21/03/2014, that as per the judgment of Hon’ble Delhi High Court in LPA No. 895 of 2010, Section 25 and 33A of the Water Act and Section 21 and 31A of the Air act are not applicable to the building housing residential apartment/units as there is no trade effluent discharge from such type of activities and requested to give suggestion regarding applicability of the judgment.

As reported by SRO Thane –II , as per

consent conditions, project proponent has submitted the Bank Guarantee of Rs. 5 Lakhs vide BG no: 550 LG 0534/12 dated: 16/11/2012 which was valid up to 06/11/2013. The Regional Officer has instructed vide letter dated: 20/11/2013 to submit revalidated Bank Guarantee , However the same is not yet submitted
