Agenda Item No.1 Confirmation of the minutes of 130TH meeting of Executive Committee held on 24th February, 2006 at New Delhi.

It was noted that the minutes of 130th meeting of Executive Committee held on 24th February, 2006 at New Delhi were placed before the CCIM in its meeting held on 25.2.2006, the minutes were considered and were ratified by the Central Council.

The Executive Committee confirmed the same.

Agenda Item No.2 To enhance the amount of Retainership of Shri SK Sharma, Advocate, Retainer of the Central Council of Indian Medicine.

It was noted that in pursuance of decision of the 130th meeting of EC held on 24.2.2006. A letter No.12-7/2003-Estt. Dated 6.3.2006 was issued to Shri SK Sharma, Advocate Retainer of the CCIM informing that the Executive Committee did not agree to enhance the amount of retainer ship fee but agreed to extend the period for further one year.

In response of the above mentioned letter Shri SK Sharma, Retainer of the Council vide his letter dated 19.4.2006 has stated that he is grateful to the Council for extending the tenure of the Retainership for another one year. However, it is submitted that Retainership fee be increased by atleast Rs.2,000/- per month alongwith into the overall circumstances and in view of the facts that in all cases before the Minority Commission for Minority Education and Institution he is also defending the Government of India and is not charging any fee of defending the Government of India therefore, the matter regarding the said minor increase in retainership may be reconsidered by the Executive Committee of the CCIM.

Executive Committee considered the matter and decided to enhance Rs.1000/- per month i.e. from Rs.12000/- to Rs. 13,000/-per month.

Agenda Item No.3 Creation of post of inspector in CCIM .

It was noted that a meeting was held on 7.10.2005 regarding enforcement of PG Regulations and functioning of CCIM under the Chairmanship of Joint Secretary AYUSH. In this regard, it is submitted that Government of India has asked to send a fresh proposal for creation of posts of Inspector as per Section 19 of the IMCC Act, 1970. The relevant portion of the minutes reads as under:-

“The Section 19 of the IMCC Act, 1970 prescribes for appointment of Inspectors, a resolution of the Council not to have Inspectors’ is not as per the Act. Therefore for the sake of objective evaluation of infrastructure of college, the Secretary, CCIM was asked to send a fresh proposal for creation/revival of posts of Inspectors. It was also opined that Inspectors may be appointed on deputation or tenure basis from teachers having MD qualification and 10 years teaching experience of Reader/Assistant Professor level should be posted as CCIM Inspector (on deputation)”

In this regard, it was noted that Auditors of Internal Audit of the Ministry of health & Family Welfare in their Inspection Report for the year 2003-04 (Internal Audit) in audit para (No. 8) has rais objection about the non-appointment of Inspectors at Examination (old para 8 of 95 & 96 4 of 96-97, 98-99, 2 of 99-2000).

A meeting of CCIM office bearers with Secretary (AYUSH) was held on 11.7.2005 regarding Amendment in CCIM’s notified Regulations for opening of new colleges, starting new or higher courses and increases in admission capacity-submission of draft notification by CCIM in which under para 6(iv) the Ministry has directed to send a fresh proposal to sanction the post of Inspectors in CCIM.

In this connection, it was further noted that a proposal for creation of posts of inspectons was submitted to Government of India, Ministry of Health & Family Welfare vide office letter No.12-1/96-Estt. Dated 13.2.2001 in reference to the same, the Government of India vide their letter No.V.27016/14/99-Ay. Desk dated 18.12.2001 had asked that CCIM should mobilize resources to meet expenditure on appointment of Inspectors. The matter was placed before the 32nd meeting of CCIM held on 15.3.2002 under Agenda Item No.6 in which the Central Council revised the recognition fee to be charged from ISM colleges but did not agree to create the post of Inspectors in the Central Council.

Central Council in its 38th meeting held on 25.2.2006 while ratifying the minutes of Executive Committee decided to put before the next meeting of Executive Committee.

Since there are 222 colleges of Ayurveda, 37 colleges of Unani and 07 college of Siddha so if regular Inspectors are appointed then there will be need of atleast 7+2+1=10 Inspectors. The annual expenditure on an inspector may be about Rs. 5 lakhs per person so there will be a burden of Rs. 50 lakhs per annum approx. to the Council on this account. The work on inspection and visitation is of similar nature and members of the Council are doing this work effectively. Therefore, the Executive Committee is of the opinion that there is no need of appointment of separate Inspectors presently.

Agenda Item No.4 Consideration of visitation reports of Ayurved Colleges alongwith the recommendations of Education Committee (Ayurved).

It was noted that following Ayurved/Unani/Siddha colleges were visited to assess the available facilities of teaching and practical training and to verify the compliance. As per decision of the Central Council of Indian Medicine, the visitation reports of Colleges were placed before the Education Committee (Ayurved)/Unani/Siddha.

In this regard, it was also noted that the meeting of Education Committee Ayurved/Unani/Siddha were held on 27.6.2006. The Visitation Report of Ayurved/Unani/Siddha alongwith recommendations of Education Committees Ayurved/Unani/Siddha on visitation reports of Ayurved/Unani/Siddha colleges were placed before the Executive Committee. The Executive Committee approved the same with some modification.

Dr. MA Kumar, Member, CCIM observed that the matter of granting permission by CCIM is not necessary as the Govt. of India is final authority after 07.11.2003 for the same because amendment have been enforced from 07.11.2003. The Executive Committee did not agree to this as 13 C will be effective from 07.11.2006. _________________________________________________________________ Name of the College Recommendations

3. Rajkiya Lalit Hari Ayurved College Considering less available facilities of teaching Pilibhit and practical training in the Institution, Committee

did not agree to grant permission to admit students in Ayurvedacharya Course for the year 2006-2007.

The Committee decided that the President, CCIM alongwith a delegation may meet with the authorities of the Government of Uttar Pradesh to remove the shortcomings in respect of this colleges and also other four Government colleges in UP. Thereafter only, if agreed admission to these colleges be considered.

Committee decided to grant permission to admit 50students in Ayurvedacharya Course for the year 2006-2007.

The college be asked to construct its own building at earliest and fulfill the other shortcomings and submit the compliance by 30th November, 2006.

11. Ayurved Medical College, Davangere Considering available facilities of teaching and practical training in the Institution, Committee decided to grant permission to admit 50 students in Ayurvedacharya Course and in PG in Kayachikitsa 05 and Shalya 05 students for the year 2006-2007.

The college be asked to fulfill the shortcomings and submit the compliance by 30th November, 2006.

Ayurved treatment are not given to mostly patients.

(iii) Departments have not been bifurcated so far. (iv) Many specialties are running under one

medicine for each subject has been kept which is not as per norms of CCIM.

Paprola (i) There are only 82 beds.(ii) Ayurved Hospital of the State Government has

been attached to this College. There is no own hospital of the college.

(iii) The administrative control of the hospital is not with Principal of the college.

(iv) Two more hospitals are attached with the college which are approximately 42-43 Km. away from the college.

(v) Herbal garden is at Jogendernagar which is 15 Km. away from the college.

(vi) Sanskrit teacher has made as HOD of Sanskrit, Samhita and Siddhant Department.

(vii) Condition of the Laboratories is also not good.(viii) AMO are teaching PG students.(ix) The students were re-examined without any rules

and were promoted on their choice.(x) Examination of Third Professional are being

conducted after completing only teaching of 12 months instead of 18 months which is the violation of Regulations of CCIM.

Considering less available facilities of teaching and practical training in the Institution, Committee did not agree to grant the permission to admit studentsin Ayurvedacharya Course and PG also not permittedfor the year 2006-2007 till shortcomings are removed..

110. Shri Balahanuman Ayurvedic College, The Committee observed that Lodhra (i) The post of Demonstration is still existing.

(ii) There is no proper sitting arrangement for the teaching staff.

(iii) Condition of Laboratories is not satisfactory. (iv) Working condition of the Hospitals is not good. (v) Teaching staff is less.

Therefore considering the availability of facilities of teaching and practical training in the Institution as per CCIM norms, Committee did not agree to grant the permission to admit students in Ayurvedacharya Course for the year 2006-2007.

113. Shri Krishna Govt. Ayurved College, Committee observed that Kurukshetra (i) Post of Demonstrator are still existing.

(ii) College building is being used for the purpose of Drug Store and PHC also.

(iii) Teaching staff is very less.(iv) State Government is not following the instructions

of the Central Council.(v) Govt. of Haryana has submitted a affidavit by

stating that CCIM is only advisory body there is no binding on Govt. of Haryana to follow the norms of CCIM.

Considering less available facilities of teaching and practical training in the Institution, Committee did not agree to grant permission to admit students in Ayurvedacharya Course for the year 2006-2007 till shortcomings are moved.

Dr. VV Chhikara submitted his note of dissent against the decision of the Education Committee.

Executive Committee Noted the following shortcomings :-1.There is shortage of teaching staff. It be made up as prescribed in Post-graduate Education Regulations 1988 of Central Council of Indian Medicine and NIUM Karnataka Project Report 1997-98, henceforth called Project Report. Qualifications prescribed for Post-graduate teachers in the said Regulations be strictly followed.

2.Existing Pathology-Biochemistry Lab. be fully equipped for Post-graduate training.

3.All Laboratories prescribed in the Project Report be established soon.

4.There is no Radio diagnosis unit. It be provided immediately with X-Ray, Ultrasound, C.T.Scan, MRI system etc.

7.Minor Operation Theatre be provided. Operation Table, OT Ceiling light, pedestal light, Electro surgical unit, suction, Anaesthesis equipmen and Resucitation kit.

8.Non teaching staff is less than the prescribed one.

RECOM MENDATION:-

There are only four Rajiv Gandhi University of Health Sciences recognized Post-graduate teachers, 2 for Ilmul Advia. One of them is Director who is an extremely busy person, one for Moaliljat and one for Hifzan-e-Sehat. They can be hardly expected to do justice to28 students(2004 -2005 Batch) as their guide. There is no body to guide 7 of them, who are student of Amraz-e-Niswan, Evident consequence as such will be turn out of sub standard ,Post-graduates, NIUM is expected to be Model Post-graduate institution. The matter calls for a very serious consideration. NIUM admitted 28 students in the academic year 2004-2005 as 15 in 2005-2006, without required facilities. For the year 2006-2007 NIUM should admit students only when it can provide them proper facilities for teaching, practical teaching and research.

Executive Committee agreed to send the same with Visitation Report to the Govt. of India.

It was also noted that the visitation report of Velumailu Siddha Medical College, Sriperumbudur, Kancheepuram has not been received so far. It was decided to place the same before next Executive Committee. It was also decided the visitation of Govt. Siddha Medical College, Chennai and Pallayam kottai also be carried out for the session 2006-07.

The Executive Committee decided to instruct all colleges of Ayurved/Unani/Siddha that payment of salary etc. of teaching and non teaching staff should be only through Bank.

Agenda Item No. 7 Ratification of action taken by President, CCIM

It was noted that as per provision of CCIM General Regulations, 1996 the annual accounts of the Central Council duly approved by President/CCIM have been sent to Comptroller of Auditor General of India, New Delhi vide this office letter No.10-13/2006-Accts. Dated 12.6.2006.

The Executive Committee ratified the same with the decision that Accounts should be sent to DGCAR with the approval of Executive Committee in future.

Agenda Item No.8 Provision of funds under non plan on yearly basis for meeting pensionery liabilities in respect of employees of autonomous bodies

namely Central Council for Research in Ayurveda & Siddha, Central Council for Research in Unani Medicine, National Institute of Homoeopathy, National Institute of Ayurveda, Central Council of Indian Medicine and Central Council of Homoeopathy.

It was noted that Ministry of Health & Family Welfare vide their letter No.V.27031/36-99/HL dated 27th

May,2004 stated that the Department has taken up with the Ministry of Finance the proposal for Provision of funds under Non-Plan on yearly basis for meeting pensionery liabilities in respect of employees of autonomous bodies namely CCRUM, NIH, NIA, CCRAS, CCH, CCIM and CCRH and the decision of the Ministry of Finance, Department of Expenditure in the matter is reproduced below for information and necessary action:-

“The proposal for regularization of pension scheme on GOI pattern in these autonomous bodies is agreed to as a special case. However, while regularizing the existing pension scheme, it would be expedient to make it clear to the Management/Governing Body of these autonomous institutions that all such employees who have joined the autonomous body on or after 01.01.2004, will be compulsorily governed by new pension scheme which has already been extended to the employees of autonomous bodies.”

It has also been informed that in case any of the above organizations has generated/are generating Pension fund/corpus fund, it must first exhaust the fund before seeking the funds in ensuing budgets.

In this regard, it is submitted that Central Council of Indian Medicine is generating pension fund contributing amount from recognition fee being charged from Ayurved, Unani and Siddha Colleges as recognition fee every year according to decision of Finance/Executive Committee subsequently ratified by CCIM.

Now, as per contents of the above letter of Govt. of India, the corpus fund is to be exhausted and provision is to be made for seeking funds.

Agenda Item No.9 Upgradation of the post of Accountant in the CCIM from the scale of

It was noted that in pursuance of the decision of 120th meeting Executive Committee held on 23.3.2004 the proposal of upgradation of the post of Accountant in the CCIM from the scale of Rs.5500-175-9000 to Rs.6500-200-10500 was submitted to the Government of India, Ministry of Health & Family Welfare, Deptt. of AYUSH vide this office letter No.1-27/04 dated 19.3.2005

In response of the same Government of India, Ministry of Health & Family Welfare, Deptt. of AYUSH vide this letter No.V.27016/24/2004-Ay.Desk dated 25/4/06 stated that the proposal of the Council has been taken up with the Internal Finance Division of the Ministry and that no merit has been found in the recommendation for up gradation of the post of Accountant to Rs.6500-200-10500/-.

Further, on examination of the existing Recruitment Rules, it has been observed that for the post of Accountant in the CCIM in the scale of pay of Rs.5500-9000/-, for grant of promotion to the post, has provided as follows:-

“UDC in the scale of pay of Rs.4000-6000/- with eight years of regular service in the grade OR LDC in the scale of pay of Rs.3050-4590/- with twelve year regular service in the grade with at least three years working experience in Accounts.”

But as per the DOPT guidelines, indicated in their OM No.AB-14017/2/97-Estt.(RR) dated 25.5.98 (copy enclosed), eligibility for grant of promotion to a post in the scale of pay of Rs.5500-9000/-, is service of 10 years on a post in the scale of pay of Rs.4000-6000/- and 18 years of service on a post in the scale of pay of Rs.3050-4590/-.

The existing Recruitment Rules for the post of Accountant and appointment made on the basis of these Recruitment Rules, are defective to the extent indicated above and needs to be received, immediately.

In this connection, the Recruitment Rules for the post of Accountant have been amended in view of the DOPT Guidelines received alongwith above mentioned letter of the Government. A copy of the same be seen at Annexure – A for consideration. The Executive Committee may kindly consider and approve the Recruitment Rules to be send to Government of India, Ministry of Health & Family Welfare, Deptt. of AYUSH, New Delhi.Executive Committee approved the Recruitment Rule prepared by office to send to Govt. of India for sanction.

Addl. Agenda Item No.1. Ratification of action taken by President, CCIM regarding Acharya Gyan Ayurved Mahavidyalaya, Indore.

It was noted that on receipt of several complaint and as per directions of President, CCIM Acharya Gyan Aired College, Indore was visited by the visitors of the Central Council of Indian Medicine on 25.3.2006. The visitation report of the same will be placed before the Committee at the time of consideration of agenda item.

In this regard, it is also noted that after going through the visitation report and complaint etc. the President decided to write a letter to Government of Madhya Pradesh to transfer the student in other college where facilities of teaching and practical training are available.

It is also submitted that a complaint regarding land and construction has been received in the office. Copy of the same may be seen at Annexure-I.

Executive Committee ratified the action taken by the President,CCIM.

Addl. Agenda Item No.2. Ratification of Action taken by President, CCIM regarding Government Ayurved College & Hospital, Burhanpur.

It was noted that it was brought to the notice of the Central Council through various complaints that there are not sufficient facilities of teaching and practical training including teaching staff. The comments of the Principal, Government Ayurved College & Hospital Burhanpur on the compliance were asked. The Principal also consented that there is only 4-5 teaching staff.

In view of the above, President decided to write a letter to Government of Madhya Pradesh Director and University to transfer the students to other colleges.

In this regard it is also submitted that Principal has also submitted the compliance report the same may kindly be seen at Annexure-II.

Executive Committee ratified the action taken by the President,CCIM.

Addl. Agenda Item No.3. Charging fees from Ayurved/Unani/Siddha college who have not permitted by CCIM for last five years.

It was noted that the matter for charging fee from Ayurved/Unani/Siddha college who have not been permitted by CCIM for last five years was placed before Executive Committee at its 120th meeting held on 23.3.2004 and It was decided that since above colleges have not been permitted by CCIM, balance of fees be not charge if it is ensured that there is not any student of batch permitted by CCIM.

Office wrote a letter to the colleges to ensure the position but with no response has been received so far.

Government Ayurved College, Atarra, and Government Ayurved College, Handia, Allahabad have sent the DDs to clear the balance of fees.

It is further submitted that both these colleges have been visited by CCIM on 6.6.2006 & 07.06.2006 respectively.

It is also submitted that Ayurved College, Bareilly, Pilibhit and Jhansi have been visited recently.

Executive Committee may consider whether balance of fees given by these colleges may not be accepted as per previous decision or be accepted considering the visitation of the college.

Executive Committee agreed to accept the fee sent by the Govt. of Ayurved Colleges of Uttar Pradesh.

By visitors of Central Council of Indian Medicine the matter may be Reconsidered. i) Consent of Affiliation as per proforma ii) Inspection report of the University iii) No objection certificate of the State Government as per proforma.

The Executive Committee decided to place the shortcomings in respect of some colleges pointed by Govt. of India before the Executive Committee in next meeting.

In this regard Dr. J.P. Narayan moved a resolution seconded by Dr. M.S. Gupta, Vaidya Raghunandan Sharma, Dr. P.K. Jain and Dr. Shivanandam reads as under:-

Reconsideration of permission to deserving Ayurveda,Unani & Siddha Medical College.

It is pointed out in this connection that some deserving institutions which have fulfilled all relevant requirements for starting the colleges are not permitted, even through they have spent many crores of rupees.

Looking at the shortcomings pointed out of the Ayurveda Colleges, inspite of fulfilling all the requirements these colleges are not permitted an certain ground bases in small remediable points for example.

1. Atreya Ayurvedic Medical College, Doddaballapura Taluka, Bangalore.2. Harekrishna Ayurveda Medical College, Bhopal.

Visitors of CCIM and of Govt. of India deputed for the purpose have confirmed that these institutions have the required infrastructure for starting the colleges. But permission has not been granted to them.

It is pointed out that these institutions have spent crores of rupees for the purpose and have paid the fees of CCIM. The shortcomings pointed out by Govt. of India are small and remediable in a short time.

Hence the Govt. of India be requested to take a sympathetic view and reconsider to permit them to start from the year 2006-07.

Addl. Agenda Item No.5 Proposal received from Government of India as per Section 13 A of IMCC Act, 1970.

It is submitted that approximately 51 proposals (46 Ayurved, 4 Unani and 1 Siddha) regarding to establish an Ayurved/Unani/Siddha college starting PG Course or increase intake capacity have been received through Government of India upto 31st May 2006 under Section 13 A of IMCC Act 1970 for recommendation. These are under the scrutiny and shortcomings are being intimate to the Society for fulfillment by 15th July, 2006.

Executive Committee decided that all new proposals be placed before the Executive Committee in next meeting.

Further, it was also decided that as recommendation of Central Council as required under Section 13A on the proposal received through Govt. of India are to be sent by 31st August 2006 after approving the recommendation of Executive Committee therefore meeting of Central Council be decided in the next meeting.

Addl. Agenda Item No.6 Consideration of permission of the Ayurved/Unani/Siddha colleges not proposed/visited for the year 2006-07.

It is submitted that only 108 Ayurved and 24 Unani and 05 Siddha Colleges were proposed for visitation. The permission for 2006-07 to remaining Ayurved/Unani/Siddha colleges (except permitted by Government of India) may be extended for the year 2006-07 for the intake capacity as per previous years.

The Executive Committee decided to extend permission to all Ayurved, Unani,and Siddha colleges not proposed for visitation during the year 2006-07 except to the college proposed or under process of visitation.

Addl. Agenda Item No.7 Acceptance of recognition of fee of NIUM Bangalore.

It is submitted that National Institute of Unani Medicine, Bangalore has submitted Rs. 20,000/- recognition fee for four Post-graduate subjects.

In this regard it is submitted that Government of India permitted the National Institute of Unani Medicine, Bangalore to conduct PG Course in following specialities :-

The Executive Committee agreed to accept the fee remitted by NIUM, Bangalore

Addl. Agenda Item No.8 To procure the services of Computer Operator on contract/out- sources basis in CCIM office-regarding.

It is submitted that the work of the office of the Council has been increasing at many folds. The work of Computer typing is increasing day by day. After amendment of IMCC Act, 1970 more than 50 proposals are received every year for establishing new Ayurved/Unani/Siddha colleges to increase in take capacity and to start Higher Course of study. These proposals are to be screened and visitation are to be carried out. Due to increase of typing work, the work of typing is not completed by the existing Computer Operator. Therefore, it is necessary to procure the services of Computer Operator having sufficient knowledge and good speed of Hindi and English may be procured on contract/out-sources basis for three months.

The Executive Committee agreed to the same.

Addl. Agenda Item No.9. Increase in per appearance charges for conducting Court Cases.

It was noted that Shri S.K. Sharma, Advocate, Retainer of the Central Council of Indian Medicine vide his letter dated 30.5.06 stated that “this Council started paying the undersigned @ Rs. 1100/- per appearance w.e.f. March, 2003 (instead of paying lump sum fee as was being given earlier). Since more than last three years, the same rate is continuing and no revision in the same has been done though even the Government rates for per appearance are around Rs. 3300/- per appearance for High Court cases, and the misc. costs and expenses have gone up manifold.

It is further submitted that he has requested to kindly increase his per appearance fees for High Court and Minority Commission cases and fix the same @ Rs. 2200/- per appearance for which he shall be grateful to Council.

The Executive Committee agreed to enhance the appearance of retainer of the Council from Rs. 1100/- to 1500/- per appearance.

Addl. Agenda Item No.10. Investment of amount kept in Reserve Fund of the CCIM

It was noted that in pursuance of decision of Finance Committee at its meeting held on 23.8.05 80% of amount of application fees received for starting of new colleges, application fee for starting of new Post-graduate subject and application fee for increasing admission capacity in existing colleges has been kept in Reserve Fund in Saving Bank Account with State Bank of India.
