Standard for Professional Service Provider Performance Reports for

professional services in engineering and construction works

1 Scope

This standard for professional service provider (PSP) performance reports provides for a uniform and

consistent method of assessment of the performance of a PSP with respect to the following

performance criteria:

time management;

management of resources;

co-operative relations; and

standard of service.

Subject to sufficient PSP performance reports being available, PSP performance reports can be used,

amongst others, for the purpose of managing procurement risks through:

assessing the suitability of PSP for pre-qualification, selective tender lists or expressions of interest;

and

adjudication for the award of a contract.

PSP performance reports also allow for the PSP to benchmark its performance against national norms

– thus encouraging performance improvement.

This standard sets out:

the process and responsibilities by which the PSP performance report is to be completed; and

the information required.

The standard is applicable to PSPs that will carry out professional services on construction and

building projects within the following Professional Service Disciplines:

2 Terms and Definitions

For the purposes of this document, the following terms and definitions apply:

client: “client” means a person, body or organ of state who enters into a contract to procure

construction works; (cidb Act)

completion: completion in a professional services contract means:

a) cidb Standard Professional Services Contract: the date when the Employer considers that the works have

been completed in accordance with the contract,

b) NEC3 Professional Services Contract: when the consultant (PSP) has done all the work which the scope states

he has to do by the completion date and corrected defects which would have prevented the employer from

using the services and others from doing their work.

completion date: is the completion date unless later changed in accordance with the contract (NEC)

Construction Industry Development Board (CIDB): the board established in terms of the

Construction Industry Development Board Act of 2000 (Act 38 of 2000)

contract: the contract signed by the parties (cidb),

contract price: The price to be paid for the performance of the services in accordance with the

pricing data (cidb)

employer: The contracting party named in the contract who employs the service provider (cidb)

employer's representative: person authorized to represent the employer and named as such in the

contract data

services: the services defined in the scope of services to be performed by the consultant (PSP) in

accordance with the agreement which comprise normal services, additional services and exceptional

services

Professional service provider: the contracting party named in the contract data who is employed by

the employer to perform the services described in the contract and legal successors to the service

provider and legally permitted assignees (cidb)

Subcontractor (subconsultant): A person or body corporate who enters into a subcontract with the

service provider to perform part of the services (NEC – is a person or organisation who has a contract

with the Consultant (PSP) to provide part of the services)

reporting officer: employer’s representative or his/her delegated representative that is authorized to

complete the contractor performance reports on behalf of the employer

3 Requirements

3.1 Submission of Professional Service Provider Performance Reports

Completed PSP performance reports (see Annex 1) must be submitted by the reporting officer to the

employer’s representative:

i) where no dispute exists, within 15 days of the date of completion of a contract; or

ii) where a dispute exists, within 15 days of the date of receipt of the outcome of the dispute (see

Item 3.3).

NOTE: Other than for interim PSP performance reports (Item 3.4), PSP performance reports should only be

completed for contracts which reach completion. Subject to the CID Regulations, where a contract is terminated

or abandoned due to poor or non-performance of a PSP, such performance must be recorded on the CIDB

Register of Professional Service Providers.

3.2 Completion of Professional Service Provider Performance Reports

The reporting officer is responsible for the completion of the PSP performance reports on behalf of

the employer on completion of the PSP’s contract. To be in a position to make factual assessments

against the evaluation criteria in the PSP performance report on the PSP’s performance, the reporting

officer must:

be experienced in the management of PSPs; and

have frequent and direct liaison with the PSP.

Taking cognizance of the time requirements of Item 3.1, each PSP performance report must be

discussed with the PSP, who must be given the opportunity to comment on the assessment. The

reporting officer must respond to any issues raised by the PSP in writing, and the PSP’s comments and

the written response by the reporting officer must form part of the PSP performance report. The PSP

performance report must then be signed-off by the employer’s representative.

The PSP performance reports must be signed off by the reporting officer, the PSP and the employer’s

representative.

3.3 Right of Reply / Appeal

Where significant differences of opinion exist between the reporting officer and the PSP which cannot

be resolved by the parties, the PSP has the opportunity to an independent review of the PSP

performance report by a mutually agreed adjudicator, as stipulated in the contract.

The resulting PSP performance report after adjudication must be signed by the adjudicator and

witnessed by the reporting officer and the PSP.

The reporting officer will forward this copy of the PSP performance report to the employer.

3.4 Interim Professional Service Provider Performance Reports

Interim PSP performance reports (see Annex 2 to Annex 18) should be completed for each PSP

engaged by the employer for each stage of the project, and should a project stage be longer than

three months than a PSP performance report needs to be completed every three months. The

appropriate PSP performance report must be completed for each PSP engaged by the employer as set

out below.
