Foreign nationals who wish to reside in the Netherlands

for more than 3 months require a residence permit. This

publication explains how you can apply for a residence

permit at the Immigration and Naturalisation Service

(IND). Most foreign nationals first need a special visa to

enter the Netherlands: the Regular Provisional Residence

Permit (mvv). You must apply for the mvv before entering

the Netherlands at the Dutch embassy or consulate. This

publication contains detailed information about thisprocedure.

I you wish o reside in he Neherlands, here are hree

differen possibiliies:

You wish to stay in the Netherlands for more than

3 months, and you are not (a family member of ) an EU,

EER or Swiss national.

In his case you will always need a residence permi. Thispublicaion explains how you can apply or a residence

permi. In mos cases you will also need an mvv (Regular

Provisional Residence Permi) in order o ener he

Neherlands. The mvv is a special visa ha you mus have

o ener he Neherlands i you wish o say or more han

3 monhs. You need o apply or he mvv beore you ener

he Neherlands. Some people are exemped rom he mvv

requiremen. They can apply or a residence permi direcly

You are an EU, EER or Swiss national and wish to stay inthe Netherlands.

Applying for an mvv

You need o apply or an mvv a he Duch embassy or

consulae in eiher your counry o origin or your counry

o coninuous residence. To do his you will, in mos cases,need a sponsor (he reeren) in he Neherlands. The sponsor

is he person wih whom you wish o say or he organisaion

ha is arranging your say in he Neherlands.

Request for advice preceding the actual application for mvv

Beore you apply or an mvv, your sponsor can ask he IND

or an advice regarding he issue o an mvv. I he IND

makes a posiive advice, you will know ha your applicaion

is likely o be successul. You can read more abou his

procedure in chaper 4.

Applying for a residence permit

You can apply or a residence permi in he Neherlands a

he IND desk. I you wish o sudy in he Neherlands, in

many cases he educaional insiuion will submi he

applicaion o he IND.

Requirements and documents

To be eligible or an mvv and/or a residence permi you mus

mee cerain requiremens. You will also have o provide a

number o documens. The IND will assess wheher or no

A counry o coninuous residence is a counry in which a person ispermited o reside or a period o more han 3 monhs, by reason

o enilemen o emporary residence or pending enilemen o

The requiremens depend on he purpose o say in he

Neherlands: work, sudy, orming a amily, visiing amily

members, o name a ew. The appendices conaininormaion abou how he requiremens vary depending

on your purpose o say in he Neherlands. A number o

requiremens need o be me whaever your purpose o say

in he Neherlands. For example, you mus have a valid

passpor. In order o obain a residence permi, you will in

many cases need o undergo a uberculosis es and have

The civic integration examination abroad

To be eligible or an mvv you will, in a number o cases, be

required o ake he civic inegraion examinaion abroad.

This examinaion ess your basic knowledge o boh he

Duch language and Duch sociey. The examinaion is aken

a he Duch embassy or he consulae in your counry o

origin or counry o coninuous residence, beore you come

o he Neherlands.

Everyone aged beween 18 and 65 who needs an mvv and

who wishes o live in he Neherlands or a prolonged

period will need o ake he civic inegraion examinaion

abroad. This includes oreign naionals who wish o orm a

amily wih someone in he Neherlands or o be reunified

wih amily members already living in he Neherlands.

Religious leaders coming o he Neherlands oremploymen, such as imams or preachers, will also have

o ake he civic inegraion examinaion abroad.

The civic inegraion examinaion abroad cerificae will be

valid or 1 year. I you passed he civic inegraion examinaion

abroad more han 1 year ago, you will need o si he exam

again i a reques or advice is being submited on your

behal or i you submi an applicaion or an mvv.

You do no need o ake he civic inegraion examinaion

abroad i you wish o reside in he Neherlands or he

purposes o an exchange, as an au pair, as a amily member

o someone who has asylum saus, or i you are coming or

a amily visi. Foreign naionals and heir dependen amily

members who wish o say in he Neherlands o sudy, o

undergo medical reamen, o ener employmen, o work

on a sel-employed basis, as a scienific researcher pursuano and wihin he meaning o Direcive 2005/71/EC or as

highly skilled migrans, are also no required o ake he

civic inegraion examinaion abroad. Exempion rom

having o ake he civic inegraion examinaion abroad

may also be graned on medical grounds, and here are

excepions or people wih Surinamese naionaliy. This lis

The Regular Provisional Residence Permi (mvv), he

residence permi, and he civic inegraion examinaionabroad cos money. The ee mus be paid when you submi

correc orm, oherwise your applicaion may be delayed!

In principle you are eligible or an mvv and a residence

Sponsor in the Netherlands

I is imporan ha you have a person or organisaion in

he Neherlands who will, among oher hings, ac as a

guaranor or you. The sponsor could, or insance, be he

amily member wih whom you will be living or he

employer who will guaranee your income. I may be ha

you do no have a sponsor. For insance, you can ake up

residence on a sel-employed basis wihou a sponsor.

In such a case here are ofen addiional requiremens.

You mus hereore horoughly prepare your applicaion

or an mvv and residence permi.

Period of validity of the sponsor declaration

The sponsor declaraion will sae ha your sponsor will

sponsor you or a period o 5 years or he shorer period o

your say. The guaranee will auomaically cease o apply in

he ollowing cases:

I sufficien securiy is provided in anoher orm

I you leave he Neherlands permanenly

I you are graned a permanen residence permi or a

residence permi or a differen purpose o say

I you acquire Duch ciizenship

Who does not need an mvv?

No everyone needs an mvv. Below is an overview o he

main naionaliies and siuaions ha are exemped rom

he mvv requiremen. This lis is by no means exhausive.

amongs ohers, you will notrequire an mvv:1. You have a Duch residence permi.

2. You are a naional o one o he ollowing counries:

Ausralia, Canada, Japan, Monaco, New Zealand, Souh

Korea, he Unied Saes o America or Vaican Ciy.

Tuberculosis

In order o obain a residence permi, you mus be prepared o

undergo a uberculosis examinaion and, i necessary, reamen or

uberculosis. To do his you (or he person who represens you) mus

fill in and sign a declaraion o inen relaing o he uberculosis

examinaion. I you complee he Declaraion o Inen or a

Tuberculosis Examinaion and submi i o he Immigraion and

Nauralisaion Service (IND) ogeher wih your applicaion (and i you

also mee all oher requiremens), he IND will gran you a residencepermi as soon as possible. You will be graned his permi on he

specific condiion ha you acually undergo a uberculosis examinaion

wihin 3 monhs. I i becomes apparen afer a residence permi has

been issued o you ha you ailed o undergo a uberculosis

examinaion wihin 3 monhs - despie he ac ha you signed he

declaraion o inen - he residence permi may be wihdrawn.

The obligaion o undergo he examinaion does notapply i:

you have the nationality of one of the following countries: one of

he EU/EEA member saes, Ausralia, Canada, Israel, Japan, Monaco,

New Zealand, Surinam, Unied Saes o America, and Swizerland

(including Liechensein); or you have a valid residence permit for an EEA country, an EU country,

or Swizerland; or

you have an EC residence permit for long-term residents issued by

anoher EU counry; or

you are a family member of a long-term resident and you have

been admited o anoher EU counry as a amily member o he

long-erm residen.

Completing the form and gathering the documents

The mvv applicaion orm mus be compleed in ull. I can

counry o residence. Cerain documens mus be enclosed

an mvv. Wha he requiremens are depends on your

Submitting your application and paying the fee

Sign your mvv applicaion and submi i o he Duch

embassy or consulae, ogeher wih he required documens.

You will need o pay he ee or he mvv applicaion afer

you have submited i o he Duch embassy or consulae in

your counry o residence. Once you have submited he

applicaion, you will receive confirmaion o receip.

The confirmaion o receip will ell you how much youneed o pay; his amoun varies, depending on your reason

or applying or an mvv.

Assessment of the application

The IND will assess your mvv applicaion. This may ake

some ime. On average an assessment will take 3 months.

an mvv.

Response to your application

You will receive one o wo responses o your applicaion:

The Duch embassy or consulae conacs you o ell you

ha you can collec your mvv. The embassy will place he

mvv sicker in your passpor, which you can now use oener he Neherlands.

Your applicaion or an mvv is rejeced. I your applicaion

or an mvv is rejeced, you will receive a leter (he decision

noice) which will explain why you have no been graned

an mvv. You can appeal agains his decision. You can find

Your sponsor submits a request for advice preceding the actual

application for a Regular Provisional Residence Permit

Prior o your applicaion, your sponsor in he Neherlands

can submi a reques or advice o he IND so ha you will

know, in advance, wheher you may be eligible or an mvv.

Your sponsor can ask he IND or advice preceding he acual

applicaion or an mvv. To do his your sponsor mus use

he orm eniled Reques or advice preceding he acual

Sending your application

The reques or advice preceding he acual applicaion or

Assessment of the request for advice

The IND will assess he reques or advice. On average an

assessment will take 3 months.I he response o he

reques or advice is posiive, you will need o go o heDuch embassy or consulae o officially submi your

applicaion or an mvv. I he response o he reques or

advice is negaive, he IND will inorm your sponsor

accordingly. I is no possible o submi an applicaion or

review wih regard o a negaive advice.

Language of the documents

All documens mus be in Duch, English, French or

German. I his is no he case, please have he

documens ranslaed by a ranslaor sworn by a cour

and submi he ranslaion and he documen alongwih he applicaion o he IND desk. I you do no have

he documen ranslaed in he Neherlands by a

ranslaor who is sworn by a Duch cour, bu abroad

insead, he ranslaion also has o be legalised.

Legalisation of foreign documents

All official oreign documens relaing o persons, or

insance birh cerificaes, single saus declaraions,

marriage cerificaes or judicial decisions regarding

adopion and cusody, mus be legalised, or provided

wih an aposille samp by he compeen auhoriies in

he issuing counry. Single saus declaraions mus

have been issued by he compeen auhoriies wihin

he las 6 monhs. As legalisaion can ake a long ime,

you should arrange or your documens o be legalised

or provided wih an aposille samp several monhs

beore you plan o submi your applicaion. I is

Submitting your application and paying the fee

Once you have ully compleed he orm and gahered all

Which documens you will need o enclose depends on

passpor, or anoher ravel documen, and a recen passpor

Assessment of the application

The IND will assess your applicaion or a residence permi.This procedure may ake some ime. Someimes he IND

will need o veriy your documens in your counry o

residence.The IND can, in principle, take 6 months to

make a decision.

Response to your application

You will receive one o wo responses o your applicaion:

You are graned a residence permi. You will be noified

o his in wriing; he leter will explain where and when

you can collec your residence documen.

Your applicaion or a residence permi is rejeced. I your

applicaion is rejeced, you will receive a leter (hedecision noice) which will explain why you have no

been graned a residence permi. You can appeal agains

Residence permit with or without mvv

The procedure or applying or a residence permi is much

The mos imporan difference is ha people who are in

I he oreign naional and he principal applican wihwhom he or she is applying o say do no have and are no
