CARBON AND CERTAIN ALLOY STEEL WIRE ROD FROM THE PRC IS BEINGSOLD OR OFFERED FOR SALE AT LESS THAN FAIR VALUE
Pricing and cost information reasonably available to petitioners confirms that CASWR
from the People's Republic of China is being sold, or offered for sale, in the United States at less
than normal value. Because China is a non-market economy, petitioners compared the price of
CASWR from China sold in the U.S. to a normal value calculated using on a factor valuation
methodology for a non-market economy in accordance with 19 C.F.R. § 351.408.
1. THE PRC IS A NON-MARKET ECONOMY
The Department has identified the PRC as a non-market economy ("NME") country as
recently as January 2, 2014, and has not since that time published any notice of a determination
that China is a market economy.' See 19 U.S.C. § 1677(18)(C). As China remains an NME
country, sales or offers for sale of such or similar merchandise in the PRC or from the PRC to
third countries do not permit calculation of "normal value" ("NV") under section 773(a) of the
Act (19 U.S.C. § 1677b(c)(1)) or under 19 C.F.R. § 351.408. In accordance with the
Department's practice, therefore, petitioners have calculated normal value by valuing the factors
of production for production of a representative sample CASWR product, based on values in a
market economy that has a level of economic development that is comparable to China.
II. INDONESIA IS THE APPROPRIATE SURROGATE COUNTRY FOR THE PRC
Petitioners have used Indonesia as the appropriate surrogate country for valuing Chinese
factors of production for CASWR for purposes of this review because: (1) Indonesia is at a level

of economic development that is comparable to China;' (2) Indonesia is a significant producer of
comparable merchandise;' and (3) public information from Indonesia is available to value all
material input factors. Accordingly, for the above reasons, Indonesia is the appropriate surrogate
country for this investigation.
III. CALCULATION OF EXPORT PRICE ("EP")
Petitioners are basing export prices on price quotes obtained during the ordinary course
of business for CASWR manufactured in the PRC and sold or offered for sale in the United
States by Chinese producers/exporters during the period of investigation ("POI").' See Exhibit
PRC-1. The quoted prices ranged from [ .*Soo ] to [0404 ] per short ton. Id. Chinese producers
may sell CASWR directly to U.S. purchasers or through trading companies which resell steel
wire rod directly to unrelated wire drawers in the United States.' Petitioners have no reason to
believe that the subject CASWR referenced in the price quotes was sold through affiliated sales
agents in the United States and therefore have calculated export price on the basis of the obtained

price quotes. Id. The quotes were for a typical grade of CASWR sold by Chinese exporters in
the United States, [ grade ] industrial quality wire rod containing at least 0.0008 percent boron.'
In order to calculate ex-factory export prices for the U.S. sales , petitioners deducted from
the price quotes, where applicable, U.S. inland freight and insurance (Exhibits PRC-1 and
PRC-3), U.S. brokerage and handling (Exhibit PRC-1), international freight and insurance
(Exhibit PRC-1), foreign brokerage and handling (Exhibit PRC-4), foreign inland freight
(Exhibit PRC-5), and U.S. merchandise processing and harbor maintenance fees, pursuant to 19
U.S.C. § 1677a(c)(2), 19 C.F.R. §§ 24.23(b)(1)(A) and 24.24(a). In addition, petitioners have
deducted 8 percent of the FOB foreign port price for the unrebated portion of the 17 percent
VAT on CASWR in China, pursuant to the Department's current policy . See Exhibit PRC-6.
Petitioner did not calculate imputed credit expenses for the sample U.S. sales because
petitioners are basing NV on a factors analysis which uses a constructed value that is inclusive of
net financial expenses, pursuant to section 773(e)(2)(A) of the Act, which requires that the
Department include in constructed value ("CV") the actual amount of selling, general and
administrative ("SG&A") expenses incurred on sales.
'The vast majority of imported Chinese CASWR contains minimal amounts of boron (exceedingslightly 0.0008 percent by weight) to allow it nominally to be classified for customs purposes asalloy wire rod in HTSUS subheading 7227.90. See Exhibit PRC-6. This allows Chineseproducers to take advantage of a 9 percent VAT rebate on exports of alloy wire rod. See id.Based on annualized 2013 data, of 614,402 net tons of subject CASWR imported during 2013,562,205 net tons, or 91.5 percent, entered as alloy wire rod. See id. (i,^-^q-icon rt(e

]. Petitioners are therefore treating the Chinese prices in this petition ascontaining the minimal amounts of boron necessary for the Chinese producers to obtain the 9percent VAT rebate.
PUBLIC VERSION
A. U.S. Inland Freight
For those prices quoted delivered to the U.S. customer, or to a barge port near the U.S.
customer, petitioners estimated U.S. inland freight charges from the port of entry to the customer
or barge port. The port of entry was determined based on industry knowledge of ports of entry
used for barge alongside shipments to the barge ports closest to the U.S. customers . See Exhibit
PRC-1. Where delivered by barge, petitioners used barge rate reported from the appropriate
ocean port to the nearest river port to the customer and then calculated truck delivery rates where
necessary. See Exhibits PRC-1 and PRC-3. Distances were calculated using Google Maps.
The barge rate information was obtained from [ 5ovrc.., ]. Id.
The barge rates include the cost of U.S. inland insurance. See Exhibit PRC-1. The source of
truck freight rates is freightrateindex.com. See Exhibit PRC-3. Petitioners deducted the U.S.
inland freight charges, where applicable, from the quoted U.S. price. See Exhibit PRC-7. For
those prices quoted FOB U.S. port, no U.S. inland freight charges were deducted.
B. U.S. Brokerage, Handling and Port Unloading Charges.
Petitioners deducted the cost for U.S. brokerage, handling and port unloading or barge
alongside charges from the U.S. transaction price. See Exhibit PRC-7. The source of the
brokerage, handling and port unloading charge information was provided by the [
:50OMP, ]. See Exhibit PRC-1.
C. Ocean Freight
Petitioners obtained the cost of "break bulk" shipment for wire rod from [
]. See Exhibit PRC-1. The "break bulk" shipment rate
includes the charges for marine insurance. Petitioners deducted the international ocean freight
and marine insurance charges from the U.S. transaction price. See Exhibit PRC-7.

D. U.S. Duty and Port Fees
Petitioners deducted port fees from the U.S. price. Imports of wire rod enter the United
States duty free but are subject to a 0.125 percent harbor maintenance and a 0.3464 percent
merchandise processing fee. See 19 C.F.R. §§ 24.23(b)(1)(A) and 24.24(a). These fees were
applied on an ad valorem basis to the U.S. dutiable value. Therefore, petitioners calculated port
fees based on the following formula: Port Fees = (0.00125 + 0.003464) * (Delivered Price -
U.S. Freight - U.S. Insurance - U.S. Brokerage - Ocean Freight - Marine Insurance) / (1+
0.00125 + 0.003464).
Petitioners then deducted the customs fees, calculated on a per pound basis, from the U.S.
transaction price. See Exhibit PRC-7.
E. Foreign Inland Freight and Brokerage
Petitioners deducted from the export price foreign brokerage and handling charges at the
foreign port (Exhibit PRC-4) and foreign inland freight charges from the factory to the foreign
port (Exhibit PRC-5). Foreign inland freight and brokerage charges were obtained from the
World Bank publication, Doing Business 2014: Indonesia. See Exhibit PRC-4.
F. Adjustment for Unrebated Portion of VAT
Petitioners deducted from export price the amount of the unrebated VAT which is
charged on exports of CASWR from the PRC. See Exhibit PRC-6. This deduction is consistent
with the Department's methodological change concerning the treatment of VAT in non-market
economy proceedings. See Methodological Change for Implementation of Section 772(c)(2)(B)
of the Tariff Act of 1930, as Amended In Certain Non-Market Economy Antidumping
Proceedings The VAT on Chinese Exports, 77 Fed. Reg. 36481 (June 19, 2012) and Exhibit
PRC-6. The VAT charged on exports of wire rod from the PRC is 17 percent. See Exhibit

PRC-6. As noted above in footnote 5, Chinese producers include boron in the production of
wire rod in order to take advantage of a 9 percent VAT rebate on exports of alloy wire rod. See
also Exhibit PRC-1, para . 2. Therefore, in accordance with the Department's methodology,
petitioners deducted the net 8 percent VAT charge on exports of wire rod from China. See
Exhibit PRC-7.
G. Net Export Price
Petitioners' calculation of net export price is provided at Exhibit PRC-7. The calculated
net export prices on the three sample sales are [##'tsb ], J# cwO ) and [4 4SO ) per metric
ton. See Exhibit PRC-7.
IV. NORMAL VALUE
A. Factors of Production and Surrogate Values
Petitioners do not have access to the actual cost of manufacturing for Chinese producers
of CAS WR. As the best information reasonably available to petitioners, this petition relies on a
major U.S. producer's direct material consumption of raw material inputs, labor usage, and
energy consumption, adjusted for known differences, as an estimate of the Chinese
manufacturers' factors of production. See Exhibit PRC-8 . Petitioners then valued those direct
inputs using surrogate values from Indonesia, an appropriate surrogate market under the
Department's NME methodology. See Exhibit PRC-9.
Factory overhead, SG&A expenses, and profit are based on the financial results of a
surrogate producer of a comparable product, carbon steel bar, in Indonesia.' Where it was

necessary to rely on data from a period preceding the POI, in accordance with the Department's
practice, petitioners inflated such values to reflect current prices using the CPI data for Indonesia
published by the International Monetary Fund. See Exhibit PRC-10.
B. Direct Materials
Petitioners calculated the Chinese producer's market economy value for direct material
inputs by using the average CIF import value at the Indonesian port of entry of such direct
materials imported into Indonesia for the period April 2013 to September 2013 (the most recent
period for which such data was available to petitioners). See Exhibit PRC-12. Petitioners
added to this value the average Indonesian brokerage and inland freight charges for importing
goods into Indonesia as reported in Doing Business 2014: Indonesia, published by the World
Bank. See Exhibit PRC-4.
C. Energy
Energy could not specifically be broken out of the financial statements of the surrogate
company used to value factory overhead , SG&A expenses , profit , and overhead. See Section
IV.E. Therefore, in accordance with the Department ' s practice , petitioners omitted energy costs
in the calculation of NV , in order to avoid potentially double-counting energy costs that have
been captured in the surrogate financial ratios. See Memorandum from Thomas Martin and
Jonathan Hill, through Robert Bolling to The File, re: "Third Antidumping Administrative
Review of Polyethylene Terephthalate Film, Sheet , and Strip from the People's Republic of
China: Surrogate Values for the Preliminary Results," December 3, 2012, at 5.
(cont'd from previous page)during 2012 or 2013 . Petitioners therefore relied on a financial statement for a producer of acomparable product in Indonesia.

D. Labor
Petitioners valued labor using information published by the International Labor
Organization. See Exhibit PRC-13. In 2008, the most recent year for which data are available
for Indonesia, the Indonesian wage rate for the manufacture of basic iron and steel industry was
reported as 1,750,530.21 Rupiah per month, or 9,117.35 Rupiah per hour, based on 192 hours per
month. See id. Petitioners adjusted this value for inflation using the CPI for Indonesia during
the period to 12,101.32 per hour in the POI. See Exhibits PRC-10 and PRC-13. Using the
average exchange rate in the POI, petitioners calculated a rate of US$ 1.08 per hour.8 See
Exhibits PRC-11 and PRC-13. Petitioners calculated Chinese producers' costs of labor (wages
and benefits) by applying that rate to the labor hours expended by U.S. producers . See Exhibit
PRC-9.
E. Calculation of Financial Ratios to Calculate Constructed Cost
Petitioners used the 2012 financial statements of Indonesian round bar producer PT
Betonjaya Manunggal Tbk. (`Betonjaya") to calculate surrogate financial ratios. Several factors
support petitioners' reliance on the most recent financial statements issued by Betonjaya to
calculate surrogate financial ratios. First, petitioners have been unable to locate any publicly
available financial statements for any known CASWR producer in Indonesia that were
profitable. The production of rebar and round bar is similar to that of wire rod and, thus,
Betonjaya's operations and experiences are an appropriate surrogate. Second, Betonjaya's
operations earned a profit in 2012. While petitioners were able to identify several Indonesian
companies in the steel industry with publicly available data, none of those companies was

profitable in 2012. Third, Betonjaya has issued an unconsolidated financial statement that
reflects predominantly, if not overwhelmingly, its returns on steel manufacturing operations. For
these reasons, Betonjaya's 2012 unconsolidated financial statements are the best available source
to calculate surrogate financial ratios.
Petitioners calculated factory overhead as a percentage of the sum of direct material,
labor, and energy. The overhead ratio, the SG&A ratio, and the profit ratio are based on the
financial data from Betonjaya's 2012 unconsolidated financial statements. Each income and
expense line item on the Profit and Loss Statement was properly classified as either raw
materials, labor, energy, manufacturing overhead, purchased goods, and SG&A costs. Based on
this data, the financial ratios were calculated in the manner consistent with Department practice.
See Exhibit PRC-14. Consistent with that methodology, petitioners calculated the surrogate
manufacturing overhead Chinese wire rod producers as its factory depreciation, plus
maintenance and repair expenses, divided by cost of goods sold ("COGS") without factory
depreciation and maintenance/repair costs. Petitioners then applied the calculated ratio of
factory overhead to COGS (without factory depreciation and maintenance/repair costs) to the
sum of materials, labor, and energy calculated for Betonjaya, above, to calculate the cost of
manufacture ("COM"). See Exhibit PRC-9.
Petitioners also used Betonjaya's 2012 unconsolidated financial statements to calculate
SG&A expenses, inclusive of net financial expenses, as a percentage of its COM. See Exhibit
PRC-14. This ratio was applied to the Chinese producer's COM calculated, above, to derive a
cost of production ("COP"). See Exhibit PRC-9.
Finally, petitioners used Betonjaya's 2012 unconsolidated financial statements to
calculate profit before taxes as a percentage of COP. See Exhibit PRC-14. This ratio was

applied to the COP calculated for the Chinese wire rod producers, above, resulting in a
constructed normal value of [ $900/MT ] for the sample product . See Exhibit PRC-13.
V. MARGIN
A comparison of the calculated normal value to the calculated U.S. net selling prices for
the representative sample product results in a dumping margin of 100.10, 109.47 and 110.18
percent for the three sales of the sample product. The dumping margin calculations are provided
for each transaction at Exhibits PRC-15A, PRC-15B and PRC-15C.

The US Freight Rate Index:
The US Freight Rate Index is a comprehensive Cost Per Mile (CPM) indicator that is based on fact. Comprised of 8 main and 65 total cost and costinfluencing components, it considers completely, every cost related to freight transport by land. Each component is from the factual source andapportioned per mile, or is a calculated derivative of the actual cost.
The Freight Rate Index or "Cost Per Mile" (CPM) indicator standard equipment model configuration is a full loaded 48 foot trailer with a standard long-haul semi-tractor power unit . This general configuration complies with the laws of, and is usable in, any jurisdiction , and therefore is an average whichclosely represents the cost of most equipment configurations.
The US Freight Rate Index information presented herein, represents the cost and potential profit for the standard equipment model configuration totravel 1 mile, and is reflected in USD$ , or portion thereof.
The Freight Rate Index is updated during the first week of each month.
