they hud finished the work before then There were seventeen members of the original jury present when court opened last nght the law requiring that stxteeh must be present to constitute a quorum There were sixteen on hand at the close ot last week and as one ot these K S Perry of ManU as absent Monday on account of the death of his wife the pro < edtng day at Provo the jury was un able to continue Its work by reason of the lack of a quorum and an adjournment was taken until Mr Perry could return to this city He arrived In the city late yesterday and when the regular work of the day was finished and second class In Utah as shown In a re- port just compiled In the office of A C Nelson state superIntendent of pub lie Instruction Salt Lake contributes 21017 of this number Ogden and Murray show decreases in the children of school age This can be accounted for at Murray through the removal of many families when the smelters closed down but the decrease at Ogden was rather surprising There are now 253 children less than In 1908 between the ages of 6 and IS years In Ogden as shown by the report while Murray shows a decrease of only 47 Salt Lake shows a gain of 906 and Provo of 286 An Condemnation Suits CITY MORTGAGE RECORD DENIES RIGHT OF CITY TO OPEN THIRD AND FOURTH SOUTH Contending that nearly aU or Sixth West and that the crossings of ThIrd South FIlth South and Sixth South streets aU belong to the company through franchises granted by Salt Lake the Denver Rio Grande Rail road company yesterday filed a long answer to the suit of Carl A Ek and about fifty others to compel the rail road company to open ThIrd South and Fourth South streets now shut ort by fences and company buildings The Rio Grande company claims that It owns between the center of Sixth West street to the West line of FIfth West street at Second South also at Fourth South Sixth South and Seventh South streets It admIts that fences and buildings have been erected which stop traffic from east to west on these streets at the tracks but claims this I right Is given the company In a num ber of franchIses from Salt Lake dat Ing as far back as 1SGT and runnIng up to 1906 All of the later ordinances are mentioned Including those of Jan uary 25 1901 and January 3 1906 by which the railroad company was given the right to block the streets The company also tells of the latest mortgage of the company
